INTRODUCTION
Les traités multilatéraux ont du sens dans un monde globalisé. Ils apportent un cadre
juridique. Ils ont apporté à notre profession les arguments pour la libéralisation des
services. Sujet de discussion s’il en est.
L’Organisation Mondiale du Commerce (l’OMC) travaille pour une économie
mondialisée ouverte. Les services juridiques ont été inclus dans les nouvelles
négociations sur les services, qui ont commencé en janvier 2000. La Profession
d’Avocat a été incluse dans les négociations sur les services d'affaires. Ces négociations
incluent le conseil et la représentation juridique (pour le droit du pays d'accueil, du pays
d’origine et/oú d'un pays tiers, aussi bien que pour le droit international),
la documentation juridique et la certification.
La Directive Européenne sur les services aborde un grand nombre d’obstacles qui
bloquent ou freinent le développement des services entre les Etats Membres.
La Directive sur les services dans le marché intérieur a été adoptée par le conseil
de l’Union Européenne et le Parlement Européen en fin d’année 2006. Cette
Directive devra être transposée par les Etats Membres à la fin de l’année 2009.
Tout ceci nous permet d’aborder dans ce séminaire des questions primordiales,
comme la réglementation par l’Etat de notre profession, et l’indépendance du
Barreau.

The European Services Directive addresses the large number of barriers which are
preventing or slowing down the development of services between Member States. The
Directive on Services in the internal market was adopted by the European Parliament
and the Council in December 2006. It will have to be transposed by the
Member States by the end of 2009.

The World Trade Organisation has been striving for a global open economy. Legal
services are included in the new services negotiations, which began January 2000. The
legal profession has been incorporated into the business services discussions. The
negotiations include advisory and representations services for host country law, home
country and/or third country law, international law, legal documentation and
