The political debate and the media frequently repeat the slogan that 'Europe’ would require this or that
amendment of national law concerning the judiciary (e.g., separation of the careers of judge and
prosecutor, a system of direct liability in case of miscarriage of justice, etc.); this meeting therefore aims
to promote knowledge of the sources of European law on the status of judges and prosecutors, not
losing sight of the case-law of the courts of Luxembourg and Strasbourg. The course will be
complemented by a survey of the "effective" statute of judges and prosecutors in the main European and
foreign countries.
Accommodation
The dates of the training initiatives are tentative and subject to confirmation, based on the accomodation

Ce module s'adresse aux praticiens en droit de la famille des Etats membres de l'Union Européenne ; son
objectif de leur donner les moyens de pouvoir gérer de manière adéquate les litiges familiaux
transfrontaliers, et plus particulièrement la séparation des couples « mixtes » et leurs conséquences
personnelles et pécuniaires pour les enfants de ces mêmes couples.
La formation proposée vise à faire connaître, comprendre et appliquer de facon pertinente les
dispositions de droit international privé –compétence et loi applicable –, les règles de reconnaissance et
d’exécution transfrontalières , enfin les règles de coopération envisagées par les textes européens de
droit familial - règlement Bruxelles II (2201/2003), règlement Rome III (1950/2010) et règlements «
obligations alimentaires », ainsi que par les conventions internationales corrélées, essentiellement les
conventions de la Haye de 1980 et 1996 .
Au dela de la simple amélioration de la connaissance et du bon usage de ces règles, la session vise à en
démontrer la haute valeur ajoutée pour la vie de familles mobiles à l'intérieur de l'espace judiciaire
européen , quoi qu’il en soit des differences de conception du droit familial qui existent entre les Etats
membres, et qui viennent encore trop souvent contrarier la bonne application des textes transnationaux

Pour ce séminaire l’INM couvre l’hébergement et les repas pour touts les participants. Le transport
international reste en charge du chaque participant.

Die Tagung wendet sich an Richterinnen und Richter der Strafgerichtsbarkeit sowie an
Staatsanwältinnen und Staatsanwälte.
Sie dient der Förderung des Verständnisses für die Opfer und der Optimierung des Umgangs mit vom
Menschenhandel Betroffenen. Praktische Lösungen von Problemen im Strafverfahren werden erörtert.

Die Veranstaltung stellt das "Phänomen Menschenhandel" sowie die Rolle des Opfers im Ermittlungsund Strafverfahren (psychologische Hintergründe und Auswirkungen von Erlebnissen auf die
Aussagefähigkeit; Umgang in Vernehmungen) dar. Außerdem werden die Gesetzeslage zur
Bekämpfung des Menschenhandels, die ausländerrechtliche Situation nach Umsetzung der
„Opferschutzrichtlinie“ sowie praktische Fragen zur Durchführung eines Strafverfahrens wegen
Menschenhandels (Rechtshilfe, Zusammenarbeit mit Nichtregierungsorganisationen, Opferschutz)
diskutiert.
Diese Tagung wird auch im Rahmen des European Judicial Training Network (EJTN) ausgeschrieben.
Sie ist in besonderem Maße auch für ausländische Teilnehmerinnen und Teilnehmer geeignet.
This conference is targeted at criminal court judges and public prosecutors. It aims to aid judges’ and
public prosecutors’ understanding of victims and to optimise the way in which persons affected by
trafficking in human beings are dealt with. Practical solutions to problems in criminal proceedings will
be discussed.
The conference will look at the phenomenon of human trafficking as well as the victim’s role in
investigation proceedings and criminal proceedings (psychological background and the effects of
victims’ experiences on their capacity to give testimony; dealing with victims in witness examinations).
Subsequently, the statutory position regarding the combating of human trafficking and practical
questions concerning the conduct of criminal proceedings for human trafficking will be discussed
(mutual legal assistance, cooperation with non-governmental organisations, victim protection).
This Meeting is also being convened as part of the European Judicial Training Network (EJTN).
Moreover, it is praticulary suitable for foreign participants.

Cette formation détaillée pour les praticiens en droit pénal de l'UE expliquera les types d'actions, la
procédure et la jurisprudence de la Cour de Justice de l'Union européenne (CJUE) en matière pénale.
Le séminaire comprendra une visite à la CJUE et la participation à une audience.

- La procédure du renvoi préjudiciel (admissibilité, effets, procédure d'urgence)
- La jurisprudence récente de la CJUE en matière pénale

Ceci est la deuxième partie d'un projet de formation juridique organisé avec le soutien financier du
Programme Justice Pénale de la Commission européenne de l'Union europénne - Direction-Générale
Justice.
Le nombre de places est limité. Les places seront allouées parmi les candidats éligibles dans l'ordre
d'arrivée des demandes.
Les juges et procureurs (25 places disponibles) se verront rembourses leurs dépenses de voyage à
concurrence de 300 €. Les participants sont tenus d'organiser eux-mêmes leur voyage.

About the project
This project, mainly sponsored by the European Commission, consists of three major seminars that will
take place in Seville, Milan and Prague.
Each seminar will have a specific focus:
Seminar 1 (Seville, 6-7 June 2013): An introduction to electronic evidence in criminal proceedings:
collection, analysis and presentation of the electronic evidence in Court (Introductory)
Seminar 2 (Milan, 21-22 November 2013): Challenges in obtaining and relying on electronic evidence
and issues of admissibility in Court (Specialised 1)
Contents of the seminar in Milan
The seminar will discuss the validity and admissibility of electronic evidence in criminal proceedings.

Accommodation
Accommodation for 2 nights in Milan will be booked and covered by ERA. Travel costs will be

Contexte
Destinée à des professionnels français et étrangers (magistrats, fonctionnaires) confrontés à la gestion
administrative ou judicaire des faits de corruption ou assimilés, cette session se propose de sensibiliser

et de former ces professionnels tant à la prévention qu'à la répression de ce phénomène. La session
permettra de mettre à la disposition des participants l'expertise du SCPC ainsi que des outils techniques
et juridiques permettant de détecter au mieux, de réguler ou de traiter ce type d'infractions.
Pédagogie
Pour ce faire, et dans un cadre à la fois théorique et pratique, interviennent des acteurs des différents
secteurs concernés (magistrats, policiers, universitaires, hauts fonctionnaires, responsables du secteur
privé, ONG) ayant expériences et connaissances à partager en ce domaine afin de parvenir à une
meilleure prise de conscience des enjeux de la corruption, tant en France qu'au niveau international.
