TO THE HONOURABLE
THE LIEUTENANT GOVERNOR IN COUNCIL
(3) Where the administration of an Act or portion of an Act
or a part of the public service is transferred to a minister under
subsection (2), the Lieutenant Governor in Council may also
transfer to the minister for administration of the whole or any
part of the moneys appropriated in respect of that Act or part
of the public service.
2 By Your Honour’s Order 244/2007, dated April 2, 2007, certain
duties were prescribed for members of the Executive Council,
including responsibility for Acts of the Legislative Assembly.
1 Sections 3, 4 and 5 of The Government Organization Act
provide, in part, as follows:
3 It is desirable and in the public interest to repeal Your
Honour’s Order 244/2007, dated April 2, 2007, and appoint members
to the Executive Council and prescribe their duties, including
responsibility for Acts of the Legislative Assembly.
3 The Executive Council of the Province of Saskatchewan
is continued and consists of its present members and any other
persons that the Lieutenant Governor may appoint.
The undersigned has the honour, therefore, to recommend that
Your Honour’s Order do issue pursuant to sections 3, 4 and 5 of The
Government Organization Act:
The undersigned has the honour to report that:
4(1) The Lieutenant Governor may appoint, under the
Great Seal, from among the members of the executive council,
the following officers to hold office during pleasure:
(a)
a President of the Executive Council;
(b) ministers to preside over the departments of the
executive government and to exercise any powers and
perform any duties or functions that the Lieutenant
Governor in Council may assign or transfer pursuant to
section 5;
(c) ministers, in addition to those appointed pursuant
to clause (b) to exercise any powers and perform any duties
or functions that the Lieutenant Governor in Council may
assign or transfer pursuant to section 5.
(2) The Lieutenant Governor in Council may determine the
titles by which the ministers appointed pursuant to subsection
(1) shall be known.
5(1) The Lieutenant Governor in Council may, on the
recommendation of the President of the Executive Council:
(a) assign to any minister any power, duty or function
conferred or imposed by law on a minister;
(b) transfer any power, duty or function assigned to a
minister under clause (a) to any other minister;
(c) transfer any power, duty or function that is conferred
or imposed by law:
(i)
on any minister, to any other minister;
(ii) on any department, to any minister or other
department;
either absolutely or limited for any period and in respect of any
purpose or area of Saskatchewan that may be specified by the
Lieutenant Governor in Council.
(2) Without limiting the generality of subsection (1), the
Lieutenant Governor in Council may assign to any minister or
transfer from one minister to another the administration of:
(a)
any Act or portion of an Act;
(b)
any part of the public service;
either absolutely or limited for any period and in respect of any
purpose or area of Saskatchewan that may be specified by the
Lieutenant Governor in Council.
(a)
repealing Your Honour’s 244/2007, dated April 2, 2007;
(b) listing the members of the Executive Council in order of
seniority as set out in the first column of Schedule I attached
hereto along with their respective offices and their
responsibilities set out in the second column;
(c) appointing the Acting Minister for each Minister as set
out in the third column of Schedule I attached hereto with
respect to the office opposite it and where there is more than
one Acting Minister, the Acting Minister whose name is
underlined with respect to all other responsibilities of the
Minister unless another Minister is listed as an Acting Minister
opposite a responsibility;
(d) designating the senior member of the Executive Council
present in the City of Regina according to the list of Ministers
in Schedule I attached hereto, excluding the President of the
Executive Council, to be Acting Minister in the event that the
Minister and the Acting Minister are absent for any reason;
and
(e) assigning ministerial responsibility for the
administration of the various Acts of the Legislature as set out
in Schedule II attached hereto, subject to the exceptions set out
in Your Honour’s Order 737/2006, dated September 15, 2006,
with respect to the following acts:

MO L021/2007-08. Pursuant to the powers vested in me by
section 118 and subsection 54 of The Education Act, 1995, and in
compliance with section 357 of the said Act, I, Deb Higgins, Minister
of Learning hereby order as follows, effective the date of this Order:
1 that the following lands be transferred from Sub-division No. 6
of the South East Cornerstone School Division No. 209 of
Saskatchewan to Sub-division No. 4 of the Holy Family Roman
Catholic Separate School Division No. 140 of Saskatchewan:
In Township 4, Range 13: the east half of section 11;
All West of the Second Meridian;
Excepting those lands included within the boundaries of an Indian
Reserve;
2 that the education portion of the tax arrears on the
aforementioned land shall be payable to the Board of Education of
the South East Cornerstone School Division No. 209 of Saskatchewan;
3 that the education portion of the property tax owing or already
paid for the current year on the aforementioned land shall be divided
in a proportion as mutually agreed on by the Boards of Education of
the South East Cornerstone School Division No. 209 of Saskatchewan
and Holy Family Roman Catholic Separate School Division No. 140
of Saskatchewan; and
4 that all lands registered in the names of the board of education
of the school division or any of their predecessors, shall be vested in
the name of the Board of Education of the Holy Family Roman
Catholic Separate School Division No. 140 of Saskatchewan.

