One of these changes concerns the Insurance Contract Law of 2 April 1908, which applies to direct insurance (i.e. not to reinsurance) and requires insurers to provide insureds with precontractual information. As a result of this, the NMA 2242 General Conditions have been re-written and re-named in English, NMA 2242A en, French: NMA 2242A fr, and German: NMA 2242A ge, and are attached to this bulletin. For detailed guidance as to their purpose, and reason for amendment, please refer to the market bulletins above. There is some precontractual information (such as information on the insurer's identity or on data protection) that is standard and can be provided comprehensively for all contracts and types of insurance. This general information has been included in the new wording NMA 2242A which should be included in every contract of Lloyd's Swiss contract. The wording contains nine basic provisions which are stated as having overriding power over any other contractual provisions unless explicitly stated otherwise. As regards the contract-specific or class-specific precontractual information we ask you to please refer to market bulletin Y3887 (Appendix 1, page 5, point 6). The Underwriters and contractual partners of the Policyholder (hereafter: “the Policyholder”) are underwriting members of the association of underwriters known as Lloyd’s (hereafter: "the Underwriters"), having the following domicile, address and legal form: Lloyd's One Lime Street London EC3M 7HA United Kingdom Lloyd's Versicherer, London Head office: London / United Kingdom Zweigniederlassung für die Schweiz Legal form: Association of Underwriters Seefeldstrasse 7 8008 Zurich Switzerland B. The insurance contract is concluded with the assistance of the Lloyd's Broker. These are independent insurance intermediaries in the sense of Swiss legislation. C. The insurance contract includes among other things the following General Conditions, which contain nine separate provisions. The Policyholder is therefore explicitly requested and required to read carefully through the following information and the nine mainly short and easily understandable provisions. These refer inter alia to the following: Number 1 deals with the general exclusions namely war and hostilities as well as certain losses resulting from ionising or radioactive radiation and in connection with nuclear installations or processes. In these cases the contract offers no insurance coverage. Number 2 requires, in accordance with the Swiss Federal Law concerning the Insurance Contract that the written questions of the Underwriters in connection with the insurance proposal must be answered truthfully. A breach of this duty may lead to the cancellation of and to the loss of rights under the insurance contract; here it should be noted that breaches of duty committed up to 31 December 2005 shall be judged in accordance with the (for the Policyholder or Insured) stricter law (withdrawal from the contract, forfeiture of premium) applying hitherto. Numbers 3 and 4 outline individual obligations or duties, which must be observed by the Policyholder or Insured following the occurrence of a loss. A breach of these may entail a loss of entitlement to indemnity. Number 5 sets out the addresses of the Underwriters to which notices are to be sent by the Policyholder or Insured or the addresses of the Policyholder or Insured to which notices are to be sent by the Underwriters, so that these may have the foreseen effect in a timely manner. Changes of address must be reported without delay. Number 6 is linked with Number 3 und stipulates the time and place for the payment of claims as well as the preconditions for these becoming due and to be able to be made against the Underwriters. Numbers 7 and 8 explain how and where a possible legal action can be directed against the Underwriters. Number 9, finally, refers to the provisions of the Swiss Federal Law concerning the Insurance Contract, which always then apply, should the relevant insurance contract establish no provisions to the contrary (for example in the General Conditions or in the Special Conditions). D. Lloyd’s makes two data collections (client data and claims