CONSENT AGENDA/QUESTIONS SOUMISES À L’APPROBATION DU CONSEIL 4.1 International Travel – Pitch Management seminar Motion: That the Utility 6 Grounds and Arenas staff person be retroactively approved for international travel to attend the Pitch Management seminar paid for by Soccer Canada in Barbados between January 31st and February 3rd 2016. 4.2 Programme « Mon paysage linguistique » THAT City Council adopt the proposed resolution, so that the municipality can participate in the bilingual commercial signage program sponsored by the Association des municipalités francophones du Nouveau-Brunswick. THAT City Council direct staff to manage the bilingual commercial signage program, as per the instructions and conditions as established by the Association des municipalités francophones du Nouveau-Brunswick. REPORTS FROM CITY MANAGER/ RAPPORTS DU DIRECTEUR MUNICIPAL 9.1 Presentation – Grant Thornton – 2015 Audit Mr. Ostridge provided an overview of the 2015 Audit – Report Consolidated Financial Statements for the City of Moncton dated December 31, 2015. He indicated that the City of Moncton is currently in good financial shape. Mr. Ostridge advised Council that the Operating budget could cause some risk. With this said, it will be important for the municipality to carefully manage finances in the future years. Motion: 1. That Grant Thornton be re-appointed for 2016 for a one (1) year term under the terms of the RFP 11-083 awarded in 2011. Moved by : Councillor Lawrence Second by : Councillor Arnold The City Manager indicated that positive the audit results were due to hard work by Council and staff. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with Modern Construction (1983) Ltd., and affix the Corporate Seal of the City of Moncton thereto. That Tender #TCS16-018 for the Patching of Asphalt Concrete Pavement – Zone B be awarded to the lowest Bidder meeting the Terms and Conditions, and Specifications, being MacArthur’s Paving and Construction Co. Inc., for the Total Tendered Price of $925,020.00, plus H.S.T. 2. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with MacArthur’s Paving and Construction Co. Inc., for the Total Tendered Price of $338,400.00, plus H.S.T. 2. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with MacArthur’s Paving & Construction Co. Inc., and affix the Corporate Seal of the City of Moncton thereto. Moved by : Councillor Léger Second by : Councillor Landry MOTION CARRIED 9.6 Supply and Delivery of Waterborne Traffic Paint Motion: It is the recommendation of the Public Works and Purchasing Department that the City of Moncton purchase its 2016 traffic line paint from the sole authorized distributor of Franklin Paint, being Équipements Stinson (Québec) Inc., at the negotiated unit prices indicated herein. Ms. Carter indicated that she was under the belief that the smaller municipalities contract out all services; however, she will make some inquiries. MOTION CARRIED 9.7 City Contract No. W16B 03AC – Watermain CIPP Motion: That, subject to Capital Borrowing Board approval of funding, City Contract No. W16B 03AC – Watermain CIPP be awarded to Dexter Construction Company Ltd. in the amount of $2,333,148.75 including HST, and that the budget for the project be set at $2,400,000.00 including net HST, engineering and contingency. That Tender #TCS16-020 for Riverfront Boardwalk Replacement be awarded to the lowest Bidder meeting the Terms & Conditions, and Specifications, being Construction Neptune Inc., for the Total Tendered Price of $144,746.00, plus H.S.T. 2. That the City exercise the optional pricing included in the Tender document for the removal and disposal of existing decking and installation of new decking (including all incidentals) on the existing bridge and the installation of a new lookout for the Total Tendered Price of $46,500.00 plus HST. 3. That a twenty percent (20%) Contingency Allowance in the amount of $38,249.20, plus H.S.T.) be established for this project to address any unforeseen / unknown site conditions which may result in additional work being required. 4. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with Construction Neptune Inc., and affix the Corporate Seal of the City of Moncton thereto. Moved by : Councillor Léger Second by : Councillor Landry MOTION CARRIED 9.10 Request for Proposal RFP14-108 – Supply of Six (6) Up To Twelve (12) Additional 40’ Transit Buses Motion: 1. It is the recommendation of the Evaluation Committee that Request for Proposal #RFP14-108 be awarded to Nova Bus for purchase of eight (8) new forty foot (40’) low-floor, heavy duty Urban Design Transit Buses, for the total purchase price of $4,092,616.00 (CAD), plus H.S.T. @ 15%. 