reviewing the work of the Selection Committee.
The Poet Laureate has written a poem entitled "My City" written especially for
the inauguration of the position of Poet Laureate for the City of Greater
Sudbury. The Poet Laureate will read the poem at the Council meeting.)

2. Source Water Protection Plan for the Greater Sudbury Source Protection Area

(The Nickel District Conservation Authority/Greater Sudbury Source Protection
Authority (NDCA/GSSPA) have been working on a municipal drinking water Source
Protection Plan for the Greater Sudbury Source Protection Area. In June, 2010 a
scientific based Assessment Report will have to be submitted to the Minister of the
Environment and by August 2012, the first Source Protection Plan for our area will have
to be submitted to the Province.
The Province is currently paying 100% of the cost for the planning phase of this
project and will do so until the Source Protection Plan is submitted in 2012.
Following 2012, the NDCA and the City of Greater Sudbury will have
implementation and monitoring responsibilities under the Clean Water Act. At
this time the Province has not identified how funding for post 2012 work will be
provided.
The NDCA/GSSPA would like to start discussion with the City of Greater
Sudbury on the post 2012 period for source protection planning in our
watershed.)

private road has been given. Public notice of the proposed By-law has been
given as required by the Municipal Act 2001 and in accordance with the City’s

MOTIONS
R-3. As presented by Councillor Berthiaume:
WHEREAS water privatization has detrimental impacts on the environment and adds
additional cost to the user;
AND WHEREAS manufacture and disposal of plastic bottles releases
dangerous toxic chemicals and contaminants into the air, contributing to
environmental degradation;
AND WHEREAS bottled water distribution requires fossil-fuel based
transportation and contributes to global warming while tap water is energy
efficient in its delivery;
AND WHEREAS public tap water is safe, healthy and significantly more
accessible and environmentally sustainable than bottled water;
AND WHEREAS Canada’s system of public water provision is reliable,
subsidized and of high quality;

AND WHEREAS public ownership of water sources is the only way to
ensure adequate, accessible and clean drinking water;
AND WHEREAS enforced government regulations and guidelines of public
water systems are the best and only way to ensure public trust in tap water
for drinking and avoiding dependence on bottled water;
THEREFORE BE IT RESOLVED THAT the City of Greater Sudbury endorse
the Canadian Federation of Students, Sierra Youth Coalition and Polaris
Institute’s Bottled Water Campaign and declare March 11th Bottled Water
Free Day;
AND BE IT FURTHER RESOLVED THAT residents of Greater Sudbury be
encouraged to take the Bottled Water Free Day Pledge and hold events to
create awareness about this campaign;
AND BE IT FURTHER RESOLVED THAT residents be encouraged to work
together and with coalition partners to promote Bottled Water Free Day and
create awareness of the dangers of water privatization.
R-4. As presented by Councillor Landry-Altmann:
WHEREAS the storm of July 26, 2009 was extreme in its intensity and in the
amount of water which fell over a short period of time and created devastating
damage for several Greater Sudbury residents;
AND WHEREAS in accordance with the resolution endorsing the creation of
the Greater Sudbury Climate Change Consortium by the NDCA passed by
Council on November 12th, 2009, although the July 26, 2009 severe storm
event in Greater Sudbury affected only a small part of the community, it is
likely that these types of severe storm events will become even more
frequent and larger in scale in the future;
AND WHEREAS we are approaching the storm season;
AND WHEREAS the Storm Working Group’s Final Report includes a
suggestion for a preventative plumbing subsidy program having an
approximate value of $350,000;
AND WHEREAS a preventative plumbing subsidy program could reduce the
likelihood of insurers insisting on stricter coverage terms for owners of
repeatedly flooded premises and measures aimed at reducing the amount of
water directed into the city’s sewer system will also assist the city in handling
water volume during storms and further compliments other existing CGS
initiatives to promote water efficiency programs;
NOW THEREFORE BE IT RESOLVED that City Council direct staff to more
fully develop a preventative plumbing subsidy program which, if approved
and funded, would be effective retroactive to July 25th, 2009 for those who
experienced flooding due to the July 26th, 2009 storm and subsequently to
residents residing in flood regions, as identified in the draft policy; and to
identify a potential funding source for the program, and present the draft
policy to Council at its April 21st, 2010 Policy Committee meeting.

