Monsieur le Ministre, A la date d’aujourd’hui, vous avez bien voulu, avec le chargé d’affaires de Grèce à La Haye, me remettre, conformé ment à l’article 40 du Statut de la Cour, la copie dûment certifiée conforme d’un compromis d’arbitrage conclu le 15 juillet 1931 entre le Gouvernement de la République française et le Gouvernement de la République hellénique et portant devant la Cour permanente de Justice internationale la question de savoir si le contrat du ier/14 avril 1913 entre l’Administration générale des Phares de l’Empire ottoman et le Gouvernement ottoman est dûment intervenu et, partant, opérant vis-à-vis du Gouvernement hellénique en ce qui concerne les phares situés sur les territoires qui lui furent attribués à la suite des guerres balkaniques ou postérieurement. Vous voudrez bien trouver ci-joint un exemplaire du reçu officiel de ce compromis, dont l’autre exemplaire est destiné au chargé d’affaires de Grèce à La Haye. Je n’ai pas manqué de prendre bonne note du fait, inscrit à l’article 6 du compromis, qu’aux fins de la présente affaire le Gouvernement français et le Gouvernement hellénique élisent domicile au siège de leurs légations respectives à La Haye. D’autre part, j ’ai pris bonne note que vous remplirez, à titre provisoire, les fonctions d’agent du Gouvernement français près la Cour. J ’ai de même noté la déclaration analogue du chargé d’affaires de Grèce. J ’aurai l’honneur de porter à votre connaissance dès que faire se pourra, après la désignation des agents des deux Gouvernements conformément à l’article 35 du Règlement, les délais pour le dépôt des pièces de procédure écrite, délais qui pourront être fixés en tenant compte des propositions énoncées à l’article 3 du compromis. A ce propos, j ’ai pris note de l’interprétation que le chargé d’affaires de Grèce et vous-même avez bien voulu donner, lors de notre entretien, de cet article 3, et portant que le Gouvernement français et le Gouvernement hellénique, en envisageant seulement le dépôt de mémoires et de contre-mémoires, ont entendu renoncer en ce qui les concerne au dépôt des répliques prévues à l’article 39 du Règlement de la Cour. [Translation.] The Hague, May 23rd, 1933. Monsieur le Ministre, You have to-day been good enough, together with the Chargé d’affaires of Greece at The Hague, to hand me, pur suant to Article 40 of the Court’s Statute, a duly certified true copy of a Special Agreement for arbitration concluded on July 15th, 1931, between the Government of the French Republic and the Government of the Greek Republic sub mitting to the Permanent Court of International Justice the question whether the contract of April ist/i4th, 1913, between the “Administration générale des Phares de l’Empire ottoman” and the Ottoman Empire was regularly concluded and is accordingly operative as against the Greek Government in so far as concerns lighthouses situated in territories assigned to th at Government after the Balkan wars or subsequently. You will find herewith a copy of the official receipt for this Special Agreement, the other copy being destined for the Greek Chargé d’affaires at The Hague. I have duly noted the fact mentioned in Article 6 of the Special Agreement that, for the purposes of the present case, the French Government and the Greek Government have selected as their addresses their respective Legations at The Hague. I have also noted that you will, provisionally, act as Agent for the French Government before the Court. I have similarly noted the corresponding announcement made by the Greek Chargé d’affaires. I shall have the honour to notify you as soon as possible, after the appointment of the Agents of the two Governments pursuant to Article 35 of the Rules, of the timedimits for the filing of the documents of the written proceedings, which may be fixed having regard to the proposals formulated in Article 3 of the Special Agreement. In this connection, I have noted the interpretation which the Greek Chargé d’affaires and yourself were good enough, in the course of our conver sation, to give of this Article 3, namely, that the French and Greek Governments, since they only mention the filing of Cases and Counter-Cases, intend, in so far as they are con cerned, to waive their right to file the replies provided for by Article 39 of the Rules of Court. [Translation by the Registry.'] The Greek Legation presents its compliments to the Registrar of the Permanent Court of International Justice and has the honour to inform him that the Greek Government has appointed M. Séfériadès, Professor of the University of Athens, as judge, and M. Tryfon Triantafyllakos, Chargé d’affaires of Greece at The Hague, as its Agent, in the case th a t has been submitted to the Court in accordance with the Special Arbitration Agree ment concluded on July 15th, 1931, between the Government of the French Republic and the Government of the Greek Republic. The Hague, June 7th, 1933. III.—LETTER FROM THE FRENCH MINISTER AT TH E HAGUE TO THE REGISTRAR OF TH E COURT. The Hague, July 27th, 1933. [Translation by the Registry.] Sir, With reference to your letter of June 6th last, I hasten to inform you that, in virtue of a decision dated the 13th instant, M. Basdevant, legal adviser to the Ministry for Foreign Affairs, has been appointed Agent of the French Government before the Permanent Court of International Justice in the Franco-Greek dispute concerning the concession for the light houses of the Ottoman Empire. I have, etc. (Signed) V i t r o l l e s . 