L'Ecole doit porter cette convention à la connaissance de
l'élève, ou s'il est mineur, de son représentant légal, et obtenir
préalablement au stage, soit de l'élève, soit de son
représentant légal, un consentement exprès aux clauses de la
convention.
The School shall inform the student of this agreement or, if he
is a minor, his legal representative, and shall obtain consent to
the clauses of this agreement prior to the internship, either
from the student or from his legal representative.

ARTICLE 1
Ce stage de formation obligatoire a pour objet essentiel
d'assurer l'application pratique de l'enseignement donné à
l'Ecole, sans que l'employeur puisse retirer aucun profit direct
de la présence, dans son entreprise, d'un élève stagiaire.
This compulsory training internship is essentially aimed at
ensuring the practical application of the teaching courses

provided at the School, without the employer being able to derive
any direct benefit from the presence of the trainee student in his
company.

ARTICLE 2 : Déroulement du stage
La durée hebdomadaire maximale de présence du stagiaire dans

Interruption définitive du stage
En cas de volonté d’une des trois parties d’interrompre
définitivement le stage, celle-ci devra immédiatement en
informer les deux autres parties et confirmer par écrit. Les
raisons invoquées seront examinées en étroite concertation.
La décision définitive d’interruption du stage ne sera prise qu’à
l’issue de cette phase de concertation.
If one of the three parties wishes to prematurely terminate the
Placement, this party should immediately inform the other
parties and confirm this request in writing. The reasons given
shall be examined carefully by all parties and the final decision
made at the end of the consultation.

ARTICLE 3
L'organisation du stage est mise au point par le Chef
d'Entreprise en accord avec MINES ParisTech, compte tenu
du programme des études et des activités de l'Ecole.
The organization of the internship is decided on by the
Company Director in agreement with MINES ParisTech, taking
into account the curriculum and activities of the School.

ARTICLE 4
Pendant la durée de leur séjour dans l'entreprise, les élèves
stagiaires demeurent élèves de l'Ecole ; ils sont suivis par les
membres du corps enseignant de l'Ecole dans des conditions
qui sont déterminées dans chaque cas particulier en accord
avec MINES ParisTech et le Chef d'Entreprise ou son
représentant.
During their presence in the company, trainee students remain
students of the School; they will be supervised by members of
the School’s faculty under conditions determined in each
particular case in agreement with MINES ParisTech and the
Company Director or his representative.

ARTICLE 5
Durant leur stage, les élèves sont soumis aux dispositions du
règlement intérieur de l'entreprise, notamment en ce qui
concerne la discipline, les visites médicales et l'horaire de
travail.
During their placement, the students will be subject to the
provisions of the company’s internal regulations with regard to
discipline, medical check-ups and working hours.

ARTICLE 6
En cas de manquement à la discipline, le Chef d'Entreprise se
réserve le droit de mettre fin au stage de l'élève fautif, après
avoir prévenu MINES ParisTech, tout en respectant les
dispositions fixées à l’article 3 de la présente convention.
Avant le départ de l'élève stagiaire, le Chef d'Entreprise doit
s'assurer que l'avertissement adressé à MINES ParisTech a
bien été reçu par ce dernier.
In the event of any breach of discipline, the Company Director
shall have the right to terminate the placement of the student
at fault after having notified MINES ParisTech, in compliance
with the article 10 of the present agreement. Before the trainee
actually leaves the company, the Company Director shall
ensure that MINES ParisTech has actually received the
notification of misconduct sent.

ARTICLE 7
Le stage étant intégré à la scolarité, la présente convention
n'est pas considérée comme un contrat de travail ; l'élève peut
donc bénéficier d’indemnités ou de gratifications laissées à la
discrétion de l'entreprise d'accueil.
As the placement is an integral part of the academic
programme, this agreement is not considered to be a work
contract; the student may therefore benefit from any

allowances or gratuities which the host company may wish to award
him.
•
ARTICLE 8
Pendant leur stage, les élèves continuent à bénéficier des
prestations d'assurances maladie, maternité ainsi qu'éventuellement
des allocations familiales au titre du régime d'assurances sociales
auquel ils sont affiliés : soit Sécurité Sociale (régime étudiant), soit
ayants-droits d'assurés sociaux. Par ailleurs, les élèves bénéficient
d'une couverture pour le régime accidents du travail, en application
de l'article 412-8° du Code de la Sécurité Sociale tant pour
l'accident survenu dans l'entreprise que pour le trajet. En cas
d'accident du travail ou de trajet, l'entreprise s'engage à faire
parvenir tous les renseignements utiles, dans les 48 heures, à
MINES ParisTech qui effectuera les formalités nécessaires.
De plus les étudiants sont couverts par une assurance
hospitalisation-rapatriement valable dans le monde entier. Cette
assurance privée, propre à l’école, couvre également la
responsabilité civile des élèves.
During their placement, students continue to benefit from sickness
insurance, maternity benefits and family allowances as provided by
the social insurance regime to which they are affiliated, either Social
Security (student regime) or as beneficiaries of parental insurance
cover. Furthermore, students are also insured against professional
injury, in accordance with Article 412-8º of the Social Security Code
both for an accident occurring on company premises or when
travelling to or from work. In the event of an accident at work or
when travelling to or from work, the company undertakes to send all
useful information, within 48 hours, to MINES ParisTech which will
undertake the necessary procedure.
Furthermore, the students are covered by hospitalizationrepatriation insurance valid throughout the world. This private
insurance, specific to the school, also covers the students’ civil
liability.

ARTICLE 9
Les frais de nourriture et d'hébergement restent éventuellement à la
charge de l'élève, tandis que les frais de formation nécessités par le
stage sont pris en compte par l'entreprise.
The student will take charge of his food and lodging expenses, while
expenditure related to training required by the placement will be met
by the company.

ARTICLE 10
MINES ParisTech demandera au Chef d'Entreprise son appréciation
sur le travail des élèves stagiaires et, s'il y a lieu, sur certains points
particuliers qu'il jugera utile d'approfondir.
MINES ParisTech will ask the Company Director for his appreciation
of the student trainee’s work and, where appropriate, of certain
specific points which he may consider useful to elucidate.

ARTICLE 11
A leur retour à l'Ecole, les élèves doivent remettre à la Direction de
l'Ecole un rapport de stage qui sera porté à la connaissance du Chef
d'Entreprise ; ce dernier renverra le rapport à l'Ecole afin qu'il soit
noté.
On their return to the School, the students shall submit to the
Dean’s Office a report on their placement which will be sent to the
Company Director, who will subsequently return the report to the
School for grading.

ARTICLE 12
Clause de confidentialité : le stagiaire est astreint au secret
professionnel. Il est lié par l'obligation de discrétion professionnelle
pour tout ce qui concerne les faits, informations et techniques dont il
peut avoir connaissance au cours de son stage.
Professional confidentiality: the trainee is bound by professional
confidentiality. He or she is obligated to exercise discretion
regarding the activities, information, and technology to which he/she
may be exposed to during the course of the internship.
