forest products import and export worldwide surged to 478.8billion USD. 1.1.2 International forest products trade emphasizes more on environmental protection and sustainable development, and takes For e.g. introduction of a computerized WTS • Institutional (Governmental and private operators) readiness for LAS roll‐out very critical; resources and capacity enhancement very essential. Continuous stakeholder engagement very necessary. • Industry players very sensitive about any extra cost burden for the implementation of the LAS • Any system to be developed must recognize timber procurement policy for the domestic market • The business case for the industry; the regulatory case for government agencies; and the transparency/advocacy case for the civil society needs to be well communicated to these different stakeholders for their buy‐in of the FLEGT/VPA process International Workshop to Promote Understanding of FLEGT VPAs ProgressonFLEGTVPA inLiberia By : Charles K. Karnwea, Sr., Interim Managing Director, Forestry Development Authority Liberia 30 – 31 October 2013, Beijing, China VPAimplementationinLiberia Introduction • Following five rounds of negotiations, the VPA between the Government of Liberia (GoL) and the European Union (EU) was successfully concluded and initialed on May 9, 2011; • The Agreement was signed in Brussels on 27 July, 2011. • The VPA has been ratified by the EU(May 15, 2012) and Liberia(September 2013). • Liberia has estimated to issue the first FLEGT license by 2014. • VPA implementation in Liberia is in its inception phase with a capacity needs assessment of stakeholders to determine a baseline for capacity requirements of stakeholders for VPA implementation • This will be followed by the development of three capacity building implementation plans, one each for civil society, private sector and government for VPA implementation . 1 MeasuresforSupportingVPA implementationinLiberia A number of supporting measures has been identified in the VPA • These include: 1. establishing implementing structures to ensure effective coordination; 2. building capacity of key stakeholders; 3. establishing the legality assurance system ; 4. strengthening the legal and regulatory framework; • • Liberia recognizes that a lot of work is needed to implement the VPA and establish the Timber Legality Assurance System (TLAS) • It is envisaged that the total time required to prepare Liberia for full implementation of the VPA is seven (7) years as follows: • a) Preparatory phase: 2011‐2013; • b) Operational phase: 2014‐2017. . Cont’d 5. monitoring domestic trade in timber and its importance to the national economy; 6. monitoring the impact of the VPA, including communities and private‐sector operators; 7. monitoring implementation of the VPA; 8. communicating with national and international stakeholders; 9. Financing Mechanism. StatusofVPAImplementation inLiberia • Liberia has put in place institutions/structures and is now developing systems and capacity for effective VPA implementation: 6 1a.Institutionstooversee VPA implementation 1b.Institutionstocoordinate VPAimplementation • The Joint Implementation Committee (JIC): This body comprising of both the GoL and EU and is charged with the responsibility of overseeing the implementation of the VPA. • The Government of Liberia (GoL) has also established the Liberian Implementation Committee (LIC): This committee brings together the government and other stakeholders who were involved in the development of the VPA through negotiations. It meets regularly to oversee progress. 3 2.Capacitybuilding& developmentofsystems • Liberia has estimated to issue the first FLEGT license by 2014. This means that a lot of capacity issues (human resource, equipment, finance, etc.) have to be addressed with urgency. • Institutions identified for capacity building, include the FDA, Environmental Protection Agency (EPA), civil society, industry, community, and other government agencies directly involved in implementing the LAS. This work has commenced with detailed needs assessment initiatives during this inception period (September – December 2013). • There is a lot of detailed work on systems development (especially the LAS) and development of guidelines and procedures (on legality verification, FLEGT licensing, Social Agreements, etc.) to meet requirements for VPA implementation. 