Terms and Conditions
I – R E N TA LS T ER MS A N D C O N DI TI O N S
AR TI C L E 1 – R E N TA L C O N D I TI O N S
No respect to these conditions or the non-delivery of one of these
documents will pull the immediate cancellation of the Contract, without
return of the amount paid by the Tenant for the reservation of the
Vehicle.
The main Driver and the additional drivers mentioned on the
Contract need to :
- Be older than 21 (twenty one) years old,
- Present a valid driving licence of more than 3 ( three) years
In case these 2 conditions would not be respected, it will be charged a
20€ additional costs and the application of a 457 €franchise(frankness) by sinister engaging Civil liability responsibility
of the tenant.
A driving licence freed(delivered) by a Member state of the European
Economic Area is valid in France. The holders of a licence
freed(delivered) by an outside State will have to present a licence
with photography.
The detention of a “white” licence or in restricted validity, or of a
statement of loss or theft of the driving licence does not authorize the
rent of Vehicle. The Tenant has to give evidence on the honor of the
validity of his driving licence as well as the absence of a measure of
suspension, limitation or cancellation of the driving licence.
The main conductive Tenant will have to present, during the
signature of the Rental agreement:
- A valid ID card,
- The valid driving licence (duplicate or photocopy not accepted)
- A proof of address of less than 2 ( two) months (charge water, gas,
electricity or landline telephone)
- A bank card in its name, to proceed to the payment of the deposit.
20 TTC (twenty euros inclusive of all taxes) for every additional
driver will be charged. These drivers benefit from the same Contract
as the main Driver.
In case of revocation of licence of the main Driver and in case the
option ” additional driver ” was not signed, the Tenant will be obliged
to pay the expenses of repatriation of the Vehicle to saint Jean d’
Illac’s office.
Only the registered and named driver (s) on the Rental agreement has
the quality of insurant (s) in conformance with(for) the insurance
contract of the Renter. If the Vehicle is driven by a driver not
indicated into the Contract, the Tenant remains solely responsible of
all of expenses resulting from a disaster.
AR TI C L E 2 – R ES E R V AT I O N A ND
R E GU LA TI O N( P A Y ME N T )
2.1 – Reservation
3 steps :
1. Reservation request :
- Online
- By telephone
- By e-mail
2. Payment of the advance : 50 % (fifty percent) of the rent. The
reservation is effective only at the time of the collection by the Renter
of this advance.
3. Confirmation : an e-mail or postal mail (5-€ TTC management fees
((five euros inclusive of all taxes) in addition) summary is sent.
- The Renter cannot be on no account considered as person in charge
of the damage resulting from the loss or from the flight(theft) of the
confirmation of the reservation sent to the Tenant nor of the use of
this document by a third(third party).
- The Renter will not be held responsible for the possible delay of
provision of the Vehicle when this delay has for origin the fact that
the information passed on(transmitted) by the Tenant is incomplete
or inaccurate, what the latter accepts expressly.
The minimal duration of rent is of 24 ( twenty four ) hours(o’clock).
The price list(rate) of the rent includes:
- The VAT (the mentioned price lists(rates) are always inclusive of all
taxes),
- The rent of the Vehicle according to tariff period,
- Accessories and arrangements(developments) added to the Vehicle,
- The bedding and the material(equipment) of cooking(kitchen),
- The insurances and the assistance(audience) 24 hours a day –
7jours / 7,
- 1 (a) driver authorized, who is the Tenant
- The options signed at the time of the reservation.
The price list(rate) of the rent does not include:
- The fuel,
- The options not signed at the time of the reservation,
- The damages of broken glass, body, tires, roof, bottom / bottom of
box(cash register) and inside of the Vehicle, optical (lighthouses,
indicators), rear-view mirrors,
- The overtakings of schedule pulling(entailing) a penalty fixed by the
Renter,
- The amount of the franchise(frankness) sold(produced) by the
Renter in the event of an accident or of damage in the Vehicle with or
without known third(third party),
- The expenses of parking lot and tolls,
- The expenses of expert’s report,
- The fines(infractions)
- The cost of the repairs not taken care in conformance with(for) the
signed insurances and the amount of which would exceed(overtake)
the amount of the franchise(frankness).
Price lists(Rates) may be revised at any time. The current price
lists(rates) are the ones in the day of the validation of the reservation.
The exhaustive list of the options, and the associated prices(prizes),
appear exclusively on the supplier’s web site. The Renter reserves the
right to modify this list at any time. The Tenant is thus invited to
consult her(it) regularly.
2.2 – Regulation(payment)
The Renter accepts the following means of payment:
- Bank card of credit: visa, MasterCard, Credit card. Cards(maps)
emitted(uttered) by banks taken up residence outside France
necessarily have to be international bank cards. Debit cards are not
accepted.
- Banking / mail check: only checks emitted(uttered) in euros, by a
bank taken up residence in metropolitan France will be accepted.
They must be established in the order of the supplier.
- In cash: only the euro is accepted.
In Holiday vouchers ANCV, in the name of the Tenant.
Quite different means of payment as well as Visa cards Electron,
MasterCard Maestro, Indigo, Kyriel, Cofinoga, Aurore or other
withdrawal card are not accepted
The deposit is made by imprint on bank card. This amount is not
taken(collected) during the duration of the rent.
In the case of non-payment or outstanding payment:
- In the reservation (payment of deposit(advance)): the reservation is
cancelled
- In the provision of the Vehicle: the rent is cancelled, without
return(restoration) of the already paid(poured) deposit(advance).
- After the provision of the Vehicle (non-payment of the rent after the
departure of the Tenant): the Rental agreement is cancelled.
The Tenant is warned by telephone (Call(Appeal) + SMS). The Vehicle
must be immediately restored. The already paid(poured) sums are
not paid off. The Tenant is indebted of the rent increased by a 20 %
late charge (twenty percent). In case of not return(restoration) of the
Vehicle as from the day of cancellation of the Contract, will be charged
200 TTC (two hundred euros inclusive of all taxes) a day of delay,
besides the price list(rate) of rent increased by the 20 % (twenty
percent) of penalties. The tenant accepts that the supplier takes these
penalties from its bank card. Furthermore, the Renter can
begin(affect) criminal procedures for not return(restoration) of the
Vehicle and breach of trust.
A R TI C L E 3 – P R O V I S I O N A N D R E TU R N ( R ES T O R A T I O N)
O F TH E V E H I C L E
3.1 – Provision of the Vehicle
The provision of the Vehicle takes place in the premises(places) of the
supplier. The presentation(display) of the vehicle and the
administrative procedures require 1 one hour of time(weather).
The vehicle is given from 8 ( eight) hours (except specific
demand(request))
The Renter puts back(hands) the Vehicle to the Tenant in perfect
working order, of cleanliness, with the height of fuel and clean water,
and provided with all the administrative titles(securities) necessary
for its traffic(circulation) as well as the accessories made compulsory
by the regulations:
- 2 ( two) vests of high visibility and 1 a triangle of pre-road marking.
In case of not return(restoration), the Renter will charge a fixed
penalty to the amount of 30,00 TTC (thirty euros inclusive of all