2. It is also recommended that Moncton City Council authorize the purchase of one (1) additional bus from the accrued 2014-2015 equipment reserve fund ($512,000) for the total purchase price of $511,577.00 (CAD), plus H.S.T. @ 15%. Fraser & Son Ltd., for the Total Tendered Price of $143,200.16, plus H.S.T. @ 13%. 2. It is also recommended that a ten percent (10%) Contingency Allowance, in the amount of $14,320.00, plus H.S.T. @ 13%, be established for this project to address any unforeseen / unknown site conditions which may result in additional work being required. 3. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with J.K. Fraser & Son Ltd., and affix the Corporate Seal of the City of Moncton thereto. Moved by : Councillor Arnold Second by : Councillor Léger MOTION CARRIED 9.12 Request for Proposal #RFP16-010 – Supply of Mobile Food and Beverage Concession Services (Magnetic Hill Zoo) Motion: That Request for Proposal #RFP16-010 – Supply of Mobile Food and Beverage Concession Services (Magnetic Hill Zoo), be awarded to the highest-scoring Proponent, being East Coast Foods Inc., for the Zoo’s 2016 season, with an option to extend the agreement for up to two (2) additional seasons, if it is in the City’s best interest to do so. It is also recommended that an agreement be drafted, and the Mayor and City Clerk be authorized to sign said agreement and affix the Corporate Seal of the City of Moncton thereto. Moved by : Councillor Landry Second by : Councillor Léger Ms. Dallaire provided an overview of the process for providing healthier food options offered at city’s facilities. MOTION CARRIED 9.13 Tender #TCS16-012 - Supply and Installation of Pedestrian Bridge Crossing (Rabbit Brook Trail) Motion: 1. It is recommended that that Tender #TCS16-012 for the Supply and Installation of a Pedestrian Bridge Crossing (Rabbit Brook Trail) be awarded to the lowest Bidder meeting the Terms & Conditions, and Specifications, being Modern Construction (1983) Ltd., for the Total Tendered Price of $249,247.00, plus H.S.T., subject to approval of the City of Moncton’s application to the Municipal Capital Borrowing Board. 2. Furthermore, it is recommended that a ten percent (10%) Contingency Allowance in the amount of $24,924.70, plus H.S.T. be established for this project to address any unforeseen / unknown site conditions which may result in additional work being required. 3. It is also recommended that the Mayor and City Clerk be authorized to sign an agreement with Modern Construction (1983) Ltd., and affix the Corporate Seal of the City of Moncton thereto. Moved by : Councillor Arnold Second by : Councillor Lawrence MOTION CARRIED 9.14 Land Expropriation for Elmwood Drive Widening Project – Trans Canada Highway to north of Ogilvie Brook Motion: That the City of Moncton, having received and considered the reports of the Expropriations Advisory Officer, Jonathan Roch Noël, confirm its Notice of Intention to Expropriate land situated on Elmwood Drive, being identified as Parcels 15-1, 15-2, 15-3, 15-4, 15-5, 15-6 and 15-7, and that the Mayor and City Clerk be authorized to sign and affix the corporate seal to any and all documentation related thereto. Moved by : Councillor Léger Second by : Councillor Boudreau MOTION CARRIED Regular Public Council Séance ordinaire publique 9.15 6 March 22, 2016 le 22 mars 2016 Expropriation of land for building purposes and for a municipal services easement – portion of PIDs 70454400 and 70454418 Motion: That the City of Moncton, having received and considered the report of the Expropriations Advisory Officer, Jonathan Roch Noël, confirm its Notice of Intention to Expropriate land situated on the northwest side of NB Route 126/chemin Front Mountain Road, being identified as Parcels 15-A and 15-AA, portion of PIDs 70454400 and 70454418, and that the Mayor and City Clerk be authorized to sign and affix the corporate seal to any and all documentation related thereto. Moved by : Councillor Arnold Second by : Councillor Pellerin MOTION CARRIED 9.16 Acquisition of part of PIDs 70352448 and 00930347 on Shediac Road at Harrisville Boulevard Motion: That the acquisition of approximately 130.5 sq/m of PID#`s 70352448 and 00930347 located at the southwest corner of Shediac Road and Harrisville Blvd. and referred to on the Tentative Subdivision Plan annexed as Schedule “A” from the registered owner for the sum of $3,500 and authorize the Mayor and City Clerk to execute an agreement of purchase and sale by signing and affixing the corporate seal of the City of Moncton to said agreement and any other documentation required to close the transaction Moved by : Councillor Boudreau Second by : Councillor Lawrence MOTION CARRIED 9.17 Recommendation for Purchase and Installation of Radio Equipment Item removed 9.18 Mobile Vending Update & Program Renewal Mr. Dunn provided an update on mobile vending program. In the first year, only one vendor took advantage