This document is intended as useful information for applicants.
Given varying call requirements and specificities, the replies included in this
document cannot and do not replace or overrule the information contained in the
respective Guidelines for grant applicants that are published for each call for
proposals.
They also do not substitute the provisions in the Practical Guide to Contract
Procedures in External Actions. In case of discrepancy between the FAQ and the
Guidelines for grant applicants, the latter is the only legally binding document.

En cas de divergence entre les FAQ et les Lignes directrices à l'intention des
demandeurs de subventions, celles-ci constituent le seul document légal.

1) Eligibilité du demandeur et des partenaires / Eligibility of applicants and partners

Société de production cinématographique, nous souhaitons répondre à l’appel d’offre en
proposant un long-métrage malien. Soucieux de constituer ce dossier de la manière la plus
correcte possible, nous vous serions grés de bien vouloir répondre à ces questions :
peut-il y avoir des liens capitalistiques entre la société demandeur et les sociétés
partenaires? Puisque le demandeur doit être « une personne morale enregistrée
antérieurement à la date de publication du présent appel », peut-on en déduire que cette
contrainte n’est pas valable pour les partenaires ?

Le demandeur et les partenaires doivent être des entités juridiquement distinctes. Les
partenaires doivent satisfaire aux mêmes critères d’éligibilité qui s'appliquent au demandeur
de la subvention. (Cf. Lignes directrices 2.1.2 Partenariats et éligibilité des partenaires)

Est ce qu’un ministère de la culture ou la direction de la culture peut Etre éligible à cet
appel à propositions ?

2) Eligibilité de l’action / Eligibility of the action

Est il possible d’obtenir une subvention afin d’améliorer la qualité d’un film documentaire
et de passer à sa distribution. En effet, nous avons produit un film documentaire et faute de
moyen nous n’avons pu passer à la distribution.

Q
We have a doubt about the profile of the proposal itself. Our project is focused on the
designing of public policies in order to set the grounds for developing a cultural industry in,
at least, three African countries. The question is if this could be an eligible project. The call
is not absolutely clear about that because is apparently focusing the private initiative, but, at
the same time, «consulting and exchanging skills with culture sector operators, notably for
the design, implementation or adherence to regulations» are mentioned as well.

If our application is successful, part of the action will be implemented in an ACP state and
part of it in South Africa. The South African component will be financed by an SA
institution and none of the ACP money would be spend in SA. Would you consider this
proposal eligible?

3) Contrats / Contracts

J'aurais besoin de précisions sur le montage financier :
1/ La subvention est versée seulement au demandeur ou peut-elle être versée
en partie au demandeur et en partie à un des partenaires ?
2/A quel moment la subvention est-elle versée en amont du projet ? En fin de
projet ?
1/ Le demandeur est l’organisation chef de file et, en cas de sélection, le Bénéficiaire de la
subvention et la partie contractante. La subvention est versée au Bénéficiaire, qui reste seul
responsable vis-à-vis de l’Administration contractante de la mise en œuvre de l’Action. (Cf.
Lignes directrices, Annexes G1/G2 (Conditions particulières, art. 7.2) et Annexe II
(Conditions générales, art. 1.1 à 1.3)).
Le bénéficiaire est responsable des versements éventuels à ses partenaires et du respect par
ceux-ci des termes du contrat.
2/ La subvention est versée au bénéficiaire sous forme de tranches : le préfinancement initial
(au début du projet), les préfinancements intermédiaires (au cours de la mise en œuvre) et le
solde (à la fin du contrat).
En ce qui concerne le préfinancement initial, veuillez vous référer aux FAQ week 4/semaine
4 – Réponse 5-1. Pour la fréquence des demandes de paiement intermédiaires, voir également
les FAQ semaine 3 – Réponses 4-3 et 6-1. (Cf. Annexe G1 ou G2 des lignes directrices, Art.
7.2)
4) Montant de l’enveloppe financière / Financial Allocation

Les contributions en nature ne sont pas acceptées comme contribution du
demandeur au cofinancement de l'action. Mais peuvent-elles être considérées comme un
cofinancement d'un partenaire et faire partie des 20% minimum de cofinancement requis
pour les projets du lot 2?

