Title
1 These regulations may be cited as The Adoption Amendment Regulations, 2004.
R.R.S. c.A-5.2 Reg 1 amended
2 The Adoption Regulations, 2003 are amended in the manner set forth in these
regulations.
Section 2 amended
3 The definition of “affidavit of birth mother” in subsection 2(1) is
repealed.
Section 5 amended
4 The following subsection is added after subsection 5(4):
“(5) Where the consent of a person who is 18 years of age or more is required, the
consent to adoption is to be substantially in Form C-7”.
New section 5.1
5 The following section is added after section 5:
“Form re consent to change of name
5.1 The consent of a child who is 12 years of age or more to a change of his or her
name is to be substantially in Form C-5”.
Section 7 repealed
6 Section 7 is repealed.
Section 13 amended
7 Clause 13(b) is repealed and the following substituted:
“(b) in any case other than an application for adoption of a Crown ward, a
certificate of the director stating that, to the director’s knowledge, no person
who may revoke his or her consent to adoption or transfer of guardianship has
revoked that consent to adoption or transfer of guardianship within the time
during which it is revocable”.
Section 14 amended
8(1) The portion of subsection 14(2) preceding clause (a) is amended by
striking out “Before a child is placed for adoption” and substituting “Unless a
court dispenses with the requirement”.
(2) The portion of subsection 14(3) preceding clause (a) is amended by
striking out “Before a child is placed for adoption” and substituting “Unless a
court dispenses with the requirement”.
Section 22 amended
9 The following subsection is added after subsection 22(3):
“(3.1) A person who requests a certified copy of a birth registration must pay the
fee prescribed pursuant to section 21 of The Vital Statistics Regulations”.

Le Règlement de 2003 sur l’adoption est modifié de la manière ci-énoncée.
Modification de l’article 2
3 La définition du terme « affidavit de la mère de sang » au paragraphe 2(1)
est abrogée.
Modification de l’article 5

Le paragraphe qui suit est ajouté après le paragraphe 5(4) :
« (5) Le consentement d’une personne âgée de 18 ans ou plus étant requis, le
consentement à l’adoption doit être établi essentiellement selon la formule C-7 ».
Nouvel article 5.1

L’article qui suit est ajouté après l’article 5 :
« Formule de consentement au changement de nom
5.1 Le consentement d’un enfant âgé de 12 ans ou plus au changement de son
nom doit être établi essentiellement selon la formule C-5 ».
Abrogation de l’article 7

L’article 7 est abrogé.
Modification de l’article 13

L’alinéa 13b) est abrogé et remplacé par ce qui suit :
« b) dans tous les cas hormis celui d’une demande d’adoption d’un pupille de
la Couronne, un certificat du directeur attestant que, à sa connaissance,
aucune personne pouvant révoquer son consentement à l’adoption ou au
transfert de la tutelle ne l’a révoqué dans le délai imparti pour sa révocabilité ».
Modification de l’article 14
8(1) La partie du paragraphe 14(2) précédant l’alinéa a) est modifiée par
suppression des mots « Avant qu’un enfant ne soit placé en vue de l’adoption » et
leur remplacement par les mots « À moins qu’un tribunal n’accorde une
dispense à cet égard ».
(2) La partie du paragraphe 14(3) précédant l’alinéa a) est modifiée par
suppression des mots « Avant qu’un enfant ne soit placé en vue de l’adoption » et
leur remplacement par les mots « À moins qu’un tribunal n’accorde une
dispense à cet égard ».
Modification de l’article 22

Le paragraphe qui suit est inséré après le paragraphe 22(3) :
« (3.1) La personne qui demande une copie certifiée conforme d’un enregistrement
de naissance doit payer le droit fixé à l’article 21 du Règlement sur les services de
l’état civil ».