data) in connection with the processing of the insurance contract. The client data serve as evidence of whether an insurance is in existence at Lloyd's. The claims data serve the adjustment of claims. The parties which receive the data are the respective Lloyd’s Brokers and the Underwriters; in the event of a claim, potentially also the loss adjusting firm appointed by the Underwriters and, as the case may be, the Swiss Lloyd's UVG Claims Office. The data may only be passed on to other third parties with the agreement of the party or parties so affected or based on a law. The data are stored in part electronically, in part in paper form and are destroyed after ten years. E. IMPORTANT NOTICE: The definitive wording is exclusively and only that of the nine named provisions themselves; the pre-contractual information does not form part of the contract. -2- GENERAL CONDITIONS The following General Conditions form part of the insurance contract concluded with the Underwriters. They all override all other provisions of this contract which state differently unless individual of these General Conditions have been explicitly amended in the other contractual documentation or have been marked as being not applicable. 1. EXCLUSIONS This insurance does not cover: 1.1 any loss directly or indirectly occasioned by the following events: war, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, confiscation, nationalisation, requisition, destruction of or damage to property by or under the order of any Government or Public or Local Authority. 1.2 (a) damage to any property whatsoever as well as any loss or expense resulting or arising therefrom and any consequential loss (b) any legal liability of whatsoever nature directly or indirectly caused by or contributed to by or arising from: (i) ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, (ii) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof. 2. NON-DISCLOSURE 2.1 Acts of non-disclosure committed from 1 January 2006 If the Policyholder or any person (or firm) insured hereunder shall have made upon conclusion of this insurance a false declaration of a material fact which he knew or ought to have known and about which he has been asked in writing, or if he omitted to declare such fact, the Underwriters shall in accordance with Article 6 of the Federal Law concerning the Insurance Contract be entitled to cancel the contract by a written declaration within four weeks of such false declaration or omission coming to their knowledge. The Underwriters shall in such event be freed also from all duty to indemnify losses already incurred whose occurrence or scope has been influenced by the omission to declare or the false declaration of the material fact. Insofar as the Underwriters may have already indemnified a loss or losses they shall be entitled to reimbursement. Also following the conclusion or renewal of this insurance, the Underwriters shall be entitled to cancel this contract during all subsequent renewal periods, if the Policyholder or Beneficiary falsely declared or omitted to declare such information to the Underwriters 2.2 Acts of non-disclosure committed up to 31 December 2005 Acts of non-disclosure, which were committed up to 31 December 2005 but which were only discovered from 1 January 2006 are to be judged in accordance with Article 6 of the Federal Law concerning the Insurance Contract in its previous version, which was valid until 31 December 2005. -3- 3. OBLIGATION IN CASE OF LOSS OR DAMAGE The Policyholder and the Beneficiary shall in the event of loss and as a condition precedent to any rights or claims under this contract report to the Underwriters without delay the occurrence of the loss and shall give the Underwriters all information, proof and evidence in respect of the loss as the Underwriters may reasonably require from them and as may be in their power. 4. FRAUDULENT CLAIMS If the Policyholder or the Beneficiary makes any claim knowing the same to be false or fraudulent as regards the amount or otherwise, the Underwriters shall be released from all liability in respect of all claims made under this insurance by that claimant. 