The Lieutenant Governor in Council of Saskatchewan, on the recommendation of the Saskatchewan Minister
of Justice and Attorney General, pursuant to subsection 18(1) of the Sex Offender Information Registration
Act, makes the attached Regulations Amending the Saskatchewan Sex Offender Information Registration
Regulations.

REGULATIONS AMENDING THE SASKATCHEWAN SEX OFFENDER INFORMATION
REGISTRATION REGULATIONS
amendments
1. Subsection 2(1) of the Saskatchewan Sex Offender Information Registration Regulations
(SOR/2004-304) is replaced by the following:
2(1) A sex offender whose main residence is located in the Province of Saskatchewan may make any report
required under paragraph 4.1(1)(a) or (b) or section 4.3 of the Act by telephone.
2. Subsection 5(1) of the Regulations is replaced by the following:
5(1) The following places are designated as registration centres in the Province of Saskatchewan:
(a) the Saskatchewan Sex Offender Central Registration Centre, administered by RCMP “F” Division and
located at 6101 Dewdney Avenue, Regina;
(b) each RCMP detachment;
(c) the municipal police service office in:
(i) Estevan;
(ii) Moose Jaw;
(iii) Prince Albert;

(iv) Regina;
(v) Saskatoon; and
(vi) Weyburn; and
(d) each office of the File Hills First Nations Police Service.
3. The schedule to the Regulations is repealed.
Coming Into Force

MODIFICATIONS
1. Le paragraphe 2(1) du Règlement de la Saskatchewan sur l’enregistrement de renseignements
sur les délinquants sexuels (DORS/2004-304) est remplacé par ce qui suit:
2(1) Le délinquant sexuel ayant sa résidence principale dans la province de la Saskatchewan peut comparaître
par téléphone au titre des alinéas 4.1(1)a) ou b) ou de l’article 4.3 de la Loi.
2. Le paragraphe 5(1) du même règlement est remplacé par ce qui suit :

RESTRUCTURING OF THE VILLAGE OF RABBIT LAKE
Pursuant to section 53 of The Municipalities Act, the Village of Rabbit Lake has applied to restructure to
become included in the Rural Municipality of Round Hill No. 467 as a designated special service area.
IT IS HEREBY ORDERED THAT:
1 The Village of Rabbit Lake is restructured through the inclusion of the Village of Rabbit Lake within the
Rural Municipality of Round Hill No. 467.
2 The former Village of Rabbit Lake is designated as a special service area for the purpose of assigning
different tax rates, applying different tax tools and providing different service levels within the Rural
Municipality of Round Hill No. 467.
3 The boundaries of the former Village of Rabbit Lake designated as a special service area are located in the
Province of Saskatchewan, within the whole north half of Section 13, Township 48, Range 13, West of the Third
Meridian excepting therefrom all that portion of the said north half of Section 13 bounded on the north-east by
the south-westerly limit of the right-of-way and station grounds of the Canadian National Railways.
4 The Rural Municipality of Round Hill No. 467 shall allocate all revenues collected from and on behalf of
the special service area to special service area ledger accounts; and all expenses of the special service area shall
be allocated to and paid from special service area ledger accounts.
5 A statement of revenues and expenditures of the special service area shall be presented to council annually
and any additional time(s) requested by council.
6 The terms and conditions of the restructuring agreement entered into by the Village of Rabbit Lake and
the Rural Municipality of Round Hill No. 467 are confirmed as follows:
(a) this agreement has been entered into by the Village of Rabbit Lake and the Rural Municipality of
Round Hill No. 467 for the purpose of the dissolution of the Village of Rabbit Lake;