of the program. Last year saw the program grow to include 4 vendors. This season, the program will be expanded to other areas of the city and will be a 7 day a week operation. Motion: That the Mobile Vending Program be taken out of Pilot, and continue with the modifications listed below. Increased flexibility will allow for additional vendors to become involved in the program, while providing the general public and visitors with interesting vending options during the Summer and Fall seasons. Licensing fees to become a seasonal rate with no pro-rating for the 2016 season, $750 for truck locations and $400 for cart locations. With the increase in available locations, it is expected that vendors will be able to maintain a reasonable ‘per day’ charge. There will be no additional fees for parking. No refunds will be provided under any circumstances. That the program operate from the first Monday in May until the last day in October. A year-round program would present additional challenges such as snow clearing, and uptake would likely not be sufficient. Hours of operation to become seven days a week, from dawn until dusk. No nighttime hours are recommended under this program, as it is believed that this would present additional challenges for enforcement, and that appropriate lighting and safety would be a concern at the proposed locations (Parks are also closed at dusk). All locations are subject to blackout periods for Festivals and Events, with a minimum 30 day notice period. That the locations identified below be adopted and designated by the working group, with final sign-off by the Transportation Coordinator. Generally, these locations will accommodate multiple units at the same time. The configuration of designated areas will be contingent upon the number of applications received and where vendors prefer to operate. All locations will be reviewed and evaluated by the working committee on a periodic basis: Truck locations • The cul-de-sac by Treitz House • Designated area within the Riverfront Parking lot • Designated area along Cameron Street at Victoria Park • The Coliseum Parking Lot, adjacent to Worthington Avenue • Designated area in the parking lot for Mapleton Park, adjacent to Gorge Road • Designated area along St. George St. near the Laundromat, not for prepared foods Regular Public Council Séance ordinaire publique 7 March 22, 2016 le 22 mars 2016 These truck locations will not require supplemental parking levies. Moved by : Councillor Arnold Second by : Councillor Léger Councillor Léger suggested that perhaps some signage, similar to the performers signage found on the sidewalks in the downtown area, could be utilized to indicate that food vendors are at times parked in the area. Councillor Arnold and Councillor Lawrence left the meeting MOTION CARRIED Councillor Arnold and Councillor Lawrence returned to the meeting 9.19 Survey Equipment Purchase Motion: That the purchase of a new R8 receiver and S7 total station from Cansel be approved, as outlined in the attached quotation, for the quoted price of $50,075 + HST. REPORTS AND RECOMMENDATIONS FROM COMMITTEES AND PRIVATE MEETINGS/ RAPPORTS ET RECOMMANDATIONS DES COMITÉS ET RÉUNIONS À HUIS CLOS 8.1 Presentation – Enhancing Democracy Report – Frank Vandenburg, Chair Mr. Vandenburg provided an overview of the Enhancing Democracy Report. He indicated that the committee focused on 4 key steps –Informing, Interacting, Engaging and Participation of citizens. Four key themes were then identified by the committee – municipal education, citizen engagement, transparency & accountability and eliminating barriers. Mr. Vandenburg provided a brief overview of these 4 key themes. Councillor Theriault indicated that the City should implement a system to communicate the decisions and workings of council to the public. Mr. Dubé advised Council that all decisions of council are placed on the city’s website, as well as the social media sites, in both official languages within 48-hours of council meetings. Councillor Boudreau indicated the importance of having the role of council and councillors, the code of conduct and compensation formula approved by the current Council. He asked that the City Manager attend to these 3 items and that these be brought back to council for approval prior to the next council being sworn in. Mr. Dubé advised Council there is a need for clarification from our Legal Department prior to making a recommendation. Councillor Hicks indicated that he feels staff should be responsible to compile the monthly/quarterly reports for councillors. Motion: That the Enhancing Democracy Committee Final Report dated March 21, 2016 be approved in principle and that it be referred to the City Manager for review and that any budgetary implications be brought back to Council for