4 3.Communication,outreach • Liberia is currently reviewing its overall VPA communication strategy to update it with support of the EFI FLEGT Facility. Two priority areas for this piece of work are: • Communication towards European buyers as of March 2013 when the EU Timber Regulation took effect; and • Communication targeting participatory involvement of all stakeholders in the implementation of the VPA 5 • Some stakeholders are involved in the implementation of communication and outreach activities. 6 5.Developmentofregulations 4.MonitoringVPAImplementation • In the VPA, the Government of Liberia (GoL) commits to establish a National Multi‐ stakeholder Monitoring Committee (NMSMC) • During VPA negotiations, several needs were identified for further regulation to ensure effective functioning of the LAS, namely: • Confiscated Timber, • Abandoned Timber, • Transit Timber (or Timber in Transit), • Imported Timber, and • Third Party Access to Concession Areas. • An Interim Multi‐stakeholder Monitoring Committee has been constituted to assist the LIC with implementation activities. • Draft Terms of Reference (ToR) for the NMSMC has been developed and is now being reviewed by Liberian stakeholder. • Civil society organizations (CSOs) have established a monitoring framework to jointly monitor the VPA implementation process. • At end of the VPA negotiation process, the VPA Technical Secretariat established for the negotiations process was tasked to coordinate the VPA pre‐implementation activities during the pre‐implementation phase. • For full implementation of the VPA, a VPA Support Unit has been established. • It is not a part of government structure, rather, it is independent of all stakeholders groups • It will channel support for capacity building and coordination required for VPA implementation. • The TOR of the Support Unit includes an assessment of capacity building needs as its first task. • These regulations have already been drafted, inputs provided by EFI and are undergoing stakeholders review. 7 • FDA and other stakeholders are currently developing regulations to addressed the controversial Private Use Permits (PUPs) operations in Liberia. 8 6.Transparency,accessto information MovingfromNational VerificationSystemtoVPATLAS • At the moment the Support Unit is updating its website which will be linked to the government (FDA) website; with future hope of linking it to the official government website (Executive Mansion) to reflect/avail vital information on the forestry sector – e.g. laws & regulations, information from LiberFor (Chain of Custody System), concession agreements, etc. • The Forestry Development Authority (FDA) has established an “Info Shop” to improve access to information 9 TimberLegalityAssurance System(TLAS) • • 2. 3. 4. 5. The LAS includes five elements : 1. • Following a reform of the Liberia Forest Sector in 2005, and prior to the launch of VPA initiatives/process in Liberia (March 2009), a Chain of Custody System(COCS) was established as a national Wood Tracking System (WTS). • The COCS has limitations as it only concerns tracking of timber and timber products from forest to processing, through to market s or export and not for legality of concessions nor their activities. • Credible verification systems for timber legality were non‐ existent as there was no exact or agreed definition for legal timber. • At the time, only a few laws and/or government ministries and agencies were consulted for verification for legality of timber. • Following verification, an export permit is issued to exporters. PROCESSUS DE NEGOCIATION DE L’APV L’une des contributions de l’Union européenne à la lutte contre l’exploitation illégale des forêts est le Plan d’action FLEGT qui propose aux pays exportateurs du bois, la négociation et signature avec elle d’un Accord de partenariat volontaire (APV). • 2003(octobres): Déclaration ministérielle de Yaoundé sur l’application des réglementations forestières et la gouvernance; • 2005: Règlement du Conseil européen sur l’établissement d’un régime d’autorisation FLEGT pour les importations du bois dans la Communauté européenne • 2005‐06 : Désignation de l’Allemagne comme facilitateur du FLEGT au Cameroun = Début du travail préliminaire sur les grilles de légalité et la traçabilité • 2007 : Ouverture des négociations