On February 25, 2005 at approximately 07:10 hrs. Police were dispatched to a three vehicle collision at the
Intersection of Highway 59 and Highway 101. Investigation revealed that the accused was southbound in the
median lane on Hwy 59 approaching the lights at the intersection. There were two vehicles in the southbound median
lane that were stopped for the traffic lights at this intersection. According to a witness the accused vehicle did not
slow down as he approached the intersection. The accused then collided with the rear of a 1991 Chevrolet Sprint
convertible. The impact propelled the Chevrolet into the rear of a 2000 Hyundai Accent and sending that vehicle
across the intersection narrowly missing a power pole. The 40 year old female driver of the Chevrolet Sprint was
transported to Concordia Hospital where she was pronounced dead. The 52 year old driver of the Hyundai was
transported to Concordia Hospital where she was treated and released. At 0812 hrs. the accused was transported to
the East St. Paul Police Department where he was subsequently arrested for impaired Driving causing Death. The
accused was also given an opportunity to speak with legal counsel. The accused refused to provide police with a
breath sample upon demand. The accused was also subsequently charged with Dangerous operation of a motor
vehicle causing death and Criminal negligence causing death..
