Petition of tbe States of the Island of Guernsey

GuC"rnsey appointed to enquire into the question
of controlling I"he sale of intnxic,-lting liquors, on
the 12th day of March 1927, adopted a Bill or

the Cf<l\Vl1, on the lines of the English Act of
T9T5 relating tn the S81e of Immature Spirits,
and requested the Dailifr to submit the same to
the Slates for their approval: 2. That on the 4th

Spirits) and to order and direct that the same

1.-:\0 spirits shall be delivered for conslLmption
in the Island unic:::;s Liley have been warehoused in
tile States Bonded Stores for a period of at least
Lh ree years;
Provided that
(a) This restriction shall not apply to spidts
dcli\·ered for purpos(~s for v.:hieh they may
for the time being' be deli'\Trccl free of duty.
or (0 mixtures, compounds or prcparation~.,
which ht:lxe beell charg·ed to duty in respect
of Lhe spirits contained in them or used in
their preparation or manufacture; and
(b) Subject to the payment of such duties (if
any) ,IS the States ma~y delcrminc~ and to
compliance ""Ivith such conditions as the
States may impose, this restriction shall
not apply
(i) To spirits delivered to a licensed recliiler, to a manufactllring chemist, or to
a \11,ll1tJfaduref of p(>rfurnes, for use in
their manufactures, or to other persons
licensed by the States ~ or
Oi) to spirits delivered [or scientific purposes, or
(iii) to imported British Gin. Geneva and
perfumed splrllS and Brit-ish and
foreign liqueurs; and
(c) Subject to tbe payment 01 sucbduties (if
any) as the States may determine and to
compliance wilh such conditions -as the
States may impose, this restriction shall
not apply for a period of one year after tbe
commencement of this law
(i) To spirits of any sort delivered for consumption in the 'Island, if they have
been warehoused in the States Bonded
Stores for a period of at least two
years; or
(ii) to imported rum delivered for consumption in the Island if it has been
warehoused in tbe States Bonded
Stores for a period of at least nine
months; and
(d) Any period which in the case of imported
spirits is shown to the satisfaction of the
States Board of Administration to have
elapsed between the dates of distillation
and importation shall be treated, for the
purpose of tilis Im·v, as a period during
which the spirits have been vvarehoused in
the States Bonded Stores.
2.-::\'othing contained in this Article shall inter~
fere with the supply of rectified spirits of wine for
the purpose of making medicines, to registered
medical practilioners, to hospitals and to persons,
firms and bodies corporate entit1ed to carryon the
business of a Chemist and Druggist.
3-Tf an:.y person procures or attempls to procure
the delivery of spirits in contravention of this law
or acts in contravention of or fails to comply \vith
any conditions imposed by the States or by Ordina~ce of the Royal Court he shall be lhd,le to a
penalty not exceeding One hundred pounds j and
an v spirits in respect of which the offence has been
CO;11mitteJ may be forfeited at the discretion of the
Court.
4-- Where any existing contracts are interfered
with by this law the Contractor shall, to the extent
of such interference, be relieved therefrom.
s.-The Royal C(')urt is authorised to pass from
time to time all and such Ordinances as may be
necessary to give effect to this law.