FLEGT • Octobre 2008 : Publication du projet de réglementation sur le bois par la Commission Européenne • 2010 : Signature de l’APV par le Cameroun (06 Octobre ) 2. BUT ET OBJET DE L’APV • L’objet de l’APV est de fournir un cadre juridique visant à s’assurer que toute les importations au sein de la communauté européenne à partir du Cameroun, des bois et produits dérivés ont été légalement produits ou acquis. • L’APV fait désormais partie de l’arsenal juridique qui gouverne le secteur forestier au Cameroun. Son fonctionnement repose sur six(06) éléments : 1. la vérification de la légalité de l’entité forestière (en utilisant de la grille de légalité qui contient les critères, indicateurs et les vérificateurs, il y a 08 grilles de légalité); 2. le suivi national de l’activité forestière; 3. le contrôle national de l’activité forestière; 4. la vérification de la conformité de la chaîne d’approvisionnement (système de traçabilité); 5. l’émission des autorisations FLEGT; 6. un audit indépendant; Le SVL conduit à la délivrance des certificats de légalité et des autorisations FLEGT 4.IMPLICATION DE L’APV (1/2) (Article 23) • L’APV/FLEGT instaure entre le Cameroun et l’Union Européenne un Régime d’autorisation FLEGT. • Ce qui suppose que le bois ne va désormais franchir les frontières européennes que s’il est accompagné d’une “licence d’exportation” = “Autorisation FLEGT” délivrée par le Cameroun. • Ce régime d’autorisation FLEGT instaure un ensemble d’exigences et de procédures afin de vérifier que les bois et les produits dérivés expédiés vers l’Union européenne sont produits légalement et attestés par la délivrance d’autorisations FLEGT: c’est le Système de Vérification de la Légalité (SVL) Spécificité de l’APV • Diversité de l’accès à la ressource forestière • Processus multi-acteurs • Système devant s’appliquer à tous les produits, tous les marchés et les bois en transit dans la zone CEMAC 4.IMPLICATION DE L’APV (2/3) L'audit indépendant du système (AIS) (Annexe 6) • Est chargé des opérations suivantes: 1) Auditer le système de vérification de la légalité (SVL) Identifier les défaillances du SVL et en faire rapport au Conseil 2) Évaluer l'efficacité des activités correctives qui ont été prises à la suite de l'identification des défaillances constatées dans les rapports d'audit 3) Évaluer l'efficacité du processus mis en place par l'Union pour la mise en libre pratique des produits couverts par le régime FLEGT sur le marché de l'Union, 4) Évaluer le système de suivi du bois en transit 5) Examiner à la demande conjointe des deux parties tout autre point qui surviendrait pendant la mise en œuvre du SVL 5. BENEFICES ATTRENDUS PAR LE CAMEROUN DE LA MISE ENNOEUVRE DE L’APV Article 18 L'accès au marché de l'Union des bois et produits dérivés importés du Cameroun selon les termes du présent accord est accompagné d'actions de promotion de ces bois et produits dérivés. Ces actions comprennent: a)l'encouragement des politiques d'achat publiques et privées qui reconnaissent les efforts pour assurer un approvisionnement en produits forestiers d'origine légale, notamment les bois et produits dérivés; b)la promotion des bois et produits dérivés faisant l'objet d'une autorisation FLEGT sur le marché de l'Union; c) la promotion au niveau international du système de vérification de la légalité établi dans le cadre du présent accord d) L’amélioration de la gouvernance et de la transparence dans le secteur; e) L’amélioration des recettes f) La lutte contre l’exploitation illégale des bois. 6.MISE EN ŒUVRE DE L’APV 6.MISE EN ŒUVRE DE L’APV 6.1.Dispositif institutionnel de mise en œuvre (Article 19) Après la ratification du présent accord, les parties ont mis en place: ‐Une structure de décision appelée "Conseil conjoint de mise en œuvre", ci‐après dénommé "le Conseil", constitué de deux représentants désignés par chacune des parties ‐ Une structure consultative appelée "Comité conjoint de suivi" (CCS), ses membres sont désignés par les parties. ‐ Au niveau du Cameroun, il y a le Comité National de Suivi (CNS) constitué des représentants des parties prenantes 7.ETAT D’AVANCEMENT DE LA MISE EN OEUVRE ACTIVITESALISATION Le document de l’Accord a prévu à l’annexe IX, un calendrier de mise en œuvre qui donne les différentes activités (14) et sous‐activités ainsi que le chronogramme de leur mise en œuvre.