2. Plan de protection des sources d’eau pour la Zone de protection des sources
du Grand Sudbury
(PRÉSENTATION ÉLECTRONIQUE) (A TITRE D'INFORMATION)
Nels Conroy, président du Comité de protection des sources du Grand
Sudbury
(L’Office de protection de la nature du district du Nickel et l’Office de protection des
sources du Grand Sudbury (OPNDN / OPSGS) ont travaillé à un plan de protection
des sources d’eau potable pour la Zone de protection des sources du Grand Sudbury.
En juin 2010, il faudra déposer un rapport scientifique d’évaluation auprès du ministère
de l’Environnement et d’ici août 2012, le premier plan de protection des sources d’eau
pour notre zone devra être déposé auprès de la Province.
La Province paie actuellement 100 % des frais de la phase de planification de
ce projet et continuera de le faire jusqu’au dépôt du plan de protection des
sources d’eau en 2012. Après 2012, l’OPNDN et la Ville du Grand Sudbury
auront des responsabilités de mise en œuvre et de surveillance aux termes de
la Loi sur l’eau saine. À l’heure actuelle, la Province n’a pas indiqué le mode
de financement des travaux après 2012.
L’OPNDN et l’OPSGS aimeraient commencer la discussion avec la Ville du
Grand Sudbury sur la période post-2010 pour la planification de la protection
des sources d’eau dans notre bassin hydrologique.)

ATTENDU QUE la privatisation de l’eau a des impacts néfastes pour
l’environnement et qu’elle ajoute un coût supplémentaire pour le consommateur;
ATTENDU QUE la fabrication et l’élimination des bouteilles en plastique
émet des produits chimiques toxiques dangereux et contaminants dans l’air,
ce qui contribue à la dégradation de l’environnement;
ATTENDU QUE la distribution de l’eau en bouteille nécessite le transport qui
a recours à des combustibles fossiles et contribue au réchauffement de la
planète tandis que la distribution de l’eau du robinet est économe en énergie;
ATTENDU QUE l’eau du robinet publique est sécuritaire, saine et beaucoup
plus accessible et durable sur le plan environnemental que l’eau en bouteille;
ATTENDU QUE le réseau de distribution d’eau public du Canada est fiable,
subventionné et de haute qualité;
ATTENDU QUE l’étatisation des sources d’eau est le seul moyen de veiller
à une eau potable suffisante, accessible et saine;
ATTENDU QUE les règlements et directives gouvernementaux appliqués en
matière des réseaux de distribution d’eau publics sont le meilleur et le seul
moyen de veiller à la confiance du public à l’égard de l’eau du robinet pour la
consommer et éviter la dépendance de l’eau en bouteille;
PAR CONSÉQUENT, IL EST RÉSOLU QUE la Ville du Grand Sudbury
appuie la Fédération canadienne des étudiantes et étudiants, la Sierra
Youth Coalition et la campagne contre l’eau en bouteille du Polaris Institute
et qu’elle déclare le 11 mars « Journée sans eau en bouteille » ;
ET QUE les membres de la communauté de Sudbury soient encouragés à
faire la promesse de la Journée sans eau en bouteille et qu’elle organise des
activités relativement à cette campagne;
ET QUE les membres de la communauté de Sudbury soient encouragés à
travailler ensemble et avec des partenaires de la coalition pour promouvoir
la Journée sans eau en bouteille et pour sensibiliser le public aux dangers
de la privatisation de l’eau.
R-4. Présentée par la Conseillère Landry-Altmann :
ATTENDU QUE la tempête du 26 juillet 2009 était extrême quant à son intensité et
à la quantité d’eau qui est tombée en une brève période et qu’elle a occasionné des
dommages dévastateurs pour plusieurs membres de la communauté du Grand
Sudbury;
ATTENDU QUE, conformément à la résolution appuyant la création du
Consortium sur les changements climatiques du Grand Sudbury par
l’OPNDN adoptée par le Conseil municipal le 12 novembre 2009, même si
la violente tempête du 26 juillet 2009 dans le Grand Sudbury n’a touché
qu’une petite partie de la communauté, il est très probable que ces types de
violentes tempêtes deviendront de plus en plus fréquents et d’une ampleur
de plus en plus importante à l’avenir;

