CONSIGLI DI POSA Le nostre piastrelle possono essere posate indifferentemente sia secondo il metodo tradizionale (con malta cementizia) sia con collanti, anche se noi consigliamo una posa con collanti in quanto si riesce ad ottenere una maggiore aderenza fra il sottofondo e la piastrella. Il metodo tradizionale richiede una certa esperienza considerata la bassa porosità di alcune tipologie produttive. Si raccomanda di effettuare la stuccatura delle fughe solo dopo un certo tempo dalla posa del pavimento e del rivestimento così da permettere una perfetta adesione fra piastrella e sottofondo. Le fughe dovranno essere ben pulite in profondità e poi stuccate con prodotti a base cementizia. Una corretta posa in opera, seguendo alcune semplici regole, garantirà un perfetto risultato finale : - Controllare la planarità delle pareti da rivestire o del massetto su cui posare le piastrelle da pavimento. - Posare il prodotto miscelando il materiale prelevandolo da più scatole - Maneggiare con cura il prodotto prima e durante la posa - Per nessun motivo saranno accolte contestazioni su materiale posato per danni visibili prima della posa. - Livingstone si riserva di apportare modifiche senza preavviso ai prodotti di questo catalogo, declinando ogni responsabilità per danni diretti o indiretti derivanti da eventuali modifiche. LAYING The tiles can be layed either with cement mortar or with adhesives. We advise the laying with adhesives since a better adhesion between tile and ground con be obtained. The laying with cement mortar requires a wide experience, especially for the operations which can improve the fixing, considering the low porosity of certain types of tiles. It is recommended to make the clearance grounting after a certain period from the floor laying in order to allow the adhesion between tiles and ground to take a place. The clearances should be deeply cleaned and successively grounted with cementbased products. A properly performed laying, following a few simple rules, will ensure a perfect finished result : - Check that the wall or floor slab onto which you will be laying the tiles is perfectly flat. - Pick material at random from different boxes while laying. - Handle the product with care before and during laying. - Claims on items which have already been laid won’t be accepted, for any reason for any damage visible before laying. - Livingstone reserves the right to modify the mentioned products from this catalogue without notice, declining all responsibility on direct or indirect damages caused by eventual modification. POSE La pose peut etre faite tant avec une méthode traditionelle ( avec mortier de ciment) qu’avec des adhésifs. La pose avec adhésifs est conseillée; elle permet d’obtenir une adhésion majeure entre carreaux et sous-couche. La pose traditionelle demande une grande expérience en tenant compte de la basse porosité de certaines typologies de production ( dépoussiérage et coup de presse). Le remplissage des joints devra etre effectué après un certain temps de la pose du carrelage pour permettre l’adhesion entre carreau et sous-couche. Les joints doivent etre nettoyés en profondeur et ensuite garnis avec des produits à base de ciment. Une pose en ouevre correcte, en suivant quelques règles simples, garantira un parfait résultat final : - Controler la planitude des murs à revetir ou du ravoirage sur lequel poser les carreaux de sol. - Poser le produit en mélangeant le materie en le prélevant de plusieures boites. - Manier avec soin le produit avant et pendant la pose. - Pour aucun motif, des contestations pour du matériel posé avec des dommages visibles avant la pose ne viendront acceptées. - Livingstone se réserve d’apporter modifications aux produits de cette catalogue sans prèavis, en déclinant chaque responsibilité pour les dommages directs ou indirects dérivants des éventuelles modifications. VERLEGUNG Unsere Fliesen koennen sowohl nach traditioneller Art (Zementmoertel) als auch mit Klebern verlegt werden, auch wenn wir eine klebeverlegung zwecks staerkerer Haftung zwischen Fliesen und Untergrund empfehlen. Bei einer Verlegung mit Zementmoertel wird eine Groessere Erfahrung benoetigt, da die Fliesen