taxes) by not restored accessory.
- 2 ( two) breath tests, in case of not return(restoration) or if they are
not replaced after use, the Renter will charge a fixed 5-€ TTC penalty
(five euros inclusive of all taxes) by breath test.
- 1 (a) parking disc, in case of loss or deterioration during the
duration of the rent, if he(it) is not replaced the Renter will charge a
fixed 5-€ TTC penalty (five euros inclusive of all taxes).
The state of the Vehicle (inside and outside) is described in the ”
Descriptive Index card(Form) of Provision of Vehicle ” by the Rental
agreement.
The Tenant and the Renter make a commitment to record(deposit)
there in writing, before the departure, any imperfection is similar.
The Tenant has the possibility, during the first 10 ( ten) kilometers of
his route, of contacting the Renter to indicate him(her) an
imperfection not identified during the provision of the Vehicle.
After this deadline, the rented(praised) Vehicle will be considered as
in compliance with the state described on this index card(form). The
Renter cannot take into account complaints concerning visible
damages which will not have been indicated on the ” Descriptive
Index card(Form) of Provision of Vehicle “.
In the case of not availability of the Vehicle (because of breakdown, of
accident, of delay of the previous Tenant), the Renter makes a
commitment to make every effort to supply to the Tenant a Vehicle of
replacement, as soon as possible. This Vehicle can present
characteristics different from that reserved by the Tenant.
In this case:
- If the Tenant refuses the substitution Vehicle, or the delay, his
deposit(advance) will be completely restored to him(her) (Exception:
a Vehicle of range and identical arrangement(development), but color
different from that asked, does not establish(constitute) a motive for
cancellation of the rent by the Tenant)
- If the Tenant accepts the substitution Vehicle, and, where necessary,
the delay, the Renter adjusts the price(prize) of the rent according to
the new Vehicle and to its arrangements(developments) and the
accessories (in the sense(direction) of a possible decrease of price
list(rate) only) and according to the new duration of rent.
In case no substitution solution can be found by the Renter, the rent
will be cancelled, and the deposit(advance) of the Tenant will be
completely restored to him(her).
On no account, the customer can protest of damages to cover the
impossibility for the Renter to assure(insure) the rent over the
planned period, or the delay in delivery of the Vehicle, or the
replacement of the Vehicle reserved by a substitution Vehicle.
3.2 – Return(restoration) of the vehicle
The return(restoration) of the Vehicle is made in the
premises(places) of the Renter, at the hours and agreed dates in the
Rental agreement. In case of delay, the Tenant makes a commitment
to inform immediately the Renter about it.
Plan again 1 one hour to make the formalities.
The Vehicle must be returned:
- Clean(appropriate) inside and outside. Should the opposite occur,
expenses of cleaning will be charged has 80-€ TTC height (eighty
euros inclusive of all taxes). The cleanliness of the Vehicle is
determined during the return of the rent. All the expenses
engendered by the restoration of the Vehicle will see each other put
chargeable to the Tenant and taken from the deposit.
- With the height of fuel. The Renter supplies the Vehicle with the
height at first within the framework of a service(department) granted
to the customer. If the Tenant does not restore the Vehicle with the
height, the Renter will assure(insure) the filling of the Vehicle and
will charge to the customer the increased expenses of fuel that is 1,70
TTC (an euro and seventy hundred of the euros inclusive of all taxes)
by liter, taken from the deposit.
- With all the arrangements(developments) and the accessories
supplied in the provision. In case of not return(restoration), of loss or
of break-in(breakage) of said accessories and/or equipments, the
Renter will charge to the Tenant the price(prize) of said accessories
and/or equipments, according to the tariff scale to post(show) in
agency, and the copy of which will be put back(handed) on request
either in the day by the departure, or in the day of the
return(restoration) of the Vehicle.
- Cleaning and draining of the chemical toilet made. If the Renter even
has to make him(her) this spot, technical 20-€ TTC expenses (twenty
euros inclusive of all taxes) will be taken from the deposit.
- With his(her,its) titles(securities) of traffic(circulation). For lack of
return(restoration) and/or in case of not replacement of said
documents, the Renter will be entitled to charge to the Tenant, a 100TTC fixed price(package) (hundred euros inclusive of all taxes) for
the purposes of obtaining of duplicatas and/or documents of
replacement.
- In the state recorded(deposited) in the ” Descriptive Index
card(Form) of Provision of Vehicle ” established in the provision of
the Vehicle,
In the hypothesis where he(it) would refuse to sign the descriptive
state of return of the Vehicle, the Tenant accepts that the Renter
resorts(turns) to an independent automobile expert to establish the
descriptive state of return, and that the cost of this
participant(speaker) is charged to him(her). Besides, very fresh of
restoration will be chargeable to the Tenant.
In case of return(restoration) with date and time not contract
employees(meter maids):
- Demand(request) of return(restoration) before date / hour was
indicated on the Contract, the Tenant has to inform the Renter about
it 2 ( two) days before the new date of return(restoration). He(it) will
be proceeded to no refund(repayment).
- Demand(request) of return(restoration) after date was indicated on
the Contract, the Tenant has to inform the Renter about it, 3 ( three)
days before the date of return(restoration) appearing on the Contract.
a- Has If the Renter gives its agreement, the date of
return(restoration) will be changed. In this case, the Tenant gives
authorization to the Renter to proceed to the taking, on the bank card
of the Tenant, the tariff surplus calculated on the basis of the price
list(rate) of current(in class) rent (bass / average / high season).
b-If the Renter does not give its agreement, and that the Vehicle is not
restored to the date fixed by the Contract, the delay is charged 200
TTC (two hundred euros inclusive of all taxes) a day of delay, besides
the price list(rate) of rent calculated on the basis of the price list(rate)
of current(in class) rent (bass / average / high season). The Tenant
accepts that the Renter takes these penalties from its bank card.
Furthermore, the Renter can begin(affect) criminal procedures for
not return(restoration) of the Vehicle and breach of trust
- Return(restoration) in the date was indicated on the Contract, but
with the delay with regard to(compared with) the hour was indicated
on the Contract, the Tenant owes inform the Renter about it as soon
as possible, and at the latest in the morning of the day of the
return(restoration). The first 2 ( two) hours are neutralized and
beyond, a 30-€ TTC invoicing per hour of delay (thirty euros inclusive
of all taxes) will be applied.
A R TI C L E 4 – C A NC E L L A TI O N O F R ES E R V A TI O N
4.1 – Cancellation on behalf of the Tenant
Any demand(request) of cancellation must be formulated in writing
at the following address: In Van camp – 205 gone Isaac Newton –
Zone Boulac Dauphine – 33127 saint Jean d’ Illac.
Any total or partial cancellation of the rent because of the Tenant,
pulls(entails) the immediate payability, as revocation, following
expenses:
- More than 45 (forty five) days before the coverage(care) of the
Vehicle: 15 % (fifteen percent) of the total price(prize) of the
reservation,
- Between 45 ( forty five) days and 21 ( twenty one) days before the