consideration prior to implementation. PUBLIC PRESENTATIONS/PETITIONS/APPEARANCES/ PRÉSENTATIONS, PÉTITIONS ET INTERVENTIONS PUBLIQUES 5.1 Presentation – Frye Festival and Mayor’s Poetry City Challenge – Danielle LeBlanc, Frye Festival, Executive Director and Christine Melanson Poet Flye Ms. LeBlanc provided an overview of the Frye Festival 2016 events. The festival will be held during the week April 23 – May 01, 2016 and will feature many authors and events throughout Greater Moncton area. Ms. LeBlanc introduced Christine Melanson, this year’s Poet Flye to perform for council three of her original poems. This was done in conjunction with Calgary’s Mayor Naheed Nenshi Poetry City Challenge. Councillor Léger declared a conflict 5.2 Presentation – LED Signage – George Bartlett Mr. Bartlett came before council to request an amendment to the signage by-law. He is asking that Council exclude the Zio’s property from the “no sign zone”. The City Clerk indicated that should Council decide to accept the proposal to exclude the Zio’s property from Schedule E.2 – Special Signage District, as per section 66(1)(b) of the Community Planning Act, Council will need to refer the change to the Planning Advisory Committee (PAC) prior to proceeding with the enactment of the by-law (2nd & 3rd reading). As this could be seen as a substantial amendment, a new Public Hearing would also be recommended as per section 68(5) of the Community Planning Act. 5.3 MH35 – Kim Rayworth Ms. Rayworth came before council to express her concern with not having any consultation with the Capitol Theatre for the proposed theatre being proposed for the re-development of Moncton High School. Councillor Léger returned to the meeting 5.4 Diane Ross – Chair Moncton Library Board Ms. Ross came before Council to advise the Board’s position on the relocation of the library to the MHS site. Prior to moving the library an extensive public consultation would be required. The library is about to be open 7 days/week. She spoke of library branches being established in the north end area. 5.5 MH35 - Mark Higgins Mr. Higgins provided his full support for the MH35 proposal, and does not wish to have a U-Haul storage unit. He indicated that the City must work towards a solution done in a timely manner. Other Presentation/Autres présentations 6. PLANNING MATTERS/ QUESTIONS D’URBANISME 6.1 Public Hearing - Rezoning Application for 27 Augusta Terrace (R2 to R3) – Objections received. Mr. Budd advised council and those present that a request was received from Mel Kennah, Youth Impact Jeunesse to rezone a property at 27 Augusta Terrace from R2 to R3. The rezoning is to accommodate a residential care facility. Mr. Budd provided details of the proposed project and the importance of locating youth homes within established neighbourhoods. Mel Kennah, Executive Director, Youth Impact Jeunesse, indicated that none of the kids that are placed in a Youth Homes are young offenders. All youth are housed there are under the care of the Ministry of Social Services. Each youth has an established plan from several professionals. The youth are supervised 24-hours/day. France Bourque – Representing citizens in the area. Provided her reasons for opposing the project; she feels that it will be detrimental to the neighbourhood. Questioned how many people would want to have troubled teenagers living next door? Would they be transitional? Would the staff be rotating shifts? Jeffery Reath – Questions why the neighbourhood is resisting the rezoning. Need to be inclusive. Marie Blyth – Would love to have a residence in her neighbourhood. Everett Porter – Feels that property values will be impacted. Denise Ouellette – Lives close to Maison Nazareth – never had problems with the homeless shelter. Councillor Boudreau provided his support for the project. Councillor Hicks cautioned Council in changing the zoning of a property. He indicated he is not able to support the project, as he feels that council has not listened to the citizens, who have done their due diligence. Councillor Bourgeois provided his support for the project and the importance of these homes for our young troubled youth. Motion: That the rezoning process proceed for By-law amendment Z-213.25, from Mel Kennah, Executive Director, Youth Impact Jeunesse, to rezone property at 27 Augusta Terrace (PID 70349824) from R2 (Two Unit Dwelling Zone) to R3 (Multiple Unit Dwelling Zone). The rezoning will accommodate a Residential Care Facility. (File 16MZ-40786) Further, that the rezoning shall be subject to a conditional rezoning agreement, including but not limited to the following conditions: 1) The Residential Care Facility shall not be permitted to have more than six (6) residents at one time; 2) If the Residential Care Facility ceases to operate on this lot, the