Prêts accordés par l'employeur Vom Arbeitgeber gewährte Kredite Loans granted by the employer MEMENTO MARS/MÄRZ/MARCH 2014 www.bdo.lu 1|4 Mars/März/March 2014 Note sur les prêts personnels et les prêts hypothécaires accordés par l’employeur à son personnel L’employeur peut accorder à ses salariés des prêts personnels ou hypothécaires, des bonifications ou des subventions d’intérêts à des taux d’intérêts inférieurs à ceux du marché. Ces avantages constituent des économies pour les salariés. Ils sont considérés comme des suppléments de salaires et soumis à l’impôt sur les salaires. Afin de mesurer l’avantage imposable, le législateur a fixé un taux considéré comme taux du marché. Ce taux est adapté régulièrement par règlement grand-ducal. Par règlement grandducal du 21 décembre 2012, le taux a été fixé à 2 % à partir de l’année d’imposition 2013, et aussi longtemps qu’un règlement grand-ducal ne modifie pas cette disposition. Um den steuerpflichtigen Vorteil zu ermitteln, hat der Gesetzgeber einen als marktüblich angenommenen Zinssatz festgelegt. Dieser Zinssatz wird regelmäßig durch großherzogliche Verordnung angepasst. Durch großherzogliche Verordnung vom 21. Dezember 2010 wurde der Zinssatz ab dem Steuerjahr 2013 auf 2 % festgesetzt, solange diese Bestimmung nicht durch eine großherzogliche Verordnung geändert wird. These benefits are savings which are considered as wages for the employees and are subject to the income tax. In order to measure the taxable benefits, the legislator fixed a rate which is considered as the market rate of interest. This rate is adapted regularly by grand-ducal regulation.
