Le Conseil de l’Union européenne a adopté le 24 juin 2013 les Orientations de l’UE relatives à
la promotion et à la protection de la liberté de religion ou de conviction dans lesquelles elle
réaffirme qu’elle est déterminée à promouvoir la liberté de religion ou de conviction dans sa
politique extérieure en matière de droits de l’homme. (English version : EU Guidelines on the
promotion and protection of freedom of religion or belief)
Le secrétaire général du Conseil de l'Europe Thorbjorn Jagland a déclaré le 11 novembre à
Berlin lors de la 28e convention de la conférence des rabbins européens qu’ « en aucun cas le
Conseil de l'Europe ne veut interdire la pratique de la circoncision ». Cette annonce fait suite
aux débats soulevés par la résolution (fr) (eng) de l’Assemblée parlementaire du Conseil votée
le 1er octobre dernier et relative au droit des enfants à l’intégrité physique.

En 2013, deux sociétés religieuses, qui fonctionnaient jusqu’alors comme communautés
confessionnelles de droit privé, ont été reconnues sur la base du § 2 de la loi RGBl. no.
68/1874, modifié en dernier lieu par la loi BGBl. I no. 3/2009, et du § 11 de la loi BGBl. I no.
19/1998, modifié en dernier lieu par la loi BGBl. I no. 78/2011. A l’avenir, elles auront une
personnalité du droit public.
Au mois de mai, la communauté religieuse islamique alévie a été reconnue comme société
religieuse sous le nom « Islamische Alevitische Glaubensgemeinschaft in Österreich » par la
Ministre de l’éducation, de l’art et de la culture. Le décret a été publié dans BGBl. II no.
133/2013.
Au mois d’aout, la même ministre a reconnu la Fédération baptiste, la Fédération des
communautés évangéliques, les communautés chrétiennes ELAIA, la communauté chrétienne
libre (pentecôtiste) et l’Eglise libre mennonite comme Eglise (société religieuse). Le décret a
été publié dans BGBl. II no. 250/2013. L’Eglise porte le nom de « Freikirchen in Österreich »
(Eglises libres en Autriche).
Ce dernier développement est digne d’attention dans la mesure où cette Eglise constitue pour
la première fois une Eglise « au pluriel » reconnue par décret. Vu que ces Eglises singulières
ne disposaient pas du nombre minimum de membres exigé par § 11 de la loi BGBl. I. no.
19/1998 pour être reconnues individuellement, elles ont convenu de créer cette fédération pour
remplir cette condition. Dans le passé, la législation parlementaire avait en un tel cas adopté
des lois spécifiques et individuelles sur la position juridique des communautés
correspondantes, comme ce fut le cas pour la reconnaissance de l’Eglise copte orthodoxe par
la loi BGBl. I no. 3/2003.
Deux autres organisations religieuses furent enregistrées comme communautés
confessionnelles en 2013 : la « Islamische-Schiitische Glaubensgemeinschaft in Österreich
(Schia) » (communauté religieuse islamique chiite), disposant de la nouvelle personnalité
juridique depuis le 1er mars et l’« Alt-Alevitische Glaubensgemeinschaft in Österreich
(AAGÖ) » (communauté religieuse vieille-alévie), disposant de la nouvelle personnalité
juridique depuis le 23 août.
Autres / Others
En créant la plate-forme de recherche Institut für Islamische Studien (Institut des études
islamiques) en 2012, l’Université de Vienne a fait un premier pas vers la mise en place
d’études de théologie musulmane, prévue pour 2015. Au semestre d’hiver 2013, un cycle de
cours intitulé « la théologie islamique comme science en Europe » a été dispensé.

basis statistics concerning the approved religious groups in Denmark. The publication is
currently primarily in Danish, but there is an English website, and the Center is in a process of
making the data accessible to researcher in an international context. For more information

All art forms have relationships with communities and their understandings and representation
of ideas, ideals, norms and order. Secular and religious European, global and local legal cultures interact with representations of norms, ideals and conflicts in many art forms.
Technology and globalization have influenced and changed both norms and representations.
This workshop will address some of these relations hoping to contribute to an emerging field
of research and action.

22nd Nordic Conference for Sociology of Religion 2014 Change and Continuity - Religion,
State, Civil Society 20.-22. August, 2013, University of Copenhagen.
Across the world, in the last two decades of the twentieth century, religions have been
increasingly visible in public space as influential discursive and symbolic systems partly
beyond the control of either traditional religious authorising institutions or states. Religion
may be found and studied in both overt and concealed forms in many matters conventionally
categorised as secular. This situation carries new challenges for democracy, (welfare) state
systems and civil society. The 22nd Nordic Conference for Sociology of Religion seeks a
more thorough understanding - theoretically as well as empirically - of the dynamic
interrelations of religion, state and civil society. In short, we would like to find out how this
interrelation is part of processes of change and continuity in society today. In line with the
traditions of the Nordic conferences, contributions addressing this scope as well as other
topics within the sociology of religion are welcome!

Ban on religious slaughter
Since the end of December 2012, the religious slaughter is not permitted any more in Poland.
The Constitutional Court ruled that Ordinance of 9 September 2004 by the Minister of the
Agriculture and Rural Development concerning the conditions of religious slaughter is
inconsistent with the Law on the Protection of animals. According to the judgment of the
Polish constitutional tribunal (27 November 2012), this ministerial ordinance is no more in
force from 1st January 2013.
The government draft amendment to the Law on the Protection of Animals restored the right
to religious slaughter. This draft was rejected by the Parliament on 12 July 2013. The Jewish
community has voiced strong reaction and has requested the Polish constitutional tribunal to
examine of the Law on the Protection of Animals in the light of the Constitution (art. 53) and
the ECHR (art. 9).

Preparations for the celebration of the 20th Anniversary of the founding of the Church Law
Society
The Church Law Society is planning a celebration of the 20th anniversary of its founding.
During the celebration scientific activities of the Society during the last 20 years and future
activities will be discussed. The Church Law Society has more than 400 members from the
Czech Republic, Slovakia, United States of America, Poland, United Kingdom, Germany,
Austria and Italy. The celebration will take place in the barocco refectory of the St. Gill
Monastery in Prague Old Town on Sunday, December 15, 2013, at 4:00 pm. The refectory can
be accessed through the entrance at 7a Jilska Street.

The Results of the Karlsbader Legal Days competition
The Church Law Review was ranked fifth best legal journal out of thirty legal journals in the
Czech and Slovak Republics in 2012/2013 in this year’s competition of the Society of Czech,
German, Slovak, and Austrian Lawyers held by Karlsbader Legal Days (Karlsbader
Juristentage). The results were announced during this year’s XXIst congress of the Society in
Karlovy Vary on 13 June 2013.

Results from the British Social Attitudes (BSA) Survey for 2012 were released by NatCen on
10 September 2013, and can be found here although the data itself has not yet been released.

Loi fédérale du 02.07.2013 n° 180-FZ, ajoutant à l’article 9 de la loi « Sur la liberté de
conscience et les associations religieuses » un nouvel alinéa 3, qui interdit à certaines
personnes (condamnées pour des activités extrémistes) d’être fondateur, « membre » ou
« participant » (associé) d’une organisation religieuse.
Loi fédérale du 02.07.2013 n° 185-FZ, modifiant les articles 4, 5 et 19 de la loi « Sur la liberté
de conscience et les associations religieuses » pour les harmoniser avec la nouvelle loi
fédérale « Sur l’éducation ». Notamment, au lieu du terme « établissement d’enseignement »
on utilise maintenant le terme « organisation d’enseignement ».