only other main uses that will be permitted are a single dwelling unit or a two unit dwelling; 3) All plans must conform with City of Moncton Building and Engineering standards; 4) The development shall be carried out in substantial conformance with the plans and letters submitted; and 5) That the $1000 security deposit required for a Conditional Rezoning Agreement and bylaw registry fees be paid prior to registration. Moved by: Councillor Léger Seconded by: Councillor Hicks Councillor Lawrence indicated that the revitalization of MHS is a great opportunity for the city. He spoke of the importance to consider the cost to citizens and the city for its redevelopment. All 3 proponents have valid proposals. It is to be noted that Council has met 3 times with MH35, once with U-Haul and have not met with third proponent as of yet and indicated that all of these meetings have been held in private. He feels that all 3 proposals need to be presented to Council and only then can Council make an informed decision. He has difficulty in supporting a motion that only promotes one proponent. He does not want to rush a decision. He would like to see a joint working committee between the City and the Province, and that recommendations come out of this committee. Councillor Boudreau believes that most citizens want to see the MH35 vision come to reality; however, at what cost will this project be to our citizens. It is important that council be provided costs for any project being proposed. He indicated that the motion before Council does not close the door to any other proponent that wishes to redevelop MHS. Councillor Hicks spoke of the length of time that has elapsed since the first presentation from the MHS35. He indicated that according to the Provincial Government the only proposal for the redevelopment of MHS is from U-Haul. It is imperative that the MH35 proposal be referred to the province sooner than later. Councillor Theriault reiterated the importance of investing in the city’s heritage buildings. She expressed her concerned with the rezoning that will be required with the U-Haul proposal. She supports the MH35 project. Councillor Arnold supports the motion, and looks forward to the upcoming conversation with the proponents. She made mention of the need for transparency in this project. Councillor Léger indicated that that all options should be explored and that firm timeframes be established. There needs to be public discussion on the redevelopment of MHS and its tenants. Mr. Jim Lockyer, representing MH35, believes that the project can be a standalone viable project. The developers are basing the project on the Friends of the Moncton Hospital model. The week of April 02, there will be public consultations on the project. Councillor Lawrence indicated that he requires financials prior to supporting any motions before council. Regular Public Council Séance ordinaire publique 13 March 22, 2016 le 22 mars 2016 Mr. Lockyer indicated that the auditorium has 1300 seats and would be the largest theatre East of Quebec City. Deputy Mayor Crossman indicated that he supports the MH35 project. He does not feel that the UHaul project fits the area; however, would welcome them coming to the city. He is concerned at the length of time that this project has taken. Mr. Sackville gave an overview of the usage of the open outdoor space. That Council approve funding in the total amount of $5,240,000 plus an additional contingency of $1,960,000 to recognize the class E estimates, in advance of the building and plaza fundraising efforts, for a total of $7,200,000, for the inclusion of all work associated with: 1. Various enhancements and project management items required in conjunction with the construction of the Downtown Center Building, including consideration for the Wall of Fame and the hiring of consultant Engineers required to validate the design and assist in the commissioning of the center facility and public art provisions: 2. The installation and/or upgrades to all subsurface civil infrastructure including, water, sanitary and storm sewer, electrical main infrastructure and service lateral connections associated with Highfield Street and all ancillary lands; 3. The overall enhanced Plaza design, including underground servicing, as presented by BDA Landscape Architects; The construction of a underground storm water detention system under the Plaza, eliminating the need for the construction of a detention pond on ancillary lands, known as parcel “B”; and 4. Other associated items required to complete the project. It is further recommended that, in the interest of expediting project administrative processes, that the City Manager’s signing authority for this project be raised to $150,000. In response to a question from Councillor Pellerin, Mr. MacDonald