• Religious instruction in public schools in Berlin
In Berlin, there is an on-going controversy over a popular initiative supported by churches and other
religious communities, to introduce religious instruction in public schools according to Article 7 of the
Eurel newsletter n. 9
Basic Law (Grundgesetz) as a full alternative to an ethics curriculum which is currently obligatory for
all pupils. The initiative has succeeded in finding enough support to force the Berlin Senate to
organize a referendum which took place on April 27.

• En janvier et février 2009, la Cour européenne des droits de l’homme a prononcé plusieurs
décisions contre l’Autriche.
Dans l’affaire Verein der Freunde der Christengemeinschaft et autres (26 février 2009, 76581/01), la
Cour s’est référée à un précédent arrêt concernant les témoins de Jéhovah (31 juillet 2008, 40825/98)
et a déclaré qu’il y avait eu violation de l’article 14 de la CEDH combiné avec l’article 9, considérant
que l’exigence de dix ans d’existence comme communauté confessionnelle enregistrée avant de
pouvoir être reconnue comme société religieuse de droit public n’était pas justifiée dans le cas de la
présente communauté religieuse, établie depuis longtemps dans le pays et donc bien connue des
autorités compétentes.
Dans les cas Löffelmann (12 mars 2009, 42967/98), Gutl (12 mars 2009, 49686/99) et Lang (19 mars
2009, 28648/03), la Cour a également constaté une violation de l’article 14 de la CEDH combiné avec
l’article 9. L’exemption du service militaire bénéficiant aux seuls ministres des cultes reconnus, elle ne
fut pas accordée aux ministres des témoins de Jéhovah, ministres d’une communauté confessionnelle
enregistrée et non pas d’une Église ou société reconnue par la loi. Cette différence de traitement
n’étant pas basée sur une « justification objective et raisonnable », elle constitue une discrimination.
Dans l’intervalle, le ministère de l’Éducation, des Arts et de la Culture a présenté un projet
d’ordonnance qui permettrait à la Société religieuse des témoins de Jéhovah d’obtenir le statut de
droit public de société religieuse reconnue par la loi.

• Le Conseil d’État évite le foulard :
En titrant “le foulard pourra être interdit à l'école”, la presse belge rend mal compte de deux arrêts du
Conseil d'État du 17 mars 2009, n° 191.532 et 191.533, qui statuent en réalité sur l'intérêt à l'action
d'une association antiraciste - le MRAX - et non au fond sur la question du foulard.

• Délits d’expression et religions :
Par arrêt n°191.742 du 23 mars 2009, le Conseil d'État a suspendu en extrême urgence une décision
d'un collège des bourgmestres et échevins d'interdire un spectacle de l'humoriste controversé
Dieudonné : “Considérant que les circonstances extraordinaires censées justifier l’arrêté attaqué sont
en premier lieu «les propos de l’artiste lors de ses précédentes représentations, lesquels sont
ressentis comme injurieux envers la Communauté juive par une grande partie de l’opinion publique».
• Distinctions justifiées par la liberté de culte :
La Cour Constitutionnelle de Belgique, dans un arrêt 17/2009 du 12 février 2009, relatif à la loi du 10
mai 2007 “tendant à lutter contre certaines formes de discrimination” a pris d'importantes positions
concernant la liberté de religion et les distinctions qui peuvent y être associées.
• Décret régional : sépulture et religion :
Un décret régional, adopté par le Parlement wallon le 4 mars 2009 en matière de funérailles et
sépultures (M.B. 26 mars 2009), porte diverses dispositions importantes en matière religieuse et
philosophique.

• Financer ou non les établissements scolaires qui ne pratiquent pas la mixité
Plusieurs communautés autonomes (Andalousie, Galice, Catalogne) ont exprimé leur intention de
mettre fin aux contrats d’association existant avec les collèges qui maintiennent une séparation entre
filles et garçons, établissements qui sont en très grande majorité liés à l’Opus Dei.

• La nouvelle matière scolaire ciudadanía (citoyenneté)
La chambre du contentieux du Tribunal suprême a décidé fin janvier 2009 qu’il ne pouvait y avoir de
droit à l’ « objection de conscience » contre l’enseignement de la matière ciudadanía, arguant que
celle-ci ne remettait pas en cause le droit des parents à ce que leurs enfants reçoivent l’éducation
religieuse et morale qu’ils désirent. Ceci confirme le caractère obligatoire de cet enseignement.