6 IV. — COMPROMIS D’ARBITRAGE CONCLU ENTRE LE GOUVERNEMENT DE LA RÉPUBLIQUE FRANÇAISE ET LE GOUVERNEMENT DE LA RÉPUBLIQUE HELLÉNIQUE. Le Gouvernement de la République française et le Gouver nement de la République hellénique, Considérant qu’entre la Société française en nom collectif Collas & Michel, dite « Administration générale des Phares de l’Empire ottoman », et le Gouvernement de la République hellénique s’est élevée une contestation portant sur la validité à l’égard de la Grèce du contrat de prorogation de concession intervenu entre ladite société et l’ex-Empire ottoman le i er/i4 avril 1913 ; Considérant que les démarches faites par le Gouvernement de la République française en vue de faire reconnaître par le Gouvernement de la République hellénique la validité dudit contrat de prorogation n’ont pas abouti, et qu’en conséquence du refus opposé au Gouvernement de la République française de donner satisfaction à l’Administration des Phares, il existe à ce sujet un différend entre les deux Gouvernements ; Considérant, par ailleurs, que la Société Collas & Michel et le Gouvernement de la République hellénique sont en désac cord au sujet de diverses réclamations pécuniaires se rappor tant à la concession précitée ; Sont tombés d’accord pour soumettre le différend dont il s’agit à la Cour permanente de Justice internationale et les réclamations pécuniaires en question à un tribunal arbitral, et à cette fin ont désigné pour leurs plénipotentiaires, savoir : Le Président de la République française : Monsieur Aristide B r i a n d ; Le Président de la République hellénique : Monsieur Nicolas P o l i t i s , qui, après avoir échangé leurs pleins pouvoirs reconnus en bonne et due forme, sont convenus du compromis ci-après : Ch a p it r e pr e m ie r . Article premier. — La Cour permanente de Justice interna tionale sera priée de statuer sur la question de savoir si le contrat intervenu le i cr/i4 avril 1913 entre la Société fran çaise en nom collectif Collas & Michel, dite « Administration générale des Phares de l’Empire ottoman », et le Gouverne ment ottoman, portant prorogation du 4 septembre 1924 au 4 septembre 1949 des contrats de concession consentis à ladite société, est dûment intervenu et partant est opérant vis-à-vis du Gouvernement hellénique en ce qui concerne les phares situés sur les territoires qui lui furent attribués à la suite des guerres balkaniques ou postérieurement. Article 2. — Le présent compromis sera, dès l’échange des ratifications, notifié au Greffe de la Cour permanente de Justice internationale par l’une ou l’autre des Parties. 7 IV.—SPECIAL AGREEMENT FOR ARBITRATION CONCLUDED BETWEEN THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE GOVERNMENT OF THE GREEK REPUBLIC. [Translation by the Registry.~\ The Government of the French Republic and the Govern ment of the Greek Republic, Whereas a dispute has arisen between the French firm Collas & Michel, known as the “Administration générale des Phares de l ’Empire ottoman’, and the Government of the Greek Republic concerning the validity as against Greece of the contract concluded between the said firm and the former Ottoman Empire on April ist/i4 th , 1913, extending the exist ing concession ; Whereas the representations made by the Government of the French Republic with a view to obtaining from the Govern ment of the Greek Republic recognition of the validity of the said contract extending the concession have proved fruitless, and as in consequence of the refusal to give satisfaction to the Administration of Lighthouses encountered by the Government of the French Republic, a dispute on this subject exists between the two Governments ; Whereas, furthermore, the firm Collas & Michel and the Government of the Greek Republic disagree in regard to various pecuniary claims connected with the concession above men tioned ; Have agreed to submit the dispute in question to the Permanent Court of International Justice and the pecuniary claims mentioned to an arbitral tribunal, and to this end have appointed their Plenipotentiaries as follows : For the President of the French Republic : Monsieur Aristide B r i a n d ; For the President of the Greek Republic : Monsieur Nicolas P o l i t i s , who, having exchanged their full powers found to be in good and due form, have agreed on the terms of the following Special Agreement : C h a p te r I. Article 1.—The Permanent Court of International Justice shall be requested to give its decision upon the question whether the contract concluded on April ist/i4 th , 1913, between the French firm Collas & Michel, known as the “Administra tion générale des Phares de l’Empire ottoman", and the Otto man Government, extending from September 4th, 1924, to September 4th, 1949, concession contracts granted to the said firm, was regularly concluded and is accordingly operative as regards the Greek Government in so far as concerns light houses situated in the territories assigned to it after the Balkan wars or subsequently. Article 2.