indicated that the project has not been budgeted. Mr. Martin indicated that reallocation to capital budget is one option, and if there are enough funds, that it would be put in as a shortfall, and the debt ratio may be affected; however, Mr. Martin does not believe that this would be the case. Dunn fournit une mise à jour sur le programme de vente ambulante. Au cours de la première année, un seul vendeur avait profité du programme. L’année dernière, avec quatre vendeurs, le programme s’est développé. Cette année, le programme sera étendu à d’autres zones de la ville et fonctionnera 7 jours par semaine. Motion : Que le programme de vente ambulante soit retiré du projet pilote, avec les modifications énumérées ci-dessous. Une plus grande souplesse permettra à davantage d’exploitants de participer au programme et au grand public et aux visiteurs de profiter d’options intéressantes en matière de vente pendant l’été et l’automne. Passage des droits de permis à un taux saisonnier sans calcul au prorata pour l’année 2016, soit 750 $ pour les emplacements de camions et 400 $ pour les emplacements de chariots. Grâce à l’augmentation du nombre d’emplacements disponibles, on s’attend à ce que les vendeurs ambulants soient en mesure de maintenir des frais « quotidiens » raisonnables. Il n’y aura pas de frais supplémentaires de stationnement. Aucun remboursement ne sera accordé, quelles que soient les circonstances. Un programme offert toute l’année poserait des difficultés supplémentaires telles que le déneigement, et la mobilisation ne serait probablement pas suffisante. Heures d’exploitation : sept jours par semaine, du matin au soir. Aucune exploitation nocturne n’est recommandée dans le cadre de ce programme. On pense en effet que cela poserait des difficultés supplémentaires en ce qui a trait à l’exécution des règlements et que l’éclairage approprié et la sécurité poseraient problème aux emplacements proposés (les parcs sont également fermés au crépuscule). Quatre thèmes clés ont ensuite été retenus par le comité : enseignement municipal, participation des citoyens, transparence et responsabilité et élimination des obstacles. M. Vandenburg fournit un bref aperçu de ces quatre thèmes clés. M. Dubé informe le Conseil que toutes les décisions du Conseil sont publiées sur le site Web de la Ville, ainsi que les sites de médias sociaux, dans les deux langues officielles dans un délai de 48 heures suivant les réunions du Conseil. Le conseiller Boudreau indique qu’il est important que le Conseil actuel approuve le rôle du Conseil et des conseillers, le code de conduite et de la formule de rémunération. Mme LeBlanc présente Christine Melanson, la poète flyée de cette année qui doit interpréter trois de ses poèmes originaux devant le Conseil. Ce défi a lieu en même temps que le Défi de la poésie du maire de Calgary, Naheed Nenshi. Le conseiller Léger déclare être en conflit d’intérêts. 5.2 Présentation – Affichage DEL – George Bartlett M. Bartlett se présente devant le conseil pour demander une modification de l’arrêté sur l’affichage. Il demande au Conseil d’exclure la propriété du restaurant Zio’s de la « zone sans affichage ». La greffière municipale indique que si le Conseil décidait d’accepter la proposition visant à exclure la propriété du restaurant Zio’s de l’Annexe E.2 – District d’affichage particulier, conformément à l’alinéa 66(1)b) de la Loi sur l’urbanisme, le Conseil devrait renvoyer le changement au Comité consultatif d’urbanisme avant de procéder à l’adoption de l’arrêté (2e et 3e lectures). Cette modification pouvant être considérée comme importante, la tenue d’une nouvelle audience publique serait également recommandée conformément au paragraphe 68(5) de la Loi sur l’urbanisme. 5.3 Projet MH35 – Kim Rayworth Mme Rayworth se présente devant le Conseil afin de faire part de sa préoccupation quant à l’absence de consultation du Théâtre Capitol pour le théâtre proposé dans le cadre du projet de réaménagement de l’école secondaire Moncton High. Le conseiller Léger réintègre la séance. 5.4 Diane Ross – Présidente du conseil d’administration de la Bibliothèque publique de Moncton Regular Public Council Séance ordinaire publique 23 March 22, 2016 le 22 mars 2016 Mme Ross se présente devant le Conseil pour faire part de la position du conseil d’administration relativement à la relocalisation de la Bibliothèque sur le site de l’école secondaire Moncton High. Avant de déplacer la Bibliothèque, il faudrait procéder à une vaste consultation publique. La Bibliothèque sera bientôt ouverte sept jours par semaine. Elle parle des succursales de la Bibliothèque qui sont installées dans le secteur nord. 5.5 Projet MH35 – Mark Higgins M. Higgins appuie pleinement le projet MH35 et il ne souhaite pas avoir une unité de stockage U-Haul. Il indique que la Ville doit tenter de trouver une solution dans les meilleurs délais. 