eine niedere Porositaet aufweisen. Das Verfugen soll erst nach einiger Zeit erfolge, um eine sichere Haftung am Untergrund zu gewaehrleisten. Die Fugen muessen gruendliche gereinigt und mit einer Zementmasse verfugt werden. Eine korrekte verlegung, folgend einiger Regeln, wird er ein perfektes Endergebnis gewaehrleisten : - Man muss die Ebenflaechigkeit der Waende oder des Estrichs, auf den die Fliesen verlegt werden, kontrollieren. - Die Produkte muessen aus unterschiedlichen Kartons, vermischt, verlegt werden. - Das Material muss mit Sorgfalt bahandelt werden. - Auf keinen Fall werden Beanstandungen auf verlegtes Material akzeptiert, fuer schaeden, welche bereits vor der Verlegung sichtbar waren bzw. generell nicht auf bereits verlegtes Material. - Livingstone bahaelt sich vor, moegliche Aenderungen zu den Produkte von diese Katalog, ohne Vorankuendigung durchzufuehren und lehnt jegliche Verantwortung ab fuer direkte oder indirekte Schaeden, die sich aus eventuellen Aenderungen ergeben. 50 NORME DI MANUTENZIONE L’AZIENDA, RACCOMANDA FILA. Lavaggio-Protezione e manutenzione del Gres Porcellanato. 1 – Lavaggio dopo posa. Il lavaggio dopo posa è una fase di fondamentale importanza per tutti gli interventi successivi e per la manutenzione. E’ bene sapere che oltre il 90% delle contestazioni in cantiere è dovuto ad un cattivo o addirittura inesistente, lavaggio con detergente acido dopo posa. Per questa operazione, Livingstone propone Fila Deterdek, detergente disincrostante acido. 2 – Protezione tipo levigato e/o Lappato. La migliore protezione si realizza con Fila MP/90, un protettivo liquido antimacchia. 3 – Protezione tipo naturale-strutturato. In questa caso, solo per pavimentazioni interne, si consiglia di usare FilaJet. 4- Manutenzione per tutte le superfici. Per la pulizia di tutti i giorni, FilaCleaner, detergente neutro a basso residuo. 5 – Per sporchi più intensi e per togliere le macchie. Fila PS/87, detergente, sgrassante e smacchiatore. MAINTENANCE RULES The Company recommend Fila. Cleaning-Protection and routine care of porcelain tiles. 1 – After installation clearing. Cleaning after installation is of fundamental importance for all subsequent procedures and for care operations. It should be borne in mind that more than 90% of complaints at the time of installations are due to poor clearing, or even failure to clean, with an acid product after installation of the tiles. RÈGLES DE MAINTENANCE Lavage-protection et entretien du gres cérame 1 – Lavage apres pose Le lavage aprés pose est une opération extremement importante au renard de toutes les interventions stivante ainsi que pour l’entretien. Il convient de rappeler que plus de 90% des contestations sur chantier sont dues à un mauvais lavage aprés pose effectué à l’aide d’un détergent acide voire à l’absence de tout lavage. Pour cette opération Livingstone propose Fila Deterdek, décapant acide. 2 – protection pour surface polie et/ou adoucie. La meilleure protection s’obtient avec Fila MP/90, une protection anti-tache. 3 – Protection pour surface de type naturelle – structuree Danc ce cas, il est raccomandè d’utiliser FilaJet. 4 – Entretien de toutes les surfaces. Pour le nettoyage quotidien, FilaCleaner détergent neutre à faible résidu. 5 – Pour le saletés tenace set pour limine les taches. Fila PS/87, détergent dégraissant et détachant. REGELUNGEN DER WARTUNG Die Firma empfiehlt Fila. Reinigung, Schutz und instandhaltung von Feinsteinzeug. 1 – Reinigung nach den Verlegen. Die Reinigung nach dem Verlegen ist von ausschlaggebender Wichtigkeit fuer alle nachfolgenden Arbeitsgaenge und die Instandhaltung. Es ist tatsache, dass ueber 90% der Beschwerden auf der Baustelle auf eine unzureichende oder gar ueberhaupt nicht erfolgte Reinigung nach dem Verlegen mit einem saeurehaltigen Reinigungsmittel zurueck zu fuehren sind. Fuer diesen Vorgang empfiehlt Livingstone Fila Deterdek, ein saeurehaltige Entkrustungsmittel. 2 – Schutz poliert und/oder geschliffener materialien. Der beste schutz wird erziehlt durch Fila MP/90. 3 – Schutz typ natuerlicher bzw.strukturierter materialien. In diesem Fall wird Fila Jet empfohlen. 