List of Aboriginal Intervenors and Oral Traditional Evidence
On 30 October 2014, the National Energy Board (Board) received EEPL’s application to
construct and operate Energy East. The Application to Participate (ATP) process for Energy East
occurred in February and March 2015.
On 2 April 2015, EEPL informed the Board that amendments are anticipated for the Energy East
application. In a letter dated 6 May 2015, the Board stated that it could not determine that the
Energy East application was complete until after the future amendments were added to the record
and assessed.
In a letter issued 5 June 2015, the Board stated that it would continue its assessment of the
Energy East application based on the information that is currently available and that it would
communicate future process steps at a later date. The Board has decided that it will release a
ruling on participation and begin to collect oral traditional evidence prior to receiving the
amendments to the application. This will provide greater certainty for those who applied to
participate and allow those who qualify to access participant funding.
The complete ruling on participation and list of participants will be released in the coming
weeks. To facilitate collection of oral traditional evidence, attached as Appendix II is a list of
Aboriginal groups granted Intervenor status who may choose to provide oral traditional
evidence.
Oral Traditional Evidence
The Board understands that Aboriginal peoples have an oral tradition for sharing stories, lessons
and knowledge from generation to generation. The Board is of the view that it would be valuable
to hear oral traditional evidence that would assist the Board in understanding how the Project
may impact Aboriginal communities’ interests. The Board therefore wishes to extend an
invitation to Aboriginal Intervenors to provide a Notice of Intent to provide oral traditional
evidence.

Taking advantage of this opportunity to provide oral traditional evidence is not mandatory, but
the Board encourages those Aboriginal Intervenors who are able to participate to do so. This is
an opportunity to identify and increase understanding of Aboriginal issues relating to the Project
early in the process. For groups who are eligible for participant funding, funding allocations can
be used to help support preparation for and participation in this oral traditional evidence process.
The Board recognizes that there will be certain amendments to the application; however, these
amendments are not expected to affect the majority of the Project. Therefore, the Board is of the
view that valuable information may be provided by way of oral traditional evidence related to
aspects of the application that are not expected to change as a result of the amendments.
Aboriginal groups and EEPL are also encouraged to speak directly with each other to address
issues.
Any Aboriginal Intervenor who chooses to participate in this early oral traditional evidence
process will still be able to fully participate in all process steps that are scheduled later, if and
when the Board releases a Hearing Order. This will include further opportunities to submit
evidence, including any evidence relating to the amendments to the application.
The Board has identified Aboriginal groups who may wish to provide oral traditional evidence in
Appendix II. These groups demonstrated to the Board’s satisfaction that they are either directly
affected by the proposed project or are in possession of relevant information or expertise.
Appendix II includes only those Aboriginal groups who were granted Intervenor status. Any
Aboriginal groups who were approved to provide letters of comments will be included in the full
list of participants when it is issued.
Those Aboriginal Intervenors who wish to provide oral traditional evidence at this time must
submit their written Notice of Intent to the Board on or before 12:00 noon (MST) on
13 August 2015 using the form provided in Appendix I. The Board will provide further details
on the process after the Notices of Intent are received.
Process Update
The Board intends to continue offering information sessions and workshops. Details on these
sessions will be posted on the NEWs website.
If the application is determined to be complete after the amendments are filed, the Board will
issue a Hearing Order setting out the process steps which will include the process steps for all
approved Participants.
The Board wishes to reassure everyone that the Board has authority and procedural flexibility to
deal with future amendments to applications and to ensure that it hears from all those directly
affected.

Notice of Intent to provide oral traditional evidence
To assist those Intervenors providing oral traditional evidence, the Board recommends that this
evidence focus on how the Project would impact their community’s interests and rights. In
addition, the Board does not consider the following types of information to be oral traditional
evidence, and should not be included in any oral presentation:

Technical and scientific information.
Opinions, views, information, or perspectives of others, whether obtained from news
clippings, personal discussions, or written materials.
Detailed views on the decisions the Board should make and opinions about the Project.
Recommendations to the Board on whether or not to approve the Project or the terms and
conditions that should be applied if the Project were to proceed.
Questions that require an answer from either the company or the Board, or rhetorical
questions.
The Board requires the following information from those Aboriginal Intervenors planning to
present oral traditional evidence:
