Engl. Pursuant to Article 63, paragraph 1, of the Convention, the Republic of Slovenia communicates the list of sanctions applied and enforced in the criminal law of the Republic of Slovenia: 1. Punishments involving deprivation of liberty 1.1 Imprisonment The Criminal Code provides for very detailed rules on sanctions in the area of criminal (substantive) law. A term of imprisonment (punishment by imprisonment) may only be imposed as a principal punishment. A punishment by imprisonment may be imposed for a term not shorter than 1 month and not longer than 30 years. A punishment by imprisonment shall be determined in full years and months, unless its term does not exceed a period of six months, in which case it may be determined in full days. The punishment of life imprisonment may be imposed for criminal offences of genocide, crimes against humanity, war crimes and aggression, two or several murders or two or several murders in cases of terrorism. The prisoner, who has served half of his punishment by imprisonment, may be released from a correctional institution (prison) under the condition that until the term, for which he was punished, he has not committed another criminal offence. The prisoner, who has been punished to over fifteen years of imprisonment, may be released on parole after he/she has served three quarters of the punishment and the prisoner, who has been punished to life imprisonment, may be released on parole after he/she has served twenty-five years in prison. Prisoners usually serve the punishment by imprisonment in correctional institution (prison). The punishment by imprisonment up to nine months may be substituted with house detention. The court shall decide with a decision whether to substitute imprisonment by house detention. The punishment by imprisonment up to two years, except when imposed for a criminal offence against sexual integrity - may be enforced so that, instead of serving the punishment by imprisonment, the convicted person performs community service for a period of a maximum of two years from the enforcement of the judgment. The punishment by imprisonment of up to three years, except when imposed for a criminal offence against sexual integrity, may also be enforced so that a convict who meets the conditions provided by the Act on the Enforcement of Penal Sanctions continues working or schooling and resides at home, except on work-free days, as a rule at weekends, when he must stay in prison. ../.. -21.2 Juvenile detention The court may impose a punishment of juvenile detention on a young adult (16-18 years) if she/he has committed a criminal offence for which a punishment graver than five years' imprisonment is prescribed by the statute and if, owing to the nature and gravity of the crime and the high degree of criminal liability, the application of educational measures would not be reasonable. A punishment of juvenile detention shall last not less than six months and not more than five years. For criminal offences for which the punishment of twenty years' imprisonment may be imposed, the punishment of juvenile detention shall not be imposed for more than ten years. 1.3 Compulsory psychiatric treatment and confinement in a health institution - see safety measures 2. Fines A fine may be imposed both as a principal as well as an accessory punishment. A fine shall be imposed in such a manner that the number of daily instalments set in the judgment, which the perpetrator must pay, is multiplied by the daily instalment amount set by the court by taking the pecuniary circumstances of the perpetrator into account. The number of daily instalments may amount to a minimum of ten and a maximum of three hundred and sixty daily instalments, while for criminal offences committed to one’s own benefit, this may amount to a maximum of one thousand five hundred daily instalments. The court shall fix the daily amount by taking into account the perpetrator's pecuniary circumstances on the basis of data on his income, other revenues, property value, his average maintenance costs and his family expenditure. The daily amount may not exceed 1,000 Euros (EUR). 3. Confiscation 3.1. Confiscation of objects Objects used or intended to be used, or gained through the committing of a criminal offence may be confiscated if they belong to the perpetrator. They may be confiscated even when they do not belong to the perpetrator if that is required for reasons of general security or morality and if the rights of other persons to claim damages from the perpetrator are not thereby affected. 