MAINTENANCE PROGRAM TERMS
OBLIGATIONS DE PREMIER TECH
OBLIGATIONS OF PREMIER TECH
1.
Premier Tech s’engage, après paiement des frais, à effectuer les services
d’entretien de la filière de déphosphatation et de désinfection intégrant l’Unité
de déphosphatation DpEC Autonettoyant (ci-après désignée « Unité DpEC »)
et des autres composantes identifiées sur le recto du contrat installées chez
l’Utilisateur durant une période de un (1) an comme l’exige la réglementation
québécoise. Ceci inclut l’entretien et deux (2) échantillonnages annuels.

Premier Tech agrees, after the payment of the fees, to provide maintenance
services for the Phosphorus Removal and Desinfection Treatment system
combined with the DpEC Self-Cleaning Phosphorus Removal Unit (hereafter
referred to as the « DpEC Unit ») and the other components identified on the
front page of the contract installed on the premises of the User during a one
(1) year period as required by the Province of Quebec’s regulations. This
includes the annual maintenance and two (2) samplings over the year.
2.
Le prix du contrat d’entretien doit être payé à Premier Tech par l’Utilisateur. Il
couvre les services mentionnés à l’article 1 ci-dessus. Ce montant exclut le
coût de l’achat, de l’installation ou du remplacement d’une Unité DpEC et de
toutes autres composantes ainsi que toute réparation d’une Unité DpEC ou
des autres composantes n’étant pas assumée par le fabricant aux termes de
la garantie offerte lors de l’achat de celles-ci.
2.
The amount of the service contract must be paid to Premier Tech by the User.
It covers the services referred to in section 1 hereinabove. This amount does
not include the price for purchase, installation or replacement of a DpEC Unit
or of all the other components as well as any repair not covered under the
manufacturer’s warranty offered at their purchase.
3.
IMPORTANT. Premier Tech souhaite rappeler à l’Utilisateur qu’afin de se
conformer aux lois et règlements de la province de Québec régissant les
systèmes de traitement des eaux usées et pour assurer l’efficacité, la
longévité et la durabilité de l’Unité DpEC, le remplacement des électrodes de
l’Unité DpEC est requis en fin de vie selon le débit d’eau à traiter. Dans le cas
où une unité DiUV serait installée, les lampes doivent être remplacées tous les
ans. Un échantillonnage (référence article 1) de l’effluent rejeté par le système
sera effectué deux fois dans l’année et transmis pour analyse à un laboratoire
indépendant accrédité par le ministère du Développement durable, de
l’Environnement de la Faune et des Parcs. Les résultats obtenus devront être
conformes aux normes établies par la réglementation en vigueur.
3. IMPORTANT. Premier Tech wishes to remind the User that in order to fully
comply with the laws and regulations of the Province of Quebec governing
septic installations and to ensure the efficiency, longevity and durability of the
DpEC Unit, the replacement of the electrodes of the DpEC Unit is required
when they reach their end-of-life and according to water flow to be treated. If
a DiUV Unit is installed, the lamps must be replaced every year. sampling
(see article 1) of the effluent discharged by the system will be performed twice
a year and sent for analysis to an independent laboratory duly authorized by
the ministère du Développement durable, de l’Environnement, de la Faune et
des Parcs. Results obtained shall respect all norms established by the
regulation in effect.

sera heureux de vous assister. Premier Tech et l’Utilisateur reconnaissent que
le présent contrat est lié à l’achat d’une Unité DpEC par l’Utilisateur et qu’il
n’est valable que si un tel achat est réalisé.
For more information about the maintenance of your DpEC Unit or the other
components identified, please consult the owner’s manual or contact us at
1 800 632-6356 or 418 867-8883. One of our representatives will be happy to
assist you. Premier Tech and the User acknowledge that this Agreement is
related to the purchase of a DpEC Unit by the User and is considered valid
only if such a purchase is made.
OBLIGATIONS DE L'UTILISATEUR
OBLIGATIONS OF USER
4.
L’Utilisateur s’engage à remettre à Premier Tech une copie du présent contrat
dûment signé afin que l’entretien de l’Unité DpEC et des autres composantes
puisse être effectué et que la garantie puisse être honorée par Premier Tech,
le présent contrat d’entretien étant une condition à la validité de la garantie de
l’Unité DpEC et des autres composantes identifiées (s.v.p. vous référer à la
clause 4 du certificat de garantie). L’entretien de l’Unité DpEC doit être fait ou
être préalablement autorisé par Premier Tech.
4. The User agrees to provide Premier Tech a copy of this Agreement duly
signed so that the maintenance of the DpEC Unit and the other components
can be performed and the warranty can be honoured by Premier Tech, this
maintenance agreement being considered as a condition to the validity of the
warranty on the DpEC Unit and the other components identified (please refer
to clause 4 of the warranty certificate). The maintenance of the DpEC Unit
must be made by or preauthorized by Premier Tech.
5.
L’Utilisateur s’engage à remettre une copie du présent contrat dûment
complété à la municipalité dans laquelle l’Unité DpEC a été installée.