ATTENDU QUE la saison des tempêtes s’approche;
ATTENDU QUE le rapport final du Groupe de travail sur les tempêtes inclut
une suggestion de créer un programme de subventions pour la plomberie
préventive d’une valeur approximative de 350 000 $;
ATTENDU QU’UN programme de subventions pour la plomberie préventive
pourrait réduire la probabilité que des assureurs insistent sur des conditions
de couverture plus sévères pour les propriétaires de bâtiments inondés à
répétition et des mesures visant à réduire la quantité d’eau dirigée dans le
réseau d’égout de la Ville aidera aussi la Ville à gérer le volume d’eau
pendant les tempêtes et compléter davantage d’autres initiatives existantes
de la VGS afin de promouvoir les programmes d’économie des ressources
en eau;
PAR CONSÉQUENT, IL EST RÉSOLU QUE le Conseil municipal ordonne
au personnel d*élaborer plus complètement un programme de subventions
pour la plomberie préventive qui, s’il est approuvé et financé, sera en
vigueur avec effet rétroactif au 25 juillet 2009 pour les personnes qui ont subi
une inondation en raison de la tempête du 26 juillet 2009 et par la suite pour
les membres de la communauté qui habitent des régions inondables
reconnues dans le projet de politique et pour trouver une source de
financement pour le programme et présenter le projet de politique au
Conseil municipal lors de la réunion de son Comité des politiques qui doit
avoir lieu le 21 avril 2010.

2010-37 Craig - Bethiaume: That the City of Greater Sudbury include the
332 Pine Street elevated water tank in the City’s register of heritage
properties as a listed structure;
That the City of Greater Sudbury proceed with the demolition of the 332
Pine Street elevated water tank;
That the City of Greater Sudbury document the 332 Pine Street elevated
water tank, prior to its demolition, and submit this information to the City of
Greater Sudbury Archives for future reference and use; and
That the City of Greater Sudbury investigate and report back on a process,
including funding, to erect a historical plaque on the site, convert the site
into a public park with a new public art element, which may incorporate
parts of the existing elevated water tank.

Greater Sudbury’s Poet
Laureate 2010 -2012
Report dated February 10, 2010 was received from the General
Manager of Community Development regarding Greater
Sudbury’s Poet Laureate 2010 -2012.
A copy of Dr. Roger Nash’s poem entitled “My City” was
distributed to Council Members at the meeting.
Claire Zuliani, Manager of Libraries & Heritage Resources, stated
that a Selection Committee was set up to choose Greater
Sudbury’s first Poet Laureate. She thanked Mayor Rodriguez for
spearheading the Selection Committee and listed its members.
She outlined the Poet Laureate’s vision to take poetry to the
people and people to the poetry, to make Greater Sudbury the
poetry capital of Canada and to encourage local poets. She
advised he has published works of poetry and has received
numerous literary awards. She introduced Greater Sudbury’s first
Poet Laureate, Dr. Roger Nash.

Dr. Roger Nash thanked the Mayor and Council and members of
the Selection Committee and stated that he is honour and
humbled to be Greater Sudbury’s first Poet Laureate. He read the
poem he wrote for the inauguration of the position of Poet
Laureate for the City of Greater Sudbury – “My City”.
Mayor Rogriguez stated that, as Greater Sudbury’s first Poet
Laureate, Dr. Nash will interpret this City in poetry to the world
and promote literacy in all aspects of the community. He
presented Dr. Nash with a plaque in honour of the occasion on
behalf of Council and the citizens of Greater Sudbury.
The Manager of Libraries & Heritage Resources advised that Dr.
Nash will be at the main library tomorrow morning (February 25,
2010) to meet the public.
The following motion was presented:

the position of Poet Laureate for the City of Greater Sudbury for a

presentation entitled “State of Drinking Water Source Protection
Planning – Greater Sudbury Watersheds”.
Rob Rogers introduced the topic stating that they wish to enlist the
City’s assistance with the Plan. Paul Sajatovic gave a brief
overview of where the Plan is presently and what is planned
beyond 2012. Nels Conroy outlined the program status of the
planned 5-year process indicating that currently they are drafting
the assessment report and provided an overview of the timelines
for the process to submission of the Source Protection Plan in
August 2012.

Judy Sewell listed the Source Protection Staff, outlined the
contents of the Assessment Report and advised of City Staff
working on the source protection program as well as four elected
officials. Jamie Dumoulin explained the detailed mapping around
each municipal water source. Anoop Naik provided details on the
water quality sampling. Melanie Venne advised of the Ontario
Drinking Water Stewardship Program which helps landowners
who may be impacted by the Clean Water Act. Brianne Carter
advised of the Assessment Report Consultation which begins on
March 16, 2010 before the report is submitted to the Ministry of
the Environment on June 8, 2010.
Judy Sewell listed the current priorities and challenges including
public consultation and information management and post 2012
source protection responsibilities and funding.
Bob Rogers stated that in looking ahead they are taking a multibarrier approach, planning ahead to be ready when the plan is
completed and preparing local plans to deal with local issues.
Paul Sajatovic explained the annual funding to the Conservation
Authorities from the Ministry of the Environment and the Ministry
of Natural Resources from the years 2004-2005 to 2009-2010 and
the distribution of funding by Source Protection Region. With
respect to Source Protection Planning Beyond 2012, he outlined
the implementation issues and the conceptual framework.
Bob Rogers concluded by stating there is a need to move the
partnership forward to determine what is best for Greater Sudbury
to protect drinking water and to develop a ‘Sudbury Model’
concept for Post 2012 implementation requirements.