5. NOTICE All notices which may be required to be sent by the Policyholder or the Beneficiary to the Underwriters shall be served in writing on the address contained herein, or subsequently brought in writing to the attention of the Policyholder, or at the seat of administration for the entire Swiss business. All notices addressed by the Underwriters to the Policyholder or the Beneficiary shall be served on the address last communicated to the Underwriters. 6. DUE DATE AND PAYMENT OF CLAIMS Claims shall become due for payment four weeks after the Underwriters have received the information concerning the loss and have been able to satisfy themselves as to the correctness of the claim (Article 41 of the Federal Law concerning the Insurance Contract). Claims shall be paid at the Swiss domicile of the Insured or of the Policyholder. 7. LITIGATION Legal actions for the full claim may be directed against the Underwriters subscribing to this insurance. The defendant Underwriters have therein to be named "Lloyd's Underwriters, London, subscribing to Policy No. …… represented by their General Representative for Switzerland." 8. JURISDICTION In the event of any litigation, the Underwriters shall accept the jurisdiction of the court at their seat of administration for the entire Swiss business, Seefeldstrasse 7, 8008 Zurich, or at the Swiss domicile of the Policyholder or Beneficiary. Lloyd's Underwriters' General Representative for Switzerland shall be authorised to represent all the undersigned Underwriters in any litigation with the right for substitution in legal proceedings. 9. APPLICABLE LAW As far as this contract provides nothing to the contrary, the provisions of the Swiss Federal Law concerning the Insurance Contract of 2 April 1908 shall be applicable. NMA 2242A en (01 January 2007) INFORMATIONS PRE-CONTRACTUELLES A. Les Assureurs et contractants du Preneur d'Assurance (ci-après: "Preneur d'Assurance") sont les membres de l’association d’assureurs, connus sous le nom de Lloyd's (ci-après: "Assureurs") dont le siège est mentionné ci-après et dont l'adresse et la forme juridique sont les suivants: Lloyd's One Lime Street London EC3M 7HA Grande Bretagne Lloyd's Versicherer, London Siège principal: Londres / Zweigniederlassung für die Schweiz Grande Bretagne Seefeldstrasse 7 Forme juridique: Association 8008 Zurich d'Assureurs Suisse B. Le contrat d'assurance est conclu avec la participation des courtiers au Lloyd's. Ces courtiers sont des intermédiaires d'assurance non liés au sens de la législation suisse. C. Partie constitutive de ce contrat d’assurance sont, entre autres, les Conditions Générales suivantes qui contiennent neuf dispositions individuelles. De ce fait le Preneur d’Assurance est explicitement encouragé et prié de lire les informations suivantes attentivement, ainsi que les neuf dispositions pour la plupart courtes et faciles à comprendre. Elles parlent notamment de ce qui suit: Chiffre 1 décrit les exclusions générales, notamment guerre et hostilités ainsi que certains dommages causés par des radiations ionisantes ou radioactives et en rapport avec des installations ou des processus nucléaires. Dans ces cas le contrat n'offre aucune couverture d'assurance. Chiffre 2 est en accord avec la loi fédérale sur le contrat d'assurance (ci-après: "LCA") et dispose que le Preneur d'Assurance doit répondre de manière véridique aux questions qui lui ont été posées par écrit et qui sont en rapport avec le contrat d'assurance. Une violation de ce devoir peut entraîner une résiliation du contrat et la déchéance de tout droit à une indemnité. Toute violation commise avant le 31 décembre 2005 est cependant jugée selon la loi plus stricte pour le Preneur d'Assurance ou pour l’Assuré qui était en vigueur jusqu'à cette date (résiliation du contrat, échéance de la prime). Chiffres 3 et 4 décrivent les obligations ou devoirs individuels qui doivent être observés par le Preneur d’Assurance ou l’Assuré suite à un sinistre. Lors de violation de ces obligations, le droit à une indemnité peut échouer. Chiffre 5 désigne l’endroit où les notifications du Preneur d’Assurance ou de l'Assuré à l’encontre des Assureurs, soit les notifications des Assureurs à l’encontre du Preneur