ARRÊTÉ NO. 78‐12 ARRÊTÉ DE LA MUNICIPALITÉ DE DIEPPE CONCERNANT LE DÉPLACEMENT DE BÂTIMENTS DANS LES RUES LE CONSEIL DE LA MUNICIPALITÉ DE DIEPPE, DÛMENT RÉUNI, ADOPTE CE QUI SUIT: 1. Nulle personne, corporation, société en nom collectif ou société ne doit placer ou faire placer ou déplacer une maison, un garage, une grange, une remise ou un bâtiment quelconque dans une rue sans avoir obtenu au préalable l’autorisation écrite du directeur des travaux publics. 2. Le déplacement d’une maison, d’un garage, d’une grange, d’une remise ou d’un bâtiment dans les rues ou chemins doit se faire conformément aux stipulations formulées par le conseil municipal ou son représentant dûment autorisé. 3. Lorsque des rues ou routes sont endommagées lors du déplacement d’une maison, d’un garage, d’une grange, d’une remise ou d’un bâtiment, le propriétaire du bâtiment est responsable des dégâts qu’il doit réparer à la satisfaction de la ville. Si ledit propriétaire ne fait pas les réparations voulues dans les quarante‐huit heures de la signification d’un avis par la ville, la ville peut faire réparer les dégâts, en facturer le coût audit propriétaire et en obtenir le paiement au moyen des voies légales ordinaires. 4. Toute personne, corporation, société en nom collectif ou société qui enfreint l’une des dispositions du présent arrêté est coupable d’une infraction et passible, sur déclaration sommaire de culpabilité, d’une amende de 20 à 200 dollars recouvrable en application des dispositions de la Loi sur les poursuites sommaires. BY‐ LAW NO. 78‐12 A BY‐ LAW OF THE MUNICIPALITY OF DIEPPE RESPECTING THE MOVING OF BUILDINGS OVER STREETS THE COUNCIL OF THE MUNICIPALITY OF DIEPPE DULY ASSEMBLED HEREBY ENACTS AS FOLLOWS: 1. No person or persons, corporation, partnership, or society shall place, or cause to be placed, or be moved over any street any house, garage, barn, shed, or any building whatsoever, without having first obtained the written authorization from the Director of Public Works. 2. The moving of any house, garage, barn, shed, or building over the streets or roads shall be done according to the specifications formulated by the Town Council or its duly authorized representative. 3. Any damage caused to the streets or roads in the process of moving any such house, garage, barn, shed, or building, shall be the liability of the owner thereof who shall repair the said damages to the satisfaction of the Town. Upon failure of the said owner to do so within forty‐eight hours from the service of a notice by the Town, the Town may proceed to have the said damages repaired and charge the costs of such repairs to the said owner and collect from him in the normal course of law. 4. Any person or persons, corporation, partnership or society who violates any of the provisions of this by‐law is guilty of an offense and is liable on summary conviction to a fine of not less than $20. and not more than $200. and all such fines shall be recoverable under the provisions of the Summary Convictions Act. 5. L’arrêté no. 17 intitulé “A By‐Law for Regulating the Moving of Houses and Other Buildings within the Town of Dieppe” est abrogé par le présent arrêté. 5. By‐law No. 17 entitled “A By‐law for Regulating the Moving of Houses and Other Buildings within the Town of Dieppe” is hereby repealed. 6. Le présent arrête entre en vigueur le jour de son adoption définitive. 6. This by‐law comes into force on the date of final passing thereof.
