Refusal to register the Church of the Flying Spaghetti Monster
On 15 March 2013, the Minister of Administration and Digitization refused to register the
Church of the Flying Spaghetti Monster. Justifying his decision, the Minister emphasized that
the Register may only contain religious communities that are set up in order to profess and
promote their religious faith. He shared the experts’ view that, in fact, we are dealing “with a
kind of anti-religion.” On those grounds, he stated that the Church of the Flying Spaghetti
Monster did not meet the criteria set out in art. 2 para. 1 of the act of 17 May 1989 on the
guarantees of freedom of conscience and religion.

Parliament rejected three projects of law of same sex marriage
On 25 January 2013, Parliament rejected all three projects concerning the same sex marriage
(regulations of those projects are similar with the French Pacs). Before the parliament debate
get started, the Minister of Justice Jaroslaw Gowin stated that all three projects are
unconstitutional because marriage according to art. 18 of Constitution is only union a man and
women. For the first project 276 deputies voted for reject, 150 voted against, and 23
abstentions; for the second project 283 deputies voted for rejection, 137 against and 30
abstained from voting. Parliament rejected a last project by the voting as following: 228 for,
211 against and 10 abstentions.

La Douma a adopté en première lecture le projet de loi qui établira une peine criminelle pour
offense aux sentiments religieux. (Voir la lettre d’information précédente #16). Ce projet de
loi sera amélioré lors de la deuxième lecture.

Fin janvier 2013, le Ministère de la Justice a présenté à la Douma un projet de loi afin de
préciser la réglementation sur les manifestations religieuses publiques prévu par l’article 16 de
la Loi fédérale sur la liberté de la conscience et des associations religieuses. Selon l’arrêt de la
Cour constitutionnelle de Russie du 5 décembre 2012, le texte de cet article doit être corrigé
pour préciser que toutes les manifestations religieuses publiques ne doivent pas faire l’objet
d’une déclaration préalable aux autorités. Une dispense doit être prévue dans le cas des
manifestations religieuses publiques dans les édifices du culte, les immeubles et les terrains
temporairement affectés aux organisations religieuses (location d’une salle de concert).