ALTERATION OF BOUNDARIES —
THE RESORT VILLAGE OF MELVILLE BEACH AND
THE RURAL MUNICIPALITY OF GRAYSON NO. 184
1 Pursuant to sections 53, 56, 57, 59, and 61 of The Municipalities
Act, the Council of the Rural Municipality of Grayson No. 184 has
submitted an application to alter its boundaries to the Minister of
Government Relations.
2 Upon consideration of the application, the Minister is of the
opinion that the municipalities affected will be viable entities
following the alteration of boundaries. Therefore, the undersigned
hereby orders, pursuant to Sections 61, 62, and 63 of The
Municipalities Act, that:
(a) the boundaries of the Resort Village of Melville Beach
and the Rural Municipality of Grayson No. 184 be altered by
withdrawing from the rural municipality and adding to the
resort village the territory described in Schedule A;
(b) Schedule B is conclusively deemed to be the legal
description of the boundary of the Resort Village of Melville
Beach; and
(c) the alteration shall take effect on and from the date of
this Order.

SCHEDULE B
The boundaries of the Resort Village of Melville Beach shall
comprise the territory in the Province of Saskatchewan lying within:

the northerly bank of Crooked Lake and the southerly boundary

In accordance with section 41 of The Heritage Property Act, I,

declare as Provincial Heritage Property the site commonly known as:
Ernest Lindner Studio on Fairy Island
and legally described as:
Island No. 2 as shown on the Plan of Survey of
Township 53, Range 27, West of the 2nd Meridian that
was approved and confirmed by the Surveyor General on
August 20, 1912 (Registered Plan No. 100075519).

THE SASKATCHEWAN CHICKEN MARKETING PLAN
REGULATIONS, 1978 — OVERPRODUCTION CHARGES
ORDER NO. 36/07. The Chicken Farmers of Saskatchewan,
pursuant to the provision of The Saskatchewan Chicken Marketing
Plan Regulations, 1978, and The Agri-Food Act, 2004, hereby
determines and orders as follows:
1(a) Subject to clause (b), all kilograms of production in excess of
the kilograms allocated to a licensed producer in a cycle will be
deducted from the kilograms allocated to that licensed producer six
cycles later.
(b) Beginning in Chicken Farmers of Canada production
period A79 and for all future production periods, all kilograms
of production in excess of 101 percent of the kilograms allocated
to a licensed producer in a cycle will be deducted from the
kilograms allocated to that licensed producer six cycles later.
(c) In the event the excess kilograms to be deducted are
greater than the Quota held by the producer in the cycle when
the allocation reduction is to occur, the remaining excess
kilograms will be deducted in the immediate consecutive
cycle(s) to the cycle the reduction was to occur.
2(a) All production over 105% but less than 110% of a unit’s
authorized periodic allocation shall be subject to overproduction
charges of 44 cents per kilogram.
(b) All production over 110% of a unit’s authorized periodic
allocation shall be subject to overproduction charges
of 88 cents per kilogram.
3(a) Where the Board is required to remit and enforce such
overproduction charges as determined by the Board for production of
chicken over allocation, the Board shall forthwith collect like amounts
and enforce such overproduction charges.
(b) Any licensed producer who produces and markets
chicken over amounts authorized by the Board motion to be
produced in specified allocation periods shall be liable for such
overproduction charges based upon that share of the chicken
produced over allocation.
4 The overproduction charge assessed for all unauthorized
production shall be in like amount and calculated in like manner as
described in paragraph 1 for each kilogram of chicken produced by
any person in excess of the authorized production for any period.
5 Any change relating to:
(a) authorized production levels for any period including
allowable overproduction sleeves;
(b) the level of production charge to be paid on chicken
produced over authorized allocations shall be authorized by a
motion of the Board and subject to the approval of the Council.
6 Changes made pursuant to section 5 shall be communicated to
all licensed producers and processors and to the Council within one
week of the date of such change.
7 The Board shall invoice the producer in the amount of the
overproduction charge, and the producer shall be given thirty days
to remit his/her overproduction charge to the Board.
8(a) Failing to receive the overproduction charge payment within
thirty days of the invoice being mailed out, the Board shall request
the processor to deduct the charge from the proceeds of the next
chicken marketings by that producer.
(b) The processor shall deduct any such overproduction
charge from the proceeds of the next marketing of that producer,
and shall remit it to the Board.

