Vous trouverez ci-joint une liste de conventions de garde en vigueur au
30 juin 2003 intervenues entre le Fonds canadien de protection des épargnants
(FCPE), à titre de simple fiduciaire pour le compte des membres, et diverses
entités telles que des sociétés d'organismes de placement collectif, la Banque du
Canada, etc.
La liste atteste que ces entités satisfont aux conditions relatives aux « lieux agréés
de dépôt de titres » concernant le lieu où les titres sont détenus par un tiers, sous
forme physique ou d’inscription en compte, au nom de sociétés membres,
conformément à l’article 1 du Règlement 2000 de l’ACCOVAM et à la définition
au paragraphe (d) du Formulaire 1.

valeurs, la société ou son mandataire peut, entre autres, conclure une convention de garde avec le
FCPE, énonçant les modalités aux termes desquelles ces titres sont déposés et comprenant des
clauses selon lesquelles aucun usage ni aucune disposition des titres ne sera effectué sans le
consentement écrit préalable du membre et mentionnant que les titres pourront être livrés au
membre sans délai sur demande. Le FCPE a signé ces conventions au nom des membres d'OAR de
façon à réduire la nécessité pour la société ou son mandataire de conclure des conventions
individuelles avec chaque membre avec lequel il fait affaire.

Une autre façon pour la société ou son mandataire d'être considéré comme un lieu agréé de dépôt
de valeurs est que le membre conclue une convention de garde, conforme aux règlements d'OAR,
avec la société ou le mandataire.
Sauf indication contraire, une société d'organismes de placement collectif ou un gérant de fonds
dont le nom figure sur la présente liste a signé une convention seulement pour son groupe de fonds.
Lorsque la société d'organismes de placement collectif ou le gérant de fonds gère un organisme de
placement collectif tiers, il doit signer une convention distincte. Dans un tel cas, la liste indiquera
le ou les organismes de placement collectif tiers régis par la convention.
