Among the five chapters, one was dedicated to distribution and the consumer. The report suggests five principles governing distribution: promotion of choice of distribution channels; transparency and clarity surrounding adviser status; transparency in remuneration; clarifying the cost of advice; enhancement of adviser professionalism and empowerment of consumers; and a level playing field for different products and distribution channels. The report also highlights two prospective initiatives which will provide an opportunity to move European regulations forward in the way that the RDR (Retail Distribution Review) promises in the UK. The two regulatory responses include the Markets in Financial Instruments Directive (MiFID) and Packaged Retail Investment Products (PRIPS), which could both greatly influence the distribution of funds in Europe. Similar to the RDR, these regulatory changes set out a blueprint for retail distribution in the UK and in Europe. The study outlines that there should be clarity for consumers about the status of the advisers and the nature of the advice service they are receiving. Disclosure needs to have a strong and transparent role in the distribution process and the cost of advice should be distinguishable from the cost of the product at the point of sale. There should be a tiered system of qualifications for advisers to reflect the advice required on more complex products. Standards of disclosure of product features and other aspects of the advice process should also be raised to the level of best existing practice in an equivalent way for all investment products. AXELTIS - Newsletter 6 Axeltis News • Actualité d’Axeltis Axeltis is happy to announce the arrival of Laurent Moha as Head of Business Development Laurent describes his experience: “I have been working within the asset management industry for 13 years and have been in charge of the reporting department of Natixis Asset Management for 5 years. This department is at the confluence of various activities of the asset management company and contacts with business, fund managers, legal and marketing or IT teams are numerous. Therefore, I was able to go with the multiple mutations of the business related to new customer demands and higher standards and regulations. Axeltis structure is booming, backed by an important group and whose ambitious projects are challenges that I want to meet. Axeltis will become an essential intermediary between asset management companies and fund distributors. For this, it will initially build greater proximity to clients and maintain relationships of trust that have been forged by a quality team”. The Industry think tanks Axeltis still pays attention to the on-going industry think tanks in France and Europe. Here are a few words about the main topics that are more oriented towards the distribution of mutual funds. I deduced a deep belief that only a company working close to its clients and with clear processes can make a difference. It is this proximity to clients that I want to develop within Axeltis. Axeltis est heureuse d'annoncer l'arrivée de Laurent Moha comme Responsable Commercial Marie-Laure Faller Stress in Europe the involvement of the CESR (Committee of European Securities Regulators) on the proposed changes MiFID, seeking to better define the concept of "investment advice". In France we also note the recommendations of the AFECEI (The French Association for Banks and Investment Companies) regarding the payment to distributors. These recommendations include information on trailer fees and marketing materials containing this information. This information may be given either by a single rate or be based on ranges of maximum and minimum, or an weighted average with a maximum rate. More importantly, this data should be made available via the product fact sheets, newsletters, subscriptions form and / or promotional materials and websites. Finally, keeping in mind the two objectives of harmonisation and fluidity of the workshop DMFSA (Dematerialized Mutual Funds Sales Agreement) on which Axeltis is strongly involved. Based on the same concept as the ISDA (International Swaps and Derivatives Association Inc) model, the project must lead to a simplification of legal, business and operational negotiations and help to optimise distribution of investment products.
