An Examination of the Private International Law Tradition of the Commonwealth: David McClean David McClean, professeur à l’Université de Sheffield, procède dans ce cours à l’examen de la tradition du droit international privé des pays appartenant au Commonwealth. Les États du Commonwealth partagent une même tradition juridique, sont au bénéfice d’un courant particulier de l’histoire du droit, la tradition de la Common Law telle qu’elle a été développée en Angleterre. Le Professeur McClean se demande dans ce cours si dans la situation actuelle cette tradition commune existe toujours. Pour répondre à cette question, l’auteur s’intéresse successivement à l’existence d’un héritage commun, à la question du domicile, à différents aspects de l’expérience du Commonwealth en matière de compétence et à la question de la rencontre du fédéralisme et du droit international privé. A Common Inheritance? An Examination of the Private International Law Tradition of the Commonwealth: David McClean In his course of lectures, David McLean, Professor at the University or Sheffield, examines the private international law tradition of the countries that belong to the Commonwealth. The Commonwealth countries share the same legal tradition and stand in a particular stream of legal history: the Common Law tradition as it was developed in England. Professor McClean asks himself in this course if this common tradition still exist today. To reply to this question, the author highlights the following topics: the existence of a common heritage, the story of domicile, the different aspects of Commonwealth experience in jurisdiction, and the question of the meeting of federalism and Commonwealth private international law. The Contribution of International Trade Law to the Development of International Law: Donald M. McRae Le cours de Donald M. McRae, professeur à l’Université d’Ottawa, a pour objet la relation entre le droit international et le droit du commerce international. Le Professeur McRae s´intéresse à la manière dont les spécialistes du droit international perçoivent le domaine du droit du commerce international et à la pertinence des concepts et des procédures de base du droit du commerce international par le droit international général. Il s’intéresse également aux conflits qui ont surgi entre le droit du commerce international et certaines branches du droit international. Le Professeur McRae analyse ainsi successivement la relation traditionnelle entre droit du commerce international et droit international, les fondements économiques juridiques du droit du commerce international et du droit international, les concepts et institutions du droit du commerce international et leur relation avec le droit international, les conflits surgissant entre droit du commerce international et droit international. The Contribution of International Trade Law to the Development of International Law: Donald M. McRae The object of this course by Donald M. McRae, Professor at the University of Ottawa, is to investigate the relationship between international law and international trade law. Professor McRae is interested in the way how the field of international trade law is perceived by international lawyers and in the relevance of basic concepts and procedures of international trade law to the general field of international law. Areas of conflict that have arisen between international trade law and particular branches of international law are also discussed in this course. In the different sections of his course, Professor McRae focuses on the traditional relationship between international trade law and international law, the economic and legal foundations of international trade law and international law, the concepts and institutions of international trade law and their relationship with international law, and the emerging conflicts between international trade law and international law. La Conservation et la gestion des Ressources de l’Antarctique: Francesco Francioni Au cours des vingt dernières années, relève Francesco Francioni, professeur à l’Université de Sienne, le système juridique de l’Antarctique a subi une évolution remarquable sans que l’instrument constitutif originaire, le traité de Washington de 1959 ne subisse de modification. Dans un premier chapitre, le professeur Francesconi présente ce traité ainsi que le droit international en matière de conservation des ressources. Le deuxième chapitre du cours du professeur Francesconi est consacré aux ressources exploitables, le troisième aux ressources interdites et le quatrième aux ressources intangibles. Le cinquième chapitre a pour objet la responsabilité pour les dommages causés aux ressources de l’Antarctique. Antarctic Conservation and Resource Management: Francesco Francioni Over the past twenty years the legal system of the Antarctic has undergone a remarkable evolution. At the same time, the originating instrument, the treaty of Washington of 1959, has not undergone any modifications. Francesco Francesconi, Professor at the University or Sienna, starts his course by presenting the Treaty, and international law with respect to the field of the conservation of resources. The second chapter addresses the exploitable resources, the third chapter the prohibited resource exploitations, and the fourth the intangible resources. The fifth chapter is devoted to the question of responsibility for damage to the Antarctic resources.
