This is an Order pursuant to clause 12(1)(q) of The Assessment Management Agency Act, to:
(a) repeal the 2013 Revaluation Base Date Order, which Order was approved by the SAMA Board on
December 16, 2009, and published in The Saskatchewan Gazette on December 31, 2009; and
(b) establish January 1, 2011 as the base date for determining assessed values of properties for the
years 2013 to 2016.

The Assessment Management Agency Act
[subsection 12.1(4)]

2013 Revaluation Base Date
Whereas:
1 Clause 2(e.1) of The Assessment Management Agency Act (the “Act”) provides that:
“(e.1) ‘base date’ means, subject to the regulations, the date that is established, by order, by the
agency and that is approved by the minister for determining the value of land and improvements for
the purpose of establishing assessment rolls for the year in which the valuation or revaluation is to
be effective and for each subsequent year preceding the year in which the next revaluation is to be
effective;”
2 Clause 12.1(1)(a) of the Act requires ministerial approval of orders of the Board of Directors of the
Saskatchewan Assessment Management Agency (the “Board”) relating to the establishment of base dates
pursuant to clause 2(e.1) of the Act.
3 The Board has made an order dated July 8, 2010 which repeals a previous order that established
the base date as December 31, 2010 for the 2013 revaluation and which establishes an amended date of
January 1, 2011 as the base date for determining values of properties for the years 2013-2016 (the “Board
Order”).
4 The Board has applied to the minister to have the Board Order approved.
5 It is in the public interest to approve the Board Order.
Therefore, pursuant to subsection 12.1(4) of The Assessment Management Agency Act, I hereby approve the order
of the Saskatchewan Assessment Management Agency dated July 8, 2010 which order repeals a previous order
that established the base date as December 31, 2010 for the 2013 revaluation and which establishes an amended
date of January 1, 2011 as the base date for determining values of properties for the years 2013‑2016.

COURT OF QUEEN’S BENCH For Saskatchewan
The Rules of the Court of Queen’s Bench for Saskatchewan are amended, effective the 10th day
of September, 2010, in the manner set out below:
1 Part Forty-eight (Family Law Proceedings) of The Queen’s Bench Rules is amended by adding
the following Division after Division IX:
“DIVISION X
“Proceedings under The International Child Abduction Act, 1996
“652 In this Division:
‘Act’ means The International Child Abduction Act, 1996;
‘applicant’ includes any person, institution or other body claiming that a child has been removed or
retained in breach of custody rights;
‘Central Authority’ means a Central Authority designated under article 6 of the convention;
‘contracting state’ means a state signatory to the convention;
‘convention’ means the Convention on the Civil Aspects of International Child Abduction, a copy of
which is set out in the Schedule to the Act.
“653(1) This Division applies to family law proceedings under the Act and the convention.
(2) Unless provided otherwise by the Act or the convention or by the rules in this Division, the provisions
of this Part and the general procedure and practice of the court shall be adopted and applied, with necessary
modification, in a family law proceeding under this Division.
“654 An applicant who wishes to commence a family law proceeding under this Division shall do so by
Notice of Motion (Family Law Proceedings) in Form 602.
“655 An affidavit in support of a motion made under this Division shall set out:
(a) information concerning the identity of the applicant, the child and the person or persons alleged
to have removed or retained the child;
(b) the date of birth of the child;