4 – Instandhaltung fuer alle Flaechen. Fuer die taegliche Reinigung Fila Cleaner, Neutrales Reinigungsmittel. 5 – Fuer staerkeren Schmutz und zur Beseitigung von Flecken. Fila PS/87, Fett loesendes und Flecken entfernendes Reinigungsmittel. 51 CONDIZIONI GENERALI DI VENDITA A – APPROVAZIONE DELLA FORNITURA. Gli ordini rilasciati ai nostri agenti, anche se sottoscritti dagli stessi, sono per noi impegnativi solo dopo la nostra eventuale approvazione scritta. La fornitura comprende solamente quanto specificato nella nostra conferma di ordine o in altre comunicazioni scritte provenienti da noi. Il testo della nostra conferma d’ordine prevarrà in ogni caso sul testo difforme della eventuale offerta o della ordinazione. L’esecuzione parziale dell’ordine non significa approvazione dell’azienda per l’intero ordine. B - CONSEGNA . La consegna del materiale s’intende avvenuta a carico completato presso in nostri magazzini. Ogni nostra responsabilità cessa a carico compiuto. La merce viaggia sempre per conto del committente ed ogni rischio del trasporto, compresi rotture, deterioramenti, ammanchi o manomissioni, è a carico del medesimo anche se il prezzo è pattuito franco di porto, Fob e C & F. C – TERMINI DI CONSEGNA. I termini stabiliti per la consegna della merce debbono intendersi a favore di entrambi i contraenti; essi di norma non sono perentori, ma si intendono per la Livingstone come indicazione approssimativa del’’approntamento della merce, eventuali ritardi nella consegna non potranno quindi in nessun caso dare luogo a richiesta di risoluzione di contratto, di riduzione di prezzo o di risarcimento danni. I termini di consegna indicati nella conferma d’ordine sono perentori e vincolanti per il ritiro della merce da parte del committente entro le date segnate. In caso di mancato ritiro entro 10 gg. la società venditrice ha la facoltà di risolvere il contratto per la parte inevasa ed applicare una eventuale penale per la merce non ritirata. D - RECESSO. La venditrice si riserva la facoltà di recedere in tutto o in parte dal contratto di vendita definitivamente concluso nonché di quelli in corso di perfezionamento quando si verifichino cause di forza maggiore o fatti a circostanze (ivi compreso stato di allarme, mobilitazione, blocco guerra o calamità naturali anche in Stati fornitori di materie prime, crisi energetica, forzata restrizione della produzione, scioperi, occupazioni di stabilimento, serrata, incendi, crolli, ecc.) tali che alterino in modo sostanziale lo stato dei mercati, il vlore della moneta e le condizioni dell’industria delle ceramiche. E – GARANZIE E RECLAMI Le illustrazioni e le descrizioni dei cataloghi, tutte le pubblicazioni ed i campionari non sono impegnativi ma puramente indicativi. Le dimensioni dei prodotti soggetti a calibro, e in particolare a tutti i nostri pavimenti in particolare i nostri pavimenti in monocottura, sono da considerarsi con le tolleranze d’uso. La garanzia della merce è limitata al solo materiale di 1° scelta. La responsabilità è quindi espressamente esclusa per i materiali di 2° E 3° scelta o di stock, che si intendono venduti senza alcuna garanzia. Le differenze di tonalità non possono essere denunciate come vizio del materiale. Eventuali reclami per vizi o difetti della merce debbono essere proposti per iscritto, a mezzo lettera raccomandata, indirizzata alla nostra sede a pena di nullità. La garanzia del venditore è limitata ai soli vizi e difetti che vengano denunciati dal compratore nel termine di decadenza di giorni otto dalla consegna o dal ricevimento della merce. Qualora il reclamo sia tempestivo e risulti fondato, l’obbligo del venditore è limitato alla accettazione in restituzione e alla conseguente sostituzione della merce viziata o difettosa nel luogo stesso della fornitura primitiva, restando tassativamente rinunciati ed esclusi così la risoluzione del contratto come qualsiasi riduzione prezzo o risarcimento danni. La responsabilità e la garanzia non si estendono in alcun modo ai materiali già posti in opera. La sostituzione del materiale oggetto della contestazione non avrà luogo ove il compratore non ne sospenda immediatamente l’impiego. La responsabilità del venditore non si estende in alcun caso alla idoneità