Le solde du cofinancement de l'action (c'est-à-dire la différence entre le coût total de l'action
et le montant demandé à l'Administration contractante) doit être financé par les ressources du
demandeur, celles de ses partenaires ou par des sources autres que le budget de l'Union
européenne ou le Fonds européen de développement. (Cf. Lignes directrices 1.3)
Les contributions en nature ne sont pas acceptées comme contribution du demandeur ni des
partenaires.
5) Soumission de la proposition / Submission of the proposal

Q
Concerning the Call for Proposals 2012 I would like to know if partners also need to be cofinancers. And if yes, is there a comparable co-financing letter/agreement as in last year's call
for proposals?

The balance (i.e. the difference between the total cost of the action and the amount requested
from the Contracting Authority) must be financed from the applicant's or partners' own
resources, or from sources other than the European Union budget or the European
Development Fund. (Cf. Guidelines 1.3 Financial allocation provided by the Contracting
Authority).
At step 3 of the evaluation, provisionally selected applicants will be requested to supply
proof of the financial contributions of the other co-financing partners listed in the "Expected

sources of funding" (Cf. Guidelines Annex B) This proof may take the form of i.a. letters of
intent, letters of agreement, copies of contracts, etc. (Cf. Guidelines 2.4. Submission of
supporting documents for provisionally selected applications).

We have a couple of financial related question as follows:
1. Is there any cap/maximum % on the expenditure related to the EU partner? In our case,
apart from appointing an administrative and financial manager we envisage the appointment
of several UK based experts who would help us to develop and deliver the programme of
activities with our partners in Africa.
2. What’s the maximum we can spend in Equipment?

1. There is no specific limitation on expenditures related to any partner. The activities carried
out during the action should be appropriately reflected in the budget and the ratio between the
estimated costs and the expected results satisfactory (Cf. Guidelines 2.3.2 Step 2: evaluation
of the full application).

Q
Concernant la déclaration de partenariat, faut-il présenter une déclaration par partenaire
(signée par un seul partenaire à la fois) et/ou faut-il présenter une déclaration individuelle de
partenariat plus une déclaration qui serait signée par tous les partenaires y compris le
demandeur?

Q
I am a film producer from Germany who is helping to develop a feature film project called
[…]. The screenwriter and director of the project is from Grenada in the Caribbean. He is
currently based in Los Angeles, USA. Our story is set in Namibia and stars local actor and
filmmaker […]. Filming will take place on location in Namibia, where we are partnered with
a small, local production company. We also have a South African production company and a
German production company onboard.
Reading through the guidelines, three points remained unclear and we would
be happy if you could clarify them for us:
1. Would ACP Cultures Plus be satisfied with the non-ACP production company being a
small independent company? (The size being in keeping with the applicant's company size)
2. It is stated that the applicant (which would be one of our African production companies)
has to possess all rights - including copyrights. Since there are different types of copyright
laws and in Europe, for instance, it is legally impossible to sell or give away copyrights and
intellectual property rights (economic rights, however, are usually granted to the respective
production company), which law applies? In any case, is it enough if the applying production
company possesses the economic rights to the film?
3. Does financing have to be in place already?
4. If financial partners such as film funds require us to give them the rights for a certain
territory once they funded the project, would this still be in keeping with ACP Cultures Plus
requirements for the project?
5. How likely is it for a project to be granted the highest amount of 500,000 Euro and what
are the requirements in order for this to happen? If you could give us answers to these
questions, we would be very thankful. In case you need more information about the project in
order to answer these questions, please feel free to inquire.

1. The eligibility criteria will apply to any applicant and partner regardless of their size or
other characteristics. (Cf Guidelines 2.1.1 Eligibility of applicants)
2. Where applicable, the applicant will be required to provide copies of the rights forfeiture
agreements, joint production rights, distribution rights, or pre-purchase rights. (Cf. Guidelines
2.1.3 and 2.4)
3. At step 3 of the evaluation, provisionally selected applicants will be requested to supply
among other documents, proof of the financial contributions of the other co-financing
partners listed in the "Expected sources of funding" (Cf. Guidelines Annex B) This proof may
take the form of i.a. letters of intent, letters of agreement, copies of contracts, etc. (Cf.
Guidelines 2.3.3 Step 3 : verification of eligibility of the applicant and partners and 2.4.
Submission of supporting documents for provisionally selected applications)
4. The rights required by the European Commission and by the ACP Secretariat on a film are
non-exclusive and non-commercial for a period of 10 years. These rights are detailed in art.
7.1.2 of the Special Conditions of the grant contract. (Cf. Guidelines, Annex G1)
5. In the interest of equal treatment of applicants, the Contracting Authority cannot give a
prior opinion on the eligibility of an applicant, a partner, an action or specific activities.