Section 24 repealed

Section 24 is repealed.
Section 26 amended
11 Clause 26(1)(c) is amended by adding “, including birth family members
who are adopted,” after “birth family members”.
Section 32 amended
12 Clauses 32(1)(b) and (c) are repealed and the following substituted:
“(b) an adult birth sibling of the adopted adult:
(i) with the written consent of a birth parent;
(ii) if both birth parents of the adopted adult are parents of the adult
birth sibling and lack capacity, are deceased or cannot be located after
reasonable efforts have been made by the adult birth sibling; or
(iii) if only one of the birth parents of the adopted adult is a parent of
the adult birth sibling and that parent lacks capacity, is deceased or
cannot be located after reasonable efforts have been made by the adult
birth sibling;
“(c) an adult birth family member of the adopted adult, other than an adult
birth sibling, if the birth parent that is related to the adult birth family
member making the request:
(i) provides written consent; or
(ii) lacks capacity, is deceased or cannot be located after reasonable
efforts have been made by the adult birth family member”.
Part I of Appendix amended
13(1) Part I of the Appendix is amended in the manner set forth in this section.
(2)
Form C-1 is amended by striking out the following:

« c) d’un membre adulte de la famille de sang de l’adulte adopté, qui n’est
pas une soeur ou un frère de sang adulte, si le père ou la mère de sang qui a un
lien de parenté avec le membre adulte de la famille de sang auteur de la
demande :
(i)
ou bien fournit un consentement écrit,
(ii) ou bien est incapable ou décédé ou ne peut être retrouvé après que
des efforts raisonnables ont été faits en ce sens par le membre adulte de
la famille de sang ».

Coming into force
15(1) Subject to subsection (2), these regulations come into force on the day on
which section 3 of The Adoption Amendment Act, 2004 comes into force.
(2) If section 3 of The Adoption Amendment Act, 2004 comes into force before the
day on which these regulations are filed with the Registrar of Regulations, these
regulations come into force on the day on which they are filed with the Registrar of
Regulations.

Entrée en vigueur
15(1) Sous réserve du paragraphe (2), le présent règlement entre en vigueur le
jour de l’entrée en vigueur de l’article 3 de la Loi de 2004 modifiant la Loi de 1998
sur l’adoption.
(2) Si l’article 3 de la Loi de 2004 modifiant la Loi de 1998 sur l’adoption entre en
vigueur avant le jour du dépôt du présent règlement auprès du registraire des
règlements, le présent règlement entre en vigueur le jour de ce dépôt.

1 These regulations may be cited as The Saskatchewan Farm Security Amendment
Regulations, 2004.
R.R.S. c.S-17.1 Reg 1 amended
2 The Saskatchewan Farm Security Regulations are amended in the manner set
forth in these regulations.
Section 8 amended
3 Section 8 is amended:
(a)
in clause (g) by adding “of the Act” after “clause 68(3)(a)”; and
(b) in clause (h) by striking out “clause 68(3)(c)” and substituting
“subclause 68(3)(b)(ii) of the Act”.
Appendix amended
4 Forms G and H in the Appendix are repealed and the following
substituted:

Coming into force
5(1) Subject to subsection (2), these regulations come into force on the day on
which The Saskatchewan Farm Security Amendment Act, 2004 comes into force.
(2) If these regulations are filed with the Registrar of Regulations after The
Saskatchewan Farm Security Amendment Act, 2004 comes into force, these
regulations come into force on the day on which they are filed with the Registrar of
Regulations.

Title
1 These regulations may be cited as The Pests Declaration Amendment
Regulations, 2004.
R.R.S. c.P-7 Reg 2 amended
2 The Pests Declaration Regulations are amended in the manner set forth in these
regulations.
Section 1.1 repealed
3 Section 1.1 is repealed.
Section 2 amended
4 Clause 2(b) is repealed.
Coming into force
5(1) Subject to subsection (2), these regulations come into force on the day on
which The Dutch Elm Disease Regulations, 2004 come into force.
(2) If these regulations are filed with the Registrar of Regulations after The Dutch
Elm Disease Regulations, 2004 come into force, these regulations come into force on
the day on which they are filed with the Registrar of Regulations.
