pour les années 2009 et 2010 (RCO 2009-2010)
Le présent document reprend textuellement les contributions des acteurs du marché
luxembourgeois transmises dans le cadre de la consultation sur le projet d’offre de colocalisation de référence pour les années 2009 et 2010 (RCO 2009-2010) de l’EPT.
L'Institut a reçu des contributions de la part de :
1. OPAL asbl;
2. Luxembourg Online SA;
Le fait d’inclure ces commentaires dans ce document ne signifie nullement que
l’Institut approuve ou désapprouve les opinions exprimées. L’Institut n’a pris en
compte que les commentaires qu’il a reçus durant la période de la consultation et qui
se rapportaient à l’offre en question. Les passages confidentiels et les parties ne se
rapportant pas au sujet spécifique qui étaient inclus dans les contributions n’ont pas
été publiés.
A la fin de ce document, l’Institut publie la prise de position de l’opérateur historique
à ce sujet.

Commentalres de I'OPAL au prolet de RCO 2009-2010
Due to the source language of the RCO document, the OPAL has decided to
write its comments in English in order to avoid any doubts or
misunderstandings arising from translated terms.
1. (( Provisioning process ~~, 4.1.x & 4.2.x
Even though the ordering process has been described in the actual project, the
OPAL is missing any kind of "Ready for Service" milestone: i.e. When can the
OiO start to connect end-customers?
The actual process "stops" after the OiO has placed a firm order and hence is
financially bound. Considering that OlOs are deploying technologies in the co-
locations, which might be outdated within years, it is crucial to stick to a
ROI(return on investment) calculation. However due the lack of a firm planning
it is not possible today to make these calculations and hence further investments
from the OlOs might not be done.
OPAL therefore requests that EPT includes lead-times and a milestone equivalent
to "Ready for Service" in the actual offer.
2. Lack of access to "Street cabinets"
The EPT has informed the OlOs that it will deploy VDSl and at the same time
"try to get closer" to the customer by introducing "street cabinets". EPT clearly
states that it is crucial to implement the "street cabinet" approach in order to
provide new services like VDSL.
Consequently any operator wanting to deploy the same technology will require
access to the "street cabinets". However the actual RCO offer does not mention
the access at all.
The OPAL concludes that Oios will not be able to offer new/self-operated
services or upgrade their existing customer base. This would leave EPT in a
100% monopoly position for upcoming fixed broadband technologies.
Consequently, OPAL requests regulated access to all "street cabinets" and any
other access points necessary to deploy (at least) the same technology than
EPT.

Monsieur,
Suite à la publication de l'offre de collocation de référence (RCO) de l'année 2009, nous vous joignons
nos demandes.

"When an Operator already hosted in a given Co-Location Equipment Room requests additional Co-Location Space(s) imposing an extension
of the said ~;o-Loc¿,lion Equipment Room, tiie costs related to suei', extension siiêlll bb shared equaiiy between all aiready hosted Operator\s)
(i.e. 100/n %) and be consequently invoiced by EPT. When an additional Operator requests Co-Location Space imposing the extension of an
existing Co-Location Equipment Room, it will be charged (1 OO/(n+1)) % of the extension costs plus (1 OO/(n+1)) % of the common costs paid by
the first Operators plus a fee covering administration costs. The (1 OO/(n+1)) % of the common costs paid by the additional Operator will be
refunded to the established Operator's with deduction of the administrative costs covering rebillng and financial costs."
Les coûts, de la colocation varient selon Ie nombre dopérateurs qui en profitent (investissements
initiaux, coûts de maintenance, .. .). Actuellement, LOL ne peut pas vérifier que les redevances payées
cOlTespondent bien aux coûts exacts dune colocation précise. La transparence des coûts de colocation
est nécessaire à cause des besoins croissants des locaux existants et la nécessité de mettre en place de
nouvelles colocations et de nouveaux investissements. Il faut savoir qui paye quoi et pourquoi.
q LOL souhaite la plus grande transparence sur Ie coût réel de la colocation.
q LOt demande la création dune comptabilité pour la colocation avec la production à interval1es
réguliers dun tableau récapitulatif des coûts par colocataires des différents lieux de colocation.
