Clauses et conditions d'utilisation de logiciels du LCH
Lisez soigneusement ces clauses et conditions d'utilisation du logiciel (appelées par
la suite "licence") avant d'installer ou d'utiliser le logiciel ou l'application ("logiciel").
En installant ou utilisant le logiciel ou l'application vous acceptez d'être lié par les
termes de cette licence. Si vous n'êtes pas d'accord avec lesdits termes, n'installez
ou n'utilisez pas le logiciel ou l'application.
Licence
Le laboratoire de constructions hydrauliques ("LCH") vous concède une licence sur le
logiciel ou l'application, mais en reste le propriétaire.
Utilisations permises et limitations
La présente licence vous autorise à installer et utiliser le logiciel sur un ou plusieurs
ordinateurs vous appartenant. Toute copie du logiciel aux fins exclusives de
sauvegarde doit impérativement reproduire les informations relatives aux droits
d’auteur figurant sur l’original. Sauf dans les limites expresses où la présente licence
l’autorise, vous ne pouvez pas, en totalité ou en partie, copier, décompiler,
manipuler, désassembler, modifier, louer, prêter, vendre, concéder des licences, ni
diffuser ou créer des produits dérivés à partir du logiciel.
Garantie sur le logiciel
Vous reconnaissez et admettez expressément que l’utilisation du logiciel est à vos
risques et périls. Le logiciel est fourni "tel quel" sans garantie d’aucune sorte, et le
LCH exclut expressément toute garantie. Le LCH ne garantit pas que les fonctions
contenues dans le logiciel correspondront à vos besoins ou que le fonctionnement du
logiciel soit exempt d’erreur ou que tout défaut du logiciel sera corrigé. Malgré de
nombreux tests réussis du logiciel, le LCH ne garantit pas le succès d’utilisation du
logiciel ni l'exactitude des résultats ou de la documentation. Aucune information ni
aucun conseil, communiqués oralement ou par écrit par le LCH ne pourra constituer
une garantie ou augmenter de quelque manière que ce soit l’étendue de la présente
garantie.
Support
La licence ne prévoit aucun support technique pour le logiciel. Pour l'amélioration du
logiciel, le LCH remercie toute communication d'erreur avérée.
Limitation de responsabilité
En aucun cas, y compris la négligence, le LCH ne sera responsable de quelque
dommage indirect, spécial ou accessoire résultant de ou relatif à la présente licence.
Terms and conditions for use of LCH software
Please read these terms and conditions to use the software (called "license")
carefully before installing or using the software or the computer application
("software"). By installing or using the software of the computer application, you
agree to be bound by the terms of this license. If you do not agree to the terms of this
license, do not install or use the software or the application.
License
The software licensed is conceded to you by the Laboratoire de constructions
hydrauliques ("LCH") for use only under the terms of this license, but the LCH
remains the owner.
Permitted license uses and restrictions
This license allows you to install and use the software on one or more computers at
the same time as long as the computers are owned and used by you. You may make
one copy of the software for backup purposes only, provided that the backup copy
includes all copyright or other proprietary notices contained in the original. Except
and only to the extent expressly permitted in this license, you may not copy,
decompile, reverse engineer, disassemble, modify, or create derivative works of the
software or any part thereof, nor rent, lease, sell, lend or sublicense the software.
Limited warranty on the software
You expressly acknowledge and agree that use of the software is at your own risk.
The software is provided “as is” and without warranty of any kind and the LCH
expressly disclaims all warranties. The LCH does not guarantee that the functions
contained in the software will meet your requirements, or that the operation of the
software will be error-free, or that defects in the software will be corrected. Despite
numerous successful tests of the software, the LCH does not guarantee or make any
representations regarding the use or the results of the use of the software or related
documentation in terms of their correctness, accuracy, reliability, or otherwise. No
oral or written information or advice given by the LCH shall create a warranty or in
any way increase the scope of this warranty.
Support
This license provides no technical software support. In order to improve the software,
the LCH acknowledges with thanks any communication of confirmed errors.
Limitation of liability
Under no circumstances, including negligence, shall the LCH be liable for any
incidental, special, indirect or consequential damages arising out of or relating to this
license.