(c) If not collected by any of the above means, the Board
shall suspend the producer’s license in accordance with the
quota suspension order.
9 Production and marketing of chicken above the quota allocations
or above the exempted level of 999 chickens per calendar year:
(a) shall be subject to penalties under section 42 of
The Agri-Food Act, 2004; and
(b) shall not qualify that producer for quota or for permit.
10 Order No. 35/06 is hereby wholly revoked.
Order No. 36/07 is made pursuant to clause 14(r) of The
Saskatchewan Chicken Marketing Plan Regulations, 1978, and shall
be effective on, from and after the 8th day of May, 2007. By order of

EXTRACTS FROM THE RULES AND PROCEDURES
OF THE LEGISLATIVE ASSEMBLY OF
SASKATCHEWAN RELATING TO PRIVATE BILLS
________
PETITIONS
14(1) A petition to the Assembly may be presented by a Member
at any time during the sitting of the Assembly by filing the same with
the Clerk of the Assembly.
14(6) Petitions may be either written or printed; provided always
that when there are 3 or more petitioners, the signatures of at
least 3 petitioners shall be subscribed on the sheet containing the
prayer of the petition.
14(9) No petition can be received which prays for any expenditure,
grant or charge on the public revenue, whether payable out of the
Consolidated Fund or out of moneys to be provided by the Assembly.
NOTE: A form of Petition can be obtained on application to the
Clerk of the Legislative Assembly.
PRIVATE BILLS
75(1) All petitions for Private Bills shall be in duplicate and shall
be filed with the Clerk of the Assembly not later than the twentieth
sitting day of the Session.
75(2) No petition for any Private Bill shall be received by the
Assembly if presented after the first twenty-five sitting days of the
Session.
75(3) No Private Bill may be introduced in the Assembly after the
first thirty sitting days of the Session.
76(1) Every applicant for a Private Bill shall deposit with the
Clerk of the Assembly, along with the petition for same, 2 copies of
the bill, with marginal notes inserted, and an accepted cheque
payable to the Minister of Finance for the sum of two hundred and
fifty dollars, if the said bill does not exceed ten pages, and fifteen
dollars additional for each page over that number; four hundred and
fifty words shall be held to constitute a page.
76(2) In the case of a bill incorporating a company, a receipt from
the Registrar of Joint Stock Companies for any statutory fees
required shall also be deposited with the Clerk of the Assembly.
77 No remittance of a deposit on account of a Private Bill or any
portion thereof shall be ordered by the Assembly unless the same has
been recommended by the committee charged with its consideration,
or unless the bill has been withdrawn, rejected or not reported upon,
in which cases the actual expenses incurred shall be deducted from
the deposit received before making such remittance.
79(1) All petitions to the Legislature for Private Bills of any
nature whatsoever, shall require a notice, clearly and distinctly
specifying the nature and object of the application, and where the
same refers to any proposed work, indicating generally the location
of the work, and signed by and on behalf of the petitioners, with the
address of the party signing the same; and when the petition is for an
act of incorporation, the name of the proposed company shall be
stated in the notice.
79(2) Such notice shall be published prior to the filing of
the petition with the Clerk of the Assembly as required in Rule 75(1)
in 2 consecutive issues of The Saskatchewan Gazette and 4 consecutive
issues of a newspaper, published in English and having circulation
in the locality affected.
79(3) A copy of the notice with a statutory declaration of the
several publications of advertisement shall be filed with the Clerk of
the Assembly along with the petition and bill.
80(2) Every bill for an act of incorporation, where a form of model
bill has been adopted, shall be drawn in accordance with such model
bill, copies of which may be obtained from the Clerk of the Assembly.
Any provisions contained in any such bill which are not in accord
with the model bill shall be inserted between brackets and shall be
so printed.
83 When any bill for confirming any agreement is filed with the
Clerk of the Assembly, a true copy of such agreement must be
attached to it.
COMMITTEE RULING
In cases where the proposed bill provides that the property to be
used or occupied by the petitioner be exempt from taxation, either in
whole or in part, the petitioner must file with the Clerk of the
Assembly, along with the petition, a written statement from the local
municipal authority in which the said property is situated approving
the intent of the provisions of the proposed bill which provide for the
exemption from taxation.
The name of the Member who is to present the petition and Private
Bill must be furnished to the Clerk of the Assembly at the time of
filing the petition. Such Member should not, of course, be a Member
of the Cabinet.