6. PLANNING MATTERS/ QUESTIONS D’URBANISME 6.1 Audience publique – Demande de rezonage visant le 27, terrasse Augusta (R2 à R3) – Objections reçues M. Budd informe le Conseil et les personnes présentes qu’une demande a été faite par Mel Kennah, Impact Jeunesse, en vue de rezoner une propriété située au 27, terrasse Augusta de R2 à R3. Le rezonage vise à aménager un établissement de soins pour bénéficiaires internes. M. Budd fournit des détails au sujet du projet et souligne l’importance de placer les foyers de jeunes dans les quartiers établis. Mel Kennah, directeur général de Impact Jeunesse, indique qu’il n’y a aucun délinquant parmi les enfants placés dans des foyers de jeunes. Tous les jeunes logés dans un foyer sont sous la garde du ministère des Services sociaux. Chaque jeune bénéficie d’un plan établi par plusieurs professionnels. Les jeunes sont supervisés en permanence. France Bourque : Elle représentante des citoyens du quartier. Elle indique pourquoi elle s’oppose au projet; elle estime qu’il portera préjudice au quartier. Theresa Hilderbrand : Baisse de la valeur foncière des propriétés. Elle demande combien de personnes souhaiteraient voir des adolescents en difficulté vivre juste à côté de chez eux. Est-ce que leur placement sera provisoire? Est-ce que le personnel effectuerait des quarts de travail rotatifs? Jeffery Reath : Il se demande pourquoi le quartier s’oppose au rezonage. Il faut avoir une vision inclusive. Marie Blyth : Elle adorerait voir une résidence dans son quartier. Everett Porter : Il pense que le projet aura une incidence sur la valeur des propriétés. Denise Ouellette : Elle vit à proximité de la Maison Nazareth et n’a jamais eu de problème avec le refuge pour personnes sans abri. Le conseiller Boudreau appuie le projet. Le conseiller Hicks met en garde le Conseil contre la modification du zonage d’une propriété. Il a indiqué qu’il ne peut pas soutenir le projet, car il estime que le Conseil n’a pas écouté les citoyens, qui ont fait preuve de diligence. Le conseiller Bourgeois soutient le projet et précise que ces foyers sont importants pour les jeunes en difficulté. Proposée par : Conseiller Léger Appuyée par : Conseillère Arnold MOTION ADOPTÉE 8.5 Recommandation formulée lors de l’assemblée à huis clos du 14 mars 2016 Motion : Que le Conseil municipal de Moncton : 4) Approuve d’échanger le terrain municipal portant le NID 70501028 (conformément à l’annexe « B » décrite dans l’entente) situé sur le côté sud du prolongement du boulevard Assomption contre les parcelles de terrains de l’ancienne voie ferrée appartenant au CN et portant les NID 01014299 et 70408521 (conformément à l’annexe « A » décrite dans l’entente), lesquelles parcelles sont situées sur le côté sud du boulevard Assomption, sous réserve des modalités et conditions décrites dans la convention d’achat-vente; et 5) Approuve l’acquisition par la Ville de la route d’accès déplacée et du terrain connexe (conformément à l’annexe « C » décrite dans l’entente) auprès du CN, sous réserve des modalités et conditions décrites dans la convention d’achat-vente; et 6) Que le maire et la greffière municipale soient autorisés à signer ladite convention et tous les documents qui pourraient être requis pour conclure les transactions avec le CN et à y apposer le sceau de la Ville de Moncton. Il est en outre recommandé qu’après la clôture de l’acquisition de la route d’accès déplacée et du terrain connexe (conformément à l’annexe « C » décrite dans l’entente), le Conseil approuve, sous réserve de l’approbation du conseil d’administration de TransAqua, la cession d’environ 0,7 acre de terrain (voir la parcelle ci-jointe ainsi cédée à TransAqua) situé sur le côté sud de cette route, à l’endroit où il se trouve et tel quel, à TransAqua au prix de 83 400 $, taxes applicables en sus, et que le maire et la greffière municipale soient autorisés à signer la convention d’achat-vente et tous les documents nécessaires à la conclusion de la transaction avec TransAqua et à y apposer le sceau de la Ville de Moncton. Les éléments de la participation de la Ville de Moncton seront à confirmer une fois que les analyses financières seront terminées, et sont sujettes à la présentation d’une proposition commerciale viable que le conseil municipal peut appuyer. Proposée par : Conseiller Léger Appuyée par : Conseiller Hicks Le conseiller Lawrence indique que la revitalisation de l’école secondaire Moncton High est une occasion en or pour la ville. Il dit qu’il est important de tenir compte du coût de réaménagement de l’école pour les citoyens et la municipalité. Les trois soumissionnaires ont fait des propositions valables. Il fait remarquer que le Conseil a rencontré trois fois le groupe MH35, une fois