Bottled Water Free Day
The following motion was presented by Councillor Berthiaume:
2010-86 Berthiaume-Barbeau: WHEREAS water privatization has
detrimental impacts on the environment and adds additional cost
to the user;
AND WHEREAS manufacture and disposal of plastic bottles
releases dangerous toxic chemicals and contaminants into the air,
contributing to environmental degradation;
AND WHEREAS bottled water distribution requires fossil-fuel
based transportation and contributes to global warming while tap
water is energy efficient in its delivery;
AND WHEREAS public tap water is safe, healthy and significantly
more accessible and environmentally sustainable than bottled
water;
AND WHEREAS Canada’s system of public water provision is
reliable, subsidized and of high quality;
AND WHEREAS public ownership of water sources is the only
way to ensure adequate, accessible and clean drinking water;
AND WHEREAS enforced government regulations and guidelines
of public water systems are the best and only way to ensure
public trust in tap water for drinking and avoiding dependence on
bottled water;
THEREFORE BE IT RESOLVED THAT the City of Greater
Sudbury endorse the Canadian Federation of Students, Sierra

Youth Coalition and Polaris Institute’s Bottled Water Campaign
and declare March 11th Bottled Water Free Day;
AND BE IT FURTHER RESOLVED THAT residents of Greater
Sudbury be encouraged to take the Bottled Water Free Day
Pledge and hold events to create awareness about this campaign;
AND BE IT FURTHER RESOLVED THAT residents be
encouraged to work together and with coalition partners to
promote Bottled Water Free Day and create awareness of the
dangers of water privatization.

Preventative Plumbing
Subsidy Program
The following motion was presented by Councillor LandryAltmann:
2010-87 Landry-Altmann-Caldarelli: WHEREAS the storm of July
26, 2009 was extreme in its intensity and in the amount of water
which fell over a short period of time and created devastating
damage for several Greater Sudbury residents;
AND WHEREAS in accordance with the resolution endorsing the
creation of the Greater Sudbury Climate Change Consortium by
the NDCA passed by Council on November 12th, 2009, although
the July 26, 2009 severe storm event in Greater Sudbury affected
only a small part of the community, it is likely that these types of
severe storm events will become even more frequent and larger in
scale in the future;
AND WHEREAS we are approaching the storm season;
AND WHEREAS the Storm Working Group’s Final Report
includes a suggestion for a preventative plumbing subsidy
program having an approximate value of $350,000;
AND WHEREAS a preventative plumbing subsidy program could
reduce the likelihood of insurers insisting on stricter coverage
terms for owners of repeatedly flooded premises and measures
aimed at reducing the amount of water directed into the city’s
sewer system will also assist the city in handling water volume
during storms and further compliments other existing CGS
initiatives to promote water efficiency programs;
NOW THEREFORE BE IT RESOLVED that City Council direct
staff to more fully develop a preventative plumbing subsidy
program which, if approved and funded, would be effective

retroactive to July 25th, 2009 for those who experienced flooding
due to the July 26th, 2009 storm and subsequently to residents

meeting.

CIVIC PETITIONS
Nuisance Property
By-law
Councillor Landry-Altmann submitted a petition to the City Clerk
signed by approximately 70 residents which will be forwarded to
the General Manager of Growth & Development. The petition is
requesting that Council support the development of a nuisance
property by-law.
NOTICES OF MOTION
Walden Home Support
Program
The following Notice of Motion was presented by Councillor
Barbeau:
WHEREAS the North East LHIN ceased funding the Walden
Home Support Program, which included services such as home
help, home maintenance (snow shoveling and grass cutting) and
volunteer transportation;
AND WHEREAS staff from the North East LHIN met with
members of the Walden community in April 2009 to acquire input
on this matter;
AND WHEREAS the loss of these services impacts the
community of Walden in an adverse manner;
AND WHEREAS the Councillor for the area has received
expressions of concern related to the loss of these vital
community services;
THEREFORE BE IT RESOLVED THAT the North East LHIN be
requested to reallocate funds in order that these important
services can once again be delivered in the community of Walden;
AND FURTHER BE IT RESOLVED THAT the North East LHIN
develop a strategy to re-establish these essential community
services in an approved service delivery model.
Council noted that the above motion will be dealt with at the next
Council meeting.

