The Revision of the Constitution of the Republic of Rwanda of 04 June 2003 was preceded by petitions from the population founded on their rights under Article 2 and the process required by Article 193 of the Constitution of the Republic of Rwanda. Regarding the number of terms of office, some people are of the view that there should not be any term limit. However, they expressed their concern on opening term limits for a President other than Paul Kagame. After analyzing all the above petitions, and basing on development planning, the Parliament found those petitions relevant and resolved to include their content in two provisions, namely Articles 101 and 172. Article 101 confirmed the principle of limiting the number of terms of office but reduced it to five (5) years, hence harmonised with presidential terms in other East African Community State members. Article 172 establishes the principle that provisions under Article 101 shall be effective after the expiry of a seven year term running from 2017, in order to build for the development programs a firm foundation prior to the commencement of the five -year term of office. While the draft proposal was being discussed, it was mentioned that there were many articles which provided for details instead of setting out general principles only. The Constitution contained details which should be catered for in other laws. Such details are for instance in provisions on the judiciary and on other State organs. The consequence of having a much detailed Constitution is that any change needed, even where it is a minor issue, would necessitate the amendment of the Constitution. Throughout the Constitution there are poorly drafted provisions and use of inappropriate terminology that complicate the interpretation of some provisions. The Constitution should use in as much as possible clear and unambiguous language. For these reasons, there has been improvement in redrafting such provisions, language clean-up and harmonization of translation basing on the language of adoption of the Constitution. With regard to the structure, there was a need to restructure the Constitution by shifting some articles to where they fit. Some articles are under Chapters where they have no relevance and yet they could fit better under other Chapters. In the revised Constitution, articles, paragraphs and items have been shifted to other places in the Constitution where they are more relevant. In some cases, existing short titles were redrafted in order to reflect more accurately the content of the article.