(b) the Village of Rabbit Lake be designated a special service area for the purposes of assigning different
tax rates and/or application of tax tools and providing different service levels;
(c) the designated service area being within the boundaries of the former Village of Rabbit Lake;
(d) a municipal council consisting of a Reeve and 6 councillors will continue to govern the Rural Municipality
of Round Hill No. 467;
(e) the Council of the Rural Municipality of Round Hill No. 467 agrees to establish a committee, namely
The Rabbit Lake Community Advisory Committee, and appoint at least three representatives annually.
The sole purpose of this committee is to provide advice to council on matters relating to the Special Service
Area designated above. A representative from the Rabbit Lake Community Advisory Committee will be
present at the Rural Municipality of Round Hill No. 467’s regularly scheduled monthly council meetings to
discuss Special Service Area matters. The Rural Municipality of Round Hill No. 467 will pay remuneration
to committee members from the Special Service Area revenue, and may amend, add or modify any function
of this committee as deemed necessary, by resolution;
(f) the Rabbit Lake Community Advisory Committee agrees to annually provide recommendations to the
RM Council regarding the Special Service Area’s portion of administrative costs;
(g) this agreement may be amended:
(i) by the agreement of the councils which are signatories to the agreement, prior to the application
being forwarded to the Minister for approval; and
(ii) by the Council of the Municipality of Round Hill after the Minister’s Order, not for a period of
three years and then only when an amendment is in the best interests of the ratepayers of the former
Village of Rabbit Lake and the Rural Municipality of Round Hill No. 467;
(h) the assets and liabilities of the Village of Rabbit Lake shall become the assets and liabilities of the
Rural Municipality of Round Hill No. 467 upon dissolution of the Village of Rabbit Lake;
(i) cash assets remaining subsequent to settlement of the Village of Rabbit Lake’s assets and liabilities
will be set aside for provision of services and/or benefits within the former Village of Rabbit Lake;
(j) all grants received by the Rural Municipality of Round Hill No. 467 in recognition of the former Village
of Rabbit Lake will be set aside for provision of services and/or benefits within the former Village of Rabbit
Lake;
(k) the Rural Municipality of Round Hill No. 467 will ensure that fire protection services for the area
formerly known as the Village of Rabbit Lake are inclusive and consistent with fire protection service
agreements currently established by the former Village; and any other fire service deemed necessary;
(l) the Rural Municipality of Round Hill No. 467 will continue to contract Bob Lamb for general maintenance,
water treatment plant operations and garbage collection within the boundaries of the former Village of
Rabbit Lake consistent with current arrangements and may amend or terminate the contract as deemed
necessary;
(m) the Rural Municipality of Round Hill No. 467 will continue to employ Sam Grainger as a Certified
Water Operator consistent with current arrangements and may amend or terminate the contract as deemed
necessary;
(n) the Rural Municipality of Round Hill No. 467 will continue to contract Lorraine Scott for supervision
of the village transfer station consistent with current arrangements and may amend or terminate the
contract as deemed necessary;
(p) the Rural Municipality of Round Hill No. 467 shall continue to administrate the Rabbit Lake cemetery;
however, all physical maintenance and care applications shall continue to be managed by the volunteer
committee consistent with current arrangements and may be modified or changed as deemed necessary;

(q) the Rural Municipality of Round Hill No. 467 agrees that the bylaws in place in the Village of Rabbit
Lake remain in force for the period of one year after the date of dissolution, unless sooner repealed or
amended. All bylaws of the Rural Municipality of Round Hill No. 467 will also be in force in the former
Village of Rabbit Lake, except those already addressed in the former village bylaws that remain in force;
(r) the Rural Municipality of Round Hill No. 467 shall decommission the Village of Rabbit Lake landfill
as required pursuant to provincial legislation and the Ministry of Environment plan for decommissioning
of waste disposal grounds. All expenditures associated with the decommissioning of the landfill shall be
allocated to the Special Service Area accounts;
(s) the transfer station is currently owned and operated by the Village of Rabbit Lake and this service
shall continue to be assigned to the Special Service Area of Rabbit Lake. All revenues and expenditures
associated with the transfer station shall be allocated to the Special Service Area accounts;
(t) the Rural Municipality of Round Hill No. 467 will continue to collect fees from the ratepayers of the
Rural Municipality for the use of the transfer station with the exception of the residents of the special service
area, which will continue to pay its costs through their general tax levy. The transfer station fees shall be
reviewed annually by the Rural Municipality of Round Hill No. 467. The use of the transfer station shall
continue to be restricted to ratepayers of the Rural Municipality of Round Hill No. 467;
(u) the Rural Municipality of Round Hill No. 467 will provide street maintenance and snow removal as
deemed necessary. All expenditures associated with street maintenance and snow removal shall be allocated
to the Special Service Area accounts;
(v) the Rural Municipality of Round Hill No. 467 shall allocate all revenues collected from and on behalf
of the special service area to special service area ledger accounts; and all expenses of the special service
area shall be allocated to and paid from special service area ledger accounts;
(w) a statement of revenues and expenditures of the special service area be presented to council annually
and any additional time(s) requested by council;
(x) the administrator for the Village of Rabbit Lake, Cindy Miller, will continue as the administrator of
the Rural Municipality of Round Hill No. 467;
(y) this agreement will come into effect on the date of dissolution as set out in the Minister’s Order.
7 The restructuring will take effect on October 30, 2015.
8 Verdeen Studney is appointed to adjust and settle the assets and liabilities of the Village of Rabbit Lake
including:
(a) the allocation of any grants, surplus funds and reserves; and
(b) the manner of dealing with liabilities through:
(i) the sale of, the disposition of and conversion into money of sufficient assets to satisfy the liabilities
of the village and pay the remuneration of the person appointed by this Order; and
(ii) the ability to assess, levy, collect and enforce payment of any amount that may be required to
satisfy the liabilities of the municipality, including all associated expenses and the remuneration of
the person appointed by this Order, when the realizable assets do not satisfy the liabilities pursuant
to subsection 63(4) of The Municipalities Act.
9 Remuneration for settling the assets and liabilities be paid to Verdeen Studney at a rate of $40.00 per hour
of work, in addition to 42.27 cents/travelled km and reimbursement of related miscellaneous expenses.

