L’État doit s’abstenir d’imposer des croyances dans les lieux où les personnes sont dépendantes de lui. Il
est notamment tenu à la neutralité confessionnelle dans le cadre de l’éducation publique où la présence aux
cours est requise sans considération de religion et qui doit chercher à inculquer aux élèves une pensée
critique.
Or, la Cour ne voit pas comment l’exposition, dans des salles de classe des écoles publiques, d’un symbole
qu’il est raisonnable d’associer au catholicisme (la religion majoritaire en Italie) pourrait servir le pluralisme
éducatif qui est essentiel à la préservation d’une « société démocratique » telle que la conçoit la
Convention, pluralisme qui a été reconnu par la Cour constitutionnelle italienne.
L’exposition obligatoire d’un symbole d’une confession donnée dans l’exercice de la fonction publique, en
particulier dans les salles de classe, restreint donc le droit des parents d’éduquer leurs enfants selon leurs
convictions ainsi que le droit des enfants scolarisés de croire ou de ne pas croire. La Cour conclut, à
l’unanimité, à la violation de l’article 2 du Protocole n° 1 conjointement avec l’article 9 de la Convention.

• La principale actualité belge concerne le processus public lancé par la Gouvernement fédéral et
désigné sous l'appellation d' « Assises de l'Interculturalité ». Sont stimulés des débats de terrain sur
les accommodements raisonnables en général, et le foulard musulman en particulier, objet de
nombreuses polémiques en ce moment en Belgique.
Le Gouvernement a indiqué qu'il ne prendrait pas de mesure législative sur ces questions avant la fin
du processus citoyen, fin qui n'est pas prévue avant avril 2010.
• Le Centre fédéral belge pour l'égalité des chances et la lutte contre les discriminations vient d'ouvrir
ce 25 novembre un site web de recommandation en matière de signes convictionnels :
Ce site propose deux sections principales:
1) La première, Recommandations et Principes généraux, expose les orientations et
recommandations générales du Centre en la matière.
2) La seconde, l’« outil Signes » donne un aperçu général des normes actuellement en vigueur dans
l’emploi, le secteur public et l’enseignement. Il est complété par une série de recommandations
propres à chaque secteur examiné.

• Ouverture du blog sociorel, actualités concernant la sociologie et les religions en Europe.

• A l'initiative d'André Gérin, député et maire de Vénissieux (banlieue lyonnaise), une mission
parlementaire composée de 32 députés créée en juillet 2009 est chargée d'établir un état des lieux de
la pratique du port du voile intégral en France. Elle procède pour l'instant à des auditions et devrait
conclure ses travaux en décembre 2009 et indiquer notamment s'il lui semble nécessaire de légiférer
sur ce sujet.

• 21st Century Faith: Results of the Survey of Clergy, Pastors, Ministers and Faith Leaders by Dr

• In October, the Irish High Court heard a case (McNally v Ireland) pertaining to the sale of Roman
Catholic ‘Mass cards’. There was a constitutional challenge to section 99 of the Charities Act 2009
which prohibits the sale of “Mass cards” within the State unless a Catholic bishop or religious
provincial approves the arrangement. Judgment awaited.
• The Irish Government in July passed a Defamation Act which included a new law on blasphemy.
The section of the Act on blasphemy defines the criminal offence of publishing or uttering
blasphemous matter and provides for a substantial fine. The law has been widely criticized as being
both unnecessary and problematic.

• Biodroit : opposition des évêques et de la coalition de Berlusconi à la mise en vente de la pilule
abortive.
• Affaire Boffo : suite à un commentaire prudent mais critique sur la vie privée du premier ministre, le
directeur du quotidien des évêques Avvenire, Dino Boffo, a été attaqué par le quotidien de la famille
Berlusconi, Il Giornale. Il Giornale a révélé que Boffo avait été condamné il y a quelques années pour
harcèlement sexuel. La victime, une femme, avait reçu des pressions de la part de Boffo pour qu'elle
quitte son mari, amant de Boffo. Suite au scandale, Boffo s'est vu contraint de démissionner. D’où
crispation importante entre l'Église et Berlusconi dont la vie sexuelle très libre ne cesse de faire débat.