(c) evidence of where the child was habitually resident before coming to Saskatchewan;
(d) the circumstances under which the child came to be in Saskatchewan;
(e) the grounds on which the applicant’s claim for return of the child is based, including the
circumstances of the alleged wrongful removal or retention; and
(f) all available information relating to the whereabouts of the child and the identity of the person
in whose care the child is presumed to be.
“656 The following shall also be filed in support of a motion made under this Division:
(a) a certified copy of any relevant judicial decision or agreement pertaining to either or both of
custody and access to the child;
(b) when any person is arguing that the law of another jurisdiction applies or is relevant to the
application, an affidavit of law from the Central Authority or other person approved by the court;
(c) any other relevant fact or document.
“657(1) A party bringing a motion under this Division shall serve the motion and the supporting documents
on:
(a) the person in Saskatchewan who has the child in his or her care; and
(b) the Central Authority for Saskatchewan.
(2) Service shall be effected in accordance with the provisions of this Part relating to the service of a notice
of motion commencing a family law proceeding claiming substantive relief, except that the party shall file
the motion and supporting material with proof of service seven days before the date set for hearing the
motion.
“658 An application under this Division shall be dealt with expeditiously and, except in extraordinary
circumstances, a decision shall be rendered within six weeks of the commencement of an application.
“659 If the presiding judge considers it necessary, the presiding judge may:
(a) establish time lines for the filing and service of materials and set a date for the hearing of an
application under this Division;
(b) permit any party to an application under this Division to appear by way of telephone or video
conference where appropriate;
(c) adjourn the proceeding and order a Children’s Voice Report;
(d) initiate direct communication with either or both of the Central Authority and a judge of the
contracting state where the child habitually resides subject to the following:
(i) the communication is to be limited to logistical issues and the exchange of information;
(ii) the parties to the application shall be entitled to be present during the communication and
to participate as directed by the judge;
(iii) a record of the communication shall be kept by the local registrar;
(iv) the record of communication is to be confirmed in writing by both judges or by the judge
and the individual representing the Central Authority of the contracting state.
“660(1) Costs are in the discretion of the court, and except as modified by this Rule, the provisions of Part
Forty-Six and of this Part apply to the costs of an application under this Division.
(2) The court may order costs including, but not limited to:
(a) costs incurred for legal representation;
(b) costs incurred to locate the child; and
(c) costs associated with the return of the child”.

2 Subrule 704(1) is amended:
(a) in the portion preceding clause (a) by striking out “Where the deceased died leaving a will,
the priority of right to a grant of probate or administration with will annexed shall be as follows” and
substituting “Where the deceased died leaving a will, the persons entitled to apply for a grant of probate
or administration with will annexed are the following in order of priority”;
(b) in clause (b) by striking out “legatees or devisees” and substituting “beneficiaries”;
(c) in clause (c) by striking out “legatees or devisees” and substituting “beneficiaries”;
(d) in clause (d) by striking out “legatees or devisees” and substituting “beneficiaries”; and
(e) by repealing clauses (e) to (h) and substituting the following:
“(e) executors and administrators of persons mentioned in clause (d);
“(f) beneficiaries and creditors;
“(g) contingent residuary beneficiaries, contingent beneficiaries and persons having no interest in
the estate who would have been entitled to a grant if the deceased had died wholly intestate;
“(h) the official administrator”.
3 Rule 712 is amended:
(a) in the portion preceding clause (a) by striking out “Where the deceased died wholly intestate,
the priority of right to a grant of administration shall be as follows” and substituting “Where the deceased
died intestate, the persons entitled to apply for a grant of administration are the following in order of
priority”;
(b) in clause (c) by striking out “, or” and substituting “and”;
(c) by repealing clauses (d) and (e) and substituting the following:
“(d) father or mother;
“(e) siblings”; and
(d) by repealing clause (j) and substituting the following:
“(j) the official administrator.”
4 Rule 720 is amended in subclause (1)(b)(i) by striking out “$5,000” and substituting “$25,000.”
5 Schedule I “D” of the Tariff of Costs is repealed and the following substituted:

