ASSURANCE INSURANCE 2009.08.0302F 2009.08.0302E ' ( ) * + ) , LOI SUR L’ASSURANCE AUTOMOBILE: DÉCISION RÉCENTE SUR LA NOTION D’“ACCIDENT” AUTOMOBILE INSURANCE ACT: RECENT DECISION ON THE NOTION OF “ACCIDENT” Le 15 juillet 2009, l’honorable Juge Louis Crête de la Cour supérieure du district de Montréal a rendu un jugement dans le dossier Samson c. Ville de Montréal. On July 15, 2009, the Honourable justice Louis Crête of the Superior Court, District of Montreal, rendered a decision in Samson vs. City of Montreal. Dans cette cause, la Société de l’Assurance Automobile du Québec était également mise en cause en raison de l’article 12.1 de la Loi sur l’Assurance Automobile (L.A.A.). En effet, la Ville de Montréal plaidait l’absence de compétence de la Cour supérieure en raison de l’application de la L.A.A. In this case, the Société de l’Assurance automobile du Québec was also an intervenant in virtue of article 12.1 of the Automobile Insurance Act (hereinafter the “Act”). In fact, the City of Montreal was pleading absence of jurisdiction of the Superior Court by reason of the application of the Act. Essentiellement, le demandeur réclamait un montant de 180 000 $ suite à une chute dans un conteneur de récupération d’un écocentre de la Ville de Montréal. Essentially, plaintiff was claiming the sum of $180,000, as a result of damages sustained after falling into a recycling bin in an ecocentre run by the City of Montreal. Le tribunal, après avoir fait une revue du fonctionnement de l’écocentre, a résumé la chute du demandeur de la façon suivante : The Court reviewed the activities of the ecocentre and summarized plaintiff’s accident as follows: ! " " " # $$ %# & 2 «M. Samson recule sa camionnette, dos au conteneur en question, éteint le moteur de son véhicule et sort pour aller jeter son bois dans le conteneur. À cette fin, il doit abaisser le hayon situé à l’arrière de sa camionnette, mais ce hayon est coincé et refuse de s’ouvrir. Posant un pied sur le pare-chocs, une main sur la poignée et l’autre sur le dessus du hayon, M. Samson force, le hayon cède et se rabat brusquement sur le demandeur qui est alors projeté en arrière dans le conteneur situé en bas. M. Samson se blesse très sérieusement à la jambe et ressent également une intense douleur au coude. » “Mr. Samson backed up his vehicle towards the recycling bin in question, turned off the ignition and came out to throw wood in the bin. In order to do so he had to pull down the hatch back of his vehicle but the hatch back was stuck and could not be opened. He placed his foot on one of the bumpers, one hand on the handle of the hatch back and the other on the hatch back. Mr. Samson had to force open the hatch back but the hatch back gave way and fell abruptly on the plaintiff who was then projected by the back into the recycling bin located beneath. Mr. Samson sustained injuries to his leg and elbow.” [our translation] Le tribunal était donc saisi de l’épineuse question de déterminer si cette chute constitue un accident au sens de la Loi sur l’assurance automobile du Québec. The Court was called upon to determine whether or not this constituted an accident within the meaning of the Act. Pour répondre à cette question, le tribunal a examiné la définition de préjudice causé par une automobile, à savoir « tout préjudice causé par une automobile, par son usage ou par son chargement ». De plus, il a fait référence à l’état de la jurisprudence et de la doctrine pour considérer qu’un accident d’automobile couvre également « tout événement dommageable dans lequel une automobile est impliquée », ce qui comprend l’usage d’une telle automobile. To respond to this question, the Court analyzed the definition of “prejudice caused by automobile” that is “any damage caused by an automobile, by the use thereof or by the load carried in or on an automobile”. Furthermore, it referred to the caselaw and doctrine to consider that an automobile accident also covers “any event in which damage is caused by an automobile” which, includes the use of such automobile. Le tribunal a conclu que la Cour supérieure n’avait pas compétence pour les motifs suivants : The Court concluded that the Superior Court was not competent for the following reasons: « Dans la mesure où une partie intégrante de la camionnette qui a provoqué la chute de M. Samson a été en contact direct avec lui, dans la mesure où le rôle actif ou passif du véhicule n’est pas en soi un critère déterminant du lien de causalité, dans la mesure ou le simple usage de l’automobile, son emploi, son utilisation, son maniement et son fonctionnement suffisent pour entraîner l’application de la L.A.A. et dans la mesure, enfin, où le dommage s’est réalisé “In so far as an integral part of the vehicle which provoked Mr. Samson’s fall was in direct contact with him, and in so far as the active or passive role of the vehicle is not in and of its self a determining criteria for the causal link, and in so far as or the simple use of the automobile, its operation or handling are sufficient for the application of the Act and in so far as where the damages occur within the general scope and use of the vehicle by Mr. Samson, necessarily, by 3 dans le cadre général de l’usage de son véhicule par M. Samson, force est de conclure, qu’en application de la jurisprudence dominante jusqu’à ce jour, l’accident qui a causé les dommages subis par le demandeur à l’écocentre de SaintMichel doit être considéré comme un accident d’automobile au sens de la L.A.A. » applying the dominant caselaw, the accident which caused the damages sustained by the plaintiff at the ecocentre in St-Michel must be considered as an accident within the meaning of the Act.” [our translation] Malgré tout, au cas où cette portion du jugement serait renversée par la Cour d’appel, le tribunal a décidé de traiter de la responsabilité et a considéré que la Ville de Montréal n’était pas responsable pour les motifs suivants : Nevertheless, in case this portion of the judgment could be reversed by the Court of Appeal, the Superior Court decided to deal with the liability aspect and concluded that the City of Montreal was not responsible for the reasons set forth below: il y avait des avertissements de danger; il n’était pas nécessaire de mettre une surveillance accrue sur les lieux; des mesures sécuritaires suffisantes étaient en place; la configuration des lieux ne constitue pas un piège. there were notices of danger; it was not necessary to add surveillance on the premises; the necessary security measures were in place; the configuration of the premises did not constitute a trap. Ainsi, le tribunal a considéré que le demandeur a été en grande partie l’artisan de son malheur et que la Ville n’avait pas commis de faute. As such, the Court concluded that plaintiff was the author of his own misfortune and that the City of Montreal did not commit a fault. Ce récent jugement de la Cour supérieure vient donc confirmer, une fois de plus, la portée très large de la notion d’ « accident » de la L.A.A. This recent Superior Court judgement confirms once again the broad definition to be given to the notion of “accident”. *** ! " # $ - % & ( & " % % ) % + * . ' # ' # # " # 0 $ ./ ' ) , / ' # +