(Marriage, cohabitation, procreation-new trends in the opinion of Poles) - March 2009

Half of the Poles welcomed the fact that people are now getting married at a later age than their
parents. 75% do not accept the growing number of children being born outside marriage.
• Wiara i religijność Polaków dwadzieścia lat po rozpoczęciu przemian ustrojowych (Faith and
Religiousness of Polish people twenty years after the start of political changes) - March 2009.
Nearly 95% of adult Poles declared to be Catholics. According to the declarations, 95% of the
respondents consider themselves believers, of which 13% describe their faith as profound. 5%
say that they are atheists. More than half of the respondents (54%) take part in religious practices
at least once a week, of which 5% do so several times a week. 18% practice on average once or
twice a month and almost as many (19%) participate in religious services several times a year.
• Akceptacja stosowania zapłodnienia in vitro (Acceptance of in vitro fertilisation) – March 2009)
Most Poles (60%) believe that married couples, who cannot have children, should be able to take
advantage of in vitro fertilization. A little more than 26% of respondents have the opposite
opinion.

w Polsce” (Protection of personal data in the activity of the Catholic Church in Poland). The instruction
was prepared by General Inspector for Protection of Personal Data and Secretariat of Polish
Episcopal Conference.

• Establishment of the Roman Catholic Metropolitan Church Court in Prague
Based on a decree by the prefect of the Supreme Tribunal of the Apostolic Signature and an
agreement among the bishops of the Bohemian Church province, the Roman Catholic archbishop of
Prague issued decree No. 4722/2009 establishing as of 1 July 2009 the Metropolitan Church Court of
the Prague Archdiocese. As of that date the Interdiocesan Court of the Bohemian Church Province,
which was created by a decree dated 30 May 1982 by the Prague archbishop and the ordinaries of the
Litoměřice, Hradec Králové and České Budějovice dioceses, ceased to exist. As of 1 July 2011 the
Metropolitan Court in Prague will become the appellate court for the diocesan courts in Hradec
Králové and Pilsen, both established as of 1 July 2009. Until then the appellate court for both courts is
the Interdiocesan Court of the Moravian Church Province in Olomouc.
The decree of the Supreme Tribunal of the Apostolic Signature stipulates that the appellate court for
the Metropolitan Church Court of the Prague Archdiocese is the Interdiocesan Court of the Moravian
Church Province in Olomouc. This relationship is a mutual one; the Metropolitan Court in Prague is the
appellate court for first instance decisions by the Interdiocesan Court in Olomouc.
With the consent of the Supreme Tribunal of the Apostolic Signature and upon request by the
ordinaries of the Litoměřice and České Budějovice dioceses and the Apostolic Exarch of the Greek
Catholic Church in the Czech Republic, the Metropolitan Court in Prague will handle matters that will
eventually be dealt with by courts of dioceses once those courts are established.
P. prof. JUDr. Ignác Antonín Hrdina, DrSc., O.Praem. was appointed the Metropolitan Church Court
vicar of the Prague Archdiocese; ThDr. Jiří Svoboda, JC.D. was appointed the deputy vicar of the
Court.
• Establishment of Church Courts in the Hradec Králové and Pilsen Dioceses
The Church Court of the Hradec Králové Diocese was established as of 1 July 2009 by decree No.
1525/2009 of the Roman Catholic Hradec Králové Diocese bishop. Mons. Josef Růt, a Papal prelate,
was appointed the Court vicar; ICLic. Václav Hegr was appointed the deputy vicar of the Court.

The Church Court of the Pilsen Diocese was established as of 1 July 2009 by decree 919/2009 of the
Roman Catholic Pilsen Diocese bishop. Mons. ICLic. Vladimír Gajdušek was appointed the Court’s
vicar.

• 30 July 2009: Campaigner Debbie Purdy won a historic judgement from the House of Lords
regarding assisted suicide. Five law lords unanimously ruled that the DPP should publish guidelines
as to when prosecutions would and would not be pursued against those helping others end their lives.
The offence of assisted suicide remains, under the Suicide Act 1961, but the ruling aims to clarify the
situation for those involved in ‘compassionate’ assisted suicide. See for example

• 23 September 2009: The Director of Public Prosecutions issued a consultation document, drafting
guidelines listing the factors by which the Crown Prosecution Service should judge whether to
prosecute those assisting suicide.

