Further Study and Investigation - Type A Mineral Exploration Land Use
Permit Application - MV2011 C0002
We are in receipt of your letter dated February 17, 2012 in which you indicate that the
Mackenzie Valley Land and Water Board (MVLWB) will consider adjourning the above
noted permit application until such time as the judicial review of the environmental
assessment related to this matter is complete.
In our opinion, neither the Mackenzie Valley Resource Management Act (MVRMA) nor
the associated Mackenzie Valley Land Use Regulations (MVLUR) authorize the MVLWB
to adjourn an application for a Type A land use permit. Subsection 22(2) of the
Mackenzie Valley Land Use Regulations directs the MVLWB to issue a permit within 42
days after receipt of an application. No discretion is afforded to the MVLWB to modify or
extend this time period except as provided for within ss. 22(2)(b) of the MVLUR and for
the specific reasons set out therein .
In the circumstances, the only alternatives available to the MVLWB under the MVLUR
are to issue the permit within the 42 day period, to conduct a hearing or require that
further studies or investigations be !Tlade respecting the lands proposed to be used in
the land use operation or refuse to issue the permit if the requirements of section 61 or
61 .1 of the MVRMA are not met. In our view, a decision to adjourn consideration of Mr.
Debogorski's permit application until such time as the judicial review is complete does
not fall within any of these options.

Consequently, we conclude that the MVLWB must resume consideration of Mr.
Debogorski's land use permit.