The Global Transportation Hub Authority Act

Global Transportation Hub authority — taxation Bylaws
The Taxation Bylaws of the Global Transportation Hub Authority are hereby enacted as
follows:
1 Purpose
The purpose of this Bylaw is to establish tax rates and impose taxes on:
(a) all taxable property in the Global Transportation Hub sufficient to meet the estimated expenditures
and transfers, having regard to estimated revenues from other sources, set out in the budget of the Global
Transportation Hub Authority and the Library for 2014.

2.0 Authority
The authority for these Bylaws is:
(a) section 29, 30 and 31 of The Global Transporation Hub Authority Act;
(b) section 26 and Division 7 of Part XI of The Cities Act;

(d) section 22 of The Public Libraries Act, 1996.
3.0 Mill Rates
The Regina Property Tax Bylaw, 2009 as amended from time to time shall be imposed on all taxable
assessments in the GTH.
4.0 Coming Into Force
This Bylaw No. 2014-03-01 shall come into force and take effect when published in The Saskatchewan
Gazette.

Fee bylaw
The Fee Bylaw of the Global Transportation Hub Authority is hereby enacted as follows:
1 Title
This Bylaw may be cited as the “GTH Fee Bylaw”.
2 Authority
The Global Transportation Hub Act;
The Planning and Development Act, 2007;
The Uniform Building and Accessibility Standards Act; and
The Public Health Act, 1994.
3 Definitions
In this bylaw, the following definitions shall apply;
(a) the definitions contained in the GTH Development Plan and GTH Zoning Bylaw;
(b) “Zoning Bylaw” shall mean the GTH Zoning Bylaw in effect; and
(c) “Development Plan” shall mean the GTH Development Plan in effect.
4 Introduction
The following fees will cover the cost associated with the planning application process borne by the Global
Transportation Hub for providing these services. As the GTH is a relatively new local authority and does not
have an extensive amount of history of the costs of development permits, we are estimating the costs based on
a limited number of applications to date, our contractual arrangements with our inspectors and comparisons
to other municipalities. Going forward we intend on reviewing our costs and potentially adjusting our fees
accordingly as more experience is gained.

