FUNDAMENTAL PRINCIPLES The Fund has been set up, in compliance with Articles D.7121-30 et seq. of French employment law, to provide a paid holiday service to artists and technicians who have not been employed continuously by any one employer during the twelve months prior to their holiday request, irrespective of the nationality of the employee and the type of contract of employment. Any organisation stipulated in Articles D.7121-28 and D.7121-29 of French employment law is bound to subscribe to the Fund, which particularly applies to all impresarios, film studios, and TV/radio production and communication companies, irrespective of whether such activities are their main or secondary line of business, and regardless of their legal status (company, association, etc.) and whether registered as a private or public company. Live performance employers bound by the Guso scheme must send their declaration forms directly to Guso. For the Congés Spectacles Fund, the reference holiday year runs from 1 April to 31 March of the following year (Article R.3141-3, Paragraph 2 of French employment law). In pursuance of the general law governing paid holiday, the Fund pays, from 1 May, the holiday period acquired by way of the activities performed during the previous 12 months, in the same way as any permanent employee within a company. Employees hired by a member organisation will be entitled to a holiday period determined in accordance with Articles L.3141-3 et seq. of French employment law. Employees will receive holiday pay calculated according to the provisions of Article D.7121-37 (10 % of the holiday basis declared during the reference period). Employees have access to an electronic record management service, enabling them to fill in their holiday request online. They must first register for the new login procedure. The holiday request form is automatically sent out at the end of March, at the same time as the sums declared to the inland revenue, to those of your employees that do not wish to fill in their holiday request online. If they did not receive any holiday pay the previous year, they can ask for the form by post from 1 April or via our website. -2- OBLIGATIONS - Registration of employees If any of your employees have not yet been registered with the Fund, you should invite them to download the registration form from the www.conges-spectacles.com website or apply for their registration by post. Nevertheless, you can register them yourself. In respect of foreign employees, you are responsible for their registration. At the same time, you should give your employees the appropriate explanatory notices, which are available in several languages (English, German, Italian, Spanish, Portuguese and Russian). You can find the employee's registration number on our website. - Salary to be declared The salary used as the basis for calculating contributions is the gross remuneration paid to the employee during the reference period, before any standard deductions for professional expenses and any other deductions. The amount includes overtime and benefits in kind, as well as certain bonus payments, but does not include the reimbursement of professional expenses. This salary may, in certain sectors of activity and for certain occupations, be limited to a daily maximum amount. The maximum amounts are notified by the employers’ professional organisations. The amounts will be displayed on our web site from 1 April. It is up to each member company to check if it is authorised to apply them. - Certificates of employment In accordance with Article D.7121-32 of French employment law, you must issue a certificate of employment to every salaried worker once engagement ends. For activities in progress on 31 March, two certificates should be issued - the first for the period ending 31 March, the second for the period commencing 1 April. You can send your employee activity declarations to our website at www.congesspectacles.com, to net-entreprises.fr or on a digital storage medium (diskette, CD-ROM, and so on). We will then send you the blue parts of the certificate only to be given to the employee, or if you are using an approved software program, you can print them on white paper. If you would rather fill in your employee declarations manually on paper, certificate packs featuring three parts will be sent to you. You must : - give the blue part to the employee upon leaving your company, - return the pink part to the Fund, along with the contribution declaration and payment list and your cheque, - keep the white part for your payroll department. These declarations are used as cheques that are drawn on your account with Congés Spectacles. You are wholly liable for their use and they determine the amount of your contributions. Any fraudulent use may lead to prosecution. -3- The holiday pay to which your employees are entitled will be based on your declarations. If you do not send your employee declarations we are unable to ensure that the beneficiaries are paid their holiday pay. You can review declarations submitted for the current financial year as well as those for the three previous financial years online at www.conges-spectacles.com. You can correct any erroneous declarations online. - Contributions . Declaration and payment of contributions Bearing in mind the dates on which your payments are due, you can declare and pay your contributions online via our website: www.conges-spectacles.com or net-entreprises.fr Otherwise, at regular intervals you will receive a contribution declaration and payment list, which is to be used to submit declarations for personnel that you have employed during the period in question and to calculate the amount of your contribution. The list must be returned to us within two weeks of the period in question, i.e. no later than the date indicated on the list, and accompanied by the corresponding payment by bank or post office cheque made payable to CONGES SPECTACLES or by bank transfer with the PINK parts of the certificates of employment issued or the corresponding employee declarations file if you have an approved software program. . Contribution rates Contributions are paid in full by the employer. The rate is 14.30% for activities performed from 1 April 2014. It was 15.20% for activities performed from 1 April 2012 to 31 March 2013 and from 1 April 2013 to 31 March 2014. - Company changes You must notify the Fund of any change concerning the company name, registered office, legal representative or legal status within the month following the change. You must notify the Fund in the event of the dissolution of your company within two months thereof. You must notify the Fund if your company is subject to a winding-up or liquidation order. COMPANY CONTROL The Fund has registered auditors. In compliance with Article L.3141-31 of French employment law, employers must, at all times, be able to provide the auditors with all documents and information to justify that they have discharged all their obligations. -4- BREACH OF OBLIGATIONS In accordance with the Fund’s Internal Regulations, late payment fees are calculated on contributions that have not been paid by the stipulated date. * * * INTERNET AND TELEPHONE You can order certificates of employment and employee registration forms, and request confirmation of payment from our website. You can also update your contact details, request your login code, change your password, and download or order reports of any cancelled or created certificates. Three items are required to log into our website: your account number, your assigned login and your chosen password.
