E n réponse au questionnaire que vous avez fait parvenir au Gouvernement
chinois, j ’ai l’honneur de vous communiquer ci-dessous les mesures protégeant en
Chine les femmes et les enfants contre les trafiquants.
Le fait de procurer en vue de la débauche des femmes ou filles mineures avec
ou sans leur consentement, ainsi que des femmes et des filles majeures, par mauvaise
foi, violence ou même avec leur consentement, constitue un délit punissable en
vertu des articles 349 à 353 du Code pénal chinois.
L ’âge de la femme ou de la fille ne constitue pas un moyen de défense contre
l’accusation, seulement la peine est moins sévère lorsqu’il est au-dessus de seize
ans.
Les articles précités du Code pénal chinois sont ainsi conçus :
« A r t i c l e 349. — Le fait de procurer, par violence ou par ruse, des femmes
ou filles, ou des garçons de moins de vingt ans, sera puni de trois à dix ans de
prison ; avec leur consentement, de un à cinq ans. S’il s’agit de filles ou garçons
âgés de moins de seize ans, la peine sera de trois à dix ans de prison.
« A r t i c l e 350. — Le fait de transporter hors de la Chine, par violence ou
par ruse, des femmes ou filles, ou des garçons de moins de vingt ans, sera
puni d ’emprisonnement à perpétuité ou de cinq à quinze ans de prison ; avec
leur consentement, la peine sera de trois à dix ans de prison.
« A r t i c l e 351.—Le fait de procurer, en vue de la débauche, par violence
ou par ruse, des femmes ou filles, ou des garçons de moins de vingt ans, sera
puni d ’emprisonnement à perpétuité, ou de cinq à quinze ans de prison ; avec
leur consentement, la peine sera de trois à dix ans de prison.
« A r t i c l e 352. — Le fait de procurer, en vue de la débauche, par violence
ou par ruse, et de transporter hors de la République, des femmes ou filles, ou
des garçons de moins de vingt ans, sera puni de m ort ou d ’emprisonnement
à perpétuité ou de dix à quinze ans de prison ; avec leur consentement, la
peine sera de cinq à quinze ans de prison ou la prison à perpétuité.
« A r t i c l e 353. — Le complice qui aura reçu ou recelé des femmes ou
filles ou des garçons de moins de vingt ans, procurés par violence ou par ruse,
sera puni des peines prévues aux articles 349, 350, 351 et 352. »

To the Secretary-General :
Sir ,
In reply to the Questionnaire which you have transm itted to the Chinese
Government, I have the honour to inform you herewith of the various measures
which protect women and children in China against such traffic.
The fact of procuring women or girls under age with or without their consent
for the purpose of prostitution, as well as women and girls who are of age, by
making use of fraud or violence, or even with their consent, constitutes a
punishable offence under Articles 3 4 9 - 3 5 3 of the Chinese Penal Code.
The age of the woman or girl constitutes no defence against the accusation,
but the penalty is less severe if the age is over sixteen years.
The articles of the above-mentioned Chinese Penal Code read as follows :
“ A r t i c l e 349.— The fact of procuring, by violence or fraud, women
or girls, or boys under tw enty years of age, shall be punishable by imprison­
m ent varying from three fo ten years ; if with their consent, from one to five
years. If it is a case involving girls or boys under sixteen years of age, the
penalty shall be a term of imprisonment varying from three to ten years.
“ A r t i c l e 350.—The fact of transporting from China, whether by violence
or fraud, any women, girls or boys under tw enty years of age, shall be punished
by imprisonment for life, or for a period varying from five to fifteen years ;
if with their consent, the term of imprisonment shall be from three to ten
years.
“ A r t i c l e 351.—The fact of procuring, for the purpose of prostitution,
whether by violence or fraud, any women or girls, or boys under twenty
years, shall be punishable by imprisonment for life, or for a term varying from
five to fifteen years ; if with their consent, this term shall vary from three
to ten years.
“ A r t i c l e 352.—The fact of procuring, for the purpose of prostitution,
whether by violence or fraud, and of transporting out of the Republic, any
women or girls, or boys under tw enty years of age, shall be punishable bydeath or by imprisonment for life, or by a term of imprisonment varyin g from
ten to fifteen years ; if with their consent, the penalty shall be a term of
imprisonment varying from five to fifteen years or for life.
“ A r t i c l e 353.—The accomplice who shall have received or concealed
any women or girls, or boys under tw enty years of age, who have been pro­
cured by violence or fraud, shall be subject to the penalties laid down in
Articles 349, 350, 351 and 352.”
