ANNEXE Décision du CCNR 11/12-1648 TV5 concernant Le sexe autour du monde (« Japon ») La plainte Le 27 mars 2012, le CCNR a reçu la plainte suivante par l’entremise de son formulaire Web : station : TV5 émission : Le sexe autour du monde/Japon date : March 27, 2012 heure : 7:00 - 8:00 pm préoccupation : Inappropriate programming for this time slot; contains sexually explicit material/coarse/offensive language intended for adult audiences. Not sure if there was a viewing advisory at the beginning of the program, but that is irrelevant when switching channels and doesn't help when tuning in to program half way through. Only saw a few minutes of programming but found scenes of nudity and/or sexual activity and material that was degrading to women. La réponse du télédiffuseur TV5 a répondu à la plaignante le 5 avril : We have received your complaint of March 27 concerning the documentary Le sexe autour du monde (Sex around the world) which appeared on TV5 Québec Canada. May we say, first of all, that we are very sorry if you were shocked by the broadcast of the “Japan” episode. This documentary series explores the ways in which sexuality is experienced all over the world, lifting the veil on particular aspects of sexual practices, relationships and feelings of love in general, in certain regions. In compliance with the Canadian Association of Broadcasters’ Code of Ethics, section 11 (Viewer Advisories), we presented viewer advisories at 9:00 pm, 9:14 pm, 9:30 pm and 9:47 pm. We take all feedback from our viewers very seriously, and we thank you for taking the time to write to us. 1 2 Correspondance additionnelle Le 11 avril, la plaignante a déposé sa demande de décision avec la note suivante : The broadcaster has not addressed any of the concerns that the material is degrading to women (e.g. one woman stubbing out her cigarette on the tongue of another woman), the depiction of sexual slaves/human trafficking degrading to women. The broadcaster claims to be in compliance with the Canadian Association of Broadcasters’ Code of Ethics, section 11 (Viewer Advisories), by presenting viewer advisories at 9:00 pm, 9:14 pm, 9:30 pm and 9:47 pm, but the broadcast was aired between 7:00 pm to 8:00 pm. Even with viewer advisories, this is too early to be broadcasting sexually explicit material. The fact that the entire program deals with sexually explicit material, the content of the program as described by the broadcaster to contain "ways in which sexuality is experienced" and "particular aspects of sexual practices" suggests that the 7:00 time slot is not appropriate for this "documentary".