• Dans une décision du 10 avril 2009, le Conseil d’État annule les résultats d’un concours interne de la
police nationale du fait d’une distinction opérée par le jury en raison de l’origine du candidat et de ses
opinions religieuses.
• La HALDE (Haute Autorité de Lutte Contre la Discrimination et pour l'Égalité) a rendu public le
vendredi 10 avril 2009 un avis adopté par son collège et la délibération l’accompagnant, qui retrace
l’ensemble des dispositions applicables en matière d’expression religieuse dans l’entreprise, qu’elles
soient issues de la Constitution, du droit européen, du code du travail ou de la jurisprudence.

• Décret n° 2009-427 du 16 avril 2009 portant publication de l'accord entre la République française et
le Saint-Siège sur la reconnaissance des grades et diplômes dans l'enseignement supérieur, signé à

• En septembre 2009, l’Université de Strasbourg (Faculté de Droit, sciences politiques et gestion)
ouvre une spécialité "islamologie, religion, droit et société" du master sciences et droit des
religions. L’autre spécialité de ce master est celle de “droit européen comparé des religions”. Pour

• Un état des lieux très critique de l’hémorragie d’argent public vers l’Église catholique italienne a été
dressé par Curzio Maltese, journaliste de La Repubblica, dans une série de reportages publiés dans
le livre La questua (Feltrinelli, 2008). Le quotidien des évêques catholiques italiens (Avvenire) a
critiqué cet ouvrage, dont les données sont cependant exactes, bien que l’interprétation de l’auteur
reste très anticléricale (voir le commentaire de Marco Ventura, "Per Maltese e la Sinistra la Chiesa è
solo Questua", in Il Corriere della Sera, 19 juillet 2008, p. 39).

• The Office for Religious Communities and the Commission of the Government of the Republic of
Slovenia for solving the open questions of Religious Communities during 15th of September and 18th
of September 2008 organized a conference on the subject “Legal aspects of religious freedom”.
The conference was focused on the following topics: 1. Constitutional jurisprudence in the area of
freedom of religion and belief (Status of the individual, Status of religious communities, Legislation and
the dialogue between the European Union and churches and religious communities.) 2. Administrative
matters in the area of religious freedom and religious communities. With collaboration of
representatives of constitutional/supreme courts and governments' representatives from a majority of
the EU member states the organizer successfully reviewed recent changes in the constitutional
jurisprudence in the area of freedom of religion and beliefs. Special focus was given to administrative
matters, to the legal dimensions of the dialogue between the European Union and Churches and
Religious Communities and of the interreligious dialogue.

• In October 2008 two by-laws were enacted on the basis of the Religious Freedom Act:
1. The Ministry of Health enacted the Regulation on organization and performing of religious care in
hospitals and other performers of medical services (Official Gazette RS, No. 100/2008).
2. The Ministry of Justice enacted the Regulation on organization and implementation of spiritual care
in prisons, educational institutions, juvenile detention centres and training institutions for physically
and mentally handicapped youth (Official Gazette RS, No. 101/2008).
• In April 2009 the Government of the Republic of Slovenia is about to appoint a new director of the
Office of the Government of the Republic of Slovenia for Religious Communities.

• La dévotion mariale à Lourdes et Medjugorje

• Cette année encore, la Société suisse pour la science des religions organise à Bigorio, dans le
Tessin, du 19 au 21 juin 2009, une rencontre pour les représentants de la relève académique en
Suisse. Dans le cadre du très beau couvent de Bigorio, doctorants ou jeunes docteurs présenteront
publiquement le sujet et l’état d’avancement de leur recherche.

• Votation fédérale sur la construction de minarets en Suisse :
Un comité composé de membres de l’UDF et l’UDC a déposé une initiative populaire fédérale le 8
juillet 2008 visant à interdire les minarets sur tout le territoire, en modifiant l’article 72 de la
Constitution qui charge la Confédération et les cantons de préserver la paix religieuse.
En mars 2009, le Parlement et le Conseil fédéral se sont opposés à l’initiative. Elle a toutefois été
jugée recevable par ces deux instances et devra par conséquent passer devant le peuple. À l’heure
actuelle, la date de la votation n’est pas encore connue.