del materiale all’uso cui il compratore lo intende destinare. Nessun reclamo, domanda eccezione od azione potrà essere promossa se prima non sarà interamente pagato l’importo delle fatture dei materiali acquistati. F – PREZZI. I prezzi dei listini potranno essere cambiati in qualunque momento. Ogni eventuale aumento dei costi di materie prime, mano d’opera e materiali di nostro consumo è a carico del compratore e sarà applicato anche al materiale degli ordini in corso e già contrattualmente acquisiti. G - PAGAMENTI. I pagamenti devono essere effettuati solo ed esclusivamente presso la nostra sede Amministrativa, anche se i contratti sono stati conclusi altrove; le emissioni di tratte o accettazioni di portafoglio pagabile su altre piazze non comportano deroga a questa clausola. Il mancato o ritardato pagamento di oltre 10 gg. dalle scadenze pattuite dà la facoltà al venditore di sospendere o annullare qualsiasi rapporto, anche contrattuale, con il cliente moroso, nonché di esigere l’integrale pagamento di ogni altro credito ancora non scaduto. Il ritardo nel pagamento anche parziale delle forniture delle fatture dà in ogni caso luogo alla decorrenza degli interessi di mora al tasso ufficiale di sconto maggiorato di due punti. In ogni caso, trascorsi 10 gg. da ogni pagamento dovuto, la venditrice è autorizzata a spiccare tratta a vista con spese senza preavviso. H – RISERVA DELLA PROPRIETA’. Il materiale si intende venduto con patto di riservato dominio per cui resterà della proprietà sino ad avvenuto integrale pagamento del prezzo. I – FORO COMPETENTE. Per qualsiasi controversia o contestazione è eletto esclusivamente competente il Foro di Modena. GENERAL SALES TERMS A – The terms and conditions, hereinafter stated, shall be incorporated by reference in the transaction set forth on the front of this invoice and shall be binding on both the manufactured and customer as if separately stated and acknowledged by the parties. Livingstone shall not be liable in any way to a custumer for its inability to deliver the merchandise ordered as a result of strike, unavailability of raw materials, natural disaster or other unforeseen circumstances beyond the control of the seller. D – It is understood by custode that variations in hue, intensity, tone or other visual characteritics of glazed products may occur and that absolute uniformity of these characteristics cannot be guaranteed. Additionally, customer understands that products purchased on the basis of samples may vary in their visual characteristics from the sample in the same manner and in the same degree that production runs of the merchandise may vary. For its part, however, the seller represents to customer that it will use its best efforts to produce uniformità in the visual characteristics of its product. E – Unless confirmed by the seller in writing orders placed for merchandise designated as seconds thirds or any grade other than first are subject to availability and will be filled as and when a sufficent amount of said grade or gradesi s available. It is further understood by customer that even in cases of orders of first quality merchandise absolute uniformità of quality cannot be guaranteed and an allowance for inclusion of up to 5% of lesser grade merchandise will be made by customer. F – It shall be the customer’s responsabilità to promptly inspect each shipment delivered. Except as provided in paragraph 10, no claim for defects in merchandise will be honoured more than (15) fifteen days after the merchandise is delivered to customer’s warehouse. All claims shall be made in writing and shall state in detail the nature of the damage or defect and the quantity of merchandise involved. It shall be sufficient if said notice is provided by fax or cable in no case however shall the seller be obligated to honour such claims where there are invoices of the customer past due and unpaid. G – All merchandise is considered sold and title thereto passes at the time of delivery by the seller to a shipper in seller’s warehouse. From and after that time customer shall bear all risks of loss or damage to the merchandise and shall be responsible for the arranging for and cost of