3.2. Confiscation of property benefits gained by committing of criminal offence In accordance with legislation nobody is entitled to retain the property gained through or owing to the commission of a criminal offence. Money, valuables and any other property benefit gained through or owing to the commission of a criminal offence shall be confiscated from the perpetrator or recipient. If confiscation cannot be carried out, property equivalent to the property benefit shall be confiscated from them. Property benefit gained through or owing to the committing of a criminal offence may also be confiscated from persons, to which it was transferred free of charge or for a sum of money that does not correspond to its actual value, if such persons knew or could have known that this property had been gained through or owing to the committing of a criminal offence. Property that the perpetrator or other persons whose property is confiscated use exclusively or mostly to their own benefit with the consent of persons to whom this property belongs, if these persons knew or should have known that the property was acquired through crime or that it was used to prepare, commit or conceal crime or that it was acquired with the intention of being used for crime, shall also be confiscated as property acquired through crime or related to crime. Any property gained by a legal person through or owing to the committing of a criminal offence shall be confiscated. A property benefit or property equivalent to the property benefit shall also be confiscated from legal persons, when the perpetrator or recipient have transferred this property to the legal person free of charge or for a sum of money, which does not correspond to its actual value. Proceeds or property from criminal offence or related to criminal offence that a criminal organisation has acquired or has at its disposal shall also be confiscated. The property of the perpetrator who has committed a criminal offence in a criminal organisation for which the court establishes that is derived from criminal activities in that criminal organisation shall also be confiscated as proceeds from criminal offence. ../.. -34. Safety measures The following safety measures may be imposed on perpetrators of criminal offences: 1) compulsory psychiatric treatment and confinement in a health institution: The court shall impose a measure of compulsory psychiatric treatment and confinement in a health institution on an offender who has committed an offence, punishable by a punishment by imprisonment of at least one year, in a state of insanity or considerably diminished responsibility if, on the basis of the gravity of the offence committed and the degree of the mental disturbance of the offender, it establishes that, while at liberty, the offender might commit a serious criminal offence against life and body, sexual integrity or property and that this risk may only be eliminated by ensuring that the perpetrator receives treatment and care in a forensic psychiatric ward of a health institution that meets special security conditions provided by law. 2) compulsory psychiatric treatment at liberty; 3) ban on the performance of profession; 4) restraining order and ban on communicating with the victim; 5) revocation of the driving licence; 6) the confiscation of items. Compulsory psychiatric treatment and confinement in a health institution and compulsory psychiatric treatment at liberty shall be independently imposed on an insane perpetrator if there is no other way to ensure the safety of people. In addition to these two measures, the court may also impose other measures, including a ban on the performance of profession, restraining order and ban on communicating with the victim, revocation of the driving licence, and confiscation of items. The revoking of a driving licence and the confiscation of objects may be ordered for the perpetrator, when a punishment by imprisonment, a suspended punishment, or a judicial admonition has been imposed on him, as well as in the case of the withdrawal of a punishment. Barring to perform an occupation may be ordered if the perpetrator has been punished by imprisonment or when such a punishment has been suspended. 5. Disqualifications Types of Legal Consequences of Conviction: Termination of the performance of certain public functions or official duties, or termination of an employment relationship, or the loss of the right to residence in the Republic of Slovenia, shall constitute the legal consequence referring to the cessation or forfeiture of certain rights. Legal consequences that prevent the acquisition of certain rights shall include: 1) debarment from the performance of certain public functions or official duties; 2) debarment from entering a certain profession or concluding an employment contract; 3) debarment from obtaining certain permits and endorsements granted by written order of state bodies. Driving ban - an accessory punishment (not a safety measure): The court may impose the ban on driving certain types or categories of motor vehicles to the perpetrator who has committed a criminal offence against public traffic safety as a driver of a motor vehicle. The duration of this punishment may not be shorter than six months and longer than two years from the day of finality of the judgement. ../.. -4- SLOVENIE Information consignée dans une Note Verbale de la Représentation Permanente de la Slovénie déposée avec l'instrument de ratification le 11 avril 2016 – Or. angl. Conformément à l’article 63, paragraphe 1, de la Convention, la République de Slovénie communique la liste des sanctions appliquées et exécutées dans le droit pénal de la République de Slovénie: 1. Les peines privatives de liberté 1.1 Emprisonnement Le Code pénal prévoit des règles très détaillées sur les sanctions dans