d’Assurance ou de l'Assuré doivent être envoyées, pour qu’ils produisent leur effet prévu. Tout changement d'adresse doit immédiatement être annoncé. Chiffre 6 est en rapport avec le Chiffre 3 et fixe le moment et le lieu d'exécution de la prétention. Il détermine les dispositions préalables pour que celle-ci devienne exigible et puisse être fait valoir vis-à-vis les Assureurs. Chiffres 7 et 8 expliquent où et de quelle manière toute plainte éventuelle contre les Assureurs doit être dirigée. Chiffre 9 finalement, adresse les dispositions de la LCA, qui sont mises en application si le contrat d'assurance en question n’établit aucune règle divergente (par exemple les Conditions Générales ou les Conditions Spéciales). D. Deux bases de données ont été établies par Lloyd's en rapport avec la liquidation d’un contrat d'assurance (l’une avec les données clients et l’autre avec les données sinistres). Les données clients servent de preuve qu'une assurance a été conclue avec Lloyd's. Les données sinistres servent au déroulement du sinistre. Les destinataires de ses données sont le courtier Lloyd's et les Assureurs concernés, en cas de sinistre éventuellement aussi le bureau de règlement de sinistres mandaté par Lloyd's ainsi que, le cas échéant, le Bureau de Sinistres LAA en Suisse. -2- Ces données ne seront pas transmises à des tiers, sans le consentement explicite du ou des personnes concernées ou en accord avec une loi. Les données seront sauvegardées en partie sous forme électronique ou sous forme de documents. Elles seront détruites après dix ans. E. INDICATION IMPORTANTE: Le libellé déterminant est uniquement et exclusivement celui des neuf dispositions citées. Les informations pré-contractuelles ne font pas partie du contrat. -3- CONDITIONS GENERALES Les Conditions Générales suivantes constituent la base du contrat d’assurance conclut avec les Assureurs. Elles précèdent toutes autres conditions contraires de ce contrat, dans la mesure où l’une ou plusieurs de ces Conditions Générales n’ont pas explicitement été modifiées dans ce contrat d’assurance ou ont été déclarées non-applicables. 1. EXCLUSIONS Ne sont pas couverts: 1.1 Dommages causés directement ou indirectement par les événements suivants: guerre, invasion, actes d’ennemis étrangers, hostilités (que la guerre soit déclarée ou non), guerre civile, rébellion, révolution, insurrection, pouvoirs militaires ou usurpés, confiscation, nationalisation, réquisition, destruction ou endommagement d’objets par ou sur ordre d’un gouvernement quelconque ou d’autorités publiques ou locales. 1.2 (a) Dégâts matériels de toute nature ainsi que les pertes, les frais et les dommages consécutifs en résultant, (b) toute responsabilité civile légale, causés directement ou indirectement, entièrement ou en partie par: (i) des radiations ionisantes ou par une contamination radioactive provoquées par des combustibles nucléaires ou des déchets radioactifs de la combustion de combustibles nucléaires, (ii) les propriétés radioactives, toxiques, explosives ou autrement dangereuses par n'importe quelle combinaison de matières nucléaires explosives ou d'une de ses parties nucléaires. 2. RÉTICENCE 2.1 Réticence commise dès le 1er janvier 2006 Si le Preneur d’Assurance ou une personne physique ou morale assurée a, lors de la conclusion du contrat, omis de déclarer ou inexactement déclaré un fait important pour l'appréciation du risque, qu'il/elle connaissait ou devait connaître et sur lequel il/elle a été questionné(e) par écrit, les Assureurs peuvent, en vertu de l'article 6 de la LCA résilier par écrit le contrat dans les quatre semaines à partir du moment où ils ont eu connaissance de la réticence. Dans un tel cas, les Assureurs sont aussi libérés de toute responsabilité d'indemnité pour toute perte déjà encourue et qui est due ou a été influencée par le fait d'une omission de déclarer ou d'une fausse déclaration d'un fait important. Si une responsabilité d'indemnité a déjà été satisfaite, les Assureurs ont droit à un remboursement. Même après conclusion ou renouvellement de cette assurance les Assureurs ont le droit d'annuler l'assurance pendant toutes les périodes de renouvellement suivantes, si le Preneur d'Assurance ou l'Ayant Droit a omis de déclarer ou a fait une fausse déclaration par rapport à de telles informations. 