shipping and insurance against risk of loss. H – In cases where the seller specifically agrees to arrange for shipment of merchandise at customer’s request,the seller shall not be liable to customer for any delays in delivery due to any interruption in carrier service for whatever reason. I – All prices are F.O.B. at seller’s office, and are subject to change from time to time without notice in the event estende terms are agreed upon for payment of invoices outstanding between the seller and the customer all payments are to be made on or before the date or upon the expiration of the period, set forth on the front of this invoice. All payments are to be made by check or wire tranfer, as directed, to the seller at its administrative offices. L – The seller’s liability for defects in the merchandise shipped to customer and which is ultimately determined to be the responsability of the seller shall be limited to the replacement of the merchandise found to be defective in case of latent defects in the merchandise (those which are not detectable intill the merchandise is placed in use) the liability of the seller shall be agreed upon between the seller and the customer. No claim for latent defect in the merchandise manufactured by the seller shall be validi f made more than one year from the date of shipment of the merchandise from the seller to the customer. In no event does the seller extend any warranty or guarantee to merchandise graded other than first or second or to any consequent damage or defect arising from usage of the merchandise in any manner other than reccomanded by the seller. 52 CONDITIONS GENERALES DE VENTE 1 – APPROBATION DE LA FORNITURE. La livraison du matériel est pour nous terminée une fois celui-ci a été chargé sur autocar à notre usine ou entrepot. Toute responsabilité de notre part a fin une fois que la machine est chargée et la marchandise voyage toujours pour compte du commettant, tout risque pendant le trasport y compris cassures, détériorations, manques ou manomissions, est à la charge du commettant meme si le prix convenu est FOB et C & F. 3 – DELAIS DE LIVRAISON Les délais établis pour la livraison de la marchandise doivent etre au bénèficie des deux contractans; ils ne sont donc pas normalement péremptoires, mais ne raprésentent que des indications approximatives pour la livraison, ne pourront donc en aucun cas donner lieu a une demande de résolution du contract de reductio du prix ou de dédommagement. Les délais de livraison indiqués dans la confirmation de la commande sont péremptoires et engagent le commettant à ritirer la marchandise aux dates indiquées . Au où la marchandise cas n’ait pas été retiré après 10 jours, Livingstone a la facoulté de résoudre le contract pour la partie encore en suspense t d’appliquer une pénalité éventuelle pour la marchandise non ritirèe. 4 – RENONCIATION. La vendeuse se réserve la faculté de renoncer complètement ou en partie au contrat de vente définitivement conclu ainsi qu’à ceux en cours de perfectionnement lorsque se vérifient des causes de force majeure, des faits ou circonstances ( y compris état d’alarme, mobilisation, bloc, guerres ou calamités naturelles, meme dans les pays producteurs des matières premières, crise de l’énergie, reduction forcée de la production, chomages, occupation des usines, lock-out, incendies, écroulements, etc.) tels qu’ils altèrent de manière substantielle les conditions du marchè, la valeur de la monnaie et les conditions de l’industrie céramique. 5 – GARANTIE ET RECLAMATION. Les illustrations et descriptions des catalogues, toutes les publications et les échantillons n’ont qu’une valeur indicative. Pour les dimensions des produits sujets à calibre, particulièrement les carellages in monocuisson, il faut considérer les tolérances habituelles. La garantie de la marchandise est limitèe au materiél de premier choix. Toute responsabilità est exclue pour les matérieux de 2éme et 3éme choix ainsi que de stock, qui sont donc vendus sans garantie. Les différences de tonalité ne peuvent entre dénoncées par l’acheteur comme défaut du materie. Toute réclamation éventuelle pour vice et défaut de la marchandise doit etre avancée par écrit, par