coverage(care) of the Vehicle: 30 % (thirty percent) of the total
price(prize) of the reservation,
- Less than 21 (twenty one) days before the coverage(care) of the
Vehicle: 50 % (fifty percent) of the total price(prize)
In the case of a reduction of the duration of rent:
- Arising more than 4 ( four) weeks before the date of the beginning of
rent: no cool will be engendered.
- Arising less than 4 ( four) weeks before the date of the beginning of
rent: a 80-€ TTC lump sum (eighty euros inclusive of all taxes) a day
of rent cancelled will be applied.
4.2 – Cancellation on behalf of the Renter
The Renter reserves the right to cancel the rent, without
return(restoration) of the paid(poured) deposit(advance), in the
following cases:
- Non-payment,
- Not presentation(display) of documents necessary for the rent, by
the Tenant,
- Not presentation(display) of the Tenant in 24 (twenty four) hours
according to date and the hour suited for the provision of the Vehicle
In case the Renter is brought to cancel the reservation made by the
Tenant, the Tenant is offered the same rent on an another date.
In case of refusal of the Tenant, this one can obtain the
refund(repayment) of all the sums already paid(poured) to the
Renter.
If this cancellation is due to a major case of strength, or to a
coincidence which(who) would force it the renter, such as, and
without this list is exhaustive: strike, fire, water damage, impossibility
of accesses, decisions emanating from authorities, uneven(injured)
vehicle or out of order, etc., the Tenant could aspire to no
compensation(allowance).
A R TI C L E 5 – R ES P O NS I BI L I TY O F TH E T E NA N T F A C E T O
F A C E O F TH E V E H I C L E
The rented(praised) Vehicle remains the exclusive property of the
Renter. The Tenant acquires no property right on any of the
parts(parties), accessories, equipments and
arrangements(developments) of the Vehicle.
The main conductive Tenant is solely responsible for the Vehicle. He
assures(insures) the good use, the interview(maintenance) and the
guarding(nurse) of the Vehicle and all the documents and the
equipments which are confided(entrusted) to him(her).
When the Vehicle is empty of occupants, the Tenant commits to his
safety(security), to the fact that it is suitably parked, locked, empty of
keys and titles(securities) of traffic(circulation). He(it) also makes a
commitment to put out of sight accessories such as GLOBAL
POSITIONING SYSTEMS, telephones, DVD player, camera …
In the case of loss / flight of keys or papers of the Vehicle, the Tenant,
having informed the Renter about it, follows the procedures
necessary for his expenses.
The Tenant makes a commitment to respect the recommendations
supplied by the Renter during the coverage(care) of the Vehicle.
The rent is strictly personal: the Tenant makes a commitment not to
let lead(drive) the Vehicle by other people that he even or the
additional mentioned driver (s) (s) on the Contract.
By taking delivery of the Vehicle, the Tenant becomes the exclusive
guard and assumes(accepts) only the responsibility according to
provisions of the article 1384 of the Civil code. The main conductive
Tenant makes a commitment, during all the duration of rent:
- To lead(drive) in a careful way, by respecting the speed limits and
the traffic rules of the crossed territory
- In the good(property) estimate(esteem) the template(size), in
particular the height of the Vehicle
- Not to lead(drive) under the influence of drink
- Not to lead(drive) under the influence of drugs
- To respect the number of places(squares) planned by the car
registration document
- To use the Vehicle only in its personal purposes
- Not to sublet the Vehicle
- Not to use the Vehicle for the learning(apprenticeship) of the
conduct(driving)
- Not to make a transport of people or goods for a fee
- Not to use the Vehicle for advertising purposes or of propaganda of
all kinds
- Not to participate in any running(race), rally, or
demonstration(appearance) of some nature is
- Not to modify the characteristics of the Vehicle
- Not to overload the Vehicle beyond the authorized maximal weight
such as defined on the car registration document
- Not to tow a trailer or other vehicle, nor use the Vehicle
rented(praised) for growing an other one conveys
- Not to transport dangerous goods
- Not to put in touch the Vehicle with some salt water
- Not to run(drive) except asphalted or driven traffic lanes (fields,
mud, sand, paths(ways))
- Not to smoke in the Vehicle
- Not to rise on the roof of the Vehicle
- Not to travel with pets
- Not to travel in countries not covered by the insurance(assurance)
supplied by the Renter (see list of countries on the green card)
- Not to circulate on the snow without equipments supplied by the
Renter
- Not to lead(drive) in case of retreat(withdrawal) of its driving
licence
- Not to circulate with the roof relevable in the open position
- Not to confuse(merge) the trapdoors of filling and draining
indicated by stickers
- Not to make burn with candles or incense inside the Vehicle
The Tenant is responsible for the cleaning and for the
common(current) interview(maintenance) of the Vehicle during the
period of rent, including:
- The cleaning of the inside and from the outside the Vehicle,
- The check – Person with a strong visual sense and by means of a
manometer if it seems necessary – of the pressure of
tyres(pneumatics), their inflating and possibly their repair or
replacement within the framework of one flat – In the case of a
replacement, he must be made with tyres(pneumatics) of the same
dimension(size), the even typical, if possible of the same
mark(brand), and the wear at least equal to those of origin.
- The check of the levels of oil, and various liquids (brake, cooling),
every 1500 km, and their so necessary upgrade (it is necessary to
contact the Renter to have the reference of the mechanical products
to be used.)
- The check of the level of fuel, and the addition of fuel (diesel oil only)
during the duration of the rent, and full of the reservoir at the end of
rent,
- The check of the bright witnesses(batons) (dashboard),
- The filling of the supply of clear water and the draining of the
reserves of waste water,
- The cleaning and the draining of the chemical toilet
In the hypothesis where the Vehicle did not return in perfect
condition of cleanliness (inside and outside) will be charged to the
Tenant, a fixed penalty to the amount of 80 TTC (eighty euros
inclusive of all taxes). In the hypothesis where the Tenant signed a
Fixed price(Package) Cleaning, the 80-€ TTC amount (eighty euros
inclusive of all taxes) can also be charged in case of abuse.
The Tenant makes a commitment to make circulate the vehicle only
within countries appearing in the back of the “green card”. In case of
non compliance, the customer will not be covered by the
insurance(assurance) and will be completely responsible for any
damage, loss or flight(theft).
The Tenant makes a commitment to enforce the property right by
thirds(third parties), in any circumstances, by any legal ways(means)
and at his exclusive expenses.
So, in case of seizure, of attempt of seizure, requisition or seizure of
Vehicle, the Tenant obliges himself in particular:
- To raise(to bring up) any protest and to take any
capacities(measures) to make known the property right of the Renter,
- To inform the Renter about it, immediately,
- To obtain at his(her,its) expenses the withdrawal of any seizure,
without prejudice to the action(share) in claiming(demand) reserved
for the Renter.
Besides, any seizure of the Vehicle on the border of one of the
countries not quoted on the green card of insurance(assurance) or for
any other seizure relative to the control of the borders, will be
charged to the Tenant, is the repatriation of the Vehicle as well as
1500 TTC (one thousand five hundred euros inclusive of all taxes) of
fixed fine.

