National law or case-law 1. Is in your country legislation, or other sources of law, to protect shapes of goods, packages and other 3D signs as Industrial Designs and/or as Trademarks in the Republic of Korea (South Korea)? Trademark Act, Design Act and Unfair Competition Prevention Act ("UCPA"). In particular, the well-known identifier of a product, including a 3D sign, can be protected under the UCPA, regardless of whether the famous identifier has been registered. 2. If so, what are the conditions and minimum requirements to protect them as: i) Industrial Designs • relates to features of shape (configuration), pattern, color or combination thereof • is new (novelty) • has features that appeal to and are judged by the eye • has features that are applied by an industrial process ii) Trademarks a) Special Requirements • the shape does not result from the nature of goods, and • it is not necessary to obtain a technical result. b) General Requirements • the shape must be distinctive, and must not be identical with or confusingly similar to any shape which was applied-for or registered with respect to any identical or similar goods. 1 3. Is there a specific rule that precludes Trademark protection for a shape of an object protected or previously protected as an Industrial Design or under another modality of Industrial Property (e.g., Utility Models or Patents)? No. 4. If there is no specific legal disposition under 3, can it be understood from national case law that this possibility is excluded? Yes. 5. Is it possible to accumulate protection on the same shape as an Industrial Design and as a Trademark? Yes. 6. Is it possible to claim priority of an Industrial Design in a Trademark application or vice versa, can priority of a Trademark application be claimed in an Industrial Design Application? No (Not allowed). 7. Can a shape or packaging used in combination with a word mark acquire distinctiveness through use to be protected as a 3D Trademark without the word mark? No. Only when a shape or packaging itself has acquired distinctiveness through use can it be protected as a 3D Trademark without the word mark. 8. Is there any distinction between the protection afforded by a Trademark and by a Design? In particular: 8.1 Is there a distinction on what constitutes an infringement and in the remedies available? No. An Industrial Design registration grants protection to similar goods as well as to the good itself. A criminal complaint based on design infringement, however, must be filed by an infringed design holder in order to initiate the criminal prosecution. 8.2 Is it possible to forbid the two dimensional reproduction of a 3D object protected by an Industrial Design or Trademark registration of such a 3D object? It is not possible to forbid the two dimensional reproduction of a 3D object protected by and Industrial Design. It may be possible, however, to prohibit the two dimensional reproduction of a 3D object protected by a Trademark registration. 8.3 Can the use of a sign as an Industrial Design lead to the loss of distinctivity of this sign as a Trademark, so that this sign could no longer be registered as a 2 Trademark or, if registered, cause the registered Trademark to become invalid? Yes. 8.4 What kind of measures can be taken by the proprietor to avoid that a sign loses its distinctive character as a consequence of the use of the corresponding design made by third parties? A registrant of a design conflicting with another person’s trademark rights filed prior to the date of such application for design registration shall not use the registered design without obtaining a license from the owner of the earlier trademark. Alternately, a registrant of a trademark conflicting with another person’s design rights filed prior to the date of such application for trademark registration shall not use the registered trademark without obtaining a license from the owner of the earlier design. 8.5 Any other comment you would like to make in connection with this matter, not covered above. No comments. II. Our opinion regarding the adoption of general rules on the following questions: 1. The need to establish clear criteria when a 3D object may be legally protected as an Industrial Design and as a Trademark? The scope of protection for a Trademark is broader than the scope of protection for an Industrial Design. In order to restrict the scope of protection afforded to 3D objects by Trademarks, it is necessary to establish clear criteria that permits a 3D product or package to be protected as a Trademark. 2. To make proposals to clarify these criteria and, if any, the distinction to be made between Trademarks and Designs. The current Korean Trademark Act provides that the registration of threedimensional Trademarks shall be restricted if the sign consists exclusively of: i) ii) the shape which results from the nature of the goods themselves [Art. 6 (1) (iii) ]; or the shape of the goods is necessary to obtain a technical result [Art. 7 (1) (xiii) ]. However, we are of the opinion that the following restriction should be added to the above conditions: iii) the shape gives substantial value to the goods. 