lettre recommandèe, adressèe à notre siège sous peine de nullité. La garantie de la vendeuse est limitée aux vices et aux défauts qui sont dénonces par l’acheteur dans les huit jours qui soivent la livraison ou la réception de la marchandise. Au caso ù la réclamation ait été immédiate et prouve etre fondée, l’obbligation de la vendeuse est limitèe à l’acceptation de la marchandise de retour et à la substitution de celle-ci au meme endroit où le matériel avait été livré à l’origine. Toute résiliation du contrat, réduction de prix ou dédommagement est donc formellement exclue. La responsabilité et la garantie ne concernent jamais le matériel déjà posé. La substitution du matériel objet d’une éventuelle conte station n’aura pas lieu au cas où l’acheteur n’ait arreté immédiatement l’emploi de celui-ci. La responsabilité du vendeur ne comprend en aucun cas l’aptitude du matériel pour l’emploi que l’acheteur compte en faire. Aucune réclamation, demande, exception ou action ne pourra etre fait si l’on n’aura pas payé auparavant le montant des factures des matériaux achetés. 6 – LE PRIX. Les prix courants pourront entre modifiés à tout moment. Toute augmentation éventuelle du cout des matiéres premiéres, de la main d’oeuvre et des matériaux que nous employons est à la charge de l’acheteur et sera appliquées aussi au matériel des commandes es cours et déjà achetés par contrat. 7 – PAIEMENT. Les paiements seront effectués uniquement au siège administratif de la vendeuse, meme lorsque les contrats auront été conclus ailleurs; le tirage des traites ou acceptation de portefeuille payable sur d’autres places n’entrainent aucune dèrogation à cette clause. Un retard dans le paiement de plus de 10 jours de la date d’échéance convenue donne la faculté a la vendeuse de suspendre ou annuller tout rapport, meme contractuel avec le client débiteur retardataire et d’exiger le paiement total de tout autre crédit encore pas échu. Tout retard dans le paiement meme partiel des factures donne droit en tout cas aux intérets moratoires au taux officiel d’escompte majoré de deux points. De toute manières, une fois écoulés 10 jour de la date d’échéance de tout paiement, la vendeuse est autorisée à émettre une traite à vue avec frais sans préavis. 8 – RESERVE DE LA PROPRIETE. Le matériel est vendu avec clause de propriété réservée et restera propriété de la vendeuse jusqu’au paiement totale du prix relatif. 9 – BARREAU COMPETENT. Pour toute controverse ou contestation l’unique barreau compétent auquel s’adresser est le Bureau de Modéne. ALLGEMEINE VERKAUFS-UND LIEFERUNGSBEDINGUNGEN. 1 – AUFTRAGSZUSTIMMUNG DER LIEFERUNG. Die Lieferung bezieht sich ausschliesslich auf die Ware, die in unserer Auftragsbestaetigung oder weiteren von uns schriftlich erteiltene Mitteilungen erwaehnt sind. Der Inhalt unserer Auftragsbestaetigung ueberwiegt in jedem Fall die evtl. unterschiedlich lautende Fassung des Angebots oder der Bestellung eine Teillieferung des Auftrags besagt nicht dass die Firma die Genehmigung fuer den vollen Auftrag gegeben hat. 2 – LIEFERUNG. Die Ware gilt bei Verlassen unseres Werkes bei Beendigung oder Ladung als Vertragsgerecht abgenommen. Jegliche Verantwortung unserer seits erlischt nach Beendigung der Ladung. Der Versand erfolgt auf alleinige Rechnungen und Gefahr des Auftraggebers, wie z.B. Transportrisiko, einschliesslich Sachschaden wie Bruecke Verberd, Fehlmengen oder aehnliche Verletzungen, selbst wenn der Preis frachfrei, F.O.B. und C&F vereinbart worden ist. 3 – LIEFERTERMINE. Die festgelegten Liefertermine fuer die Zustellung der Ware verstehen sich zu Gunsten beider Vertragspartner. Genannte Lieferzeitsangaben sind in der Norm unverbindlich und verstehen sich fuer Livingstone als nur annaehernd. Aus diesem Grund werden bei evtl.verspaeteter Auslieferung keine Ansprueche auf Schadenersatz, Aufloesung des Vertrags oder Preisnachlass anerkannt. Die, in der Auftragsbestaetigung angegebenen Liefertermine sind promptisch und fuer die Warenabnahme von Seiten des Auftraggebers innerhalb der festgelegten Daten bindend. Sollte die Ware innerhalb von 10 Tagen nicht abgeholt werden, behaelt sich die Livingstone das Recht vor, den Vertrag aufzuheben und kann fuer die nicht abgenommene Ware eine Vetragsstrafe fordern. 