et s’appliquent, avec les adaptations nécessaires, aux instances en matière familiale engagées sous le régime
de la présente section.
« 654 Le demandeur qui désire introduire une instance en matière familiale sous le régime de la présente
section doit le faire par Avis de motion (instance en matière familiale) établi selon la formule 602.
« 655 L’affidavit à l’appui d’une motion présentée sous le régime de la présente section doit indiquer les
éléments suivants :
a) des informations portant sur l’identité du demandeur, de l’enfant et de la personne ou des personnes
dont il est allégué qu’elle a ou qu’elles ont emmené ou retenu l’enfant;
b) la date de naissance de l’enfant;
c) une preuve du lieu où l’enfant avait sa résidence habituelle avant de venir en Saskatchewan;
d) les circonstances dans lesquelles l’enfant s’est retrouvé en Saskatchewan;
e) les motifs sur lesquels se base le demandeur pour réclamer le retour de l’enfant, y compris les
circonstances du prétendu déplacement ou non-retour illicite;
f) toutes informations disponibles concernant la localisation de l’enfant et l’identité de la personne
entre les mains de qui l’enfant est présumé se trouver.
« 656 Les éléments suivants sont également déposés à l’appui d’une motion présentée sous le régime de
la présente section :

« 657(1) La partie auteure d’une motion présentée sous le régime de la présente section signifie la motion
et les documents à l’appui :
a) à la personne en Saskatchewan qui garde l’enfant;
b) à l’Autorité centrale en Saskatchewan.
(2) La signification est régie par les dispositions de la présente partie relatives à la signification d’un
avis de motion introductive d’une instance en matière familiale sollicitant un redressement de fond, à la
différence que la partie doit déposer la motion et les pièces justificatives accompagnées de la preuve de
signification sept jours avant la date fixée pour l’audition de la motion.
« 658 Toute demande présentée sous le régime de la présente section est traitée de façon expéditive et,
sauf circonstances extraordinaires, la décision est rendue dans les six semaines suivant l’introduction de
la demande.
« 659 S’il l’estime nécessaire, le juge présidant l’instance peut :
a) fixer un échéancier pour le dépôt et la signification de la documentation et une date pour l’audition
de la demande présentée sous le régime de la présente section;
b) autoriser une partie à une demande présentée sous le régime de la présente section à comparaître
par voie de conférence téléphonique ou vidéo dans les cas appropriés;

(i) la communication doit se limiter à des questions de logistique et à l’échange de
renseignements,
(ii) les parties à la demande ont le droit d’être présentes pendant la communication et d’y
participer sous la direction du juge,
(iii) le registraire local consigne la communication au dossier,
(iv) la consignation est confirmée par écrit par les deux juges ou par le juge et le représentant
de l’Autorité centrale de l’État contractant.
« 660(1) Les dépens sont adjugés à l’appréciation du tribunal et, sauf modification apportée par la présente
règle, les dispositions de la partie 46 et de la présente partie s’appliquent aux dépens d’une demande
présentée sous le régime de la présente section.
(2) Le tribunal peut adjuger des dépens, au titre notamment :
a) des frais de représentation en justice;
b) des frais exposés pour retrouver l’enfant;
c) des frais liés au retour de l’enfant ».