3 3. To establish the circumstances when an object protected by an Industrial Design (or another modality of Industrial Property, such as utility models and patents) should also be permitted protection as a Trademark. Only when an object protected by an Industrial Design has become distinctive as a source indicator through use should the object be allowed Trademark protection. 4. The possibility to accumulate protection on the same shape, as a Trademark and as an Industrial Design. Under the above circumstances, we believe that it would be very difficult to accumulate protection on the same shape as a Trademark or as an Industrial Design. 5. Any other comments on this subject matter not covered under the above paragraphs. Not applicable. Résumé I. En ce qui concerne le droit national ou sa jurisprudence: 1. Existe-t-il une règle spécifique qui exclut la protection en tant que marque pour la forme d'un objet protège actuellement ou antérieurement comme un modèle industriel ou par une autre modalité de la propriété intellectuelle (par exemple, modèle d'utilité ou brevet)? Non. 4. S'il n'existe pas de disposition légale spécifique sous 3., la jurisprudence nationale permet-elle de déduire que cette possibilité est exclue? Oui. 5. Est-il possible de cumuler la protection de la même forme en tant que modèle industriel et marque? Oui. 6. Lors de dépôt d'une marque, est-il possible de se prévaloir de la priorité du modèle industriel, et inversement lors de la demande d'enregistrement d'un modèle industriel de se prévaloir de la priorité de la demande de marque? Non (interdit) 7. Une forme ou un emballage utilisés en combinaison avec une marque verbale peuvent-ils, grâce à leur utilisation, acquérir un caractère distinctif et être protégés comme marque tridimensionnelle sans la marque verbale? Non. Seulement quand une forme ou un emballage lui-même ont acquis un caractère distinctif grâce à leur utilisation, il peut être protégé comme une Marque tridimensionnelle sans la marque verbale. 8. Existe-t-il une distinction entre la protection accordée par une marque ou un modèle industriel? En particulier: 8.1 Fait-on une distinction dans la notion de contrefaçon, et quels sont les moyens juridiques pour lutter contre celle-ci? Non. Un enregistrement du Modèle accorde la protection aux marchandises similaires ainsi qu'à la marchandise elle-même. Une plainte criminelle basée sur l'infraction de modèle, cependant, doit être posée par un détenteur du modèle enfreint pour initier l'accusation criminelle. 8.2 Est-il possible d'interdire la reproduction en deux dimensions d'un objet tridimensionnel protégé par un modèle industriel ou par une marque enregistrée? Sans commentaires. II. Quelle est l'opinion des Groupes en ce qui concerne l'adoption de règles générales au sujet des questions suivantes: 1. Le besoin d'établir des critères clairs pour savoir si un objet tridimensionnel peut être protégé légalement comme modèle industriel et comme marque? L'étendue de protection pour une Marque de fabrique est plus large que l'étendue de protection pour un Modèle Industriel. Pour limiter l'étendue de protection offerte aux objets tridimensionnels par les Marques , il est nécessaire d'établir des critères clairs qui permettent un produit tridimensionnel ou un emballage d'être protégé comme une Marque de fabrique. 2. Faire des propositions pour clarifier ces critères et, ci c'est le cas, la distinction à faire entre les marques et modèles. L'Acte Coréen actuel de la Marque fournit que l'enregistrement de la Marque tridimensionnelle sera limité si le signe consiste exclusivement de: i) la forme qui résulte de la nature des marchandises elles-mêmes (Art. 6 (1) (iii)); ou ii) la forme des marchandises est nécessaire à obtenir un résultat technique (Art.7 (1) (xiii)). Cependant, nous estimons que la restriction suivante devrait être ajoutée aux conditions ci-dessus: 6 iii) 3. la forme donne la valeur substantielle aux marchandises. Etablir dans quelles circonstances un objet protégé par un modèle industriel(ou une autre modalité de la propriété intellectuelle, telle que les modèles d'utilité ou les brevets) devrait pouvoir bénéficier de la protection comme marque. Seulement quand un objet protégé par un Modèle Industriel est devenu caractéristique, comme une source d'indicateur par l'utilisation, il faut permettre à l'objet la protection de la Marque. 4. La possibilité d'accumuler la protection de la même forme en tant que marque et modèle industriel. Selon les circonstances ci-dessus, nous croyons qu'il serait très difficile d'accumuler la protection sur la même forme comme une Marque ou comme un Modèle Industriel. 