………………………………………………………………. ……………………………………………………………….. Question 2: Il est proposé d’ajouter les éléments suivants à la règle 2: “an indication of partial design” et “a request for an earlier publication”. Oui An indication of partial design Non Remarques ………………………………………………………………… ………………………………………………………………. 1 A request for an earlier publication ………………………………………………………………… ………………………………………………………………. Veuillez indiquer si les conditions pour obtenir une date de dépôt peuvent être complétées avec ces éléments: Oui Non Neutre A claim An indication of the product(s) which incorporate the industrial design, or in relation with the industrial design is to be used A brief description 2 Where the appointment of a representative is mandatory, such appointment Any further indication or element as prescribed under applicable law DELAI DE GRACE (article 6) L’article 6 prévoit un délai de grâce, défini à l’article 6 en projet comme “un délai de 6 ou 12 mois”, ce qui permet une certaine harmonisation, les Etats contractants n’ayant que deux délais de grâce possibles. Autorise Peut autoriser Question 6: Lors de la réunion SCT 28, il a été proposé d’ajouter un nouveau paragraphe à l’article 9, libellé comme suit: “Notwithstanding anything contained in this article, an office may (a) not disclose any information relating to the registration of an industrial design which it considers prejudicial to the interest or security of the Contracting Party and (b) take any action regarding the cancellation of the registration of the industrial design by the Contracting Party, as described by applicable law.”. SURSIS EN MATIERE DE DELAIS (Article 12) Une délégation a proposé de rendre cette disposition facultative (“A contracting party [may][shall] provide for the extension, for the period prescribed in the Regulations, of a time limit fixed by the Office for an action in a procedure before the Office, (…).”.) 4 Question 7: Veuillez indiquer si vous préférez une disposition obligatoire (autorise) ou facultative (peut autoriser): autorise Peut autoriser RETABLISSEMENT DES DROITS (Article 13) Question 8: Veuillez indiquer si vous préférez une disposition obligatoire (autorise, article 13 option 1) ou facultative (peut autoriser, article 13 option 2): Option I: autorise Option II: peut autoriser Question 9: Un délégation propose d’ajouter un nouvel 13bis et une règle 11bis, intitulés “Correction or addition of Priority Claim, Restauration of priority right” (texte ajouté à la fin de ce questionnaire). In particular, any requirements by tax authorities and monetary authorities of a Party are exempt from any obligation under these articles.”.