76(1) Les personnes qui demandent un projet de loi d’intérêt
privé déposent auprès du greffier de l’Assemblée, outre la pétition
connexe, 2 exemplaires du projet de loi qui portent les notes marginales
ainsi qu’un chèque visé payable au ministre des Finances, au montant
de deux cent cinquante dollars si le projet de loi est composé d’au plus
dix pages; ce montant est majoré de quinze dollars par page
supplémentaire. Une page est réputée renfermer quatre cent
cinquante mots.
76(2) Si le projet de loi prévoit la constitution d’une société, le
récépissé des droits réglementaires donné par le registraire des
sociétés par actions est également déposé auprès du greffier de
l’Assemblée.
77 L’Assemblée ne peut ordonner la remise totale ou partielle des
dépôts relatifs aux projets de loi d’intérêt privé, sauf recommandation
du comité chargé d’étudier le projet en question ou si celui-ci est
retiré ou rejeté ou encore n’est pas rapporté. Les dépenses réelles
sont déduites du dépôt avant de le remettre.
79(1) Toutes les pétitions introductives de projets de loi d’intérêt
privé à l’adresse de la Législature nécessitent un avis qui expose
clairement la nature et l’objet de la demande et qui est signé par les
requérants et en leur nom, avec mention de l’adresse des signataires.
Les avis qui visent des travaux proposes font état de leur emplacement;
ceux qui visent une loi de constitution en société font état du nom de
la société.
79(2) Les avis requis en vertu du paragraphe 75(1) sont publiés,
avant le dépôt de la pétition auprès du greffier de l’Assemblée
dans 2 numéros consécutifs de la Gazette de la Saskatchewan ainsi
que dans 4 numéros consécutifs d’un journal anglais diffusé dans la

pétition et le projet de loi, copie de l’avis ainsi qu’une déclaration

80(2) Si une formule-type de projet de loi a été adoptée, les projets
de loi portent constitution des sociétés sont rédigés selon cette
formule, dont les exemplaires peuvent être obtenus chez le greffier
de l’Assemblée. Les dispositions de ces projets de loi qui ne se
conforment pas à la formule-type sont indiquées et imprimées entre
crochets.
83 Une copie conforme de l’accord est annexée aux projets de loi
portent ratification d’un accord, qui sont déposés auprès du greffier
de l’Assemblée.
DÉCISION EN COMITÉ
Dans les cas où la proposition de projet de loi prévoit que les biens
devant être utilisés ou occupés par le requérant soient exempts
d’impôts, que ce soit dans leur ensemble ou partiellement, le
requérant devra déposer au bureau du greffier de l’Assemblée en
plus de sa pétition, une déclaration par écrit des autorités
municipales locales où se trouvent les biens en question approuvant
l’objet des dispositions de la proposition de projet de loi qui prévoit
l’exemption d’impôts.

Le nom du député qui présentera la pétition et le projet de loi doit
être fourni au greffier de l’Assemblée lors du dépôt de la pétition. Il

avant, soit le mercredi à midi. Pour les envois de soumissions à
la Gazette par la poste, veuillez prévoir une semaine au complet.
La parution de tout matériel reçu en retard sera remise au
numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de
la Saskatchewan doivent être soumis électroniquement
(WordPerfect ou Word) et accompagnés d’une copie papier
signée et envoyée au bureau de l’Imprimeur de la Reine,
ministère de la Justice de la Saskatchewan, B19-3085, rue
Albert, Regina SK S4S 0B1, tél. 306-787-2367, ou par courriel:
[email protected].
Chaque document ou disquette doit être complet, conformément
aux normes de parution, et doit être séparé de la lettre
d’accompagnement. Les signatures sur les documents doivent
être dactylographiées ou écrites lisiblement en lettres moulées
et doivent apparaître immédiatement en dessous de la signature
écrite.
Le paiement d’avance est exigé pour TOUS les avis placés dans la
Gazette de la Saskatchewan par les clients non gouvernementaux.
Les chèques ou les mandats doivent être établis à l’ordre du fonds
renouvelable de l’Imprimeur de la Reine. Veuillez y inclure la TPS en
plus des tarifs réguliers au taux de 7 % pour chaque article cité
ci-dessous dans la catégorie « soumis à la TPS ».
Le prix minimal pour la parution d’avis non inclus dans la
liste ci-dessous, est de 16 $ par avis. Le paiement devra
accompagner le matériel envoyé aux fins de parution.
