Le monopole est une pièce essentielle dans la construction
du droit bancaire. Un périmètre d’activités est tracé ; les
entreprises qui s’y livrent ont besoin d’avoir un agrément et
sont soumises à un corps serré d’obligations professionnelles ;
en contrepartie, ces activités leur sont réservées : tel est le sens
du monopole bancaire et de ses satellites. Depuis l’origine, le
droit bancaire européen repose sur ce modèle.

L’édifice n’est toutefois pas immuable. Plusieurs causes se
conjuguent aujourd’hui pour favoriser une évolution. Il y a,
tout d’abord, des tendances à l’assouplissement, notamment
dans la distribution du crédit. Il y a aussi la conscience de ce
que des acteurs majeurs interviennent de manière concurrente
aux établissements de crédit, sans être soumis à leur statut :
c’est le « shadow banking ». Il y a enfin les innovations
technologiques, qui requièrent un encadrement adapté : c’est
le phénomène « fintech ».
L’objet du colloque co-organisé par l’AEDBF/EVBFRBelgium et l’AEDBF-Europe est de dresser un état des lieux
de ces nouvelles tendances et d’examiner comment elles
pourraient se traduire en législation. Le monopole bancaire
n’est certes pas menacé dans son existence. Mais ses contours
sont sans doute à redéfinir : chacun est invité à réfléchir sur
les voies et moyens pour y parvenir ».

Monopoly is vital in the construction of banking law. A range
of activities is drawn; companies engaging in these activities
must have a license and are subject to a lot of professional
obligations; in return, those activities are reserved to
them: this is the meaning of the banking monopoly and its
satellites. From the outset, the European banking law is
based on this model.
The construction however is not immutable. Several causes
come together today driving an evolution. There are, first
of all, trends in relaxation, especially in the distribution of
credit. There is also the awareness that major players compete
with credit institutions, without being subject to their status:
that is “shadow banking”. Finally, there are technological
innovations, which require appropriate supervision: the »
FinTech phenomenon”.
The purpose of the symposium co-organized by AEDBF/
EVBFR-Belgium and AEDBF-Europe is to draw up an
inventory of these new trends and examine how they might
be translated into legislation. The banking monopoly is
certainly not threatened in its existence. But its contours are
likely to be redefined: everyone is invited to reflect on ways
and means to achieve it.