6.1 – Damage and flight(theft) of the Vehicle
Financial responsibility further to damage and flight(theft) covered
by the insurance(assurance)
The financial responsibility of the Tenant corresponds to the payment
of the franchises(frankness) of insurance(assurance) and is limited to
the amount of the deposit.
Financial responsibility further to damage and flight(theft) not
covered by the insurance(assurance)
The responsibility of the Tenant is completely committed(hired):
- At the level of the expenses of restoration of the Vehicle
rented(praised) at the Renter, in the case of damage, increased by
cool(expenses) of fixed asset(immobilization) calculated on the basis
of the daily price list(rate) of period concerned (in case the fixed
asset(immobilization) of the Vehicle impacts on the renting activity of
the supplier.
- At the level of the value of the Vehicle (value Argus TTC increased by
10 % (ten percent)) and of his(her,its) arrangements(developments)
and accessories (value new TTC), in the case of the flight(theft) of the
Vehicle
6.2 – Fines(infractions)
By virtue of the article L.121-2 of the Traffic rules, the Driver of the
Vehicle is personally responsible for all the fines and the
fines(infractions) relative to breaches and violations of the applicable
Traffic rules in Europe (breaches of the car park, the
acquittal(payment) of tolls, etc.). The fines(infractions) will be
directly paid to the local authorities by the Driver of the Vehicle. For
lack of direct and immediate payment, and, in the hypothesis where
the Renter would receive a notification of increased or not increased
fine, he will communicate with competent authorities, identity and
address and phone number(coordinates) of the Tenant.
Besides, the Tenant will be indebted to the Renter of the 20-€ TTC
lump sum (twenty euros inclusive of all taxes) by fine(infraction), as
management fees.
6.3 – Deposit
Payment of the deposit
The rent of a Vehicle of the supplier requires the payment of a deposit
to the amount of 1 500 TTC (one thousand five hundred euros
inclusive of all taxes).
The amount of the deposit is not taken(collected) during the duration
of the rent.
The payment of the deposit is made by imprint on bank card only and
the Tenant accepts that the Renter establishes an authorization of
taking corresponding to the amount of the deposit.
The Tenant accepts that the Renter is authorized to take(collect) if
need be the sums owed by the Tenant within the framework of the
present Contract.
Return(Restoration) of the deposit
The deposit is returned 1 one month after the return(restoration) of
the Vehicle under possible deduction:
- Expenses of restoration of the Vehicle,
- Fines(infractions),
- Late charges in case of late return(restoration) of the Vehicle.
A R TI C L E 7 – I NS U R A NC E ( A S S U R A NC E ) A ND
A S S I S T A NC E( A U DI E NC E )
7.1 – Insurance(assurance)
The insurances and the assistances(audiences) apply:
- For the incidents and the accidents arising under the direction of the
Drivers mentioned on the Contract:
- In countries mentioned on the green card of insurance(assurance),
- During the duration of the contract of Rent,
- Subject to the respect by the Tenant of all his responsibilities
towards the Vehicle,
- Under respect for the Traffic rules.
The insurance contract included in the rent includes:
- An automobile third-party insurance, without franchise(frankness),
to cover all the damage caused by the Tenant, because of the
conduct(driving) of the Vehicle, in:
a- Has A third(third party): vehicle, the good(property), the people …
b-To the passengers of the Vehicle
- A property and casualty insurance any risks, to cover the damage
caused in the Vehicle, for which the Tenant is recognized as person in
charge ( partial or total responsibility). This insurance(assurance)
contains franchises(frankness).
- An insurance against theft and the fire which contains a
franchise(frankness).
- An insurance(assurance) against the forces of Nature which contains
a franchise(frankness).
- An insurance(assurance) against the acts of vandalism, which
contains a franchise(frankness).
- An insurance(assurance) against broken glass and optics of
lighthouses which does not contain franchise(frankness).
In case the Tenant is implied(involved) in several disasters during the
duration of the rent, every disaster independently will give rise with
care of a compensation according to the modalities(methods) above.
Incidents not covered by the insurance contract
- The flight(theft) or the damages of the personal effects of the Tenant
and all the passengers of the vehicle are not covered by the insurance
contract.
- The loss of keys or titles(securities) of traffic(circulation) of the
Vehicle is not covered by the insurance contract.
- The Driver of the Vehicle is not covered by the automobile thirdparty insurance – only the passengers are covered by this
insurance(assurance).
- The following incidents caused in the Vehicle are not covered by the
insurance contract of the Renter:
a- Has Damage in the Vehicle or in the third(third party) in case the
driver of the Vehicle is neither main conductive Tenant, nor the
additional driver mentioned on the Rental agreement
b-Damage in the Vehicle or in the third(third party) in a country not
mentioned on the green card of insurance(assurance)
c-Damage in the Vehicle or in the third(third party) except the period
of rent mentioned on the Contract
d-Damage in the Vehicle in the case of failure to respect by the Tenant
of his responsibilities towards the interview(maintenance), and
towards the use of the Vehicle.
Examples (not exhaustive) of not covered damage:
- Inadequate use of fuel
- Damaged tires
- Damage and damages bound(connected) to a not careful use of the
Vehicle (it’s a pity internal and outer(foreign)): torn or made dirty
Seats, elements of the cockpit(passenger compartment) broken,
outer(foreign) shocks (body, adorns shocks), etc.
- Overheat engine owed to a conduct(driving) extended with a level of
low(weak) liquid of the radiator
- Degradation engine due to a use with insufficient level of oil
- Degradation of the systems of rotation and/or suspension due to a
conduct(driving) extended with a damaged or very deflated tire
- Degradation of the high parts(parties), the basses, the faces before
and the back or the sides of the Vehicle due to a bad appreciation of
the template(size) and the height of the Vehicle
- Damage due to a use of the Vehicle in some sand, some mud, some
snow
- Damage due to the drunkenness, or of slumber of the Tenant
- Damage due to a careless conduct(driving), and to a failure to
respect the Traffic rules on behalf of the Tenant
- Damage being the object of bad or false information and/or
statements(declarations) supplied by the Tenant to the Renter and to
his(her) insurer, or to the voluntary omission of information by the
Tenant, or to the impossible exploitation(operation) of the
information supplied by the Tenant (in particular in the accident
report of accident)
- Damage being the object of the not transmission for the
deadlines(extensions) to the Renter of the information relative to the
disaster (in particular the accident report of accident)
- Damage making neglected continuation(suite) or in the not
return(restoration) for the deadlines(extensions) mentioned on the
Rental agreement of the Vehicle by the Tenant
- Flight(theft) of the Vehicle, in the case of failure to respect by the
Tenant of his responsibilities towards the safety(security) of the
Vehicle,
- Not return(restoration) of keys and titles(securities) of
traffic(circulation) (car registration document and green card) of the
Vehicle to the Renter
- Flight(theft) being the object of bad or false information and/or
statements(declarations) supplied by the Tenant to the Renter and to
his(her) insurer, or to the voluntary omission of information by the
Tenant, or to the impossible exploitation(operation) of the
information supplied by the Tenant
- Flight(theft) making neglected continuation(suite) or in the not
return(restoration) for the deadlines(extensions) mentioned on the
Rental agreement of the vehicle by the Tenant.
In all these cases of damage and flight(theft) not covered by the
insurance contract, the responsibility of the Tenant is completely
committed(hired).
Case of not responsibility of the Renter:
- The Renter disclaims all liability in case of losses or damage caused
in the properties(goods) or in the people by a Vehicle under the legal
guarding(nurse) of the Tenant, safe in case of
carelessness(negligence) or serious offence from him/her or of any
other breach(negligence) at the end of the present CGL.
- The Renter can be held responsible on no account for any indirect
damage such as a train or a missed plane.
- The Renter can be held responsible on no account to the Tenant or
the Driver in case of loss or of damage caused in the private
properties left aboard the Vehicle during the duration of the contract
of rent.
- The Renter can be held responsible on no account for possible
damage, damages or flight(theft) caused on the personal vehicle of
the Tenant parked on the parking lot of the Renter in 205 gone Isaac
Newton – Zone Boulac Dauphine – 33127 saint Jean d’ Illac during the
duration of the stay.
In any case, if the responsibility of the Renter must be
committed(hired), whatever the reason, the amount of the damages
susceptible to be demanded to him(her) will be limited to the amount
of the sums actually perceived(collected) in conformance with(for)
the corresponding rent.
The Tenant accepts that the Renter is irrevocably authorized to
take(collect) the sums owed by the Tenant to cover these expenses,
even if these sums(naps) exceed(irritate) the amount of the deposit.
In case of disagreement concerning the amount of the expenses of
restoration of the Vehicle notified by the Renter, the Tenant will have
the possibility of asking, at his/her own expense, for an expertise
realized by an expert approved by the courts, in 5 ( five) days
following the notification of demand(request) of payment sent by the
Renter.
The conclusions of this expert will be imperative upon both
parts(parties)
7.2 – Assistance(audience)
The assistance(audience) includes in the rental agreement is available
7j / 7 and 24 hours a day and understands(includes):
- A help to the piece of information of the accident report of accident
- The towing of the vehicle or the on-the-spot repair