QUESTION PERIOD
Geothermal Technology
Councillor Berthiaume advised that at the Earthcare General
Annual Meeting last week he learned that some developers were
trying to use geothermal technology in housing to save energy
and be environmentally friendly. He was advised that the source
energy pipe they wanted to use in the pilot project was being
challenged by City staff.
He asked why this was being
challenged.
The General Manager of Infrastructure Services indicated that
staff has studied the project and are willing to work with the
contractors and developers. He indicated that the developer in
this particular situation could not meet his own time frame to
register the development and abandoned the project.
The General Manager of Growth & Development advised that the
subject property has now been registered and two homes have
been built. He indicated the concern is not with the technology
but with the backup system that will have to be in place to protect
the homeowner. The developer has been asked for additional
information so a peer review can be undertaken.
Replacement Workers
at Copper Cliff Smelter
Councillor Berthiaume stated that two weeks ago residents calling
themselves ‘C.A.N.A.R.Y.S’ attended the City Council meeting.
Their concern was the use of replacement workers at the Copper
Cliff Smelter. He asked what steps the City has taken to ascertain
the safety of citizens. He also asked if Fire Services have had
any dealing with the company regarding this issue.
The City Solicitor indicated that this is a Provincial legislation
matter and, if there are any concerns with respect to safety, there
is a complaint mechanism under that legislation.
The Fire Chief advised that they had meetings with Vale Inco
regarding responses to their properties. There are people in place
to meet Fire Services at the gate and escort them to the plants in
cases of emergency. He further advised that they indicated to the
company that they will be resuming familiarization tours.
Conversion of Offices
Councillor Berthiaume asked if a building zoned commercial or
industrial can be used as residential. He stated he received a
letter informing of the conversion of offices in Copper Cliff to
provide living accommodations for the workers. He asked if they
are contravening City by-laws.
The General Manager of Growth & Development indicated that,
with respect to the Vale Inco property, a letter was received from

Vale Inco’s Legal Department asking whether they could move
bunk houses onto the site and the answer was ‘no, the property
would have to be rezoned’. In terms of the existing buildings, it is
a building permit issue; unless they change the use, then it gets
into the zoning aspect. There are laws in terms of existing rights
and that is a more complicated scenario.

With respect to the contravention of City by-laws, the City Solicitor
advised no complaints have been received to his knowledge.
Councillor Berthiaume advised that he was twice told of noise bylaw exemption requests coming to the City by two companies –
one for hauling and one for mining. He asked if the City by-law is
being enforced. He also asked that, as By-law Enforcement only
works during the day, would Police Service enforce any noise bylaw infractions during the night.
Noise By-law
The City Solicitor advised that there is a noise by-law which
includes a specific section addressing truck noise; however, there
is some difficulty in enforcing it if there are insufficient details
provided in order to identify the vehicle. The investigation to
determine if there should be a charge and then prosecution and
conviction would be based on the information received. He
indicated that vehicle identification is very important (signage on
the vehicle, license plate number) as are records on the time,
location and duration of the noise. There is also a requirement in
the by-law that the truck be loaded. With respect to enforcing any
noise by-law infractions, he indicated that it would have to be
Police Service as the City’s By-law Enforcement Officers are not
authorized to pull over a vehicle.
The Deputy Chief of Police indicated that if they receive a
complaint they would investigate but would be faced with the
same issues of sufficient details to substantiate the investigation
of a complaint.
Ontario Labour
Relations Board – Bad
Faith Bargaining
Councillor Berthiaume indicated that the Ontario Labour Relations
Board has made a decision to delay the review of bad faith
bargaining to March 30, 2010. As this affects many citizens, he
asked that Council send a letter to the Minister of Labour
requesting that the Tribunal Board meet earlier as this should be a
priority.

Blasting By-law
Councillor Cimino asked when the blasting by-law issue would be
coming to the Policy Committee.
The General Manager of Growth & Development indicated the
blasting by-law will be presented at the Policy Committee in April.
Truck Weights & Loads
Councillor Callaghan stated that at the last meeting he requested
a report regarding the review of procedure relating to truck weight,
loads, etc. He asked when this report can be expected.
The General Manager of Infrastructure Services stated that the
report is being prepared. They are meeting with Police Services
in early March and the report will be presented at the last City
Council meeting in March.