plumbing bylaw
The Plumbing Bylaw of the Global Transportation Hub Authority is hereby enacted as follows:
1 Title
1.1 This Bylaw shall be known as the “Bylaw”.
1.2 Purpose
The purpose of this Bylaw is to control and regulate the construction, extension, renovation, alteration or
repair of a plumbing system, or connection of a plumbing system to a communal sewage works or communal
waterworks.
1.3 Interpretation
1.3.1 The Plumbing Regulations, and as amended from time to time, shall apply to and govern all plumbing
in the Global Transportation Hub except as may be altered or revised hereinafter.
1.3.2 In this Bylaw:
(a) “Board” means the Global Transportation Hub board of directors;
(b) “GTH” means the Global Transportation Hub Authority;
(c) “Plumbing Inspector” means the Building Inspector or other duly authorized employees or agents
appointed by the GTH to act for or carry out the duties of the Plumbing Inspector to the extent that
authorization is given;
(d) “Regulations” means The Plumbing Regulations.
1.4 Application
Application for a plumbing permit shall be made by the plumbing contractor on the prescribed form, and
accompanied by the required fee, to the GTH.
1.5 Plumbing Permit Fee
The fees indicated on the GTH Fee Bylaw are payable for plumbing permits and shall be paid prior to receiving
a plumbing permit.

1.6 Permit Required
1.6.1 A person is eligible to apply for a permit if they:
(a) hold a Journeyperson Certificate of Qualification issued pursuant to section 29 of The Apprenticeship
and Trade Certification Commission Regulations;
(b) hold a journeyperson’s certificate issued by another province or territory of Canada; or
(c) employees of one or more of the persons mentioned in subclause (a) or (b).
1.6.2 No person shall establish, construct, extend, renovate, alter or repair a plumbing system or connect
a plumbing system to a communal sewage works or communal waterworks, except under the authority of the
plumbing permit.
1.6.3 Subsection 1.6.2 does not apply to:
(a) the repair or replacement of a valve, faucet or fixture;
(b) the repair of a leak;
(c) forcing out a stoppage where no change in piping is required; or
(d) the installation of a water treatment device, underground sprinklers or a domestic dishwashing
machine or laundry machine.
1.6.4 A plumbing permit ceases to be valid if the work for which it is issued is not commenced within six
months of the date of issue.
1.7 Water Meter
1.7.1 No person shall obtain water except through a City of Regina water meter.
1.8 Issuance of permits
1.8.1 Where an application has been made for a plumbing permit, the Plumbing Inspector may:
(a) issue the permit, subject to any reasonable terms or conditions; or
(b) refuse to issue the permit.
1.8.2 Without restricting the generality of clause 1.8.1 the Plumbing Inspector may refuse to issue a permit
to a person who:
(a) has not paid any fee required pursuant to this bylaw;
(b) at the time of applying for the permit, has a defective work or plumbing installation outstanding;
(c) has submitted an incomplete application, or an application that contains false or misleading information;
or
(d) demonstrates an inability to perform the work in a manner that is safe and acceptable in the opinion
of the Plumbing Inspector.
1.9 Inspection
1.9.1 A permit holder who has executed work for which a permit has been issued shall notify the Plumbing
Inspector when the work is ready for inspection and testing.
1.9.2 The permit holder shall provide the equipment, material, power and labour that is required for the
inspection and testing.
1.9.3 The permit holder, or a representative of the permit holder who possess qualification acceptable to the
GTH, shall be present at the time of the inspection.
1.9.4 No part of the plumbing system is to be covered until permission is granted by the GTH.

1.9.5 If any part of the plumbing system is not approved by the Plumbing Inspector:
(a) the permit holder shall make any necessary alterations, connections or replacements; and
(b) the work is subject to any further inspection and testing that the Plumbing Inspector considers
necessary.
This Bylaw No. 2015-02 shall come into force and take effect when approved by the Minister of Health and
published in The Saskatchewan Gazette.

The Queen’s Bench Rules
The Queen’s Bench Rules for Saskatchewan are hereby amended, effective the 1st day of
January, 2015, in the manner set out below:
1(1) Rule 2-40 is amended in the manner set forth in this section.
(2) Subrule (1) is amended by repealing clause (b) and substituting the following:
“(b) filing proof of service in accordance with Part 12”.
(3) Subrule (2) is amended by repealing clause (b) and substituting the following:
“(b) file proof of service in accordance with Part 12”.
2 Rule 2-41 is amended by adding the following subrule after subrule (6):
“(7) The lawyer withdrawing as lawyer of record shall provide the local registrar with any other address,
phone number, cell phone number and email address the lawyer may have concerning the party stated in
the notice of withdrawal unless that disclosure is, in the opinion of the lawyer, contrary to:
(a) the safety or well-being of the party; or
(b) the interests of justice”.
3 Rule 3-18 is amended by adding the following subrule after subrule (5):
“(6) This rule does not apply to:
(a) noting a defendant in default pursuant to rule 3-21; or
(b) taking out a default judgment for a debt or liquidated demand pursuant to rule 3-22”.
4 Subrule 4-4(2) is amended by striking out the portion preceding clause (a) and substituting
the following:
“A request for a conference pursuant to this rule must be in Form 4-4, and the party making the request
shall:”.