le domaine du droit pénal matériel. Une peine d'emprisonnement (peine de prison) ne peut être imposée qu’en tant que peine principale. Une peine d'emprisonnement peut être imposée pour une durée supérieure à 1 mois et inférieure à 30 ans. Une peine d'emprisonnement sera déterminée en années et mois pleins, à moins que sa durée ne dépasse pas une période de six mois, auquel cas elle peut être déterminée en jours pleins. La peine d'emprisonnement à perpétuité peut être imposée pour les infractions de génocide, de crimes contre l'humanité, de crimes de guerre et d'agressions, deux ou plusieurs meurtres ou deux ou plusieurs meurtres dans les cas de terrorisme. Le prisonnier, qui a purgé la moitié de sa peine d'emprisonnement, peut être libéré d'un établissement correctionnel (prison) sous la condition que jusqu'au terme pour lequel il a été puni, il ne commette pas une autre infraction pénale. Le prisonnier, qui a été puni à plus de quinze ans d'emprisonnement, peut être mis en liberté conditionnelle après qu'il / elle a purgé les trois quarts de la peine et le prisonnier, qui a été puni de l'emprisonnement à vie, peut être mis en liberté conditionnelle après qu'il / elle a purgé vingt-cinq ans de prison. Les prisonniers purgent habituellement leur peine d’emprisonnement dans un établissement correctionnel (prison). Une peine d’emprisonnement pouvant aller jusqu’à neuf mois peut être substituée par une assignation à résidence. Le tribunal se prononce sur la décision de remplacer l’emprisonnement par une assignation à résidence. Une peine d'emprisonnement pouvant aller jusqu'à deux ans, sauf lorsqu'elle est imposée pour une infraction pénale contre l'intégrité sexuelle - peut être exécutée de telle sorte que, au lieu de purger une peine de prison, la personne condamnée effectue un travail d'intérêt général pour une période maximale de deux ans à partir de l'exécution du jugement. Une peine d'emprisonnement pouvant aller jusqu'à trois ans, sauf lorsqu'elle est imposée pour une infraction pénale contre l'intégrité sexuelle, peut également être appliquée de telle sorte qu'un condamné qui remplit les conditions prévues par la Loi sur l'exécution des sanctions pénales, continue de travailler ou d’étudier et réside à son domicile, sauf les jours chômés, en règle générale, les week-ends, où il doit rester en prison. 1.2 Détention des mineurs Le tribunal peut imposer une peine de détention pour mineurs à un jeune adulte (16-18 ans) si elle / il a commis une infraction pénale pour laquelle une peine plus grave que cinq ans d'emprisonnement est prévue par la loi et si, en raison de la nature et de la gravité du crime et le degré élevé de responsabilité pénale, l'application des mesures éducatives ne serait pas raisonnable. Une peine de détention juvénile ne doit pas être inférieure à six mois et supérieure à cinq ans. Pour les infractions pénales pour lesquelles la peine d'emprisonnement de vingt ans peut être infligée, la peine de détention pour mineurs ne peut être infligée pendant plus de dix ans. 1.3 Traitement psychiatrique obligatoire et internement en établissement de santé - voir mesures de sécurité. ../.. -5- 2. Amendes Une amende peut être infligée soit comme peine principale, soit comme peine accessoire. Une amende est infligée de telle manière que le nombre de versements journaliers fixés dans le jugement, que l’auteur de l'infraction doit payer, soit multiplié par le montant du versement journalier fixé par le tribunal en tenant compte des conditions pécuniaires de l’auteur de l’infraction. Le nombre de versements journaliers peut aller d’un minimum de dix à un maximum de trois cent six versements journaliers, tandis que pour des infractions pénales commises pour son propre avantage, cela peut aller jusqu’à un maximum de mille cinq cents versements journaliers. Le tribunal fixera le montant journalier en tenant compte des conditions pécuniaires de l’auteur de l’infraction sur la base de son revenu professionnel, autres revenus, biens matériels, ses frais d'entretien moyens et ses dépenses familiales. Le montant journalier ne peut excéder 1000 Euros (EUR). 3. Confiscation 3.1. Confiscation d’objets Les objets utilisés ou destinés à être utilisés ou acquis par la commission d'une infraction pénale peuvent être confisqués s’ils appartiennent à l'auteur de l’infraction. Ils peuvent être confisqués même lorsqu’ils n’appartiennent pas à l’auteur de l’infraction si cela est requis pour des raisons de sécurité générale ou de moralité et si les droits d’autres personnes à réclamer des dommages à l’auteur de l’infraction ne sont pas de ce fait affectés. 