General Conditions of Use for the
Oroglas®imagebank Photo Library

General
The purpose of the present General Conditions is to specify how photographs appearing on the
website www.oroglas-imagebank.com (hereinafter known as “the Photo Library”) may be used.
Access to the Photo Library and/or use of one or more photographs from the Photo Library shall be
subject to acceptance of all terms of the present General Conditions.

Users
Access to the Photo Library shall be confined to:

staff of the company ARKEMA France and its affiliated companies,
staff of the company Altuglas International SA and its affiliated companies,
certain external service providers expressly approved by the company Altuglas International
SA,
Certain distributors expressly approved by the company Altuglas International Services SAS.

Eligibility
Users wishing to access the Photo Library must first complete a registration form on the
website www.oroglas-imagebank.com
Registration shall be subject to approval by the company Altuglas International SA.
If registration is approved by the company Altuglas International SA, the user will receive a
password providing access to the Photo Library.

Use of photographs
4.1
No use shall be made of any photograph without prior agreement in writing from Altuglas
International SA. The user must previously have notified Altuglas International SA of the
photograph concerned and must give details of its intended use (viz. the medium, duration,
territory and purpose of use). The photograph shall only be used within the limits authorized
by the company Altuglas International SA.
4.2
Any further use of the photograph shall be subject to new prior agreement by Altuglas
International SA.
4.3
It is a condition that the user must ensure that the following credits appear on or near each
photograph from the Photo Library:
© names that appear on the site www.oroglas-imagebank.com / Altuglas International,
where the name of the photographer and/or the name of the company owning the
photograph or object photographed is mentioned.
© Altuglas International, where no name appears on the site
www.oroglas-imagebank.com the credit to Altuglas International remains compulsory.
4.4
No photograph may be modified in any way without prior agreement in writing from Altuglas
International SA .
5.
Responsibility of the User
Photographs present on the site are protected by intellectual property laws.
Access to the Photo Library and use of the photographs confers no rights to the said photographs.
Any use of photographs shall be exclusively the responsibility of the User and with no possible
recourse against the company Altuglas International SA or its affiliated companies.
The company Altuglas International SA and its affiliated companies accept no responsibility in the
event of litigation arising from the use of photographs originating from the Photo Library.
6.
Cancellation
The company Altuglas International SA reserves the right to cancel access by the User to the Photo
Library at any time and without prior notice.
7.
Applicable Law and competent court
Any litigation relating to use of the Photo Library and/or the website www.oroglas-imagebank.com
shall be subject to French Law and the Commercial Court of Nanterre shall be the competent court.

Photothèque entraînent l'acceptation de tous les termes des présentes conditions générales.

Adhésion
Les utilisateurs souhaitant avoir accès à la Photothèque doivent au préalable remplir une
demande sur le site www.oroglas -imagebank.com.
L’inscription fait l’objet d’un examen par la société Altuglas International SA
Si l’inscription est validée par la société Altuglas International SA, l’utilisateur se voit attribuer
un mot de passe lui donnant accès à la Photothèque.

Utilisation des photographies
4.1
Toute utilisation d’une photographie ne peut se faire sans l’accord préalable écrit d’Altuglas
International SA. L’utilisateur enverra au préalable à Altuglas International SA la photographie
concernée et précisera la destination de celle-ci (à savoir le support, la durée, le territoire et
l’objet de l’utilisation) L’utilisation de la photographie se fait dans les limites consenties par la
société Altuglas International SA.
4.2
Toute réutilisation de la photographie devra à nouveau recevoir l’accord préalable de Altuglas
International SA..
4.3
L’utilisateur devra obligatoirement faire figurer sur ou à proximité de chaque photographie
provenant de la Photothèque les mentions suivantes :
© noms figurant sur le site www.oroglas-imagebank.com / Altuglas International, dans
le cas où le nom du photographe et/ou le nom de la société à qui appartient la photo
ou l’objet photographié est mentionné.
© Altuglas International, si aucun nom n’apparaît sur le site www.oroglasimagebank.com, la mention Altuglas International reste obligatoire.
4.4
Aucune photographie ne peut être modifiée de quelque manière que ce soit sans l’accord
préalable et écrit d’Altuglas International SA.
5.
Responsabilité de l’Utilisateur
Les photographies présentes sur le site sont protégées par les lois sur la propriété intellectuelle.
L’accès à la Photothèque et l’utilisation des photographies ne confèrent aucun droit sur lesdites
photographies.
Toute utilisation des photographies se fera sous la responsabilité exclusive de l’utilisateur sans
recours possible contre la société Altuglas International SA et ses sociétés affiliées.
La société Altuglas International SA et ses sociétés affiliées s’exonèrent de toute responsabilité en
cas de litige relatif à l’utilisation des photographies provenant de la Photothèque.
6.
Résiliation
La société Altuglas International SA se réserve le droit de résilier à tout moment et sans préavis
l’accès de l’utilisateur à la Photothèque.
7.
Loi applicable, tribunal compétent
Tous les litiges relatifs à l’utilisation de la Photothèque et/ou du site www.oroglas-imagebank.com
sont soumis au droit français, le Tribunal de Commerce de Nanterre étant compétent.