In case of fixed asset(immobilization) of the Vehicle further to an
accident or an incident, or following a flight(theft), the contract of
assistance(audience) and the Renter propose no refund(repayment)
to the Tenant for the interruption neither of its journey, nor any
payment of damages.
To make in the event of an accident …
- Complete an accident report of insurance(assurance) (in defect the
responsibility of the Tenant will be completely committed(hired))
allowing to identify the conditions of the disaster, and the
responsibilities of the various parts(parties) (Tenant and third(third
party)), to identify the third(third party): name, telephone number,
number of driving licence, registration number
- Warn the Renter immediately, so that he can:
- Declare the disaster with the insurance(assurance) in 48 (forty
eight) hours
- Launch the procedure of assistance(audience), if need be
To make in case of incident or of breakdown …
- Warn the Renter immediately, so that he can launch the procedure
of assistance(audience), if need be
- Make no repair or replacement of room(part,play), without
agreement of the Renter
- To make establish and to keep(preserve), in the case of repairs or
replacements of rooms(parts,plays) made with agreement of the
Renter, invoices in the name of the supplier. These invoices will be
paid off by the Renter if the incident or the breakdown corresponds
to a normal wear and tear and if the responsibility of the Tenant is
not committed(hired).
To make in case of flight(theft) or of attempt of burglary …
- Warn the Renter immediately so that the statement(declaration) of
flight(theft) or attempt of burglary and flight(theft) is made, by the
Renter, with the insurance(assurance) in 48 (forty eight) hours
- Give evidence, in 24 (twenty four) hours following the facts, a
complaint to the police station or to the gendarmerie the closest to
the place of the flight(theft). A receipt of your statement(declaration)
will be put back(handed) to you.
This approach(initiative) allows to activate(start) the
searches(researches). It will also be the way(means) to clear(release)
your responsibility if the thief causes(provokes) an accident.
Keep(Preserve) affectedly keys and titles(securities) of
traffic(circulation) (car registration document and green card) for
return(restoration) to the Renter. This condition is essential for the
insurance coverage in case of flight(theft).

