Health control of products of animal origin not intended for
human consumption
“Control sanitario de productos de origen animal no
destinados el consumo humano”
Imports into the European Union (EU) of animal products not intended for human consumption must
comply with general conditions of public and animal health designed to guarantee a high level of
health and safety throughout the food and feed chains and to avoid the spread of infectious diseases
that are dangerous to livestock or humans.
The general health requirements applicable to these products are related to:

Hence, these products can only be imported into the EU if they come from an approved
establishment of a third country included in a positive list of eligible countries for the relevant product,
are accompanied by the proper health certifications and have succeeded the mandatory controls at
the pertinent Member State’s border inspection post (BIP).
However, the European authorities might suspend imports from all or part of the third country
concerned or take interim protective measures when products may present any risk for public or
animal health as in the case of dangerous diseases outbreaks.

In addition, if these products are intended for animal nutrition, they shall also comply with the general
rules on:





General principles and requirements of Food Law established in Regulation (CE) No.
178/2002 (OJ L-31 01/02/2002);
General requirements for feed hygiene according to Regulation (EC) No. 183/2005 (OJ L-35
08/02/2005);
General conditions concerning certain substances and pesticide residues in and on feed;
Specific marketing and labelling requirements for feed materials, compound feedingstuffs and
feedingstuffs intended for particular nutritional purposes;
Special rules for the authorisation of the use of certain products in feed: bioproteins,
Genetically Modified Organisms (GMOs) and additives;
EU legislation establishing general health conditions.
1. Country Health Approval
The European Commission's Health and Consumer Protection Directorate-General (DG SANCO)
applies a procedure to assess the candidate's third country compliance with EU Public and Animal
Health conditions. Once approved, the third country is added to the list of authorised countries for
that particular category of product. The positive lists of eligible countries for imports of animal byproducts are published in Annex XI to Regulation (EC) No. 1774/2002 (OJ L-273 10/10/2002).

2. Approved establishments
In addition to country approval, products of animal origin not intended for human consumption may
only be imported into the EU if they have been dispatched from, and obtained or prepared in,
approved establishments (processing and storage, oleo chemical, biogas and composting, pet food
and technical plants, etc). Regulation (EC) No. 1774/2002 (OJ L-273 10/10/2002) establishes
different approval procedures depending on the type of products.
3. Health certificate
Imports of these products into the EU must be accompanied by a health certificate signed by the
representative of the competent authority of the exporting third country certifying that the products
in question are suitable to be exported to the EU.
There are different models of certificate set forth in EU legislation, which vary according to the type
of product concerned, the use intended and/or the special conditions that may be laid down for
those particular product. The models of health certificates for imports of animal by-products are
published in Annex X to Regulation (EC) No. 1774/2002 (OJ L-273 10/10/2002).

4. Health Control
Upon arrival, the products and the accompanying certificates must be verified and checked by the
veterinarian officials in accordance with the provisions laid down in Council Directive 97/78/EC (OJ
L-24 (OJ L-24 30/01/1998). Applying the procedures laid down by Commission Regulation (EC)
136/2004 (OJ L-021 28/01/2004), the result of the inspection shall be reflected in the Common
Veterinary Entry Document (CVED).

Health Control Procedure
Health controls are carried out at designated control points at Border Inspection Posts (BIPs).
The importer, or his representative, must request the health inspection in advance by submitting
part 1 of the EU harmonised Common Veterinary Entry Document (CVED), together with all the
necessary certificates related to the consignment.
After documentary check the product may go through identity check and physical inspection which
may lead to sample taking for analysis.
The result of the inspection is reflected in part 2 of the CVED. The product can only be released for
consumption after a favourable result.

Import licence for agricultural products

Imports of the selected product code are subject to the prior issue of an import licence (called import
certificate) by the competent authority of the importing Member State, which entitles and obliges the
importer to introduce in the European Union (EU) the requested quantities. In order to obtain the
licence, the importer shall deposit a security, which is returned once the importation takes place within
the established period.
Import licence (import certificate)
Import certificates are issued by the competent authorities of the Member State prior to clearance for
free circulation, upon:
1. request of the certificate using an application form, drawn up in duplicate ("holder's copy" and
"copy for the issuing authority"), using either the specimen depicted in Annex I to Regulation
1291/2000/EC (OJ L-152 24/06/2000) or other sufficient means approved by the responsible
authority; plus
2. deposit of an adequate security, which amount is set in the Common Organisation of the
Market for each agricultural sector. The deposit is returnable once the importer has fulfilled all
his/her obligations. No security will be required if it comes to EUR 100 or less, or if the licence
is drawn up in the name of an intervention agency.
Certificates can also be issued using computerised systems according to rules laid down by the
competent authorities.
The import certificate constitutes both an authorisation and an obligation to import the specified
quantity of the products concerned during its period of validity.
If the imported quantity is greater or less by not more than 5% of which is indicated in the certificate,
the obligation to import will be considered as fulfilled. The security deposited upon importation shall
not be returned if the importer fails to comply with his obligations.
Obligations deriving from certificates are not transferable, though rights can be transferred by their
titular holder, during the period of its validity and for the quantities not yet attributed to the certificate.
Exceptions
Licences shall not be required for the purposes of the following operations:
a. of a non-commercial nature;
b. relating to quantities not exceeding those set out in Annex III to Regulation 1291/2000/EC,
depending on the product;
c. referred to in Regulation 918/83/EEC (OJ L-105 23/04/1983), which sets up a system of
reliefs from customs duties, as:
1. personal belongings, small consignments, educational and research products;
2. agricultural products obtained by EU citizens from properties located in a third country
bordering on the Community;
3. seeds, fertilisers and products for treatment of soil and crops intended for use by third
country's farmers in EU territory adjoining that country.