5 Rule 4-15 is amended by adding tbe following subrule after subrule (2):
“(2.1) Unless the Court orders otherwise, in any action where the consent of an insurer may be required
to settle the action, the insurer’s claim representative shall be present at all pre-trial conferences”.
6 The Information Note that follows rule 5-6 is amended:
(a) by striking out “No. 6” and substituting “CIV-PD No.1”; and
(b) by striking out “http://www.qp.gov.sk.ca/documents/English/Rules/practice.pdf” and
substituting “<http://www. publications.gov.sk.ca/details.cfm?p=69850>”.
7 Rule 5-23 is amended by adding the following subrule after subrule (1):
“(1.1) The appointment for questioning must:
(a) be in Form 5-23; and
(b) fix the time and place for the questioning”.
8 Subrule 5-29(1) is amended by repealing clause (b) and substituting the following:
“(b) the questioning must be taken down by question and answer either in shorthand or recorded
in a recording device in the presence of a court transcriber appointed pursuant to The Court Officials
Act, 2012”.
9 Rule 6-85 is amended by adding the following subrule after subrule (13):
“(14) This rule applies to third person claims and interpleader proceedings by a sheriff arising under The
Enforcement of Money Judgments Act to the extent that this rule is not in conflict with the provisions of
that Act or its regulations”.
10 Subrule 7-5(6) is repealed and the following substituted:
“(6) If the Court is satisfied there are one or more genuine issues requiring a trial, the Court may
nevertheless grant summary judgment with respect to any matters or issues the Court decides can and
should be decided without further evidence”.
11 Subrule 10-3(3) is repealed and the following substituted:
“(3) The original order must be retained by the Court”.
12(1) Rule 10-7 is amended in the manner set forth in this section.
(2) Subrule (3) is amended:
(a) by repealing clause (a) and substituting the following:
“(a) be prepared in accordance with the fiat recorded by the judge or by the chamber clerk under
the direction of the judge”; and
(b) by repealing clause (c) and substituting the following:
“(c) be signed and dated by a local registrar and sealed with the seal of the Court”.
(3) Subrule (4) is amended by adding “, dated” after “signed”.
13(1) Rule 10-9 is amended in the manner set forth in this section.
(2) Subrule (3) is amended by striking out “A judgment” and substituting “Subject to subrules (4)
and (5), a judgment”.

(3) The following subrules are added after subrule (3):
“(4) Subject to subrule (5), if an Act provides that an order or decision of another court or authority may be
filed with the Court to be enforced as an order of the Court, then, unless the Act provides for an alternate
procedure, the original or certified copy of the order or decision may be entered as a judgment of the Court
when:
(a) an address for service of the applicant is provided; and
(b) the order or decision is endorsed with a court file number and stamped as filed by the local
registrar.
“(5) If only a portion of an order or decision issued by another court or authority may be filed with the
Court as a decision of the Court, then a judgment for that portion of the order or decision may be entered
in Form 10-9F”.
14 Subrule 10-40(1) is repealed and the following substituted:
“(1) Except as otherwise provided in this Division, the claim in all actions commenced pursuant to this
Division must:
(a) be in Form 10-40A; and
(b) include the notice to defendant in Form 3-9 on the first page”.
15(1) Rule 13-24 is amended in the manner set forth in this section.
(2) Subrule (1) is amended by striking out “stamped” and substituting “sealed”.
(3) Subrule (2) is repealed and the following substituted:
“(2) A counter claim or third party claim is issued when it has been served and filed”.
(4) The following subrule is added after subrule (2):
“(3) The original commencement document must be filed with the local registrar”.
16 Subrule 16-10 is repealed and the following substituted:
“Proof of death
16-10(1) Proof of death of the deceased must be filed with an application for grant.
(2) If an application states that an executor or other person entitled to a grant is deceased, proof of death
of that person must be filed with the application for grant.
(3) For the purposes of this rule, proof of death includes a statement of death or certificate of death issued
by:
(a) a funeral director;
(b) a coroner; or
(c) the Registrar of Vital Statistics.
(4) If the applicant is unable to file direct evidence of death and there is evidence from which death may
be presumed, the Court may give leave to swear to or affirm the death, on application without notice or on
any notice that the Court may require”.
17 The following Information Note is added after rule 16-14:
“
Information Note
There is a rebuttable presumption that property held by a deceased with an adult child in joint names
with right of survivorship is held in a resulting trust for the benefit of the beneficiaries of the deceased’s
estate. (See Pecore v Pecore, 2007 SCC 17, [2007] 1 SCR 795.)