3.2. Confiscation des bénéfices de biens acquis par la perpétration d’infractions pénales. Conformément à la législation, personne n’est en droit de conserver des biens acquis par ou en raison de la perpétration d’une infraction pénale. Argent, objets de valeurs ou tout autre bénéfice de bien acquis par ou en raison de la perpétration d’une infraction pénale seront confisqués à l’auteur de l’infraction ou au bénéficiaire. Si la confiscation ne peut être menée à bien, un bien équivalent au bénéfice du bien leur sera confisqué. Les bénéfices du bien acquis par ou en raison de la perpétration d’une infraction pénale seront également confisqués aux personnes auxquelles ce bien aura été transféré gratuitement ou pour une somme d’argent ne correspondant pas à sa valeur réelle, si ces personnes savaient ou pourraient avoir su que ce bien a été acquis par ou en raison de la perpétration d’une infraction pénale. Un bien que l’auteur d’une infraction, ou toute personne à qui le bien est confisqué, utilise exclusivement ou principalement à son bénéfice propre avec le consentement des personnes propriétaires du bien, si ces personnes savaient ou auraient dû savoir que le bien a été acquis par le crime ou qu’il a été utilisé afin de préparer, commettre ou cacher un crime ou qu’il a été acquis dans l’intention d’être utilisé à des fins criminelles, sera également confisqué en tant que bien acquis par le crime ou lié au crime. Tout bien acquis par une personne morale par ou en raison de la perpétration d’une infraction pénale sera confisqué. Les bénéfices du bien ou un bien équivalent aux bénéfices du bien sera également confisqué aux personnes morales lorsque l’auteur de l’infraction ou le bénéficiaire a transféré ce bien à une personne morale gratuitement ou pour une somme d’argent qui ne correspond pas à la valeur réelle du bien. Les produits et biens issus d’infractions pénales ou liés à des infractions pénales qu’une organisation criminelle aurait acquis ou aurait à sa disposition seront également confisqués. Les biens de l’auteur d’une infraction ayant commis une infraction pénale au sein d’une organisation criminelle, pour lesquels le tribunal a établi qu’ils découlent des activités criminelles au sein de cette organisation criminelle, seront également confisqués en tant que produits provenant d’une infraction pénale. 4. Mesures de sécurité Les mesures de sécurité suivantes peuvent être imposées aux auteurs d'infractions pénales : ../.. -6- 1. traitement psychiatrique obligatoire et internement en établissement de santé : Le tribunal imposera une mesure de traitement psychiatrique obligatoire et d’internement en établissement de santé à un délinquant ayant commis une infraction, passible d’une peine d’emprisonnement d’au moins un an, en état de démence ou de responsabilité considérablement diminuée si, sur la base de la gravité de l’infraction commise et du degré de perturbation mentale du délinquant, il est établi que, en liberté, le délinquant pourrait commettre une infraction pénale portant atteinte à la vie et au corps, à l’intégrité sexuelle ou à l’intégrité des biens et que ce risque ne pourrait être éliminé que par l’assurance que l’auteur de l’infraction reçoit un traitement et des soins dans un service de psychiatrie légale d'un établissement de santé répondant aux conditions de sécurité particulières prévues par la loi. 2. traitement psychiatrique obligatoire en liberté 3. interdiction d’exercice de la profession 4. ordonnance de restriction ou d’interdiction de communiquer avec la victime 5. révocation du permis de conduire 6. confiscation des biens Un traitement psychiatrique obligatoire et internement dans un établissement de santé et un traitement psychiatrique obligatoire en liberté doivent être imposés de manière indépendante à un contrevenant aliéné s'il n'y a pas d'autre moyen d'assurer la sécurité des personnes. En plus de ces deux mesures, le tribunal peut également imposer d'autres mesures, incluant l’interdiction d’exercice de la profession, l’ordonnance de restriction ou d’interdiction de communiquer avec la victime, la révocation du permis de conduire et la confiscation des biens. La révocation du permis de conduire et la confiscation des biens peut être ordonnée pour le délinquant, lorsqu'une peine d'emprisonnement, une peine avec sursis, ou un avertissement judiciaire a été prononcé contre lui, ainsi que dans le cas du retrait d'une peine. L’interdiction d’occuper un emploi peut être ordonnée si l'auteur de l’infraction a été condamné à une peine d'emprisonnement ou lorsqu'une telle peine a été suspendue. 5. Déchéance de droits Types de conséquences juridiques d’une condamnation : La cessation d’exercice de certaines fonctions publiques ou de fonctions officielles, ou la résiliation d'une relation de travail, ou la perte du droit de séjour en République de Slovénie, constituent la conséquence juridique se rapportant à la cessation ou à la déchéance de certains droits. Les conséquences juridiques empêchant l'acquisition de certains droits incluent: 1. interdiction d'exercice de certaines fonctions publiques ou de fonctions officielles 2. interdiction d'exercice d’une profession ou de conclusion d'un contrat de travail 3. interdiction d’obtention de certaines autorisations ou approbations accordées par écrit par des organismes d’Etat. Interdiction de conduire - une peine accessoire (pas une mesure de sécurité) : Le tribunal peut imposer une interdiction de conduire de certains types ou catégories de véhicules à moteur à l’auteur d’une infraction pénale à l’encontre de la sécurité routière en tant que conducteur d’un véhicule à moteur. La durée de la peine ne peut être inférieure à six mois et supérieure à deux ans à partir du jour où le jugement devient définitif.