2.2 Réticence commise jusqu’au 31 décembre 2005 Toute réticence commise avant le 31 décembre 2005, mais découverte après le 1er janvier 2006 sera jugée selon l’article 6 de l’ancien LCA. -4- 3. OBLIGATIONS EN CAS DE SINISTRE En cas de sinistre, le Preneur d'Assurance et l'Ayant Droit doivent, comme condition précédente à tout droit ou prétention sous ce contrat, fournir aux Assureurs tous renseignements et moyens de preuve se rapportant au sinistre, que les Assureurs peuvent raisonnablement leur demander et qu'il leur est possible de donner. 4. PRETENTION FRAUDULEUSE Si le Preneur d'Assurance ou l'Ayant Droit élève une prétention, sachant que celle-ci est fausse ou frauduleuse, soit quant au montant réclamé, soit d'une autre manière, les Assureurs sont libérés à l'égard de l'Ayant Droit de toute obligation d'indemniser au titre de cette assurance. 5. COMMUNICATIONS Toutes les communications que le Preneur d'Assurance ou l'Ayant Droit doit faire aux Assureurs seront envoyées par écrit à l'adresse mentionnée dans le contrat d'assurance, ou à celle indiquée ultérieurement par écrit au Preneur d'Assurance, ou encore au siège pour l'ensemble des affaires suisses du Lloyd's. Toutes les communications que les Assureurs doivent faire au Preneur d'Assurance ou à l'Ayant Droit sont faites valablement à la dernière adresse communiquée aux Assureurs. 6. EXIGIBILITE ET EXECUTION DE LA PRETENTION La créance qui résulte du contrat est échue quatre semaines après le moment où les Assureurs ont reçu les renseignements de nature à leur permettre de se convaincre du bien-fondé de la prétention (selon l'article 41 LCA), et le lieu de paiement est le domicile suisse de l’Assuré ou du Preneur d’Assurance. 7. PLAINTES Les plaintes peuvent être dirigées contre tous les Assureurs participant au présent contrat pour le montant total de la prétention. La désignation des Assureurs actionnés sera formulée comme il suit: “Les Assureurs du Lloyd's, Londres, signataires de la police no………. , représentés par leur Mandataire général pour la Suisse”. 8. FOR Pour toutes les contestations découlant de ce contrat, les Assureurs reconnaissent le for de leur siège pour l'ensemble des affaires suisses, Seefeldstrasse 7, 8008 Zurich, ou celui du domicile suisse du Preneur d'Assurance ou de l'Ayant Droit. Le Mandataire général pour la Suisse est autorisé à représenter valablement tous les Assureurs soussignés participant au présent contrat dans toutes les contestations juridiques, avec droit de substitution en cas de procès. 9. DROIT APPLICABLE Sauf stipulation contraire du présent contrat, les dispositions de la loi fédérale du 2 avril 1908 sur le contrat d'assurance sont applicables. NMA 2242A fr (01 January 2007) VORVERTRAGLICHE INFORMATIONEN A. Die Versicherer und Vertragspartner des Versicherungsnehmers oder der Versicherungsnehmerin (nach-stehend: "Versicherungsnehmer") sind die unter dem Namen Lloyd's zusammengefassten beteiligten Lloyd's Versicherer, London (nachstehend: "Versicherer") mit folgendem Sitz beziehungsweise Adresse und Rechtsform: Lloyd's One Lime Street London EC3M 7HA Grossbritannien Lloyd's Versicherer, London Hauptsitz : London / Grossbritannien Zweigniederlassung für die Schweiz Rechtsform: Vereinigung von Seefeldstrasse 7 Einzelversicherern 8008 Zürich Schweiz B. Der Versicherungsvertrag wird unter Mitwirkung der Lloyd's Broker abgeschlossen. Bei diesen handelt es sich um unabhängige Versicherungsvermittler im Sinne der schweizerischen Gesetzgebung. C. Bestandteil des Versicherungsvertrages sind unter anderem die nachstehenden Allgemeinen Bedingungen, welche neun einzelne Bestimmungen enthalten. Der Versicherungsnehmer wird ausdrücklich darum ersucht und aufgefordert, die folgenden Informationen und die neun mehrheitlich kurzen und leicht verständlichen Bestimmungen sorgfältig durchzulesen. In diesen ist unter anderem von folgendem die Rede: Ziffer 1 behandelt die allgemeinen Ausschlüsse namentlich von Krieg und Feindseligkeiten sowie von gewissen Schäden zufolge ionisierender oder radioaktiver Strahlung und im Zusammenhang