Auszug aus den Mietbedingungen der SYSTEM RENT A. KREITZ KG
§ 01.
Bestellung und Auftragsbestätigung
Bestellungen können mündlich oder schriftlich eingereicht werden. Bei Annahme des Auftrags durch uns erstellen wir eine
schriftliche Auftragsbestätigung, die vom Auftraggeber gegengezeichnet per Fax oder e-mail an uns gesendet werden muss.
§ 02.
Zahlungsbedingungen
Die sich aus der Auftragsbestätigung ergebende Mietgebühr, zuzügl. der jeweils gültigen gesetzlichen Mehrwertsteuer ist im voraus
zahlbar und muß bis spätestens zum Ausstellungsbeginn bezahlt sein. Bei Rücktritt von einer Reservierung/einem Mietvertrag werden
Stornogebühren fällig in Höhe von:
50% des Auftragswertes bei Rücktritt 20 Arbeitstage vor Mietbeginn,
80% des Auftragswertes bei Rücktritt 1 Arbeitstag vor bzw. am Tag des Mietbeginns.
§ 03.
Verlust oder Diebstahl
Bei Verlust oder Diebstahl von Geräten oder Zubehörteilen ist grundsätzlich der Neuwert zum aktuellen Listenpreis des Herstellers zu
ersetzen. Die Entrichtung der vereinbarten Mietgebühr bleibt davon unberührt. Darüber hinaus sind alle Diebstähle anzuzeigen und dem
Auftragnehmer eine Kopie des polizeilichen Anzeigeprotokolls auszuhändigen.
§ 04.
Gerichtsstand
Gerichtsstand für alle sich im Zusammenhang mit unseren Leistungen ergebenden Verbindlichkeiten ist Frankfurt. Der Gerichtsstand
Frankfurt gilt auch für Ansprüche im Urkunden-, Wechsel und Scheckprozeß, sowie im Mahnverfahren. Der gleiche Gerichtsstand gilt,
wenn der Kunde keinen allgemeinen Gerichtsstand im Inland hat und nach Vertragsabschluß seinen Wohnsitz oder gewöhnlichen
Aufenthaltsort zu Zeitpunkt der Klageerhebung nicht bekanntgegeben hat. Zwischen den Parteien wird ausschließlich das
innerstaatliche Recht der Bundesrepublik Deutschland vereinbart.

§ 01.
Orders and Confirmation of Orders
Orders can be placed orally or in writing. On receipt of an order a written confirmation will be issued which the client must sign and
return to us by fax or e-mail.
§ 02
Terms of Payment
The rental fee arising from the confirmation of order is subject to the respective rate of statutory VAT, is payable in advance and must
be paid by the start of the event at the latest.
If the Rent contract is canceled a cancellation fee has to be paid as followed:
50 % of the rental fee if cancel 20 working days before setup date
80 % of the rental fee if cancel one day prior, or on the setup day of the event.
§ 03
Loss or Theft
In the case of loss or theft of equipment or accessories this must be compensated for by the replacement value at the manufacturer’s
current catalogue price. This does not affect payment of the agreed rental fee. Moreover all cases of theft must be reported to the police
and a copy of the police report given to the contractor.
§ 04.
Place of Jurisdiction
The place of jurisdiction for all liabilities connected with our services is Frankfurt. Frankfurt is also the place of jurisdiction for claims
concerning document, exchange and cheque litigation and similarly dunning procedures. The same place of jurisdiction is valid in cases
where the client has no general place of jurisdiction in Germany and, on conclusion of the contract, has not disclosed his place of
residence or usual whereabouts at the time when the suit is filed. Between the parties the territorial legislation of the Federal Republic of
Germany is without exception binding.