EXTRACTS FROM THE RULES AND PROCEDURES OF THE
LEGISLATIVE ASSEMBLY OF SASKATCHEWAN RELATING TO PRIVATE BILLS

PETITIONS
14(1) A petition to the Assembly may be presented by a Member at any time during the sitting of the Assembly
by filing the same with the Clerk of the Assembly.
14(6) Petitions may be either written or printed; provided always that when there are 3 or more petitioners,
the signatures of at least 3 petitioners shall be subscribed on the sheet containing the prayer of the petition.
14(9) No petition can be received which prays for any expenditure, grant or charge on the public revenue,
whether payable out of the Consolidated Fund or out of moneys to be provided by the Assembly.
NOTE: A form of Petition can be obtained on application to the Clerk of the Legislative Assembly.
PRIVATE BILLS
75(1) All petitions for Private Bills shall be in duplicate and shall be filed with the Clerk of the Assembly
not later than the twentieth sitting day of the Session.
75(2) No petition for any Private Bill shall be received by the Assembly if presented after the first twentyfive sitting days of the Session.
75(3) No Private Bill may be introduced in the Assembly after the first thirty sitting days of the Session.
76(1) Every applicant for a Private Bill shall deposit with the Clerk of the Assembly, along with the petition
for same, 2 copies of the bill, with marginal notes inserted, and an accepted cheque payable to the Minister of
Finance for the sum of two hundred and fifty dollars, if the said bill does not exceed ten pages, and fifteen dollars
additional for each page over that number; four hundred and fifty words shall be held to constitute a page.
76(2) In the case of a bill incorporating a company, a receipt from the Registrar of Joint Stock Companies
for any statutory fees required shall also be deposited with the Clerk of the Assembly.
77 No remittance of a deposit on account of a Private Bill or any portion thereof shall be ordered by the
Assembly unless the same has been recommended by the committee charged with its consideration, or unless
the bill has been withdrawn, rejected or not reported upon, in which cases the actual expenses incurred shall
be deducted from the deposit received before making such remittance.
79(1) All petitions to the Legislature for Private Bills of any nature whatsoever, shall require a notice, clearly
and distinctly specifying the nature and object of the application, and where the same refers to any proposed
work, indicating generally the location of the work, and signed by and on behalf of the petitioners, with the
address of the party signing the same; and when the petition is for an act of incorporation, the name of the
proposed company shall be stated in the notice.
79(2) Such notice shall be published prior to the filing of the petition with the Clerk of the Assembly as
required in Rule 75(1) in 2 consecutive issues of The Saskatchewan Gazette and 4 consecutive issues of a
newspaper, published in English and having circulation in the locality affected.

79(3) A copy of the notice with a statutory declaration of the several publications of advertisement shall be
filed with the Clerk of the Assembly along with the petition and bill.
80(2) Every bill for an act of incorporation, where a form of model bill has been adopted, shall be drawn in
accordance with such model bill, copies of which may be obtained from the Clerk of the Assembly. Any provisions
contained in any such bill which are not in accord with the model bill shall be inserted between brackets and
shall be so printed.
83 When any bill for confirming any agreement is filed with the Clerk of the Assembly, a true copy of such
agreement must be attached to it.
COMMITTEE RULING
In cases where the proposed bill provides that the property to be used or occupied by the petitioner be exempt
from taxation, either in whole or in part, the petitioner must file with the Clerk of the Assembly, along with the
petition, a written statement from the local municipal authority in which the said property is situated approving
the intent of the provisions of the proposed bill which provide for the exemption from taxation.
The name of the Member who is to present the petition and Private Bill must be furnished to the Clerk of the
Assembly at the time of filing the petition. Such Member should not, of course, be a Member of the Cabinet.

PÉTITIONS
14(1) Les députés peuvent toujours présenter des pétitions à l’Assemblée pendant les séances en les déposant
auprès du greffier de l’Assemblée.
14(6) Les pétitions sont écrites ou imprimées; s’il y a plus que 2 pétitionnaires, au moins 3 de ceux-ci inscrivent
leur signature sur la feuille qui expose la requête.
14(9) Ne sont pas recevables, les pétitions qui demandent que soient faites des dépenses, des subventions
ou des charges sur les revenus publics, y compris sur le Trésor ou sur des sommes allouées par l’Assemblée.
AVIS — Un formulaire de pétition est disponsible sur demande auprès du greffier de l’Assemblée législative.
PROJETS DE LOI D’INTÉRÊT PRIVÉ
75(1) Deux exemplaires des pétitions introductives de projets de loi d’intérêt privé sont déposés auprès du
greffier de l’Assemblée dans les vingt jours de séance de l’ouverture de la session.
75(2) Seules sont recevables par l’Assemblée les pétitions introductives de projet de loi d’intérêt privé qui
sont présentées dans les vingt-cinq jours de séance de l’ouverture de la session.
75(3) Les projets de loi d’intérêt privé ne peuvent être déposés à l’Assemblée que dans de les trente jours de
séance de l’ouverture de la session.