—The present Special Agreement shall be notified to the Registry of the Permanent Court of International Justice by either Party as soon as ratifications have been exchanged. Article 3. — Les Hautes Parties contractantes sont d’accord pour proposer à la Cour permanente de Justice internationale, agissant conformément à l’article 48 de son Statut et à l’ar ticle 33 de son Règlement, de fixer à trois mois à compter de la date déterminée dans l’ordonnance rendue par la Cour à cet effet (le délai imparti au Gouvernement de la République française et au Gouvernement de la République hellénique) pour présenter leurs mémoires respectifs exposant leurs vues sur la question et en formulant leurs conclusions, et à trois mois à dater du dépôt desdits mémoires pour le dépôt de leurs contre-mémoires en réponse en y formulant, s’il y a lieu, leurs conclusions complémentaires. Article 4. — Les Hautes Parties contractantes sont d ’accord pour que toute la procédure ait lieu en français. Article 5. — Pour tout ce qui n ’est pas prévu par le pré sent compromis, les dispositions du Statut et du Règlement de la Cour permanente de Justice internationale seront appli quées. Article 6. — Les Hautes Parties contractantes élisent domi cile au siège de leurs légations respectives à La Haye. Ch a p it r e second. Article 7. — Aussitôt le prononcé de l’arrêt de la Cour permanente de Justice internationale relatif à la question visée à l’article premier, toutes réclamations pécuniaires de la Société Collas & Michel contre le Gouvernement hellénique, et du Gouvernement hellénique contre ladite société, feront l’objet d’un règlement à convenir entre le Gouvernement hellé nique et la Société Collas & Michel. Il en sera de même pour la fixation de l’indemnité de rachat de la concession au cas où le susdit arrêt reconnaîtrait que le contrat du i er/i4 avril 1913 est dûment intervenu. A défaut d’entente dans le délai d’un an, ces questions seront soumises à un tribunal arbitral, composé de trois mem bres nommés l’un par le Gouvernement français, l’autre par le Gouvernement hellénique, le troisième membre, qui assumera la présidence, étant désigné d’un commun accord par les deux Gouvernements ou, à défaut d’accord, par le Président de la Cour permanente de Justice internationale. Ce tribunal siégera à La Haye. Le Gouvernement hellénique et la Société Collas & Michel jouiront d’un délai de trois mois, à compter de la constitution dudit tribunal, pour lui présenter leurs réclamations et les mémoires qu’ils jugeront utile de produire à l’appui. Un délai de trois mois leur sera accordé, à compter de l’expiration du premier délai, pour la production de leurs contre-mémoires. La procédure devant ce tribunal aura lieu en français. Pour le surplus, le tribunal se conformera aux règles de la procédure arbitrale insérées au chapitre III du titre IV de la Convention pour le règlement pacifique des conflits interna tionaux signée à La Haye le 18 octobre 1907. 9 Article 3.—The High Contracting Parties agree to propose, pursuant to Article 48 of the Statute of the Court and to Article 33 of the Rules of Court, that the Permanent Court of International Justice shall fix a period of three months as from the date fixed in the Order made by the Court for the purpose (the time-limit granted to the Government of the French Republic and to the Government of the Greek Repub lic) for the presentation of their respective Cases setting out their views on the question and formulating their submissions, and a period of three months as from the date of filing of these Cases for the presentation of their Counter-Cases in reply, in which, if necessary, they shall formulate any addi tional submissions. Article 4.—The High Contracting Parties agree th a t whole of the proceedings shall be conducted in French. the Article 5.—In. regard to any point not provided for in the present Special Agreement, the provisions of the Statute and Rules of the Permanent Court of International Justice shall be applicable. Article 6.—The High Contracting Parties select as addresses their respective Legations at The Hague. C h a p te r their II. Article 7.—As soon as the judgment of the Permanent Court of International Justice on the question referred to in Article 1 has been delivered, all pecuniary claims of the firm Collas & Michel against the Greek Government and of the Greek Gov ernment against the firm, shall form the subject of a settlement between the Greek Government and the firm Collas & Michel. The same shall apply as regards the fixing of the sum payable for the redemption of the concession, should the judgment above mentioned declare the contract of April ist/i4 th , 1913, to have been regularly concluded. Failing an agreement within one year, these questions shall be submitted to an arbitral tribunal, consisting of three members appointed as follows : one by the French Govern ment, one by the Greek Government, the third member, who shall act as president, being appointed by mutual agreement between the two Governments or, failing such agreement, by the President of the Permanent Court of International Justice. This tribunal shall sit at The Hague. The Greek Government and the firm Collas & Michel shall have a period of three months, as from the constitution of this tribunal, within which to submit to it their claims and any Cases which they may see fit to present in support thereof. As from the expiration of the first time-limit, they shall be granted a further period of three months for the production of their Counter-Cases. The proceedings before this tribunal shall be conducted in French. For the rest, the tribunal shall conform to the rules for proceedings by arbitration in Chapter III of Part IV of the Convention for the Pacific Settlement of International Disputes, signed at The Hague on October 18th, 1907. 10 Article 8. — Le présent compromis sera ratifié et les rati fications seront échangées à Paris aussitôt que faire se pourra et entrera immédiatement en vigueur. II Article 8.—The present Special Agreement shall be rati fied and ratifications shall be exchanged at Paris as soon as possible ; whereupon the Special Agreement shall come into force immediately.
