Kathy Milani is a partner in our Commercial Real Estate Group in our Calgary office.
Since 1988, Kathy has been involved in all aspects of the development, sale and
financing of multi-unit residential and mixed-use condominium projects. Transaction
documentation has included developer unit sale agreements, agreements for rental
management, vendor financing, wrap-around mortgages, rental guarantees and rental
pooling arrangements.

Kathy also represents several commercial, residential and condominium land
developers. She has assisted in many condominium developments, including bare-land
as well as high-rise developments and re-divisions. As well, she has organized
homeowner associations in connection with both lot and bare-land unit residential
developments. Kathy’s experience includes drafting governing bylaws for condominium
corporations and homeowner associations. On the land development side, Kathy has
drafted agreements for various co-ownership arrangements, joint ventures and limited
partnerships.
REPRESENTATIVE WORK

Acts for developers of prime residential projects, including providing early
advice for planning the community having regard to governance options
through either a condominium development or homeowners’ association.

Acts for developers of high-rise mixed-use condominium projects, including
addressing mixed-use concerns, air space and subsurface rights, and phasing
options.

Acted for lenders in connection with complicated lending structure that involved
strata and condominium unit titles contained within a remote industrial project.

Authored extensive periodic reports on new judgments and proposed
legislation that could affect mortgage lenders (as solicitor, on an honorarium
basis, for the Mortgage Loans Association of Alberta, which comprises most of
the province’s commercial and residential mortgage lenders and others with a
professional involvement in mortgage lending), 1991-98.
