2. Communication services
A. Postal services (CPC 7511) and B Courier services (CPC 7512)
Remarques: L’UE n’a pas pris d’engagements pour le sous-secteur “Postal
services”. Pour le sous-secteur “Courier services”, seule l’Autriche a pris des
engagements pour “special delivery services” (part of CPC 7512).
Canada:
Request: 2 B. Commercial courier services, including by public transport or
self-owned transport (CPC 75121*)
- modes 1 and 2 (MA+NT) and mode 3 (NT): take full commitments;
- mode 3 (MA): take commitments to fully bind existing regime.
USA/
Request:
- take MA and NT commitments for “express delivery services” (see
definition);
Note: Express delivery services do not include services supplied in the
exercise of government authority (GATS Art. I: 3);
- take MA commitments for those services on the “checklist” (services
performed in connection with: express delivery, which are classified
elsewhere in W/120, including part 2A (express delivery services
performed by postal administrations) and other services in relation with
transport services.
Note: commitments would be listed in express delivery sector with crossreferences to other classifications.
- Undertake additional commitments to address certain cross-subsidization
of express delivery services by revenues derived by government-granted
monopoly services.
Brésil:
Request: take full MA and NT commitments for “Postal services” (CPC 7511
+ 7512).
Note: the States Parties to Mercosur propose the integration of “courier”
services into postal services under the single heading of “Postal Services”.
Uruguay: même requête que le Brésil.
Singapour:
Request: courier services, including express letters (CPC 7512):
- take full commitments for modes 1, 2, 3 ;
- “unbound except as indicated in the horizontal section” for mode 4
(MA+NT).
Nouvelle-Zélande:
Request: CPC 7511 + 7512, including sub-sectors identified in NZ’s
S/CSS/W/115 et EC’s S/CSS/W/61: take full MA and NT commitments in
modes 1, 2, 3 and in mode 4 as requested in the horizontal section.
B. Telecommunication services
Brésil:
Request:
- eliminate horizontal restrictions (1) publics utilities, public monopolies,
exclusive rights; (2) treatment accorded to subsidiaries of third-country
companies);
- mode 4 (MA+NT): take full commitments;
- additional commitments, Belgium: eliminate restriction (“Licensing
conditions may address the need to guarantee universal service, …”).
USA
Remarque : voir les définitions des services de télécommunication de base et
des services à valeur ajoutée. Notons que les 1ers sont énumérés
limitativement tandis que les 2èmes sont énumérés de façon non limitative.
Request:
- remove any existing MA and NT limitations for any member states;
- make commitments in the other communication sectors listed above.
Japon
Request:
- all telecommunication services: include the “period of time required for
interconnection” as one of the conditions that need to be described in the
RIO (Mode 3, MA);
- value-added services: take MA and NT commitments in all sub-sectors.
Chine
Request: take commitments value-added telecommunication services, foreign
ownership no less than 50% shall be permitted (?)
Canada
Request: value-added services: clarify commitments by referring to
corresponding CPC codes.
Singapour
Request:for telecommunication services described in document W/120 (2Ca to
2Co), take full commitments for modes 1, 2, 3 and “unbound as indicated in
the horizontal section” for MA and NT in mode 4.
Australie
- remove all MA limitations for modes 1 and 3;
- make a commitment (Art. XVIII), clarifying the implementation of the
reference paper;
- make a commitment (Art. XVIII) clarifying that:
- the “packet-switched data transmission services” include all packetswitched network services necessary to transmit data between
equipment using the same or different protocols, in particular “Data
network services “ (CPC 75321).
- Services necessary to transmit the data via a public network can
include numbering, naming and routing services;

these numbering, naming and routing services can be inherent to the
transmission and do not introduce any end-to-end change in form or
content of data;
Internet delivery services are an example of “Packet-switched data
transmission service” that meets the above conditions; and
that the Reference Paper on Basic Telecommunications therefore
applies to Internet delivery services.
Corée
Request:
- value-added services: make full commitments in (1) enhanced/value-added
facsimile services and (2) on-line information an/or data processing;
- Basic telecom services: Belgium: remove all the restrictions on
commercial presence;
- additional commitments: delete the commitments of Belgium with regard
to licensing conditions to address the need to guarantee universal service,
which are compatible with the reference paper;
- request for clarification
- explain the definition and scope of “domestic and International”
services (Basic telecom services);
- clarify the necessity of footnotes (6) and (7) in the reference paper.
Mexique
Request:
- services à valeur ajoutée: prendre des engagements sans restrictions
dans le mode 3 (AM) et mode 4 (MA & NT) ;
- tous les autres secteurs :supprimer toutes les restrictions mode 1 (MA),
mode 3 (MA), mode 4 (MA & NT).
C. Audiovisual services
Remarque : l’UE n’a pas pris d’engagements pour ce secteur et a pris des
exemptions NPF.
USA
Request:
1. take commitments that reflect the current level of MA, with respect to
modes 1, 2 and 3 in the following sub-sectors (voir liste USA);
2. make commitments in modes 1, 2 and 3 addressing quantitative or other
restrictions based on foreign content on the supply of audiovisual services
and services supplying audiovisual products.
Brésil
Request
1. take full MA and NT commitments for all sub-sectors (see W/120);
2. eliminate the following MFN exemptions: 1 and 2.
Taïwan
Request
1. make full MA and NT commitments to this sector in modes 1, 2, 3;
2. mode 4: make commitments as indicated in the horizontal section.
Uruguay
Request: for CPC 9611, 9612 and 9619 (autres services de spectacle): take full
commitments in modes 1, 2, 3 and in mode 4 as indicated in the horizontal
section.
Nouvelle-Zélande
Request: for CPC 96114 (other services in connection with motion picture and
video tape production and distribution) and CPC 9612 (Motion picture
projection services: schedule full MA and NT commitments in modes 1, 2, 3
and in mode 4 as requested in the horizontal section.
Corée: CPC 9611 and sound recording:
- make full commitments for all sectors of these services;
- modes 1, 2, 3: full MA and NT commitments;
- mode 4: commit as referred in the horizontal section.
Chine
a) motion picture and video tape production services
mode 3:
MA: Foreign service suppliers are allowed to produce motion pictures and
radio and TV programs in cooperation with domestic producers;
NT: Schedule “none”
b) Cinema theatre services and motion picture projection services
Mode 3:
MA: Foreign services, suppliers will be permitted to establish joint
ventures with foreign majority ownership to construct and/or renovate
cinema theatres and engage in projection services
NT: schedule “none”
Japon
CPC 9611, CPC 9612 and Sound recording (n.a.)
- take MA and NT commitments in modes 1 and 3;
- some regulations necessary for the maintenance of cultural identity or
cultural diversity are acceptable (inscribed in the schedule);
- eliminate quantitative restrictions on the number of imported motion
pictures and on the hours of projection;
- eliminate discriminatory subsidies against foreign services suppliers;
- eliminate quantitative restrictions on broadcasting hours of foreign motion
pictures and video tapes;
- eliminate MFN exemptions where there are references to future measures;
- provide detailed information on
a. MFN exempted measures based on co-production agreements (see
details);
b. the supporting program which is listed on the MFN exemption list (see
details).