5. The User agrees to provide the municipality within which the DpEC Unit has
been installed a copy of this agreement duly completed.
6.
L’Utilisateur devra permettre à l’employé de Premier Tech ou encore à l’un de
ses représentants dûment autorisé l’accès à l’Unité DpEC et aux autres
composantes installées, et ce, afin que l’entretien puisse être effectué de
façon adéquate. Le couvercle de l’Unité DpEC et des autres composantes
identifiées doit en tout temps être accessible et libre de tout obstacle.
6. The User agrees to grant access to the installed DpEC Unit and other
components to Premier Tech’s employee or any other duly authorized
representative in order for the maintenance to be properly completed. The lid
of the DpEC Unit and the other components identified shall at all times remain
accessible and free of any obstacles.
7.
Si l’Unité DpEC et les autres composantes installées sur la propriété de
l’Utilisateur devaient ne pas être accessibles aux véhicules, l’Utilisateur
s’engage à permettre à l’employé de Premier Tech ou à l’un de ses
représentants dûment autorisé un accès praticable et raisonnable afin que
l’entretien prévu dans le présent Contrat puisse être effectué.
7. Should access to the DpEC Unit and other components installed on the
User’s premises not be accessible to vehicles, the User undertakes to provide
Premier Tech’s employee or any other duly authorized representative with
reasonable and practicable access so that the services contemplated by this
agreement can be performed.
8.
L’Utilisateur s’engage, après chaque entretien, à conserver en lieu sûr la
preuve d’entretien fournie par Premier Tech ou par l’un de ses représentants
dûment autorisé. Conformément à la réglementation en vigueur, l’Utilisateur
s’engage à conserver pour une période de cinq (5) ans les rapports
d’analyses effectuées suite aux échantillonnages prévus à l’article 3.
8. The User agrees to keep in a safe place the maintenance record provided by
Premier Tech or its duly authorized representative following each
maintenance visit. According to the applicable regulation, the User
undertakes to keep for a period of five (5) years the analysis reports obtained
after the sampling stipulated in section 3.
9.
L’Utilisateur reconnaît avoir reçu de Premier Tech ou de l’installateur de
l’Unité DpEC le livret du propriétaire. Il déclare en avoir pris connaissance et
s’engage à respecter les directives et consignes contenues dans ce livret sur
l’utilisation de l’Unité DpEC et des autres composantes identifiées.
9. The User acknowledges having received from Premier Tech or from the
installer of the DpEC Unit a copy of the DpEC Unit owner’s manual. The User
declares having read its content and undertakes to comply with the directions
and guidelines contained in this manual regarding the use of the DpEC Unit
and the other components identified.
10. L’Utilisateur s’engage, aux termes des présentes, à conserver en lieu sûr le
présent contrat, le livret du propriétaire ainsi que le certificat de garantie et à
les remettre à tout acquéreur subséquent de sa propriété afin que ce dernier
puisse en profiter et y être tenu.
10. The User hereby agrees to keep in a safe place this agreement, the owner’s
manual and the warranty certificate, and to remit them to any subsequent
purchaser of his property so that the new User may benefit from this
agreement and be bound by its the terms and conditions.
11. L’Utilisateur s’engage à ne pas changer l’utilisation ou l’affectation de
l’immeuble desservi par l’Unité DpEC vendue et à ne pas y apporter de
modification par rapport à l’utilisation originalement décrite et approuvée par
la municipalité en vertu des lois et règlements applicables. Tout changement
ou modification peut être apporté seulement sur autorisation préalable
conjointe de la municipalité et Premier Tech. Tout changement ou
modification apporté sans l’autorisation préalable de Premier Tech entraînera
l’annulation de la garantie de l’Unité DpEC et de l’unité DiUV.
11. The User agrees to make no changes to the use or function of the building
served by the purchased DpEC Unit, nor any modification to the unit’s
installation as originally specified and approved by the municipality under
applicable laws and regulations. Any change or modification shall only be
made if preauthorized jointly by the municipality and Premier Tech. Any
change or modification to the DpEC Unit without prior authorization from
Premier Tech will void the warranty of the DpEC Unit and of the DiUV Unit.
LOIS APPLICABLES ET JURIDICTION
GOVERNING LAWS AND JURISDICTION
12. Le contrat, son interprétation et son exécution seront régis par les lois en
vigueur dans la province de Québec, Canada.
13. Les Parties conviennent que toute réclamation ou procédure judiciaire
pouvant être intentée en relation avec le présent contrat le sera dans le
district judiciaire de Kamouraska, et ce, à l’exclusion de tout autre district
pouvant avoir juridiction pour entendre ladite réclamation ou procédure
judiciaire conformément à la législation applicable.
12. This agreement, its interpretation and enforcement shall be governed by the
laws in force in the Province of Quebec, Canada.
13. The Parties agree, in respect to any claim or legal proceedings for any
purpose whatsoever in connection with this agreement, to elect the judicial
district of Kamouraska as the proper forum for the hearing of said claims or
legal proceedings to the exclusion of any other judicial district which may
have jurisdiction to hear such dispute according to the requirement under the
law.