9.1 – Use of the personal information
The Tenant accepts that the supplier collects personal information
concerning him(it) (address, phone number, e e-mail). This
information is confidential, and will not be revealed by the supplier.
This information will be used by the Renter:
- To assure(insure) the reservation of the Vehicle and the
establishment of a Rental agreement
- To feed the client base of the supplier (archiving of the customer
information further to the rent, the sending of special offers)
- To settle any dispute and make apply the General Conditions of
Rent.
9.2 – Access, modification and preservation of the personal
information
According to the law, the Tenant has a right of access, communication,
modification, rectification and abolition(deletion) of the personal
information collected by the supplier. He can exercise this right(law)
by writing by mail or by e-mail to the supplier.
The Renter will proceed to the archiving of the personal information
on a reliable and long-lasting(sustainable) support(medium)
establishing(constituting) a faithful copy, according to provisions of
the article 1348 of the Civil code. The archives of the supplier will be
considered by the parts(parties) as proof of the communications, the
reservations, the payments and transactions(deals) intervened
between the parts(parties). These archives are
accessible(approachable) to the Tenant on simple demand(request)
via email.
9.3 – Right to withdraw
The Tenant proceeding to a remote reservation (by Internet or by
telephone) has, according to the law, a cooling-off period of 14 (
fourteen) days as from the validation of the reservation to cancel this
one.
This right to withdraw will practice(be applied) by the sending of a
registered letter with Defendant(Accused) Reception by the Tenant
the Renter.
9.4-Applicable law – disputes
The Rental agreement is subjected(submitted), both for its
interpretation(performance) and for its implementation, to the
French law.
Any difficulty or contesting relative to the
interpretation(performance) or to the execution of the Rental
agreement, even in case of plurality of defendants or call(appeal) in
guarantee, will be carried(worn) before the courts by Bordeaux.
LE XI C O N
The “Tenant” indicates(appoints) the natural person in the name of
whom is established the “Rental agreement”. The Tenant is the
Signatory of the Contract.
The “Renter” indicates(appoints) the the supplier / rental company.
The “Vehicle” indicates(appoints) the van / fitted out van /
campervan / fitted out vehicle put in the rent by the Renter to the
Tenant. The “Vehicle” is described on the ” Descriptive Index
card(Form) Convey ” annexed to the Contract.
The “Rental agreement”, concluded between the Renter and the
Tenant, includes the General Conditions of Rent as well as the
descriptive state of the Vehicle.