Mit den vorliegenden allgemeinen Bedingungen wird die Nutzung der Fotografien des Intranetauftritts
www.oroglasint-imagebank.com (nachstehend „die Fotothek“ genannt) definiert.
Durch den Zugriff auf die Fotothek bzw. die Nutzung einer oder mehrerer Fotografien aus der Fotothek
erklärt sich der Nutzer mit allen Bestimmungen der vorliegenden allgemeinen Bedingungen
einverstanden.

Nutzer
Zum Zugriff auf die Fotothek sind ausschließlich berechtigt:

Nutzer müssen zuerste eine Erlaubnis zum Zugriff auf die Fotothek beantragen und dazu
unter der Adresse www.oroglas-imagebank.com einen Antrag ausfüllen.
Die Anträge werden von Altuglas International SA geprüft.
Gibt Altuglas International SA dem Antrag statt, erhält der Nutzer ein Passwort für den Zugriff
auf die Fotothek.

Verwendung der Fotografien
4.1
Die Nutzung der Fotografien bedarf der vorherigen schriftlichen Genehmigung durch Altuglas
International SA. Dazu ist die betreffende Fotografie zuvor an Altuglas International SA mit
Angabe der Verwendung (Medium, Dauer, Territorium und Zweck der Nutzung) zu
übermitteln. Die Nutzung der Fotografie bleibt auf die von Altuglas International SA
genehmigten Grenzen beschränkt.
4.2
Auch jede erneute Nutzung einer Fotofgrafie bedarf der vorherigen Zustimmung von Altuglas
International SA.
4.3
Der Nutzer hat auf oder neben jeder Fotografie aus der Fotothek folgende Hinweise
anzubringen:
© Die im Internet auf den Seiten von Altuglas International unter www.oroglasimagebank.com angegebenen Namen, wenn der Name des Fotografen und/oder der
Firma, die die Eigentumsrechte an der Fotografie besitzen, dort aufgeführt sind.
© „Altuglas International“, wenn auf den Internet-Seiten von Altuglas International
unter www.oroglas-imagebank.com kein Name erwähnt wird; der Hinweis „Altuglas
International“ muss auf jeden Fall erscheinen.
4.4
Ohne vorherige schriftliche Zustimmung von Altuglas International SA darf an keiner
Fotografie eine Änderung, gleich welcher Art, vorgenommen werden.
5.
Haftung des Nutzers
Die im Internet bereitgestellten Fotografien sind urheberrechtlich geschützt.
Der Zugriff auf die Fotothek und die Nutzung der Fotografien sind mit keinerlei Übertragung von
Rechten an diesen Fotografien verbunden.
Für die Nutzung der Fotografien übernimmt der Nutzer die alleinige Haftung unter Ausschluss jeder
Möglichkeit eines Regresses gegen die Firma Altuglas International SA und die ihr angegliederten
Gesellschaften.
Die Firma Altuglas International SA und die ihr angegliederten Gesellschaften übernehmen bei
Rechtsstreitigkeiten keinerlei Haftung im Zusammenhang mit der Nutzung der Fotografien aus der
Fotothek.
6.
Kündigung
Die Firme Altuglas International SA behält sich vor, die Zugriffsrechte des Nutzers auf die Fotothek
jederzeit unangemeldet zu kündigen.
7.
Geltendes Recht, Gerichtsstand
Alle Rechtsstreititigkeiten bezüglich der Nutzung der Fotothek bzw. des Intranetauftritts www.oroglasimagebank.com unterliegen französischem Recht, Gerichststand ist das Handelsgericht Nanterre.