• 3 November 2009: An Employment Tribunal ruled that environmental beliefs were entitled to the
same protection at work as religious beliefs. Mr Justice Michael Burton decided that: ‘A belief in
man-made climate change, and the alleged resulting moral imperatives, is capable if genuinely held,
of being a philosophical belief for the purpose of the 2003 Religion and Belief Regulations’. He
outlined five tests to determine whether a philosophical belief could come under employment
regulations on religious discrimination: the belief must be genuinely held; it must be a belief and not an
opinion or view based on the present state of information available; it must be a belief as to a weighty
and substantial aspect of human life; it must attain a certain level of cogency, seriousness, cohesion
and importance; and it must be worthy of respect in a democratic society, not incompatible with human
dignity and not conflict with the fundamental rights of others.

interdisciplinary network of researchers interested in non-religion, secularity, and atheism.
• The Law and Religion Scholars Network has compiled a database of judgments delivered by
domestic courts, the European Court of Justice and the European Court of Human Rights
concerning law and religion. The list is compiled by the Law and Justice case note writing team, led
by Frank Cranmer. For each case, a short summary of the decision and a link to the transcript of the
case is provided. A fuller case note for most of the cases is published in Law and Justice. Judgments

• Votation fédérale sur la construction de minarets en Suisse :
Un comité composé de membres de l’UDF et l’UDC a déposé une initiative populaire fédérale le 8
juillet 2008 visant à interdire les minarets sur tout le territoire, en modifiant l’article 72 de la
Constitution, qui charge la Confédération et les cantons de préserver la paix religieuse.
En mars 2009, le Parlement et le Conseil fédéral se sont opposés à l’initiative. Elle a toutefois été
jugée recevable par ces deux instances.
La votation par le peuple aura lieu le 29 novembre 2009.

• 1999-2009 : L’Observatoire des Religions en Suisse (ORS) fête ses 10 ans.
Le 17 décembre 2009, l’ORS fête ses 10 ans d’existence et organise une manifestation publique de
16h à 19h. En cette occasion, Madame prof. Judith Könemann (Münster Universität, Allemagne) ainsi
que Monsieur prof. Mark Chavez (Duke University, USA) nous feront l’honneur d’être présents pour
deux conférences.

• Programme National de Recherche 58 (PNR58) : Formation en Suisse des imams et des
enseignant-e-s en religion islamique?
Le groupe de recherche «Formation en Suisse des imams et des enseignant-e-s en religion
islamique» a rendu ses résultats publics le 21 juillet 2009. Le rapport final, présenté en conférence de
presse à Berne, est disponible en français et en allemand.

• Série de documentaires sur le paysage religieux suisse : « Mein Gott. Dein Gott. Kein Gott »
Sous ce titre, la télévision suisse alémanique diffuse une série de six documentaires sur le paysage
religieux suisse lors de l’émission Sternstunde Religion. Les films tirent le portrait des églises libres,
des athées, des musulmans, des juifs, des hindous, des bouddhistes et des églises étrangères
présentes en Suisse. Les chercheurs du PNR 58 seront représentés dans les discussions.

2. Actualité du site Eurel / News of the Eurel website
- La Slovénie a été intégrée au site, en version anglaise. Slovenia has been added to the
website.
- Une série de traduction est en train d'être réalisée. Au programme notamment, la traduction
des articles pour la Pologne, la République tchèque, la Slovénie et la Belgique. La traduction
de la rubrique "débats actuels" pour la France, le Royaume-Uni, la Turquie, l'Espagne et
l'Italie sont également en train d'être faites. Translations are currently being done for the
Eurel website. Poland, the Czech Republic and Slovenia, and Belgium will soon be available
in both languages. The "current debates" heading will also be translated for Spain, United
Kingdom, Turkey, France and Italy.
- La rubrique "Débats actuels" a été récemment mise à jour pour la Finlande, l'Espagne, la
France, la Turquie et le Royaume-Uni. The "current debates" heading has recently been
updated for Finland, the United Kingdom, Spain, France and Turkey.
- Un effort de mise à jour a été fait par les correspondants du Royaume-Uni, de la Finlande,
de la Pologne, et de la Lettonie. Updates have been done by the correspondents of the
United Kingdom, Finland, Poland and Latvia.
- Une nouvelle partie a été ajoutée dans les repères bibliographiques concernant la France:
la liste des rapports officiels concernant la religion. A new part has been added in the
bibliographic highlights for France: the list of official reports concerning religion.