mit nuklearen Einrichtungen oder Vorgängen. In diesen Fällen bietet der Vertrag keinen Versicherungsschutz. Ziffer 2 bestimmt im Einklang mit dem schweizerischen Bundesgesetz über den Versicherungsvertrag (nachstehend "VVG"), dass die im Zusammenhang mit dem Versicherungsantrag schriftlich gestellten Fragen der Versicherer wahrheitsgemäss beantwortet werden müssen. Eine Verletzung dieser Pflicht kann zur Auflösung des Versicherungsvertrages und zum Verlust des Versicherungsanspruches führen, wobei Pflichtverletzungen, die bis 31. Dezember 2005 begangen wurden, unter dem für den Versicherungsnehmer oder Versicherten strengeren bisherigen Recht (Vertragsrücktritt, Verfall der Prämie) beurteilt werden. Ziffern 3 und 4 umschreiben einzelne Obliegenheiten oder Pflichten, welche vom Versicherungsnehmer oder Versicherten nach dem Eintritt eines Schadenfalles zu beachten sind. Bei deren Verletzung kann der Anspruch auf Versicherungsleistung dahinfallen. Ziffer 5 bestimmt, wohin Mitteilungen des Versicherungsnehmers oder Versicherten zuhanden der Versicherer beziehungsweise Mitteilungen der Versicherer zuhanden des Versicherungsnehmers oder Versicherten zu versenden sind, damit sie die vorgesehenen Wirkungen zeitigen. Adressänderungen sind unverzüglich zu melden. Ziffer 6 steht im Zusammenhang mit Ziffer 3 und bestimmt den Zeitpunkt und den Ort der Erfüllung des Versicherungsanspruches sowie die Voraussetzungen dafür, dass dieser fällig wird und gegenüber den Versicherern geltend gemacht werden kann. Ziffern 7 und 8 erklären, wie und wo eine allfällige gerichtliche Klage gegen die Versicherer eingereicht werden kann. Ziffer 9 schliesslich verweist auf die Bestimmungen des VVG, welche stets dann zur Anwendung gelangen, wenn der betreffende Versicherungsvertrag (zum Beispiel in den Allgemeinen Bedingungen oder in Besonderen Bedingungen) keine abweichenden Regeln aufstellt. -2- D. Im Zusammenhang mit der Abwicklung des Versicherungsvertrages werden von Lloyd's zwei Datensammlungen angelegt (Kundendaten und Schadendaten). Die Kundendaten dienen dem Nachweis darüber, ob eine Versicherung bei Lloyd's besteht. Die Schadendaten dienen der Schadenabwicklung. Empfänger der Daten sind die jeweiligen Lloyd's Broker und die Versicherer, im Schadenfall eventuell zusätzlich das von den Versicherern beauftragte Schadenregulierungsbüro und gegebenenfalls das schweizerische Lloyd's UVG Claims Office. Eine Weitergabe an sonstige Drittpersonen erfolgt nur mit Zustimmung des oder Betroffenen oder gestützt auf ein Gesetz. Die Daten werden teils elektronisch, teils in Papierform aufbewahrt und nach zehn Jahren vernichtet. E. WICHTIGER HINWEIS: Der massgebliche Wortlaut ist ausschliesslich und allein derjenige der neun genannten Bestimmungen selber; die Vorvertraglichen Informationen sind nicht Teil des Vertrages. -3- ALLGEMEINE BEDINGUNGEN Die nachstehenden Allgemeinen Bedingungen bilden Bestandteil des mit den Versicherern abgeschlossenen Versicherungsvertrages. Sie haben insgesamt Vorrang vor sämtlichen anders lautenden Bestimmungen dieses Vertrages, soweit nicht einzelne der Allgemeinen Bedingungen in den weiteren Vertragsunterlagen ausdrücklich abgeändert oder als nicht anwendbar bezeichnet werden. 1. AUSSCHLÜSSE Nicht versichert sind: 1.1 Schäden, die mittelbar oder unmittelbar durch folgende Ereignisse verursacht werden: Krieg, Invasion, Massnahmen ausländischer Feinde, Feindseligkeiten (mit oder ohne Kriegserklärung), Bürgerkrieg, Rebellion, Revolution, Aufstand, militärische oder usurpierte Gewalt, Konfiskation, Nationalisierung, Requisition, Zerstörung oder Sachbeschädigung seitens oder auf Befehl irgendeiner Regierung oder öffentlichen oder örtlichen Behörde. 1.2 (a) Sachschäden aller Art sowie daraus entstehende Verluste, Auslagen und Folgeschäden, (b) jegliche gesetzliche Haftpflicht, welche direkt oder indirekt, ganz oder teilweise herbeigeführt werden durch: (i) ionisierende Strahlen oder durch radioaktive Verseuchung durch Kernbrennstoffe oder Kernbrennstoffabfälle aus der Verbrennung von Kernbrennstoffen, (ii) radioaktive, giftige, explosive oder anderweitig gefährliche Eigenschaften irgendeiner explosiven nuklearen Anordnung oder eines nuklearen Teiles hiervon. 