Les Conditions Générales de Location s’appliquent pleinement une
fois que le Propriétaire s’est engagé à la mise à disposition de son
Véhicule en signant le Contrat de Gestion Locative.

FO U R N I R
Le Propriétaire devra présenter, lors de la signature du Contrat de
Gestion Locative :
- une pièce d’identité, en cours de validité,
- un justificatif de domicile de moins de 2 (deux) mois (facture eau,
électricité, ou téléphone)
- la carte grise du Véhicule faisant l’objet du Contrat de Gestion
Locative
- le justificatif d’assurance (carte verte) du Véhicule faisant l’objet du
Contrat de Gestion Locative
- un RIB/IBAN
Le non-respect de ces conditions ou la non-délivrance de l’un de ces
documents entraînera l’annulation immédiate du Contrat de Gestion
Locative.
A R TI C L E 2 – C O N DI TI O N S DE M I S E À DI S P O S I TI O N
Le Loueur ne sera pas tenu pour responsable de l’éventuel retard de
prise en charge du Véhicule lorsque ce retard a pour origine le fait
que les informations transmises par le Propriétaire sont incomplètes
ou inexactes, ce que ce dernier accepte expressément.
 Le Véhicule doit répondre aux critères suivants :
- moins de 150 000 kms,
- carte grise de type VASP-Autocaravane,
- valeur inférieure à 50 000 €,
- de type fourgon aménagé par professionnel ou par constructeur
automobile.

