03/08/2015 www.bdo.lu P A Y R O L L A L E R T Réforme des prestations familiales Le gouvernement a déposé le 3 juillet 2015 un projet de loi et un projet de règlement grand-ducal relatifs à la réforme des allocations familiales, dont les points principaux sont les suivants : • Allocations familiales : introduction d’un montant unique de 265€ par mois et par enfant (boni pour enfant inclus). Ce montant est majoré mensuellement de 20 € par enfant à partir de 6 ans et de 50 € par enfant à partir de 12 ans. Les conditions d’éligibilité à partir de 18 ans sont assouplies ; par contre la limite d’âge est abaissée de 27 à 24 ans. • Allocation de rentrée scolaire : introduction de deux nouveaux montants uniques de 115 € par enfant à partir de 6 ans et 235 € par enfant à partir de 12 ans. • Allocation spéciale supplémentaire pour enfant handicapé : augmentation du montant de l’allocation à 200 € contre 185,60 € actuellement. • Modification des modalités d’examens médicaux ouvrant droit aux allocations prénatale, postnatale et de naissance. Selon le projet de loi, le nouveau montant de l’allocation familiale ne sera applicable qu’aux enfants nés après l’entrée en vigueur de la loi, prévue pour le 1er janvier 2016, alors que les majorations d’âge s’appliqueront à tous les enfants dès l’entrée en vigueur de la loi. Le projet de loi ne modifie pas le régime du congé parental ; un projet séparé sera déposé à ce sujet. Reform of family allowances The government introduced on July 3rd 2015 a bill of law and a bill of of grand-ducal regulation regarding the reform of family benefits. The main points of the reform are the following: • Family allowances : introduction of a single amount of 265 € per month and per child (including the child tax credit – boni pour enfant). This amount is increased by 20 € per month for children from the age of 6 and by 50 € per month for children from the age of 12. The eligibility conditions from the age of 18 are more flexible ; on the other hand, allowances would not be granted above 24 years old (instead of 27 currently). • New school year allowance: introduction of two new single amounts of 115 € per child from the age of 6 and 235 € per child from the age of 12. • Special additional allowance for disabled child: increase of the amount to 200 € instead of 185.60 € currently. • Modification of the modalities of medical examinations for childbirth allowances. According to the bill, the new amount of the family allowance will only apply to children born after the entry into force of the law, expected January 1st 2016, whereas the increase due to age will apply to all children as from the law enters into force. The bill of law does not modify the regime of the parental leave; a separate bill of law will be introduced on that matter. 1 Reform der Familienleistungen Die Regierung hat am 6. Juli 2015 den Entwurf eines Gesetzes und einer großherzoglichen Verordnung bezüglich der Reform der Familienleistungen vorgelegt. Der Entwurf beinhaltet hauptsächlich folgende Punkte: • Familienbeihilfe: Einführung eines einheitlichen Betrags von 265 € pro Monat und Kind (einschließlich des Kinderbonus – „boni pour enfant“). Dieser Betrag wird monatlich um 20 € pro Kind ab 6 Jahren und 50 € pro Kind ab 12 Jahren erhöht. Die Anspruchsvoraussetzungen ab 18 Jahren werden gelockert; im Gegenzug wird die Altersgrenze von 27 auf 24 Jahre reduziert. • Schulanfangszulage: Einführung von zwei neuen einheitlichen Beträgen von 115 € pro Kind ab 6 Jahren und 235 € pro Kind ab 12 Jahren. • Sonderzulage für behindertes Kind: Erhöhung des Zulagenbetrags auf 200 € anstatt derzeit 185,60 €. • Änderung der Modalitäten im Zusammenhang mit den ärztlichen Untersuchungen, die den Anspruch auf die vorgeburtliche, nachgeburtliche und eigentliche GeburtsZulage begründen. Gemäß des Gesetzentwurfs findet der neue Familienbeihilfebetrag nur bei den nach dem Inkrafttreten des Gesetzes, voraussichtlich am 1. Januar 2016, geborenen Kindern Anwendung, während die Alterserhöhungen bei allen Kindern ab dem Inkrafttreten des Gesetzes angewandt werden. Der Gesetzentwurf enthält keine Änderung der Elternurlaubsregelungen; hierzu wird ein separater Gesetzesentwurf vorgelegt.