2. ANZEIGEPFLICHTVERLETZUNG 2.1 Anzeigepflichtverletzungen begangen ab dem 1. Januar 2006 Wenn der Versicherungsnehmer oder eine versicherte natürliche oder juristische Person beim Abschluss der Versicherung eine erhebliche Gefahrentatsache, die er kannte oder kennen musste und über die er schriftlich befragt worden ist, unrichtig mitteilte oder verschwieg, so sind die Versicherer gemäss Art. 6 VVG berechtigt, den Vertrag binnen vier Wochen, nachdem sie von der Verletzung der Anzeigepflicht Kenntnis erhalten haben, durch schriftliche Erklärung zu kündigen. Die Versicherer sind in diesem Fall von jeglicher Leistungspflicht auch für bereits eingetretene Schäden befreit, deren Eintritt oder Umfang durch die nicht oder unrichtig angezeigte erhebliche Gefahrstatsache beeinflusst worden ist. Soweit die Leistungspflicht schon erfüllt wurde, haben die Versicherer Anspruch auf Rückerstattung. Auch nach Abschluss oder Erneuerung dieser Versicherung sind die Versicherer berechtigt, diesen Vertrag während aller folgenden Erneuerungsperioden zu kündigen, falls der Versicherungsnehmer oder Anspruchsberechtigte derartige Informationen den Versicherern unrichtig mitteilte oder verschwieg. 2.2 Anzeigepflichtverletzungen begangen bis zum 31. Dezember 2005 Anzeigepflichtverletzungen, welche bis zum 31. Dezember 2005 begangen, aber erst ab dem 1. Januar 2006 entdeckt wurden, beurteilen sich gemäss dem bis 31. Dezember 2005 gültigen Art. 6 alt VVG. -4- 3. OBLIEGENHEITEN IM SCHADENFALL Der Versicherungsnehmer und der Anspruchsberechtigte sind verpflichtet, bei Eintritt eines Schadenereignisses und als Vorbedingung eines jeglichen Anspruches aus diesem Vertrag, den Versicherern den Eintritt des Schadenereignisses unverzüglich zu melden und ihnen alle Auskünfte, Belege und Beweismittel in Bezug auf den Schaden zu geben, welche die Versicherer billigerweise verlangen können und die erstere zu geben vermögen. 4. BETRÜGERISCHE ANSPRÜCHE Wenn der Versicherungsnehmer oder Anspruchsberechtigte einen Ersatzanspruch in Kenntnis davon erhebt, dass dieser, sei es in Bezug auf die Höhe des Anspruches, sei es in anderer Weise, falsch oder betrügerisch ist, so sind die Versicherer gegenüber dem Anspruchsberechtigten von jeder weiteren Ersatzpflicht aus dieser Versicherung befreit. 5. MITTEILUNGEN Sämtliche Mitteilungen, die der Versicherungsnehmer oder Anspruchsberechtigte den Versicherern zu machen hat, sind schriftlich der hierin bezeichneten oder dem Versicherungsnehmer später schriftlich bekanntgegebenen Meldestelle oder der Geschäftsstelle für das gesamte schweizerische Lloyd's Geschäft zu machen. Alle Mitteilungen, welche die Versicherer dem Versicherungsnehmer oder Anspruchsberechtigten zu machen haben, erfolgen rechtsgültig an die den Versicherern zuletzt bekanntgegebene Adresse. 6. FÄLLIGKEIT UND ERFÜLLUNG DES VERSICHERUNGSANSPRUCHES Schäden werden mit dem Ablauf von vier Wochen, nachdem die Versicherer die Angaben erhalten haben, aus denen sie sich von der Richtigkeit des Anspruches überzeugen konnten, zur Zahlung fällig (Art. 41 VVG). Als Erfüllungsort gilt der schweizerische Wohnsitz des Versicherten oder des Versicherungsnehmers. 7. KLAGEN Klagen können für den ganzen geltend gemachten Anspruch gegen die am vorliegenden Versicherungsvertrag beteiligten Versicherer gerichtet werden. Die Bezeichnung der eingeklagten Versicherer hat dabei zu lauten: “Die im Vertrag Nr. …….. unterzeichneten Lloyd's Versicherer, London, vertreten durch deren Generalbevollmächtigten für die Schweiz.” 8. GERICHTSSTAND Für alle Streitigkeiten anerkennen die Versicherer den Gerichtsstand ihrer Geschäftsstelle für das gesamte schweizerische Geschäft, Seefeldstrasse 7, 8008 Zürich, oder des schweizerischen Wohnortes des Versicherungsnehmers oder Anspruchsberechtigten. Der schweizerische Generalbevollmächtigte ist ermächtigt, alle beteiligten unterzeichneten Versicherer in jedem Rechtsstreit rechtsgültig zu vertreten mit dem Rechte der Substitution zur Prozessführung. 9. RECHTSANWENDUNG Soweit dieser Vertrag nichts anderes bestimmt, gelten die Bestimmungen des Bundesgesetzes über den Versicherungsvertrag vom 2. April 1908. NMA 2242A ge (1 January 2007)
