The Tobacco Control Amendment Act, 2010, S.S. 2010, c.34, that portion of clause 3(e) that adds the definition for “pharmacy” and clause 8(b) proclaimed in force April 1, 2011. *Note: A proclamation appearing in this list for the first time is indicated in bold print./Une loi proclamée qui figure pour la première fois dans cette liste apparaît en caractères gras. _____________________________________________________________________________________________________________________________ Order in council/décret ________________________ The City of Lloydminster Act [section 4] ________________________ [O.C. 610/2011] 24 november 2011 On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that: (a) subject to clause (c), effective January 1, 2012 The Lloydminster Charter is amended in accordance with the attached Schedule; (b) this Order in Council is complementary to an Order in Council of the Lieutenant Governor in Council of Alberta that adopts these amendments to The Lloydminster Charter; and (c) this Order in Council is conditional on the issuance of the complementary Order in Council mentioned in clause (b). RECOMMENDED BY: Minister of Municipal Affairs. APPROVED BY: Brad Wall, President of the Executive Council. ORDERED BY: Honourable Dr. Gordon L. Barnhart, Lieutenant Governor. REGINA, Saskatchewan. AUTHORITY: The City of Lloydminster Act, section 4. 2424 THE SASKATCHEWAN GAZETTE, december 2, 2011 SCHEDULE to oc 610/2011 O.C. 208/79 amended 1 The Lloydminster Charter is amended by this Schedule. New section 19 2 Section 19 is repealed and the following substituted: “19(1) Subject to the other provisions of this section, The Local Government Election Act (Saskatchewan) is deemed to be incorporated into this Charter and applies to the whole City, and the mayor and the councillors are to be elected in accordance with that Act. (2) For the purposes of this Charter, any reference in The Local Government Election Act (Saskatchewan): (a) to Saskatchewan is deemed to include a reference to Alberta; and (b) to a city is deemed to be a reference to the City. (3) If a form is prescribed by or under The Local Government Election Act (Saskatchewan), the council may modify the form or prescribe the use of a different form if the form used does not change the substance of the form prescribed by or under that Act. (4) If there is an inconsistency between The Local Government Election Act (Saskatchewan) and this Charter, the provisions of this Charter prevail”. New section 424 3 Section 424 is repealed and the following substituted: “424 In this Division, ‘equalized assessment’ means an assessment prepared under section 426”. New section 426 4 Section 426 is repealed and the following substituted: “426 The Minister must annually prepare an equalized assessment under Part 9 of the Municipal Government Act (Alberta) for that part of the City located in Alberta”. Part VII, Division 7 repealed 5 Division 7 of Part VII is repealed. New section 436 6 Section 436 is repealed and the following substituted: “436 In this Part, (a) ‘Alberta’s education property tax requisition’ means a requisition referred to in section 464.01; (b) ‘housing requisition’ means an amount required to be paid to a management body under the Alberta Housing Act or to the Saskatchewan Housing Corporation or a public housing authority under The Saskatchewan Housing Corporation Act; (c) ‘tax arrears’ means taxes that remain unpaid after December 31 of the year in which they are imposed”. Section 445 amended 7 Subsection 445 is amended: (a) in subsection (1)(c) by striking out “requisitions” and substituting “housing requisitions”; (b) in subsection (3) by striking out “section 436(a)(iii)” and substituting “section 464(2)(d)”. THE SASKATCHEWAN GAZETTE, december 2, 2011 2425 Section 464 amended 8 Subsection 464(2) is repealed and the following substituted: “(2) The property tax bylaw passed pursuant to subsection (1) authorizes the council to impose a tax in respect of property in the City to raise revenue to be used towards the payment of: (a) the expenditures and transfers set out in the budget of the City; (b) the housing requisitions; (c) taxes for educational purposes calculated in accordance with The Education Act, 1995 (Saskatchewan) and based on Alberta’s education property tax requisition; and (d) if agreed to by the City and the boards of education, a levy on assessment for city-wide educational programming purposes. (2.1) The council may enter into an agreement with the Lloydminster Public School Division and the Lloydminster Roman Catholic Separate School Division to provide funds to the school divisions for city-wide educational programming, and any sums to be paid by the City pursuant to such an agreement must be raised by means of the levy referred to in subsection (2)(d). (2.2) The levy referred to in subsection (2)(d) must not exceed a tax rate of 0.00075 or a mill rate of .75 in any year”. The following is added after section 464: 9 “464.01 For the purposes of section 464(2)(c), Alberta’s education property tax requisition must be in an amount that is equal to the amount that results from applying the rates established under the School Act (Alberta) to the equalized assessment for the City as prepared under the Municipal Government Act (Alberta)”. Section 464.1 amended 10(1) Subsection 464.1(2) is amended by striking out “for educational purposes” and substituting “and levy referred to in section 464(2)(c) and (d) respectively”. (2) Subsection 464.1(5) is amended by striking out “school tax revenue required by the boards of education” and substituting “the taxes and levy referred to in section 464(2)(c) and (d) respectively”. (3) Subsection 464.1(7) is repealed. The Clerk of the Legislative Assembly must be advised in writing of the name of the Private Member sponsoring the Private Bill. In cases where the proposed bill provides that the property to be used or occupied by the petitioner be exempt from taxation, either in whole or in part, the petitioner must file with the Clerk of the Assembly, along with the petition, a written statement from the local municipal authority in which the said property is situated approving the intent of the provisions of the proposed bill which provide for the exemption from taxation. 91(1) All petitions for private bills shall be in duplicate and shall be filed with the Clerk of the Assembly not later than the fourth sitting day of the spring period of the parliamentary calendar. 91(2) No petition for any private bill shall be received by the Assembly if presented after the first eight sitting days of the spring period of the parliamentary calendar. 91(3) No private bill may be introduced in the Assembly after the first 15 sitting days of the spring period of the parliamentary calendar. 92(1) Every applicant for a private bill shall deposit with the Clerk of the Assembly, along with the petition for same, two copies of the bill with marginal notes inserted and an accepted cheque payable to the Minister of Finance for the sum of two hundred and fifty dollars ($250) if the said bill does not exceed 10 pages, and fifteen dollars ($15) additional for each page over that number; 450 words shall be held to constitute a page. 92(2) In the case of a bill incorporating a company, a receipt from the Director of Business Corporations for any statutory fees required shall also be deposited with the Clerk of the Assembly. 93 No remittance of a deposit on account of a private bill or any portion thereof shall be ordered by the Assembly unless the same has been recommended by the committee charged with its consideration, or unless the bill has been withdrawn, rejected or not reported upon, in which cases the actual expenses incurred shall be deducted from the deposit received before making such remittance. ... 95(1) All petitions to the Legislature for private bills of any nature whatsoever shall require a notice clearly and distinctly specifying the nature and object of the application and, where the same refers to any proposed work, indicating generally the location of the work, and signed by and on behalf of the petitioners, with the address of the party signing the same.