l’entreprise U-Haul et n’a pas encore rencontré le troisième promoteur. En outre, il indique que toutes ces réunions ont eu lieu en privé. Il estime que les trois propositions doivent être présentées au Conseil et que ce n’est qu’à ce moment-là que le Conseil pourra prendre une décision éclairée. Il éprouve de la difficulté à appuyer une motion qui ne favorise qu’un seul promoteur. Il ne veut pas précipiter une décision. Il aimerait qu’un comité de travail conjoint entre la Ville et la Province soit créé et que des recommandations soient faites par ce comité. Le conseiller Boudreau pense que la plupart des citoyens veulent voir aboutir ce projet MH35; cependant, il se demande quel en sera le prix pour les citoyens. Il est important que le Conseil connaisse le coût des projets proposés. Selon lui, le fait que cette motion soit présentée au Conseil n’exclut nullement tout autre promoteur qui souhaiterait réaménager l’école secondaire Moncton High. Le conseiller Hicks évoque le temps qui s’est écoulé depuis la première présentation faite par le groupe MH35. Il indique que d’après le gouvernement provincial, la seule proposition pour le réaménagement de l’école secondaire Moncton High est celle faite par l’entreprise U-Haul. Il est impératif que la proposition relative au projet MH35 soit renvoyée à la Province le plus tôt possible. La conseillère Thériault insiste sur l’importance d’investir dans les édifices patrimoniaux de la municipalité. Elle se dit préoccupée par le rezonage que nécessitera la proposition faite par l’entreprise U-Haul. Elle soutient le projet MH35. La conseillère Arnold appuie la motion et elle attend avec impatience les prochaines discussions avec les promoteurs. Elle mentionne la nécessité de faire preuve de transparence dans ce dossier. Le conseiller Léger indique que toutes les options devraient être envisagées et que des délais fermes devraient être instaurés. Un débat public doit avoir lieu sur le réaménagement de l’école secondaire Moncton High et ses locataires M. Jim Lockyer, qui représente le groupe MH35, estime que le projet peut être viable et autonome. Les promoteurs s’inspirent du modèle adopté par la Fondation des Amis de L’Hôpital de Moncton pour le projet. Des consultations publiques sur le projet auront lieu la semaine du 2 avril. Le conseiller Lawrence indique qu’avant de pouvoir soutenir une quelconque motion présentée au Conseil, il exige d’avoir des données financières. M. Lockyer indique qu’avec un auditorium de 1 300 sièges, ce théâtre serait le plus grand à l’est de la Ville de Québec. Le maire adjoint Crossman indique qu’il soutient le projet MH35. Il ne pense pas que le projet U-Haul convienne au secteur; cependant, il accueillerait favorablement ce projet à Moncton. Il est préoccupé par la durée de ce projet. M. Sackville donne un aperçu de l’utilisation de l’espace ouvert. Que le Conseil approuve le financement représentant un montant total de 5 240 000 $, ainsi qu’un montant supplémentaire de 1 960 000 $ pour imprévus, afin de reconnaître les estimations de la classe E, à l’avance des efforts de collecte de fonds pour l’immeuble et l’esplanade, pour un total de 7 200 000 $, pour l’inclusion de tous les travaux liés à : 5. Divers éléments d’amélioration et de gestion de projet requis en conjonction avec la construction du complexe au centre-ville, y compris le Mur de la renommée et l’embauche d’ingénieurs-conseils requis pour valider la conception et aider à la mise en service des installations et des dispositions liées à l’espace d’art public; 6. L’installation ou la modernisation de toutes les infrastructures civiles souterraines, y compris le réseau d’aqueduc, les égouts sanitaires et pluviaux, l’infrastructure électrique principale et les branchements de conduites secondaires associés à la rue Highfield et à tous les terrains annexes; 7. La conception améliorée de l’esplanade, y compris les services publics souterrains, tel qu’ils ont été présentés par BDA Landscape Architects; La construction d’un système souterrain de rétention des eaux pluviales sous l’esplanade, éliminant ainsi la nécessité de construire un bassin de rétention sur les terrains annexes, connus comme la parcelle « B »; et 8. D’autres services connexes requis pour achever le projet. Il est en outre recommandé que, dans le but d’accélérer le processus administratif, le plafond du pouvoir de signature du directeur municipal pour ce projet soit porté à 150 000 $. En réponse à une question du conseiller Pellerin, M. MacDonald indique que le projet n’a pas été prévu au budget. M. Martin indique que la réaffectation du projet dans le budget d’immobilisations est une option, et que, s’il y a suffisamment de fonds, il serait inscrit en tant que manque à gagner, et le ratio de la dette pourrait être touché; toutefois, M.
