Mit dem reformierten USPatentrecht ändern sich ganz wesentliche, teilweise absolut grundlegende Dinge, die auch massive Auswirkungen auf Anmelder aus Deutschland und Europa haben. So wird auch vor dem USPTO das „first-to-file“-Prinzip gelten und es wird erstmalig ein Einspruchsverfahren eingeführt. Besprochen werden darüber hinaus Fragen zur Patentverletzung beim Import in die USA, insbesondere im Hinblick auf die unterschiedlichen Anforderungen bei unmittelbarer und mittelbarer Verletzung sowie für Vorrichtungs- und Verfahrensansprüche. Die wichtigen Fragen hierzu werden angesprochen und im Lichte der neusten Rechtsprechung des CAFC diskutiert und mit der Situation in Deutschland verglichen. Programm 13:30 – 14:00 Registration 14:00 – 15:45 Leahy-Smith America Invents Act (Patent Reform Act 2011) Synopsis of the Major Provisions of the Act and a Comparison of German and US law and strategies in View of the Patent Reform Michael D. Stein Günther Schneider The most important changes to US patent law passed legislation on September 16, 2011. Some of the major components of the reform include changing the US from a first-invent to a first-to-file country, changing the standard for what constitutes prior art for purposes of novelty and obviousness, adding post grant patent opposition practice, changing the standard for inter partes review, providing the USPTO director with greater fee making authority, and removing the best mode requirement as a basis to invalidate issued claims. The motivations behind such changes include reducing the cost of litigation and burden on the US courts and reaching conclusions regarding validity at earlier stages in time, as well as providing greater harmonization with the rest of the world. A thorough analysis of these very important rule changes will be presented, pointing out how the changes affect patent practice and providing a comparison between USPTO and EPO procedures and the strategies to maximize your patent protection in the US and Germany / Europe. 15:45 – 16:00 Coffee Break 16:00 – 16:20 Current Issues in IP for Green Technology James McEwen This presentation deals with how to take advantage of special procedures for renewable energy related patents before the USPTO. 16:20 – 17:30 Recent US Court Decisions Relating to Patents James McEwen Michael D. Stein Michael Schramm This presentation takes a look at recent court decisions and focuses on two main subjects within US patent law. The first subject relates to the standard for inequitable conduct (Therasense v. Becton Dickinson), before the en banc CAFC. Inequitable conduct is almost always raised in any litigation defence against patent infringement in the US. The consequences can be draconian, resulting in the unenforceability of any of the claims of the patent. Court cases have set forth varying standards for what constitutes inequitable. The latest case law will be discussed to sort out the seeming uncertainty and inconsistencies in this arena. The second subject relates to infringement issues for exports to US markets., including limitations on direct infringement including system and method claims, inducement to infringe and contributory infringement.