5. Tout autre commentaire sue ce sujet qui n'aurait pas été traité ci-dessus. Ne pas applicable. Zusammenfassung I. Hinsichtlich der nationalen Rechtsprechung 1. Das Markenrecht und Modellrecht sowie dreidimensionalen Marken sollten durch das Urheberrecht geschützt werden und es sollte eine rechtsgültige Eintragung durchgeführt werden. 2. Wenn ja, welches sind die Bedingungen und Mindestvoraussetzungen sie zu schützen als: i) Modelle • Die Form eines Produktes, die Farben, die Gestaltung und mit der Kombinationen • Die Neuheiten • Kann durch die Personen unterscheidet werden. • Kann das für die technische Prozesse angewendet werden. ii) Marken a) Die speziellen Bedingungen • Die Form muss nicht aus Produkt (oder Produkteeigenschaft) kommen. • Das muss nicht für den Gewinn von technischem Effekt sein. 7 b) 3. Die allgemeine Bedingungen • Eine Form soll Unterscheidungskraft haben. Diese Form muss für die gleiche Form als Modell und als Marke nicht gleich sein. Besteht eine besondere Regel, die Markenschutz für die Form eines Gegenstandes ausschliesst, der als Modell oder unter einem anderen gewerblichen Schutzrecht (z.B. als Gebrauchsmuster oder Patent) geschützt ist oder war? Nein. 4. Wenn keine spezielle rechtliche Vorschrift im Sinne von 3. besteht, ergibt es sich aus der nationalen Rechtsprechung, dass diese Schutzmöglichkeit ausgeschlossen ist? Ja. 5. Ist es möglich, Schutz für die gleiche Form als Modell und als Marke zu kumulieren? Ja. 6. Ist es möglich, in einer Markenanmeldung die Priorität eines Modells zu beanspruchen oder kann umgekehrt die Priorität einer Markenanmeldung in einer Anmeldung für ein Modell beansprucht werden? Nein. 7. Kann eine Form oder Verpackung, die zusammen mit einer Wortmarke benutzt wird, Unterscheidungskraft durch Benutzung erlangen, um als dreidimensionale Marke ohne die Wortmarke geschützt zu werden? Nein. Wenn eine Form als Modell und als Marke die Unterscheidungskraft durch Benutzung erlangen wird, kann eine dimensionale Marke ohne die Wortmarke geschützt werden. 8. Besteht ein Unterschied zwischen dem durch eine Marke und durch ein Modell gewährten Schutz? Insbesondere: 8.1 Besteht ein Unterschied darin, worin eine Verletzung besteht und welche Rechtsmittel zur Verfügung stehen? Nein. Die Eintragung des Musterschutzes steht zur Verfügung über die gleiche Ware und ähnliche Waren. 8.2 Ist es möglich, eine zweidimensionale Darstellung eines dreidimensionalen Gegenstandes zu verbieten, der durch ein Modell oder eine Markeneintragung geschützt ist? Es ist möglich, eine zweidimensionale Darstellung eines dreidimensionalen Gegenstandes zu verbieten, der durch ein Modell geschützt ist und aber eine Markeneintragung nicht geschützt ist. 8 8.3 Kann die Benutzung eines Zeichens als Modell zum Verlust der Unterscheidungskraft dieses Zeichens als Marke führen, so dass dieses Zeichen nicht länger als Marke eingetragen werden könnte oder, wenn es eingetragen ist, dies dazu führen könnte, dass die Marke löschungsreif wird? Ja. 8.4 Welche Massnahmen kann der Markeninhaber ergreifen um zu vermeiden, dass ein Zeichen infolge der Benutzung eines entsprechenden Modells durch Dritte seine Unterscheidungskraft verliert? Man muss das Einverständnis von Markeninhaber haben. II. Welcher Auffassungen sind die Gruppen zur Annahme von allgemeinen Regeln zu den folgenden Fragen 1. Die Notwendigkeit, klare Kriterien dafür aufzustellen, wann ein dreidimensionaler Gegenstand rechtlich als Modell oder als Marke geschützt werden kann. Der Schutzumfang als Marke ist grösser als das Modell. Um den Bereich des dreidimensionalen Markenschutzes zu begrenzen, muss der Massstab von Marken über die dreidimensionalen Gegenstände und Verpackung klar machen. 2. Vorschläge zur Klärung dieser Kriterien und gegebenenfalls zwischen Marken und Modellen zu treffenden Unterscheidung zu machen. Die dreidimensionalen Marken im koreanischen Markenrecht müssen unter anderem folgende Bedingungen erfüllen, z.B. dass die Form: • sich nicht aus der Natur der Ware ergibt, • nicht notwendig ist, technisch zu erzielen • der Waren keinen wesentlichen Wert verleiht. 3. Die Umstände festzulegen, wann es für einen Gegenstand, der durch ein Modell (oder ein anderes gewerbliches Schutzrecht, wie ein Gebrauchsmuster oder ein Patent) geschützt ist, auch möglich sein soll, als Marke geschützt zu werden. Im Falle des Schutzes von Formen und Verpackungen als Marken ist es erforderlich, dass der zu schützende Gegenstand unterscheidungsfähig sein muss. 4. Die Möglichkeit, Schutz der gleichen Form als Marke und als Modell zu akkumulieren. Unter diesen Situationen ist Schutz der gleichen Form als Marke und als Modell nicht möglich. 5. Jeder andere Kommentar hierzu, der nicht von den obigen Paragraphen abgedeckt ist. Kein weiterer Kommentar. 9