4 – RUECKTRITT. Die Livingstone behaelt sich das Recht vor, die Lieferungsverpflichtungen ganz oder teilweise aufzuheben, im falle hoeherer Gewalt, sowie bei Eintritt krisenhafter Verhaeltnisse ( wie Alarmsituationen, Mobilisierung, Blockaden, Kriegen und Naturkatastrophen – dies betrifft auch diejenigen Laender, die Rohstoffe liefern – Energiekrisen, Betriebstoerungen und Arbeitseinstellung, Streik, Werksbesetzung, Arbeiteraussperrung, Brand-Betriebs-stoerungen und Arbeitseinstellung, usw.) die, die Marktverhaeltnisse, den Wert der Waehrung und den Stand der keramischen Industrie grundsaetzlich aendern wuerden. 5 – GARANTIE UND BEANSTANDUNGEN. Abbildungen, sowie Beschreibungen in Katalogen, saemtliche Ausgeben und Musterkollektionen verstehen sich als nur annaehernd und unverbindlich. Bei abmessungen von Artikeln, die eine gewisse kalibrierung voraussetzen und dies betrifft insbesondere Fussbodebfliesen, die auch im Einmalbrandverfahren hergestellt werden muessen, die gebrechlichen Tolleranzwerte beruecksichtigt werden. Die Garantie der Ware beschraenkt sich ausschliesslich auf Material 1.Wahl. Wir lehnen demnach jegliche Verantwortung ab fuer Material 2. und 3. Wahl, sowie fuer vorraetiges Lager Material, das ohne Garantie verkauft wird. Handelsuebliche oder herstellungstechnisch bedingte Abweichungen in Farbtoenen gelten nicht als Materialmengel. Eventuelle Maengelruegen hat der Kaeufer schriftlich per Einschreibebrief bei uns eingehend zu erheben zu Vermeidung der Nichtigkeit. Die Garantie von Seiten der Verkaeufers beschrankt sich nur auf Fehler oder Mangel, die vom Kaeufer innerhalb 8 Tagen nach Empfang der Ware gemelet werden. Bei rechtzeitiger Meldung nachweisbarer Fehler und berechtigter Maengelruegen hat der Verkaeufer die Pflicht, die fehlerhaften oder defekten Teile zurueckzunehmen und zu ersetzen am selber Ortan dem die urspruengliche Lieferung stattgefunden hat. Maengelruegen oder sonstige Beanstandungen berechtigen nicht von Vetrag zurueckzutreten, Rechnungsbetraege zurueckzuhalten oder Schadenersatz zu fordern. Fuer bereit verlegtes Material wird jede Verantwortung und Garantie abgehlehnt. Die Materialersetzung wird nur durchgefuehrt, wenn der Kaeufer bis zur endgueltigen Klaerung der Reklamation die Verwendung des Schadhaften Materials einstellt. Die Verantwortung des Verkaeufers erlischt jedoch will der Kaeufer des Material an orten und fuer Zwecke verwenden, wofuer es nicht geeignet ist. Kleinerlei Maengelruegen, Forderungen, Einwendungen oder Handlungen koennen vorgenommen werden, ist im Voraus nicht der vollstaendige Rechnungsbetrag der gekauften Waren bezahlt worden. 6 – DIE PREISE. Die in der Preisliste angegebene Preise koennen jederzeit abgeaendert werden; jede moegliche Preiserhoehung von Rohstoffen, Arbeitsloehnen oder dem von uns angewandten Material geht zu Lasten der Kaeufers und wird auch auf Materialen angewandt, die bereits vertraeglich abgenommen worden sind. 7 – ZAHLUNG. Die Zahlung der Rechnungsbetraege haben ausschiesslich uber den Sitz der Verkaufsfirma zu erfolgen; wenn die Vetraege anderswo abgeschlossen worden sind bei Austellung von Wechseln oder Portefeuilles die Ausserhalb bezahlbar sind berechtigen diese nicht zu Abweichungen dieser Klauseln. Bei nichteinhaltung oder bei verspaeteter Zahlung innerhalb von 10 Tagen nach den vereinbarten Terminen, ist die Verkaufsfirma zum Ruecktritt vom Vetrag mit dem saumseligen Kunden berechtigt. Jedoch hat die Firma das Recht den genannten Betrag sowie jeden weiteren noch offenstehenden Betrag einzutreiben. Bei Verspaeteter sowie Teilzahlung wird die Firma das Recht eingeraeumt Verzugszinsen mit plus zwei Punkten uber der Bankrate zu berechnen. Auf jeden Fall ist die verkaufsfirma nach Ablauf von 10 Tagen und dafuer ist das Rechnungsdatum ausschlaggebend dazu berechtigt fuer jede uns zuzustehende Bezahlung eine Sichttratte zuzueglich Bankspesen auszustellen ohne vorherigen Mitteilung. 8 – EIGENTUMSVORBEHALT. Das Eigentum der Ware geht erst dann auf den Kaeufer uber, wenn dieser seine genannten Verbindlichkeiten aus unseren Warenlieferungen getilgt hat. 9 – GERICHTSSTAND.