76(1) Les personnes qui demandent un projet de loi d’intérêt privé déposent auprès du greffier de l’Assemblée,
outre la pétition connexe, 2 exemplaires du projet de loi qui portent les notes marginales ainsi qu’un chèque
visé payable au ministre des Finances, au montant de deux cent cinquante dollars si le projet de loi est composé
d’au plus dix pages; ce montant est majoré de quinze dollars par page supplémentaire. Une page est réputée
renfermer quatre cent cinquante mots.
76(2) Si le projet de loi prévoit la constitution d’une société, le récépissé des droits réglementaires donné par
le registraire des sociétés par actions est également déposé auprès du greffier de l’Assemblée.
77 L’Assemblée ne peut ordonner la remise totale ou partielle des dépôts relatifs aux projets de loi d’intérêt
privé, sauf recommandation du comité chargé d’étudier le projet en question ou si celui-ci est retiré ou rejeté
ou encore n’est pas rapporté. Les dépenses réelles sont déduites du dépôt avant de le remettre.
79(1) Toutes les pétitions introductives de projets de loi d’intérêt privé à l’adresse de la Législature nécessitent
un avis qui expose clairement la nature et l’objet de la demande et qui est signé par les requérants et en leur
nom, avec mention de l’adresse des signataires. Les avis qui visent des travaux proposes font état de leur
emplacement; ceux qui visent une loi de constitution en société font état du nom de la société.
79(2) Les avis requis en vertu du paragraphe 75(1) sont publiés, avant le dépôt de la pétition auprès du
greffier de l’Assemblée dans 2 numéros consécutifs de la Gazette de la Saskatchewan ainsi que dans 4 numéros
consécutifs d’un journal anglais diffusé dans la région touchée.
79(3) Sont déposées auprès du greffier de l’Assemblée, outre la pétition et le projet de loi, copie de l’avis ainsi
qu’une déclaration solennelle qui atteste les diverses publications de l’annonce.
80(2) Si une formule-type de projet de loi a été adoptée, les projets de loi portent constitution des sociétés
sont rédigés selon cette formule, dont les exemplaires peuvent être obtenus chez le greffier de l’Assemblée.
Les dispositions de ces projets de loi qui ne se conforment pas à la formule-type sont indiquées et imprimées
entre crochets.
83 Une copie conforme de l’accord est annexée aux projets de loi portent ratification d’un accord, qui sont
déposés auprès du greffier de l’Assemblée.
dÉcision en comitÉ
Dans les cas où la proposition de projet de loi prévoit que les biens devant être utilisés ou occupés par le
requérant soient exempts d’impôts, que ce soit dans leur ensemble ou partiellement, le requérant devra déposer
au bureau du greffier de l’Assemblée en plus de sa pétition, une déclaration par écrit des autorités municipales
locales où se trouvent les biens en question approuvant l’objet des dispositions de la proposition de projet de
loi qui prévoit l’exemption d’impôts.
Le nom du député qui présentera la pétition et le projet de loi doit être fourni au greffier de l’Assemblée lors
du dépôt de la pétition. Il est entendu que le député en question ne peut être un membre du Cabinet.

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the Monday of
the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m.
of the previous Friday. Please allow yourself at least one full week to ensure mail delivery of Gazette
submissions. Publication of any material received late will be delayed until the following week’s issue.
All material for publication in The Saskatchewan Gazette must be submitted electronically (WordPerfect
or Word) accompanied by a signed hard copy to the Office of the Queen’sPrinter, Saskatchewan Justice,
B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].
Each document or disk must be complete in the form required for publication and must be separate from
the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below
the written signatures.
Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients.
Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the
GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.
The minimum charge for publication of notices not specified below is $16.00 for each notice, which
sum shall accompany the material when forwarded for publication.

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi
à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de
tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette
par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera
remise au numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement
(WordPerfect ou Word) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur
