This letter is written in response to your request for information on State Licensed Adult
Residential Alcohol and Drug Program facilities in the City of Los Angeles. This matter
was raised in a City Council discussion of proposed State legislation regarding
increased regulatory authority to local jurisdictions on the location of alcoholism and
drug abuse recovery and treatment facilities (AS3005, AS 3006 and AS 3007).
Subsequent to the City Council meeting, each of the three bills failed to pass in the
Assembly.
During the Council discussion of this item, the Department of City Planning was asked
to provide a description of the process by which application for these facilities are
reviewed by the City. Our Department was also asked for a Geographic Information
Systems (GIS) map showing all existing State Licensed facilities.
. Residential Facility Location Procedures:
Residential facilities, which are licensed by the State Department of Alcohol and Drug
Programs (ADP), provide non-medical alcohol and/or other drug recovery, treatment or
detoxification services to adults. All such facilities must be licensed, regardless of size
or number of beds in the facility.
ADP's licensing process requires that a potential operator have a location, but does not
in any way govern where a facility may locate. Facilities must comply with local
land
use regulations. However, fair housing laws exempt residential facilities serving six or
fewer residents from any type of local government use permit as long as such facilities
are located in zones which allow residential uses.

The City's land use regulations allow facilties serving more than six residents to be
located in any zone, but the City requires consideration and approval through the City
Planning Department (such as a variance or conditional use permit). Thus, the City is
able to consider the proposed facility and the proposed location, and determine what, if
any, special conditions are needed on the facility given the location, or determine if the
location altogether is not appropriate, in accordance with the City's local
land use
regulations.
While the State has not defined land use limitations regarding ADP-licensed facilities,
the State has established limitations on community-based residential facilities licensed
by the State Department of Social Services (DSS), with more than six adults and which
serve other special needs populations. To prevent over concentration, the State
requires that these facilities be at least 300 feet from another li,ke facilty, unless an
exemption is obtained from the city in which the facility is located. The purpose of AS
3005 was to extend this over concentration standard to facilities serving six or fewer
residents.
AS 3007 sought to impose the same location requirement on ADP-licensed facilties. If
AS 3007 passed, ADP would have been required to notify the City of proposed alcohol
and drug treatment facilities. Such notification would include information as to whether
or not the facility is within 300 feet of another facility. If the facility were within 300 feet
of another facility, ADP would deny the application for a license, unless the City would
grant an exemption from this requirement.
If AS 3007 had passed and ADP issues notification letters regarding proposed facilities,
the City would follow the same procedures currently in place regarding DSS notification
letters. Currently, the City Planning Department receives and tracks all notices from
DSS, and forwards such notices to the respective City Council office when the proposed
facility is within 300 feet of an existing facility. In the past three years, the City has
received three such notification letters from DSS. In each case, the City Council office
allowed the State to enforce the 300-foot over-concentration standard and deny an
exemption. Additional detail is attached regarding the City's procedures and DSS
notification letters.

Adult Residential Alcohol and Drug Program Facilties:
At present, there are 75 licensed facilities in the City. These range in size from three
beds to as many as 286 beds. i have attached a spreadsheet listing of all facilities by
name, provider, address, telephone, City Council district, number of beds and target
population. i have also attached to this letter two GIS maps that plot the information
contained in the spreadsheets. The first map, "Adult Care Facilities in Los Angeles,"
shows bed capacity of each facility and whether detoxification services are also
provided at the facility. The second map, "Adult Care Facilities in Los Angeles by
Facilities Target Populations," indicates the population served at each facility.

facility. This occupancy is approved by the State or local fire authority.
Total Capacity
Designate the maximum number of residents authorized by the
department to receive recovery or treatment services at anyone time in
a facility.
Treatment Capacity
Designates the type of services offered at a facility/program, specifically residential (res), outpatient (non), or detoxification (detox - may be
combined with res). Additionally, programs licensed by another agency
but certificated by ADP will be indicated here: Dept. of Social Services
(DSS), Dept. of Health Services (DHS), and Dept. of Corrections and
Rehabilitation (COR).
The person, firm, partnership, association, corporation, county, city,