Le Véhicule doit être équipé des accessoires rendus
obligatoires par la réglementation :
- 1 (un) gilet de haute visibilité
1 (un) triangle de pré-signalisation
2 (deux) alcootests
1 (un) disque de stationnement (Normes Européennes)
 Le Véhicule est caractérisé par:
- Son type
- Ses aménagements, accessoires et options
Un état descriptif extérieur et intérieur (état et inventaire de la
carrosserie et du matériel fourni) du Véhicule est dressé
contradictoirement en début et fin de Contrat de Gestion Locative.

La mise à disposition du Véhicule s’effectue exclusivement
dans les locaux du Loueur. Prévoir 1 (une) heure pour les
formalités.
A R TI C L E 3 – R È G L E M E N T
 Concernant les tarifs :
- les tarifs de location sont fixés en cohérence avec les tarifs
saisonniers de Camp In Van et en concertation avec le propriétaire,
- la prime d’assurance obligatoire de location, souscrite par le Loueur,
sera déduite des recettes générées par la location du Véhicule,
- un forfait de 50 % sur les recettes restantes, servant à couvrir les
frais de gestion, de suivi et de nettoyage, est prélevé par le Loueur,
- il n’y a pas de cotisation annuelle.

Le fournisseur procédera au paiement des recettes effectuées
soit par virement interbancaire ou par remise de chèque à
l’ordre du Propriétaire du Véhicule.
A R TI C L E 4 – L O C A TI O N

Les locations se passent conformément aux Conditions
Générales de Location.

Le Loueur tient informé le Propriétaire de toutes nouvelles
périodes de location réservées. A contrario, le Propriétaire
doit prévenir suffisamment tôt lors d’un besoin personnel du
véhicule en dehors des périodes déjà mentionnées dans le
contrat de Gestion Locative et celles inscrites dans le système
de réservation en ligne.

Le Contrat de Gestion Locative aura une échéance d’1 (an) au
terme de laquelle les parties se rencontreront pour confirmer
ou non un renouvellement
Le Contrat de Gestion Locative peut être dissout en cours
d’échéance par lettre recommandée envoyée à la SARL ...
A réception du dit courrier, le Véhicule sera restitué sous réserve
d’honorer les dernières réservations.
A R TI C L E 6 – R ES P O NS A BI L I T É D U L O U EU R

Le Propriétaire reste seul responsable de l’entretien de son
Véhicule,

Le Loueur ne pourra en aucun cas être tenu pour responsable
d’éventuels dommages, dégradations ou vols occasionnés sur
ou dans le Véhicule du Propriétaire hors périodes de location,


En tout état de cause, si la responsabilité du Loueur devait
être engagée, pour quelque cause que ce soit, le montant des
dommages et intérêts susceptibles de lui être réclamés sera
limité au montant des sommes effectivement perçues au titre
de la location correspondante.
La responsabilité du Loueur ne saurait être engagée que sur
les périodes de location effective du Véhicule mis en gestion.

Le Propriétaire accepte que le Loueur collecte des informations
personnelles le concernant (adresse, numéro de téléphone, e mail…).
Ces informations sont confidentielles, et ne seront pas divulguées par
le Loueur.
Ces informations seront utilisées par le fournisseur.
- Pour assurer la réservation du Véhicule et l’établissement d’un
Contrat de Gestion Locative
- Pour alimenter la base clients du fournissuer (archivage des
informations client, envoi d’offres promotionnelles…)
- Pour régler tout litige et faire appliquer les Conditions Générales de
Location.
- Pour régler tout litige et faire appliquer les Conditions Spécifiques
de Gestion Locative.
7. 2 – AC C È S , MO DI FI C AT I O N E T C O N S E R V A TI O N D ES
I N FO R M A TI O NS P ER S O N N EL L E S
Conformément à la loi, le Propriétaire dispose d’un droit d’accès, de
communication, de modification, de rectification et de suppression
des informations personnelles recueillies par le fournisseur. Il peut
exercer ce droit en écrivant par courrier postal au fournisseur ou par
courrier électronique.
Le Loueur procédera à l’archivage des informations personnelles sur
un support fiable et durable constituant une copie fidèle,
conformément aux dispositions de l’article 1348 du Code Civil. Les
archives du fournisseur seront considérées par les parties comme
preuve des communications, réservations, paiements et transactions
intervenues entre les parties. Ces archives sont accessibles au
Propriétaire sur simple demande.
AR TI C L E 8 – DR O I T D E R ÉT R AC T AT I O N
Le Propriétaire procédant à une mise à disposition de son Véhicule
dispose, conformément à la loi, d’un délai de rétractation de 14
(quatorze) jours à compter de la validation de la mise à disposition
pour annuler celle-ci.
Ce droit de rétractation s’exercera par l’envoi par le Propriétaire au
Loueur, d’une Lettre Recommandée avec Accusé de Réception.

Le Contrat de Gestion Locative est soumis, tant pour son
interprétation que pour sa mise en œuvre, au droit français.
Toute difficulté ou contestation relatives à l’interprétation ou à
l’exécution du Contrat de Gestion Locative, même en cas de pluralité
de défendeurs ou d’appel en garantie, sera portée devant les
Tribunaux de Bordeaux.
LE XI Q U E

Le « Propriétaire » désigne la personne physique au nom de
laquelle est établi le « Contrat de Gestion Locative ». Le «
Propriétaire » est le Signataire du Contrat de Gestion
Locative.


Le « Loueur »

Le « Véhicule » désigne le van / fourgon aménagé /
campervan / véhicule aménagé mis à la location par le
Loueur au Locataire. Le « Véhicule » est décrit sur la « Fiche
Descriptive Véhicule» annexée au Contrat.

Le « Locataire » désigne la personne physique au nom de
laquelle est établi le « Contrat de Location ». Le Locataire est
le Signataire du Contrat.
Le « Contrat de Location », conclu entre le Loueur et le
Locataire, comprend les Conditions Générales de Location
(ci-dessus) ainsi que l’état descriptif du Véhicule.

Documents pareils