Les Règles de la Cour du Banc de la Reine de la Saskatchewan sont modifiées à compter

(2) Le paragraphe (1) est modifié par abrogation de l’alinéa b) et son remplacement par ce qui
suit :

couniel dont il dispose relativement a la partie indiquee dans l’avis de retrait, a moins que, a son avis, cette
divulgation soit contraire :

3 La règle 3-18 est modifiee par insertion du paragraphe suivant apres le paragraphe (5) :
« (6) La présente règle ne s’applique pas aux cas suivants :
a) la constatation du défaut du défendeur régie par la règle 3-21;
b) l’obtention d’un jugement par défaut en matière de recouvrement de créance ou de somme
détetminée en vertu de la règle 3-22 ».
4 La règle 4-4(2) est modifiée par suppression du passage précédant l’alinéa a) et son
remplacement par ce qui suit :
« Une demande de conférence présentée en vertu de la presente règle est établie a l’aide la formule 4-4, et
la partie qui la présente doit : ».
5 La règle 4-15 est modifiée par insertion un paragraphe suivant apres le paragraphe (2) :
« (2.1) Sauf ordonnance contraire de la Cour, chaque fois qu’un règlement amiable de l’action peut exiger
le consentement d’un assureur, l’enquêteur-régleur de l’assureur doit assister à toutes les conférences
preparatoires ».
6 Le complément d’information qui suit la règle 5-6 est modifié :
a) par abrogation de « n° 6 » et son remplacement par « CIV-PD No. 1 »;
b) par abrogation de « http://www.qp.gov.sk.ca/docurnents/English/Rules/practice.pdf » et son
remplacement par « <http://www.publications.gov.sk.ca/details.cfm?p=69850> ».
7 La règle 5-23 est modifiee par insertion du paragraphe suivant apres le paragraphe (1) :
« (1.1) L’avis de séance:
a) est établi à l’aide de la formule 5-23;
b) fixe les date, heure et lieu de l’interrogatoire ».
8 La règle 5-29(1) est modifiée par abrogation de l’alinéa b) et son remplacement par ce qui
suit :
« b) les questions et réponses de l’interrogatoire sont soit prises en sténographie, soit enregistrées
dans un appareil d’enregistrement en presence d’un transcripteur judiciaire nommé sous le régime
de la Loi de 2012 sur les fonctionnaires de justice ».
9 La règle 6-85 est modifiée par insertion du paragraphe suivant après le paragraphe (13) :
« (14) La présente règle s’applique aux mises en cause et aux procédures d’entreplaiderie d’un shérif régies
par la loi intitulée The Enforcement of Money Judgments Act dans la mesure où la règle n’est pas en conflit
avec les dispositions de cette loi ou de ses règlements ».
10 La règle 7-5(6) est abrogée et remplacée par ce qui suit :
« (6) Même si elle constate qu’il existe une ou plusieurs véritables questions en litige nécessitant un
procès, la Cour peut rendre un jugement sommaire relativement à un point ou à une question en litige si
elle estime qu’il peut et doit être tranché sans autre preuve ».
11 La règle 10-3(3) est abrogée et remplacée par ce qui suit :
« (3) L’ordonnance initiale est conservee par la Cour ».
12(1) La règle 10-7 est modifiée de la manière enoncee au présent article.
(2) Le paragraphe (3) est modifie :
a) par abrogation de l’alinéa a) et son remplacement par ce qui suit :
« a) rédigées suivant le fiat consigné par le juge ou le greffier en cabinet sous la direction du
juge »;

