The major amendments made by the Bill are described below. Le projet de loi met en oeuvre des mesures mentionnées dans le budget de 2000. Les principales modifications sont exposées ci-dessous. PART I CORPORATIONS TAX ACT PARTIE I LOI SUR L’IMPOSITION DES CORPORATIONS Amendments to section 38 of the Corporations Tax Act reduce the rate of corporate income tax from 15.5 per cent to 14.5 per cent as of May 2, 2000. The rate is further reduced to 14 per cent as of January 1, 2001. Les modifications apportées à l’article 38 de la Loi sur l’imposition des corporations ramènent le taux d’imposition du revenu des corporations de 15,5 à 14,5 pour cent à compter du 2 mai 2000. Consequential to the reduction of the corporate income tax rate, adjustments are made to the rate of the add-back to income under subsection 11 (5) of the Act with respect to certain payments to non-residents. Par suite de la diminution du taux d’imposition du revenu des corporations, des redressements sont apportés au taux de la réintégration dans le revenu, prévue au paragraphe 11 (5) de la Loi, de certains montants payés à des personnes non résidentes. Technical amendments are made to other provisions of the Act to reflect the reduction of the corporate income tax rate. These provisions are section 39, clause 40 (1) (e) and subsection 48 (5). Under section 41 of the Act, the small business deduction currently reduces the tax rate on active business income earned by a corporation to 8 per cent. Also, the Act now provides for this rate to be further reduced to 4.75 per cent by January 1, 2006. Amendments to that section will decrease the small business tax rate to 4 per cent by January 1, 2005, instead. A similar reduction is made to the tax rate available to credit unions on certain income in excess of the small business deduction, by an amendment to subsection 51 (4) of the Act. Amendments to sections 41 and 41.1 of the Act also increase the amount of a corporation’s active business income that is eligible for the small business deduction from $200,000 to $400,000. The benefit of this deduction will be recaptured when a corporation has active business income greater than $400,000, so that the benefit of the deduction is fully recaptured when the corporation’s active business income is $1 million or more. Both the $400,000 and the $1 million thresholds will be phased in over five years, beginning on January 1, 2001. Technical amendments are made to sections 43 and 78 of the Act to reflect this change. PART II INCOME TAX ACT PARTIE II LOI DE L’IMPÔT SUR LE REVENU The amendments to the Income Tax Act reduce the rate of personal income tax in the lowest and middle tax brackets, change the method of calculating tax, increase the amount of the Ontario child care supplement for working families that is available to single parents and provide for a rebate of 1999 income taxes. Les modifications apportées à la Loi de l’impôt sur le revenu réduisent le taux de l’impôt sur le revenu des particuliers dans les tranches de revenu inférieure et moyenne, modifient le mode de calcul de l’impôt, augmentent le supplément de revenu de l’Ontario pour les familles travailleuses ayant des frais de garde d’enfants qui est offert aux chefs de famille monoparentale et prévoient une remise de l’impôt sur le revenu de 1999. The amendments to sections 1 and 4 of the Act and the enactment of sections 4.3 and 4.4 of the Act provide that Ontario personal income tax will be calculated as a percentage of taxable income, starting in the 2000 taxation year. Ontario tax credits and adjustments will parallel the federal credits and adjustments that are used to determine basic federal tax. The tax rates for the lowest and the middle tax brackets are reduced, beginning in the 2000 taxation year. The tax rates and tax brackets applicable for Ontario income tax are set out in the Act. Amendments to section 3 of the Act make a related change to the annual surtax. The surtax will continue to apply at the same income levels as it does now. The enactment of section 7.1 of the Act provides a tax rebate to Ontario residents of their first $200 in 1999 Ontario personal income taxes, with a minimum refund of $25 for Ontario residents who were taxable in 1999. The amendments to section 8.5 of the Act increase the amount of the annual Ontario child care supplement for working families that is available to a single parent by $210 for each child under 7 years of age, beginning July 1, 2000. PART III LAND TRANSFER TAX ACT PARTIE III LOI SUR LES DROITS DE CESSION IMMOBILIÈRE The Land Transfer Tax Act now permits the refund of land transfer tax payable on the purchase of a newly-constructed home by a first-time buyer, but only if the purchase occurred on or before March 31, 2000. Amendments remove that limitation. La Loi sur les droits de cession immobilière permet actuellement le remboursement des droits de cession immobilière que doit acquitter l’acheteur d’un logement neuf, mais uniquement si l’achat survient le 31 mars 2000 ou avant cette date. La modification supprime ce délai. PART IV MINING TAX ACT PARTIE IV LOI DE L’IMPÔT SUR L’EXPLOITATION MINIÈRE Currently, the mining tax rate is 20 per cent. Section 3 of the Mining Tax Act is amended to phase in a reduction in that rate to 10 per cent. The new rate is phased in over a period of five years. PART V RETAIL SALES TAX ACT PARTIE V LOI SUR LA TAXE DE VENTE AU DÉTAIL Currently, a person who repairs or replaces tangible personal property under a warranty or guarantee is subject to an 8 per cent tax under the Retail Sales Tax Act on the cost of the repair or the replacement. Under the new section 2.0.1, this tax is reduced in stages to zero after March 31, 2004. Related amendments are made to the definitions of “fair value” and “purchaser” in subsection 1 (1) of the Act and to subsection 7 (1) of the Act. Currently, a 5 per cent tax is payable on automobile insurance premiums. Amendments to section 2.1 of the Act reduce that rate in stages to zero after March 31, 2004. An amendment is also made to authorize vendors to refund overpayments of tax resulting from the reduced rate. Présentement, les primes d’assurance-automobile sont assujetties à une taxe calculée au taux de 5 pour cent. Les modifications apportées à l’article 2.1 de la Loi réduisent ce taux par étapes jusqu’à ce qu’elle soit nulle après le 31 mars 2004. An amendment to subsection 2.1 (10) of the Act provides that premiums, assessments or contributions paid under the Credit Unions and Caisses Populaires Act, 1994 are not subject to tax under the Act. Amendments affecting paragraphs 13, 13.1 and 14 of subsection 7 (1) concern certain exemptions relating to farms and farming. The current exemptions for farm equipment and farm supplies are consolidated into paragraph 13. An exemption is also given for tangible personal property that is incorporated into buildings that are used exclusively in the business of farming. Gifts to schools, colleges or universities are exempted from retail sales tax, by the new clause 4.2 (4) (d.1) and paragraph 64 of subsection 7 (1) to the Act. This exemption is created by the addition of paragraph 65 of subsection 7 (1) to the Act. (1) Subsection 11 (5) of the Corporations Tax Act, as re-enacted by the Statutes of Ontario, 1998, chapter 34, section 28, is repealed and the following substituted: 1. However, no refund shall be made more than four years after the date on which the tax to be refunded was paid. Annulation de la taxe No refund (6.3) A person liable to pay tax under this section on a premium payment due before May 3, 2000 under a contract of automobile insurance is not entitled to a refund of the tax paid on the premium by reason of the amendment or termination of the contract after May 2, 2000 and before the expiry of the period of coverage under that contract unless the person establishes to the satisfaction of the Minister that the amendment or termination was not for the purpose of renewing, replacing or modifying that contract for substantially similar coverage for a premium taxable at a lower rate of tax under this section.