b) par abrogation de l’alinéa c) et son remplacement par ce qui suit :
« c) signées et datées par un registraire local et revêtues du sceau de la Cour ».
(3) Le paragraphe (4) est modifié par insertion de « , de la date » après « signature ».
13(1) La règle 10-9 est modifiée de la manière énoncée au present article.
(2) Le paragraphe (3) est modifié par suppression de « Le jugement » et son remplacement par
« Sous réserve des paragraphes (4) et (5), le jugement ».
(3) Les paragraphes suivants sont inseres apres le paragraphe (3):
« (4) Sous réserve du paragraphe (5), lorsqu’une loi permet qu’une ordonnance ou une décision d’un autre
tribunal judiciaire ou d’une autre autorité soit déposée auprès de la Cour afin que les moyens d’exécution
forcée rattachés aux ordonnances de la Cour s’y appliquent, l’ordonnance ou la décision peut, à moins que
la loi ne prévoie une autre procédure, être inscrite, dans sa version originale ou sons forme de copie certifiée
conforme, comme jugement de la Cour, si les conditions suivantes sont remplies :
a) une adresse aux fins de signification est fournie;
b) l’ordonnance ou la décision porte un numéro de dossier et une estampille confirmant son dépôt
par le registraire local.
« (5) Lorsqu’une ordonnance ou une décision rendue par un autre tribunal judiciaire ou une autre autorité
ne peut être déposée dans son intégralité auprès de la Cour dans le but d’être assimilée à une décision de la
Cour, un jugement correspondant à la partie admissible de l’ordonnance ou de la décision pent être inscrit
à l’aide de la formule 10-9F ».
14 La règle 10-40(1) est abrogée et remplacée par ce qui suit :
« (1) Sauf dispositions contraires de la présente section, dans toute action introduite sous le régime de
la présente section, la demande :
a) est établie à l’aide de la formule 10-40A;
b) comporte sur la première page l’avis au défendeur établi à l’aide de la formule 3-9 ».
15(1) La règle 13-24 est modifiée de la manière énoncée au présent article.
(2) Le paragraphe (1) est modifié par suppression de « estampillé » et son remplacement par
« scellé ».
(3) Le paragraphe (2) est abrogé et remplacé par ce qui suit :
« (2) Pour la demande reconventionnelle ou la mise en cause, l’émission s’opère sur signification et
dépôt du documente ».
(4) Le paragraphe suivant est inséré après le paragraphe (2) :
« (3) Le document introductif original est déposé auprès du registraire local ».
16 La règle 16-10 est abrogée et remplacée par ce qui suit :
« Preuve du décès
16-10(1) Une preuve du décès du défunt doit être déposée avec la requête en obtention de lettres
successorales.
(2) Lorsque la requête mentionne qu’un exécuteur testamentaire ou une autre personne ayant droit à des
lettres successorales est décédé, une preuve du décès de cette personne doit être déposée avec la requête
en obtention de lettres successorales.

(3) Pour l’application de la présente règle, la preuve du décès s’entend notamment d’une déclaration de
décès ou d’un certificat de décès délivré par l’une des personnes suivantes :
a) un entrepreneur de pompes funèbres;
b) un coroner;
c) le registraire des services de l’état civil.
(4) Si le requerant est incapable de produire une preuve directe du décès, mais qu’il existe des éléments
de preuve permettant d’inférer qu’il y a eu décès, la Cour peut autoriser la preuve du décès par serment
ou affirmation solennelle, sur requête sans préavis ou moyennant le préavis qu’elle prescrit ».
17 Le complement d’information suivant est insere apres la règle 16-14 :
«
Complement d’information
Il existe une présomption refragable voulant qu’un bien appartenant en propriété conjointe, avec droit
de survie, à un défunt et à un de ses enfants majeurs soit détenu en fiducie résultoire au profit des
bénéficiaires de la succession du défunt. (Voir Pecore c Pecore, 2007 CSC 17, (2007] 1 RCS 795.)
